Patients themselves have transformed the role of the patient in the health care system, making it far more complex than it ever has been before. As a result, the conceptual root of our contemporary understandings of “patient” is an assumption of autonomous subjectivity, i.e., of an individual aware of and capable of acting on her choices for medical care. The Symposium on Patient-Centered Health Law and Ethics of which this Article is a part considers the most recent stage in this evolution of meanings: the concept of patient-centeredness, with its implication of provider deference to the patient’s perspective. Stories Told And Untold: Confidentiality Laws And The Master Narrative Of Child Welfare, Matthew I. Fraidin

In most states, child welfare hearings and records are sealed or confidential. This means that by law, court hearings and records may not be observed. The same laws and court rules also preclude those who are authorized to enter and watch from discussing anything learned or observed in a closed courtroom or from a sealed court record with anyone not involved in the case. It is the restriction on speech—on telling stories about child welfare—with which this Article is concerned.

The master narrative of child welfare depicts foster care as a haven for child-victims savagely brutalized by “deviant,” “monstrous” parents. …

When new members begin their employment with an organization, they make a transition from being an outsider to an insider. A significant moment arranged by the organization to facilitate socialization is the New Employee Orientation (NEO). This evaluation examines NEO in relation to the encounter stage of the socialization process. Focusing on what and how information is provided during the NEO program at the University of Montana (UM), this evaluation is based on research of the informational components of Klein and Weaver (2000) and the socialization tactics from Van Maanen and Schein (1979). This thesis gives an account of the ontological basis of the profound sense of disorientation in contemporary society and attempts to discover through a phenomenological account of orienting experience that which holds the possibility of authentic orientation in reality. Martin Heidegger’s understanding of “being-in-the-world,” the “there” of Dasein, and the epochal revealing of reality as resources in modern technological society is the philosophical backdrop for the thesis. This philosophical foundation is elaborated upon by showing that the challenging-revealing of the real as resources within the “framework” of technology results in the ontological “dis-traction” of reality. This Article responds to recent claims, most prominently by Anup Malani, Eric Posner, and Todd Henderson, that much of the work of the charitable sector should be farmed out to for-profit firms. For-profit firms are said to be more efficient because they can offer high-powered incentives to cut costs. I argue, however, that because of the high costs of monitoring and the presence of externalities, low-powered incentives are preferable for firms that produce public goods, as most charities do. Further, allowing some for-profit firms to receive charitable subsidies would raise the cost of producing those goods in government or other …

SPEC Learning and Changing by Doing is a three-year, action research and organizational change project designed to ultimately promote social justice and well-being in the community. SPEC is an acronym that stands for Strengths, Prevention, Empowerment, and Community Change. The project consists of five organizations tackling internal organizational change in order to better promote justice and well-being in their respective constituencies. In this paper we present a formative evaluation of this multicase study of organizational change in human services. This paper contributes to the empirical and theoretical literature on organizational change in the nonprofit human service milieu.

New Governance And The "New Paradigm" Of Police Accountability: A Democratic Approach To Police Reform, Kami Chavis Simmons

This Article proposes that policymakers should draw from the emerging New Governance theoretical framework--particularly democratic experimentalism--in order to develop strategies to successfully reform law-enforcement agencies. Modem police departments function like administrative agencies, and as such, they are susceptible to the same deficiencies that traditional agencies experience in other administrative contexts. Given the traditionally insular nature of law-enforcement agencies, the need for political legitimacy in the reform process is amplified in the policing context. Therefore, in order to eliminate patterns of police misconduct and corruption, reform measures should embody characteristics that promote stakeholder participation and local experimentation.

"The Lawmen Faced The Outlaws, No Badge Upon A Breast:" Historical Memory And The Legacy Of Henry Plummer And The Montana Vigilantes, Melissa Poindexter Thomasma

