Trust And The Reform Of Securites Regulation, Ronald J. Colombo Jan 2010

Trust And The Reform Of Securites Regulation, Ronald J. Colombo

Hofstra Law Faculty Scholarship

Trust is a critically important ingredient in the recipes for a successful economy and a well-functioning securities market. Due to scandals, ranging in nature from massive incompetence, to massive irresponsibility, to massive fraud, investor trust is in shorter supply today than in years past. This is troubling, and commentators, policy makers, and industry leaders have all recognized the need for trust's restoration.

As in times of similar crises, many have turned to law and regulation for the answers to our problems. The imposition of additional regulatory oversight, safeguards, and remedies, some advocate, can help resuscitate investor trust. These advocates have …

A Tale Of Election Day 2008: Teaching Storytelling Through Repeated Experiences, Stefan H. Krieger, Serge A. Martinez Jan 2010

A Tale Of Election Day 2008: Teaching Storytelling Through Repeated Experiences, Stefan H. Krieger, Serge A. Martinez

Hofstra Law Faculty Scholarship

The article was inspired by a one-day project November 4, 2008, when we supervised a number of clinic students representing voters who had been denied the right to vote. As they represented client after client, we noticed significant improvement in their storytelling skills over a very short period, despite having little training in storytelling theory or techniques. Using our Election Day project as a starting point, the article questions the dominant pedagogical model for teaching storytelling, which focuses primarily on teaching storytelling and narrative theory. We propose a new method, based on cognitive science findings about experiential learning, that emphasizes …

Transepithelial D-Glucose And D-Fructose Transport Across Lobster Intestine, Ijeoma Ebelechukwu Obi Jan 2010

Transepithelial D-Glucose And D-Fructose Transport Across Lobster Intestine, Ijeoma Ebelechukwu Obi

UNF Graduate Theses and Dissertations

The mechanisms of transepithelial absorption of dietary D-glucose and D-fructose in the American lobster, Homarus americanus, were investigated in this study in order to determine whether sugar transport proteins have been conserved throughout evolution. Whole lobster intestine was isolated and mounted in a perfusion chamber to determine transepithelial mucosal to serosal (MS) and serosal to mucosal (SM) mechanisms of 3H-D-glucose and 3H-D-fructose transport across the intestine. Unidirectional MS and SM fluxes were measured by adding variable concentrations of 3H-D-glucose and 3H-D-fructose (2.5 to 50uM) to either the perfusate or the bath respectively and sampling the …

Albany’S Dysfunction Denies Due Process, Eric Lane, Laura Seago Jan 2010

Albany’S Dysfunction Denies Due Process, Eric Lane, Laura Seago

Hofstra Law Faculty Scholarship

The coup that shut down the New York State Senate for over a month last summer brought the State Legislature's dysfunction to the forefront of public consciousness. As the public waited for the approval of several critical budget bills and action on a long list of substantive legislation, two members of the newly elected Democratic majority deserted to the Republican side and then switched back again to caucus with the Democrats, destabilizing the already listing New York ship of state and spreading disgust among their colleagues and the public at large. These events were, unfortunately, not anomalous. The process by …

When Others Get Too Close: Immigrants, Class, And The Health Care Debate, Janet L. Dolgin, Katherine R. Dieterich Jan 2010

When Others Get Too Close: Immigrants, Class, And The Health Care Debate, Janet L. Dolgin, Katherine R. Dieterich

Hofstra Law Faculty Scholarship

This Article describes one genre of contemporary anti-immigrant rhetoric, examines the social and economic forces that engender that rhetoric, and delineates its implications for the national debate about health care reform.

The Article details the underlying significance of America's opaque, yet highly competitive, class system to immigration reform and to health care reform. It locates the population most compelled by anti-immigrant rhetoric in the so-called intermediate strata (more generally referred to as the lower middle class). Careful examination of the relevant rhetoric suggests a broad explanation of the nation's reluctance, over almost a century, to construct a system of universal …

Debts, Disasters, And Delinquencies: A Case For Placing A Mandatory Force Majuere Provision Into Consumer Credit Agreements, Norman I. Silber Jan 2010

Debts, Disasters, And Delinquencies: A Case For Placing A Mandatory Force Majuere Provision Into Consumer Credit Agreements, Norman I. Silber

Hofstra Law Faculty Scholarship

This article addresses inequities in the apportionment of losses which arise when traditional consumer finance rules are applied to enforce consumer payment obligations which accrue during and after catastrophes. Disasters lead inevitably to job losses, to property destruction, and to inhibited access to homes and workplaces. In the wake of devastation, consumer fees and interest charges mount, and payment defaults increase. It is argued here that the resulting individual hardships and social distress could be mitigated by mandating the inclusion of force majeure provisions in consumer finance agreements and by creating a national consumer credit insurance fund.

