The Right Stuff: Habitus And Embodied Virtue In Sir Gawain And The Green Knight, Alice F. Blackwell Jan 2010

The Right Stuff: Habitus And Embodied Virtue In Sir Gawain And The Green Knight, Alice F. Blackwell

Quidditas

One of the themes weaving in and out of Sir Gawain and the Green Knight is that of virtue: Gawain’s shield proclaims his virtue, yet at the end of the Green Chapel scene, he exclaims vice has destroyed his virtue, leaving him “faulty and false.” This scene has troubled critics and students, however, for many consider his reaction excessive for his default on the rules of a courtly game. The present paper contends that the notion of virtue written for Gawain naturalizes embodied virtue. While both religious and lay writers tended to argue that one possessed predisposition to moral or …

Saints And The Social Order: Alexander Barclay’S The Life Of St. George, Maggie Gallup Kopp Jan 2010

Saints And The Social Order: Alexander Barclay’S The Life Of St. George, Maggie Gallup Kopp

Quidditas

This paper examines The Life of St. George, Alexander Barclay’s 1515 translation of a humanist Latin prose poem. Barclay, who styled himself a laureate in the tradition of Lydgate, adapts laureate poetic practice in order to address a noble audience in a bid to gain court patronage. Barclay’s emendations and additions transform the hagiography of England’s patron saint into a commentary on traditional English ideals of citizenship and good governance, aimed at an audience comprised of both common citizens and noble elites, including, as this paper argues, the young king Henry VIII.

“Hand Hand Shooke”: Compassionate Touch In George Chapman’S Hero And Leander, Patricia Davis Patrick Jan 2010

“Hand Hand Shooke”: Compassionate Touch In George Chapman’S Hero And Leander, Patricia Davis Patrick

Quidditas

Chapman begins his continuation of Marlowe’s Hero and Leander by announcing that he intends to “censure the delights” which the lovers have enjoyed without the sanction of ceremony. However, the narrator does not maintain this attitude of stern judgment. As readers of Chapman’s Hero and Leander have often noticed, the narrator continuously shifts his tone, sometimes censuring the lovers and sometimes sympathizing with them. Chapman’s poem is thus as deeply concerned with the problem of appropriate compassion as it is with the containment of Eros. The narrator’s vacillation between censure and compassion can be fruitfully considered by examining early modern …

Banishing Ganymede At Whitehall: Jove’S “Loathsome Staines” And Fictions Of Britain In Thomas Carew’S Coelum Britannicum, Jessica Tvordi Jan 2010

Banishing Ganymede At Whitehall: Jove’S “Loathsome Staines” And Fictions Of Britain In Thomas Carew’S Coelum Britannicum, Jessica Tvordi

Quidditas

Thomas Carew’s masque Coelum Britannicum, performed at Whitehall on Shrove Tuesday of 1634, deploys an image of conjugal perfection in order to codify a fiction of national union. Not only are Charles I and Henrietta Maria models of moral and political comportment powerful enough to reform the profligate court of Jove, their harmonious marriage also provides the inspiration for reconciliation between England, Scotland, and Ireland. In order to assert this fiction of unification, the masque invokes images of sexual transgression, symbolically enacts their removal, and equates the strength of Britain with the absence of the deviant monarch, James I. …

Exposing The Underground Establishment Clause In The Supreme Court's Abortion Cases, Justin Murray Jan 2010

Exposing The Underground Establishment Clause In The Supreme Court's Abortion Cases, Justin Murray

Publications

In Roe v. Wade, the Supreme Court held that women have a right to abortion under the Due Process Clause of the Fourteenth Amendment. The Court reasoned toward this conclusion by importing concepts and concerns that are ordinarily associated with the Establishment Clause. This Article is the first attempt to systematically describe, and critically evaluate, the Court's use of Establishment Clause ideas in Roe and later abortion cases.

Some brief background is essential in order to see how the Court wove Establishment Clause themes into the structure of its Due Process analysis. The Due Process Clause prohibits the government …

Some Thoughts On The Societal Impact Of Linguistics, Arto Mustajoki Jan 2010

Some Thoughts On The Societal Impact Of Linguistics, Arto Mustajoki

Russian Language Journal

Today, scholars are obliged to justify the necessity of research in their own fields. The purpose of this paper is to discuss the channels of societal impact of linguistic research. In other words, I will try to answer the following question: in what ways is the work of scholars dealing with language(s) useful for society? The paper is based on my articles published in Finnish (Mustajoki 2005, 2011) and on oral presentations in various academic circles. I will first discuss some general ideas concerning the societal impact of research and researchers. I will then try to apply these ideas to …

Seeking Alternatives To Marijuana Prohibition, Rachel Kiesel Jan 2010

Seeking Alternatives To Marijuana Prohibition, Rachel Kiesel

Honors Program Theses

Marijuana legality is a highly controversial social issue. Although our society continues to be bombarded by negative images of drugs and crime in the media, cultural perceptions regarding marijuana have been changing over the past few years. Today, many people are more accepting of marijuana use than ever before. As a result of these shifting attitudes, several states have taken the initiative to pass new legislation on regulating marijuana with reduced restrictions.

