Having Your Cake And Condemning It Too: When Asserting The Power Of Eminent Domain Constitutes Breach Of An Oil And Gas Lease, John Allen Chalk Sr., Rebecca K. Eaton Oct 2010

Having Your Cake And Condemning It Too: When Asserting The Power Of Eminent Domain Constitutes Breach Of An Oil And Gas Lease, John Allen Chalk Sr., Rebecca K. Eaton

Texas Wesleyan Law Review

The rapid increase in urban drilling for oil and gas in Texas, especially the shale natural gas plays that have become major producers of energy in Texas and other parts of the United States, have created new concerns for surface owners who also own the related minerals. One question is, how can land and mineral owners limit or prohibit surface use while leasing the minerals to producers? The advent of horizontal drilling that permits exploitation of leased minerals from off-site drilling locations prompts this new concern. The following is a scenario that frequently occurs in the current development and production …

Expanding Algorithmic Randomness To The Algebraic Approach To Quantum Physics: Kolmogorov Complexity And Quantum Logics, Vladik Kreinovich

Departmental Technical Reports (CS)

Physicists usually assume that events with a very small probability cannot occur. Kolmogorov complexity formalizes this idea for non-quantum events. We show how this formalization can be extended to quantum events as well.

Surface Morphology Of Platelet Adhesion Influenced By Activators, Inhibitors And Shear Stress, Melanie Groan Watson Oct 2010

Surface Morphology Of Platelet Adhesion Influenced By Activators, Inhibitors And Shear Stress, Melanie Groan Watson

Doctoral Dissertations

Platelet activation involves multiple events, one of which is the generation and release of nitric oxide (NO), a platelet aggregation inhibitor. Platelets simultaneously send and receive various agents that promote a positive and negative feedback control system during hemostasis. Although the purpose of platelet-derived NO is not fully understood, NO is known to inhibit platelet recruitment. NO's relatively large diffusion coefficient allows it to diffuse more rapidly than platelet agonists. It may thus be able to inhibit recruitment of platelets near the periphery of a growing thrombus before agonists have substantially accumulated in those regions.

Toxicity Of Transition Metal Oxide Nanoparticles: Recent Insights From In Vitro Studies, Yue-Wern Huang, Chi-Heng Wu, Robert Aronstam Oct 2010

Toxicity Of Transition Metal Oxide Nanoparticles: Recent Insights From In Vitro Studies, Yue-Wern Huang, Chi-Heng Wu, Robert Aronstam

Biological Sciences Faculty Research & Creative Works

Nanotechnology has evolved to play a prominent role in our economy. Increased use of nanomaterials poses potential human health risk. It is therefore critical to understand the nature and origin of the toxicity imposed by nanomaterials (nanotoxicity). In this article we review the toxicity of the transition metal oxides in the 4th period that are widely used in industry and biotechnology. Nanoparticle toxicity is compellingly related to oxidative stress and alteration of calcium homeostasis, gene expression, pro-inflammatory responses, and cellular signaling events. The precise physicochemical properties that dictate the toxicity of nanoparticles have yet to be defined, but may include …

“From Where I Sit”: Filipino Youth, Sexuality And Immigration In Participatory Action Research, Valerie Francisco Oct 2010

“From Where I Sit”: Filipino Youth, Sexuality And Immigration In Participatory Action Research, Valerie Francisco

Faculty Publications, Sociology

Studies of young people's experiences of sexuality rarely discuss how immigration and settlement impact youths' understanding of their bodies, sexual identities, and knowledge. In this paper, Filipino youth in collaboration with adult allies, conducted a New York City-based participatory action research project and found that young people's experiences and understanding of sexuality are narrated by silences, solidarity and paradoxical spaces. This study explores the contradictory experiences of passivity and subjectivity in the sexual lives of young people. Lastly, as an adult collaborator on the project I assess how “participation” as a logic of inquiry allows for youth and adult collaborators …

The Schizophrenic Solution: Dialectics Of Neurosis And Anti-Psychiatric Animus In Ralph Ellison’S Invisible Man, J. Bradford Campbell Oct 2010

The Schizophrenic Solution: Dialectics Of Neurosis And Anti-Psychiatric Animus In Ralph Ellison’S Invisible Man, J. Bradford Campbell

English

This essay argues that Ralph Ellison's Invisible Man (1952)provides promising ground and a certain imperative to investigatethe underexamined intersections between literature and the historyof psychiatry. Especially where African American literatureis concerned, there has been a general reluctance to approachthese categories together, even while anecdotally history recordsnumerous engagements between the two. Ellison, for example, worked closely with Richard Wright and Dr. Fredric Wertham toestablish Harlem's LaFargue Clinic, the first and, in its time, only such institution committed to providing modern psychiatricservices to any and all who needed them. Ellison found in theclinic's practices a model of social psychiatry that did muchto address the …

