Monitoring the potential seepage of CO2 is a required practice for any CO2 sequestration project. Monitoring is used in order to ensure the efficiency of the sequestration process and that the CO 2 will remain in the target formation for extended periods of time. Different techniques that exist in the literature differ based on their resolution and location of their application. Transgenic hypovirulent (HV) strains of Cryphonectria parasitica [Murrill] M.E. Barr engineered to contain an infectious cDNA copy of Cryphonectria hypovirus 1 (Hypoviridae; CHV1) may provide an efficient mechanism to introduce hypoviruses into genetically heterogeneous populations of the chestnut blight fungus. However, elucidating the factors that affect the infection of chestnut and spread of C. parasitica is needed to fully utilize the potential of transgenic HV strains for the biological control of chestnut blight. Although selenium is as essential element for animal and human growth, selenium released from coal mining process and coal combustion residues to surface and groundwater may cause toxicity to aquatic life. Research has provided considerable evidence that participation in regular physical activity is associated with numerous physical and mental health benefits (Penedo & Dahn, 2005). Despite public health efforts to increase the activity levels adults, only 25% of the U.S. adult population is regularly active and nearly 60% remains sedentary (US Department of Health and Human Services [USDHHS], 2008). The project involved bench scale testing investigating geotextile filter clogging by fine particle intrusion and fabric blinding from coarse and fine coal refuse with nonwoven geotextile filter fabric. The research explored the fine particle distribution through the refuse material and interfacial contact with the geotextile. The coal refuse was obtained from an active mining and coal waste impoundment operation located in Boone County, WV. It is not clear how effective hearing protective devices are during actual use, including during coal mining. A proposed solution is individual fit-testing, which is usually done in an office environment. However, it is not clear that fit-testing accurately represents protection while actually working. This research investigates both issues for coal miners for two hearing protectors (E-A-R earplug and Peltor earmuff). Similarity measurement is a critical component in content-based image retrieval systems, and learning a good distance metric can significantly improve retrieval performance. However, despite extensive study, there are several major shortcomings with the existing approaches for distance metric learning that can significantly affect their application to medical image retrieval. In particular, "similarity" can mean very different things in image retrieval: resemblance in visual appearance (e.g., two images that look like one another) or similarity in semantic annotation (e.g., two images of tumors that look quite different yet are both malignant). The European Court of Justice's (ECJ's) jurisprudence of fundamental rights in cases such as Schmidberger and Omega extends the court's jurisdiction in ways that compete with that of Member States in matters of visceral concern. And just as the Member States require a guarantee that the ECJ respect fundamental rights rooted in national tradition, so the ECJ insists that international organisations respect rights constitutive of the EU. The demand of such guarantees reproduces between the ECJ and the international order the kinds of conflicting jurisdictional claims that have shadowed the relation between the ECJ and the courts of the Member …

This essay explores the contradictions and puzzles of modern juvenile justice, and illustrates the enduring power of the child-saving philosophy of the juvenile court in an era of punitiveness toward offenders both young and old. The exponential growth in incarceration in the U.S. since the 1970s has been more restrained for juveniles than adults, even in the face of a youth violence epidemic that lasted for nearly a decade. Should the party who loses in litigation be forced to pay the legal fees of the winner? This paper surveys the economic literature regarding the effects of legal fee shifting on a variety of decisions arising before and during the litigation process. Section 2 provides a brief survey of the practical situations in which legal fee shifting does and does not arise. Section 3 analyzes the effects of indemnification on the incentives to expend resources in litigated cases. The United States spends many billions of dollars on its system of civil litigation, and expert witnesses appear in a huge portion of cases. Yet litigants select and retain expert witnesses in ways that create the appearance of biased hired guns on both sides of every case, thereby depriving factfinders of a clear view of the facts. Nearly fifteen years ago, Audrey R. Chapman emphasized the importance of ascertaining violations of the International Covenant on Economic, Social and Cultural Rights (ICESCR) as a means to enhance its enforcement. Today, the violations approach is even more salient given the recent adoption of the ICESCR’s Optional Protocol, a powerful tool to hold States parties accountable for violations.

This is a tale of two states: one with a constitution and one without. It is a tale that has no moral but ends with the question whether, from the perspective of fundamental human rights, a constitution makes a significant difference? The tale compares the United States of America, a country with a robust, well-entrenched federal Constitution that forms the fundamental compact of its society, with Israel, a country without a formal constitution, but with a set of ‘basic laws’, that operates with two distinct legal systems for the two national entities residing within its jurisdiction.

We find ourselves in an economic crisis, the severity of which few persons living today have witnessed. Fear, the natural accompaniment of such crises, arises from our uncertainty about the depth and duration of the crisis. The consensus is that a restoration of confidence is fundamental to a recovery. From the eye of the storm, it is difficult to assess the effectiveness of attempts at quelling its ravages. Yet, we may have little choice but to begin making those assessments as the architecture of the new order is being designed now.

Water-in-oil reverse-phase microemulsions were studied to determine the effects of changing the concentrations of the components of the microemulsions on the shape, sizes, and interactions of the particles of the microemulsion system. Two fluorescent probes were used in the measurement and analysis of bis(2-ethylhexyl) sulfosuccinate (AOT) water in octane reverse phase microemulsions. Dansylpiperidine and 9-aminoacridine were chosen as the fluorescent probes used in the analysis. The experiment consisted of the analysis in solvents of differing polarity, AOT microemulsion solutions of various water, surfactant, and octane ratios, and four component microemulsions. Environmental concern has been frequently measured since the 1970's, however, much of this research has focused on adults. Of the studies that look at students, the majority focus on high school with little attention given to middle or elementary grades. None of these studies have looked at elementary, middle, and high school students from the same population. This study uses the NEP Scale for Children in conjunction with free response questions to examine the trends in environmental concern from 120 Catholic elementary, middle school, and high school students from Des Moines, Iowa.