Honest Services After Skilling: Judicial, Prosecutorial And Legislative Responses, Govind Persad, Jessie K. Liu, Cynthia J. Robertson, Govind C. Persad

Publications

In Skilling v. United States, the U.S. Supreme Court substantially narrowed the reach of the “honest services fraud” statute, 18 U.S.C. § 1346, by holding that it applies only to “bribery and kickback schemes,” not to “undisclosed self-dealing by a public official or private employee.” Skilling v. United States, 130 S. Ct. 2896 (2010). Two companion cases also were decided the same day. See Black v. United States, 130 S. Ct. 2963 (2010); Weyhrauch v. United States, 130 S. Ct. 2971 (2010). These decisions have major significance for federal fraud prosecutions.

Cold Flow Simulation Of Vortex Shedding In A Segmented Solid Rocket Motor, Rasheed Durojaye Jan 2010

Cold Flow Simulation Of Vortex Shedding In A Segmented Solid Rocket Motor, Rasheed Durojaye

Theses

Combustion instabilities are a major problem in large solid rocket boosters. They are responsible for exciting undesirable oscillations in the propellant burn rate. It is believed that vortex shedding from upstream inhibitors is one of the phenomena responsible for the onset of these instabilities. Vortex shedding frequencies are time dependent due to the unsteady nature of the flow inside the rocket motor. When one of these frequencies coincides with a structural frequency, the oscillations can increase substantially. The protruding inhibitors are caused by their slow burn rate compared to that of the fuel. In the current research, cold flow simulations …

Innovations And Barriers In Health Microinsurance, Sheila Leatherman, Lisa Jones Christensen, Jeanna Holtz Jan 2010

Innovations And Barriers In Health Microinsurance, Sheila Leatherman, Lisa Jones Christensen, Jeanna Holtz

Faculty Publications

Health microinsurance (HMI) offers a promising way to mitigate the risks of disease and ill health, which are disproportionately borne by the world’s poorest citizens. Despite that HMI is a relatively new phenomenon, recent figures indicate that approximately 40 million people worldwide have some form of HMI coverage, principally in India.

The emergence of HMI programmes worldwide provides hope that the poor will receive, at a minimum, a reliable, adequate level of access to affordable healthcare. Research shows that access to HMI reduces out-of-pocket health expenses, especially for catastrophic health events, and improves access to quality health care for those …

The Acute Time Course Of Concurrent Activation Potentiation, Luke Garceau, Erich Petushek, Mckenzie Fauth, William Ebben

Exercise Science Faculty Research and Publications

This study evaluated the acute time course of the ergogenic effect of concurrent activation potentiation (CAP). Forty-two men and women, including CAP non-responders and responders, performed a 5 second isometric knee extension on a dynamometer with the use of remote voluntary contractions (RVC). Mean torque was assessed in seven 500 millisecond (ms) time periods. A two-way repeated measures ANOVA revealed significant main effects for time period (p ≤ 0.001), but no significant interaction between time period and CAP non-responders and responders (p > 0.05). The ergogenic effects of CAP are accrued during the first 1000ms. Concurrent activation potentiation responders produce greater …

The Role Of Methyl Cpg Binding Domain Protein 2 (Mbd2) In The Regulation Of Embryonic And Fetal Β-Type Globin Genes, Merlin Nithya Gnanapragasam Jan 2010

The Role Of Methyl Cpg Binding Domain Protein 2 (Mbd2) In The Regulation Of Embryonic And Fetal Β-Type Globin Genes, Merlin Nithya Gnanapragasam

Theses and Dissertations

The reexpression of the fetal γ-globin gene in adult erythrocytes is of therapeutic interest due to its ameliorating effects in β-hemoglobinopathies. We recently showed that Methyl CpG Binding Domain Protein2 (MBD2) contributes to the silencing of the chicken embryonic ρ-globin and human fetal γ-globin genes. We further biochemically characterized an erythroid MeCP1 complex that is recruited by MBD2 to mediate the silencing of these genes. These observations suggest that the disruption of the MeCP1 complex could augment the expression of the fetal/embryonic globin genes. In the studies presented in chapter 2, we have pursued a structural and biophysical analysis of …

