The Inflammatory Response To Acute Maximal Sprint Exercise, Timothy A. Muth
The Inflammatory Response To Acute Maximal Sprint Exercise, Timothy A. Muth
Master's Theses and Doctoral Dissertations
The purpose of this study was to determine whether acute maximal sprint exercise would elicit an inflammatory response in trained and untrained runners marked by increased systemic immune proteins and byproducts of oxidation, as well as to determine a time course for the presence of these markers. In procedures approved by the Eastern Michigan University College of Health and Human Services Human Subjects Review Board, subjects participated in a total of five study visits consisting of both exercise and blood draws. Blood analysis seems to indicate that there was a secondary tissue injury, which was responsible for the greatest changes …
Effects Of Duration Of Selected Music As An Intervention On Postoperative Pain In Open-Heart Surgery Patients During Chair Rest On The First Postoperative Day, Tzu-Ting Shu
Master's Theses and Doctoral Dissertations
The purpose of this study was to test the effects of selected music on reducing postoperative pain and use of pain relief medications in open-heart surgery patients during chair rest on the first postoperative day.
This study was conducted using a pretest-posttest experimental design. A convenience sample of 13 open-heart surgery patients from a metropolitan hospital in southeastern Michigan were randomly assigned to the music group (n = 6) and the control group (n = 7). T-test analysis showed that pain scores (numeric rating scale, NRS = 0-10) were lower in the music group than the control group after 30, …
Health Impact Of Brief Interventions By A Registered Dietitian During Exercise Sessions In A Phase 2 Cardiac Rehabilitation Setting, Terrie Holewinski
Health Impact Of Brief Interventions By A Registered Dietitian During Exercise Sessions In A Phase 2 Cardiac Rehabilitation Setting, Terrie Holewinski
Master's Theses and Doctoral Dissertations
Weight management is integral to cardiovascular risk reduction. However, minimal weight loss is achieved during participation in many cardiac rehabilitation (CR) programs. The objective of the present study was to establish if brief interventions by a registered dietitian (RD) during cardiac rehabilitation sessions improved the health status of patients with cardiovascular disease. An RD provided individualized nutrition counseling, answered nutrition questions, and reviewed weekly progress in a CR program for a four-month period. At baseline and upon completion of 19 CR sessions, nutrition knowledge was assessed using a 38-question test, and body weight was measured. Upon completing CR, patients rated …
Influence Of Clinical Research Investigator Fraud On Clinical Trial Participation, Purnachandra Garimella
Influence Of Clinical Research Investigator Fraud On Clinical Trial Participation, Purnachandra Garimella
Master's Theses and Doctoral Dissertations
The number of clinical research investigators whom the Food and Drug Administration (FDA) has disqualified or totally restricted has been increasing since 1964. In addition, several public polls and surveys indicate a major dilemma in clinical trial participation and public perceptions of clinical research. This research investigates how clinical investigator fraud or misconduct influences public perceptions of participation in clinical trials. To meet this challenge, a welldesigned electronic survey was developed for the faculty at Eastern Michigan University (EMU). The survey results indicate that 79% of respondents were ―very likely‖ to be influenced by fraud committed by their own physicians. …
Structure-Activity Relationships Of Pai-1 Inhibitors, Karen Sanders
Structure-Activity Relationships Of Pai-1 Inhibitors, Karen Sanders
Master's Theses and Doctoral Dissertations
The inhibition of plasminogen activator inhibitor-1 (PAI-1) is anticipated to increase our understanding of various human ailments with which high levels of PAI-1 have been associated, including diabetes, stroke, and atherosclerosis. Previous accounts have reported the synthesis of inhibitors that bind to PAI-1 with a low affinity, inhibit the serpin plasma protein antithrombin III, and/or fail to inhibit PAI-1 when vitronectin, a cofactor of PAI-1 is present. The synthesis of small-molecule inhibitors of PAI-1 that improve upon these properties has been the main goal of this research. Research efforts focused on examining changes in inhibitor potency based on the manipulation …

The Patentability Of Electromagnetic And Acoustic Signals In Canada, Natalie Raffoul
The Patentability Of Electromagnetic And Acoustic Signals In Canada, Natalie Raffoul
Canadian Journal of Law and Technology
The issue of the patentability of electromagnetic and acoustic signals has not been litigated in Canada. If, however, the issue does come forward for litigation, Canadian courts may decide differently than their American colleagues did. The Supreme Court of Canada’s ‘Harvard Mouse’ decision shows that the Canadian law on patentable subject matter differs from American law. Under the Canadian definition of manufacture, electromagnetic and acoustic signals could constitute patentable subject matter.

Information Privacy In Public Space: Location Data, Data Protection And The Reasonable Expectation Of Privacy, Teresa Scassa
Canadian Journal of Law and Technology
This article considers whether the permissive disclosure provisions of the Personal Information Protection and Electronic Documents Act (PIPEDA) and its substantially similar counterparts mean that law enforcement agents have ready access to information about our movements and activities, or whether s. 8 of the Charter plays a role in limiting the circumstances in which disclosure without notice or consent may take place.