In the winter of 1863-1864, the Montana vigilantes hanged over twenty men in and around Bannack and Virginia City, including the region's elected sheriff, Henry Plummer. The mob claimed that these men were members of a highly-organized Road Agent Gang. While no evidence of this organization of highwaymen exists, the episode endures in the popular history of Montana; this thesis explores four elements of the legacy of this episode. First, it presents a biography of Henry Plummer and brief summary of the organization and actions of the Vigilance Committee. Improved understanding about food security has led researchers to develop increasingly holistic approaches to studying the effects of household food insecurity. This research, based in the remote prefecture of Dankpen in Togo, West Africa, presents insights into the lives of rural subsistence farmers, the role of population pressures, and the effectiveness of both international and national development work. Originally I wanted to identify positive deviants who were food secure living in the Dankpen prefecture. Natural instream flow regimes are necessary for the ecological health of streams, including the maintenance of healthy fish populations. Economic interests such as agriculture, mining, and other industries remove water from streams, which can negatively affect fish populations. Wintertime diversions of water affect autumn-spawning salmonids such as brown trout and bull trout; they occur at the critical egg-to-fry development phase, possibly reducing oxygen flow to the eggs and increasing the rate of sub-gravel freezing. Since the turn of the twentieth century, mining activities have contaminated the floodplain and streambed of Silver Bow Creek, Montana, resulting in a streambed devoid of life and severely contaminated with heavy metals. In the mid nineteen seventies, up-stream water treatment facilities were upgraded and water quality improved, bringing benthic invertebrates back to reaches of Silver Bow Creek. The extent and concentration of toxicants in and around the streams of the Upper Clark Fork River Basin resulted in the designation of over 100 miles of river as Federal Superfund sites. The application of non-metric forensic anthropological techniques produces results that are sometimes not always scientifically valid. Using the commonly accepted techniques to produce a biological profile (age, sex, ancestry, height, pathology and trauma), an application of the methods is utilized and critiqued in the analysis of The University of Montana forensic case 29 (UMFC 29). Using the accepted techniques in forensic anthropology, UMFC 29 was identified as a Black Male with an age range of 35-65 years and a height of 5’3’’-5’6’’. There are millions of acres of forestland in the Western United States that could benefit from fuel reduction treatments to improve forest health and reduce wildfire fuels. These treatments generate forest residues that are typically piled and burned. However, with increasing concerns about energy security, high oil prices, air quality from pile burning and climate change, there is great interest in examining ways to economically use these residues as a renewable energy source. Located in southeastern Montana, the Northern Cheyenne Reservation sits within the Powder River Basin energy development boundary. The Northern Cheyenne Tribe (Tribe) has had a long history of resisting energy development on the reservation. The Tribe has also opposed off-reservation development that impacts reservation water, air, and cultural resources. Current coal bed methane and coal mine developments near the reservation threaten the quality of life for the Northern Cheyenne people. When applying prescribed fire to long-unburned but fire-dependent ecosystems managers require better decision-support models to determine appropriate conditions for achieving desired effects. Prolonged combustion in duff accumulations at the base of large conifers can lead to fine root mortality, cambial injury, enhanced susceptibility to bark beetle attack, and possibly tree death. Pre-burn sampling to predict duff mound consumption from measurable attributes is vital in order to limit the deleterious effects of prolonged smoldering combustion. In the summer of 2003, the University of Idaho conducted an archaeological field school at the Nora Creek site under the direction of Dr. Mark Warner at a Swedish homestead just east of Troy, Idaho. The field school unearthed a plethora of historical artifacts including metal, glass, ceramic, and faunal items left behind by the inhabitants of the Johanson homestead in Nora, Idaho. Historical documentation indicates that the Johansons immigrated to America from Sweden in 1882 and they arrived in Nora in 1891. Currently, the lack of accurate in situ pH measurements limits our understanding of natural pH variability. In order to predict future pH changes in the oceans, quality high temporal resolution pH data are needed. This work used the newly developed Submersible Autonomous Moored Instrument for pH (SAMI-pH), a fully autonomous, in situ spectrophotometric pH sensor, to study oceanic pH variability. In the literature on "new governance" forms of regulation, the blurring of traditional boundaries is a pervasive but largely implicit theme. This Article makes this theme explicit, and argues that the capacity to blur boundaries is one of new governance's signature strengths. New governance regulation frequently blurs the roles of regulatory actors, the stages of regulation, the modes of regulation, the functions of a regulatory regime; and the structure of the regulatory regime. One of the themes weaving in and out of Sir Gawain and the Green Knight is that of virtue: Gawain’s shield proclaims his virtue, yet at the end of the Green Chapel scene, he exclaims vice has destroyed his virtue, leaving him “faulty and false.” This scene has troubled critics and students, however, for many consider his reaction excessive for his default on the rules of a courtly game. The present paper contends that the notion of virtue written for Gawain naturalizes embodied virtue. Saints And The Social Order: Alexander Barclay’S The Life Of St. George, Maggie Gallup Kopp

This paper examines The Life of St. George, Alexander Barclay’s 1515 translation of a humanist Latin prose poem. Barclay, who styled himself a laureate in the tradition of Lydgate, adapts laureate poetic practice in order to address a noble audience in a bid to gain court patronage. Barclay’s emendations and additions transform the hagiography of England’s patron saint into a commentary on traditional English ideals of citizenship and good governance, aimed at an audience comprised of both common citizens and noble elites, including, as this paper argues, the young king Henry VIII.