Defining A Foster Care Placement Move: The Perspective Of Adults Who Formerly Lived In Multiple Out-Of-Home Placements, Yvonne Unrau Oct 2010

Defining A Foster Care Placement Move: The Perspective Of Adults Who Formerly Lived In Multiple Out-Of-Home Placements, Yvonne Unrau

Social Work Faculty Publications

Several studies have demonstrated that children who experience multiple placements are more likely to experience behavioral problems and are less likely to achieve reunification. However, little is known about how move transitions— from one foster home to another, from foster care to birth family home, or between family placements and group care facilities—are perceived or experienced by children in foster care, or those formerly in foster care. This qualitative study examines the definition of foster care placement moves from the perspective of adults formerly in foster care. Participants identify both physical and psychological shifts as key dimensions of the placement …

Mississippi Kids Count: High School Graduation Rates, Jared Fisher, Kevin Golembiewski, Abram Orlansky, Jay Willis Oct 2010

Mississippi Kids Count: High School Graduation Rates, Jared Fisher, Kevin Golembiewski, Abram Orlansky, Jay Willis

Delta Directions: Publications

Though national dropout rates have generally fallen over the past twenty years, almost 1.2 million students in the United States drop out of school each year, representing nearly one-third of high school students. At about 61%, Mississippi’s high school graduation rate falls slightly below the national figure, though school districts in the Mississippi Delta fare particularly poorly. Five of the ten districts with the highest four-year dropout rates in the state are located in Delta region counties: Leflore, Tallahatchie, Sunflower, Tunica, and Panola Counties.

The Santa Clara Strength Of Religious Faith Questionnaire: Assessing Faith Engagement In A Brief And Nondenominational Manner, Thomas G. Plante

Psychology

The Santa Clara Strength of Religious Faith Questionnaire is a brief (10-item, or five-item short form version), reliable and valid self report measure assessing strength of religious faith and engagement suitable for use with multiple religious traditions, denominations, and perspectives. It has been used in medical, student, psychiatric, substance abuse, and among general populations nationally and internationally and among multiple cultures and languages. Brief non denominational self report measures of religious and faith engagement that have demonstrated reliability and validity are not common but can have potential for general utility in both clinical and research settings. This article provides an …

A Case Study Of Appendicitis At Antanimalandy Lutheran Hospital, Jennifer Gemmell

Independent Study Project (ISP) Collection

From the introduction:

The island of Madagascar houses a total of 19,159,000 people who spend only $34 per person per year on health care (“Madagascar,” 2008). The government claims to have “committed itself to the principle that good health is a right of each Malagasy citizen, and has made significant studies in the area of health care,” according to the country study for the Library of Congress. However, with political corruption, political crisis after political crisis, and lack of international support, the government does not dispense the funds necessary to support this commitment (Metz, 1994). For example, in 1976 the …

Personalization, Analytics, And Sponsored Services: The Challenges Of Applying Pipeda To Online Tracking And Profiling Activities, Eloïse Gratton Oct 2010

Personalization, Analytics, And Sponsored Services: The Challenges Of Applying Pipeda To Online Tracking And Profiling Activities, Eloïse Gratton

Canadian Journal of Law and Technology

In 2008, the online advertising industry was found to be worth 27 billion dollars, a figure that was projected to double over the subsequent four years.1 The reason for this extraordinary market growth can be explained by two factors. To begin with, current technology now makes it possible to gather a great variety of information associated with a particular device or individual, including browsing history, which can be used to create a profile specific to that device or individual. This practice facilitates more personalized advertising, tailored to the interests and tastes of the consumer. Secondly, many online services, in the …

The Accuracy Of Referral For Portable Lipid Analyzers In An Old Order Mennonite Population, Maria E. Main, M. Susan Jones, Cathy H. Abell

Nursing Faculty Publications

The primary purposes of this study were to: 1) examine the accuracy for referral of two portable lipid analyzers (PLAs) in an old order Mennonite population through a comparison to a national standardized reference laboratory, 2) examine the relationship of total cholesterol values with other known cardiovascular risk factors, and 3) foster the continued participatory model of health care service in this community. The self-selected sample was composed of 42 adult members of an old order Mennonite community residing in south central Kentucky. A descriptive correlational design was used in this study. There were clinically relevant variations in the total …