Deliberative Democracy On The Air: Reinvigorate Localism-Resuscitate Radio's Subversive Past, Akilah N. Folami Jan 2010

Deliberative Democracy On The Air: Reinvigorate Localism-Resuscitate Radio's Subversive Past, Akilah N. Folami

Hofstra Law Faculty Scholarship

Many scholars, media reformists, activists and musicians currently lament the present condition of commercial radio, given the deregulatory effects of the last two decades on radio ownership and content. Many contend that commercial radio, once thought of as a deliberative tool in advancing the democratic ideals of inclusiveness and representation, is now nothing more than a commercialized wasteland with the democratic ideals of it serving as a deliberative tool laid to rest due, in part, to radio ownership consolidation, competition from other media sources, and the provision of overlapping and homogenized content on the nation’s radio airwaves. While there has …

Synthesis Of Urethane Acrylate Macromer From Palm Oil-Based Polyol And Its Application As A Resin For Dental Composite., Fadheel A. A. Alsanabani Jan 2010

Synthesis Of Urethane Acrylate Macromer From Palm Oil-Based Polyol And Its Application As A Resin For Dental Composite., Fadheel A. A. Alsanabani

Student Works (2010-2019)

A slightly branched urethane acrylate macromer (UAM) was synthesized by reacting palm oil-based polyol with excess amounts of polymeric methylene diphenyl diisocyanate (MDI) to form urethane prepolymer, then reacted with 2-hydroxyethyl methacrylate (HEMA) and FT-IR spectroscopy confirmed the urethane and grafted acrylate groups. 0.2% by weight of camphoroquinone (CQ) and 0.8% by weight of ethyl-4-N,N-dimethylamino-benzoate (4EDMAB) by weight were added to render the experimental resins light-curable. Their viscosity, percentage of degree of conversion (%DC) and cross-linking density (CLD), percentage of volumetric polymerization shrinkage (%VPS), water sorption and solubility, flexural strength, modulus of elasticity and toughness were determined and compared to …

Financial Management Practices: Associations With Financial Well-Being And Risky Investment Among Families In Malaysia., Husniyah Abd. Rahim Jan 2010

Financial Management Practices: Associations With Financial Well-Being And Risky Investment Among Families In Malaysia., Husniyah Abd. Rahim

Student Works (2010-2019)

Financial management practices predicting good financial well-being and participation in risky assets among families were identified in this study. It also seeks to find out other factors predicting financial well-being and participation in risky assets. Associations of time horizon with risk preference, and risk preference with financial management practices, differences in financial management practices among the main ethnicities in Malaysia and among families residing in urban and rural areas were also determined. The moderating roles of self-worth between financial management practices and financial well-being of families, and between financial management practices and risky investment by families were explored. Quota sampling …

The Role Of Socioeconomic Factors In Racial And Ethnic Disparities Among Child And Adult Tuberculosis Cases, Spatial And Non-Spatial Analysis: Alabama 1993-2007, Sharada Adolph

All ETDs from UAB

This study aimed to evaluate the role of individual and community/population level socioeconomic factors on racial/ethnic disparities among children and adults with TB, and used area-based socioeconomic measures (ABSMs) for the identification of high-risk geographic areas for populations-at-risk. Joinpoint, multivariable and Poisson regression, and spatial methods were used to determine the trends and risks of disease in a low TB incidence state. General disease trends declined significantly by factors of -0.044838 from 1993-1998, and -0.061821 from 2001-2007; but, were disparate and increased for the foreign-born, African Americans (AA) and Latinos, and in long-term care settings. The average annual percentage change …

The Role Of Socs Proteins In Hiv Immune Evasion, Lisa Nowoslawski Akhtar Jan 2010

The Role Of Socs Proteins In Hiv Immune Evasion, Lisa Nowoslawski Akhtar

All ETDs from UAB

Upon human immunodeficiency virus (HIV) infection the host mounts a robust and multifaceted immune response. To achieve successful replication, HIV must possess a powerful arsenal of immune evasion weapons. While a complex strategy for HIV immune evasion has been described in the periphery, little is known about the mechanism allowing HIV to overcome the simple interferon (IFN)-ß-mediated innate immune defenses of the central nervous system (CNS). In light of the devastating cognitive dysfunction that is caused by HIV replication within the CNS, a better understanding of this mechanism is critical. Recent studies have shown that viral pathogens can induce the …

Mechanisms By Which Tra-8 Anti-Dr5 Antibody And Chemotherapy Enhance Cytotoxicity In Breast Cancer, Hope M. Amm Jan 2010

Mechanisms By Which Tra-8 Anti-Dr5 Antibody And Chemotherapy Enhance Cytotoxicity In Breast Cancer, Hope M. Amm

All ETDs from UAB

Breast cancer is the second leading cause of cancer-related death in American women and metastatic breast cancer has a 5-year survival rate of only 26%. Current targeted treatments for this disease include anti-estrogen strategies for estrogen receptor positive tumors (~60%) and anti-Her2/Neu strategies for tumors overexpressing this receptor (20-25%). A percentage of breast cancer patients, however, are resistant to these therapies and are left without any effective treatment options. One of the agents currently being investigated to improve breast cancer survival is TRA-8, an agonistic monoclonal antibody to death receptor 5 (DR5), which induces apoptosis in various types of cancer …

Leadership, Libraries, Leed For The Future, Kathryn S. Ames, Greg Heid Jan 2010

Leadership, Libraries, Leed For The Future, Kathryn S. Ames, Greg Heid

Georgia Library Quarterly

The article discusses the use of Leadership in Energy and Environmental Design (LEED) principles in the design of the modern public library. It is stated that an LEED-certified library will have lower costs in energy, systems replacement and maintenance through the use of light-emitting diode (LED) lighting and efficient heating and air conditioning, but that due to special materials, the up-front expense is higher. The inspection of the facility throughout its construction is also noted.