Fair Dealing Or Fare Stealing?: Implications Of Canadian Copyright Law Reform On The Online Classroom, Louis Grilli, Daniel Huff, Andrea Shakespeare, Michael Bliemel
Canadian Journal of Law and Technology
This article first examines Canadian copyright law as it pertains to distance education with a detailed review of literature, legislation and jurisprudence, including a comparison with influential law from the United States. Included in this analysis are the opinions of specialists and experts on distance education and copyright in the university environment, who were interviewed during this research. Based on the research findings, we have identified three distinct legislative outcomes. For each, we provide recommendations on how a university and other stakeholders might best protect their interests when confronted with any of these three possibilities.
"With Faces Hidden While The Walls Were Tightening": Applying International Human Rights Standards To Forensic Psychology, Michael L. Perlin
"With Faces Hidden While The Walls Were Tightening": Applying International Human Rights Standards To Forensic Psychology, Michael L. Perlin
Articles & Chapters
Although there are now robust bodies of literature in both Alaw and psychology and in international human rights law, there has been remarkably little written about the specific relationship between forensic psychology and international human rights standards (and about the relationship between mental disability law and such standards in general). Attention is paid when it appears that state psychiatry or psychology is used as a tool of political oppressions e.g., in the former Soviet Union or in China, but the literature is strangely silent on questions dealing with the extent to which forensic psychology practice comports withinternational human rights norms. …
Courts And Temperance “Ladies”, Richard H. Chused
Courts And Temperance “Ladies”, Richard H. Chused
Articles & Chapters
In 1873 and 1874, parts of southern Ohio were gripped by a remarkable string of marches, religious gatherings, and sit-ins by conservative, Christian, white women intent on shutting down the distribution of alcohol in their communities. A fascinating series of issues relating to the use of legal institutions to control these demonstrative women arose during these "temperance crusades." Many women in Hillsboro opposed using available legal avenues to suppress the liquor trade, preferring strategies based on moral suasion. But, as with other major controversies in our history, aspects of the temperance crusade ended up in court despite the desires of …

They Keep It All Hid: The Ghettoization Of Mental Disability Law And Its Implications For Legal Education, Michael L. Perlin
Articles & Chapters
The Supreme Court has, since 1972, decided more than fifty cases involving persons with mental disabilities, a docket spanning virtually every aspect of constitutional law and criminal procedure. These cases have dealt with the substantive and procedural limitations on the commitment power, the conditions of confinement in psychiatric institutions, the application of the Americans with Disabilities Act to persons institutionalized because of mental illness, the substantive and procedural aspects of the criminal incompetency inquiry and the insanity defense, the relationship between mental disability and sexually violent predator laws, and all aspects of the death penalty. Thousands of cases have been …
New York Recognition Of A Legal Status For Same-Sex Couples: A Rapidly Developing Story, Arthur S. Leonard
New York Recognition Of A Legal Status For Same-Sex Couples: A Rapidly Developing Story, Arthur S. Leonard
Articles & Chapters
In New York State at the beginning of 2010, same-sex couples cannot get married but can be married. The state’s highest court, the Court of Appeals, construed the state’s marriage law in 2006 to prohibit state officials from issuing marriage licenses to same-sex couples, but said nothing in that decision about whether same-sex couples married outside the state would be considered married when they were in the state. In February 2008, an intermediate appeals court in Rochester ruled that New York’s marriage recognition law supported extending comity to a same-sex marriage performed in Canada, and several other appellate courts have …

Comparative Growth And Yield Of Channel Catfish And Channel X Blue Hybrid Catfish Fed A Full Or Restricted Ration, Bartholomew W. Green, Steven Rawles
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
Growth and yield (kg/ha-1) of the channel catfish (Ictalurus punctatus, Rafinesque, 1818) and the channel x blue hybrid catfish [I. punctatus female x I. furcatus (Lesueur,1840) male], which shared the Jubilee strain of channel catfish as the maternal parent, were compared in sixteen 0.1 ha earthen ponds (14,852 fish/ha-1) during the April to November growing season. Each fish genetic group was fed a commercially formulated 32% protein feed daily to apparent satiation or at 80% of the mean daily satiation ration. Net yield and individual weight were higher for channel x …

The Cohesive Role Of Music, Dance And Traditional Artifacts In African Independent Churches In Western Kenya, Susan M. Kilonzo
The Cohesive Role Of Music, Dance And Traditional Artifacts In African Independent Churches In Western Kenya, Susan M. Kilonzo
Reconstruction: Studies in Contemporary Culture
The Kenyan society has since 1970’s been characterized by a wave of religious renewal, in which African Independent churches (AICs) sprouted up in response to people’s quest for a renewed tradition of African Culture. These movements endeavor to fulfill the people’s socio-cultural needs that are thought to have deteriorated with the advent of colonization and European Christianity. The paper subsequently examines how music, dance, and traditional artifacts used by AICs in Western Kenya have enhanced unity among the adherents in these churches. The paper also discusses how these churches, through music, dance and other artifacts survive amidst the quest for …
Local Fragmentation As Immigration Regulation, Rick Su
Local Fragmentation As Immigration Regulation, Rick Su
Journal Articles
Immigration scholars have traditionally focused on the role of national borders and the significance of nation-state citizenship. At the same time, local government scholars have called attention to the significance of local boundaries, the consequence of municipal residency, and the influence of the two on the fragmentation of American society. This paper explores the interplay between these two mechanisms of spatial and community controls. Emphasizing their doctrinal and historic commonalities, this article suggests that the legal structure responsible for local fragmentation can be understood as second-order immigration regulation. It is a mechanism that allows for finer regulatory control than the …