Primary Care Of The Adult With Diabetes, Debra Gates Jan 2010

Primary Care Of The Adult With Diabetes, Debra Gates

Nursing Doctoral

The landmark diabetes studies of the 1990’s demonstrated to the world the importance of blood glucose control in diabetes mellitus. It is now with out question controlling blood sugar significantly reduces the development of or delays the onset of diabetes related complications. Since the time of these research findings, there has been a tremendous amount of effort to both develop and study strategies that were most effective in managing diabetes. Despite this, it has been said that diabetes care in the United States is suboptimal (Mc Laughlin, 2000, p.5). Many studies individually show promise. Collectively these studies may also form …

This Article provides a summary of the law of tribal civil jurisdiction over persons who are not members of the governing tribe ("nonmembers'), followed by an analysis of trends in the lower courts. It was written to respond to a consensus view at the University of Colorado Law Review Symposium: "The Next Great Generation of American Indian Law Judges," in January 2010, that a concise, practical, yet in-depth treatment of this subject would be useful to the judiciary as well as practitioners. The Article traces the development of the Supreme Court's common law of tribal civil judicial jurisdiction from 1959 …

Tort Damages And The New Science Of Happiness, Rick Swedloff, Peter H. Huang Jan 2010

Tort Damages And The New Science Of Happiness, Rick Swedloff, Peter H. Huang

Publications

The happiness revolution is coming to legal scholarship. Based on empirical data about the how and why of positive emotions, legal scholars are beginning to suggest reforms to legal institutions. In this article we aim to redirect and slow down this revolution.

One of their first targets of these legal hedonists is the jury system for tort damages. In several recent articles, scholars have concluded that early findings about hedonic adaptation and affective forecasting undermine tort awards for pain and suffering, mental anguish, loss of enjoyment of life, and other non-economic damages. In the shadow of a broader debate about …

Converging Trajectories: Interest Convergence, Justice Kennedy, And Jeannie Suk's "The Trajectory Of Trauma", Jennifer S. Hendricks Jan 2010

Converging Trajectories: Interest Convergence, Justice Kennedy, And Jeannie Suk's "The Trajectory Of Trauma", Jennifer S. Hendricks

Publications

This essay responds to Jeannie Suk's recent article in the Columbia Law Review, The Trajectory of Trauma: Bodies and Minds of Abortion Discourse. Suk argues that feminists are responsible for legitimizing a paternalistic attitude towards women that came home to roost in Gonzales v. Carhart. This essay argues that Suk's critique of feminist paternalism needs to be supplemented with a discussion of traditional paternalism and its influence on how feminist advocacy enters the law. In particular, it suggests that Derrick Bell's theory of interest convergence provides a useful framework for understanding the cultural, legal, and rhetorical evidence adduced …

Body And Soul: Equality, Pregnancy, And The Unitary Right To Abortion, Jennifer S. Hendricks Jan 2010

Body And Soul: Equality, Pregnancy, And The Unitary Right To Abortion, Jennifer S. Hendricks

Publications

This Article explores equality-based arguments for abortion rights, revealing both their necessity and their pitfalls. It first uses the narrowness of the "health exception" to abortion regulations to demonstrate why equality arguments are needed--namely because our legal tradition's conception of liberty is based on male experience, no theory of basic human rights grounded in women's reproductive experiences has developed. Next, however, the Article shows that equality arguments, although necessary, can undermine women's reproductive freedom by requiring that pregnancy and abortion be analogized to male experiences. As a result, equality arguments focus on either the bodily or the social aspect of …

Legal Transitions And The Problem Of Reliance, David M. Hasen Jan 2010

Legal Transitions And The Problem Of Reliance, David M. Hasen

Publications

This Article analyzes the literature on legal transitions. The principal focus is taxation, but the analysis generalizes to other areas. I argue that the theoretical apparatus developed by scholars active in the legal transitions area suffers from significant conceptual shortcomings. These shortcomings include the unwarranted assimilation of legal to factual change, the naturalization of conventional arrangements, and the disregard of the distinction between making law and finding it. As a consequence, the recent literature offers an analysis that is unable either to explain actual transitions or to provide an adequate theory of how legal change should take place. In the …

Energy Justice And Sustainable Development, Lakshman Guruswamy Jan 2010

Energy Justice And Sustainable Development, Lakshman Guruswamy

Publications

Sustainable Development ("SD")--an expression of distributive justice--is the foundational premise of international energy and environmental law. It posits that international answers to environmental and energy problems cannot be pursued as independent and autonomous objectives but must be addressed within the framework of economic and social development. SD has been politically institutionalized in the Millennium Development Goals and a plethora of significant international instruments. Perhaps more importantly from a legal standpoint, SD is unequivocally codified, in the most widely accepted international energy and environmental treaties. This Article affirms the importance and continuing applicability of SD to the "other" third of the …