Maximum Feasible Participation Of The Poor: New Governance, New Accountability, And A 21st Century War On The Sources Of Poverty, Tara J. Melish
Journal Articles
In 1964, President Lyndon B. Johnson called for a Nationwide War on the Sources of Poverty to “strike away the barriers to full participation” in our society. Central to that war was an understanding that given poverty’s complex and multi-layered causes, identifying, implementing, and monitoring solutions to it would require the “maximum feasible participation” of affected communities. Equally central, however, was an understanding that such decentralized problem-solving could not be fully effective without national-level orchestration and support. As such, an Office of Economic Opportunity was established – situated in the Executive Office of the President itself – to support, through …
Revitalizing Union Democracy: Labor Law, Bureaucracy, And Workplace Association, Matthew Dimick
Revitalizing Union Democracy: Labor Law, Bureaucracy, And Workplace Association, Matthew Dimick
Journal Articles
Do core doctrines of labor-relations law obstruct the internal democratic governance of labor unions in the United States? Union democracy is likely an essential precondition for the broader strategic and organizational changes unions must undertake in order to recruit new union members — the labor movement’s cardinal priority. Yet according to widely accepted wisdom, the weakness of democracy within labor unions is the unavoidable outcome of an “iron law of oligarchy” that operates in all such membership-based organizations. This Article challenges this conventional thinking and argues that the triumph of oligarchy over democracy in US labor unions is not inevitable, …

Do Traditional Sociological Variables Apply The Same In American Indian Communities? A Comparison Of The Effects Of Social Disorganization, Social Bond, And Social Learning Variables On Delinquency And Substance Use Among Merican Indian, White, And Other Race Youth, Wendy Linn Running Crane
Graduate Student Theses, Dissertations, & Professional Papers
The history and current situations of American Indians are unique and important arenas to forward the study of crime and delinquency. There may be no better group available to study the combined effects of concentrated disadvantage, social disorganization, and abrupt societal change than the modern day American Indian community. But do traditional variables constructed to test sociological theories fit the study of this population? Findings from hypotheses testing the differences in overall effects of social control, social disorganization, social bonding, and social learning variables on delinquency and substance use suggest that there are differences in their ability to account for …

Factors Influencing The Face Validity Of Effort Tests: Timing Of Warning And Feedback, Haley Gail Trontel
Graduate Student Theses, Dissertations, & Professional Papers
The assessment of client effort during neuropsychological evaluation is of high importance. Two experiments were designed to assess factors that may influence effort testing during neuropsychological assessment. Participants for both experiments were undergraduate students without a history of neurological conditions, mental health concerns, or current problems with alcohol or drug use. The goal of Experiment 1 was to determine whether the timing of a warning that some tests may detect faking would influence (the face validity of and performance on) effort and standard neuropsychological measures. All participants were administered the Test of Memory Malingering (TOMM) and Memory for Complex Pictures …

Graduate Student Theses, Dissertations, & Professional Papers
ABSTRACT Garella, Jeanine Sandra, M.A., Autumn 2010 Geography Geographilia in Children’s Urban Spaces: Investigating How Children Explore Outdoor Places and Connect With Natural Objects Chairperson: Jeffrey A. Gritzner The benefits children receive from outdoor play time are well documented by scholars across many disciplines. Interacting within an unstructured natural setting can foster physical, social, emotional, and spiritual growth. The lessons learned in such an environment not only help children reach developmental milestones; they also play an important role in the formation of beliefs and attitudes used in decision-making processes later in life. This is a significant point to make when …

Banking And Monetary Policy In 2010, Ishrat Husain Dr.
Faculty Research - Newspaper and Magazine Articles
Pakistan faced serious economic difficulties in the last few years particularly in 2008 due to high inflation, large current account deficit, dwindling foreign exchange reserves and excessive borrowing by the Government from the Central Bank. Monetary policy was therefore tightened throughout 2009 to bring inflation under control. Policy rate was cut only when signs of moderation in inflation began to appear. It is only in the last few months that macro stability has been achieved with the assistance of the IMF. But paradoxically the global financial crises had very little to do with the domestic economic problems. The trouble inPakistanstarted …
Lumping As Default In Tort Cases: The Cultural Interpretation Of Injury And Causation, David M. Engel
Lumping As Default In Tort Cases: The Cultural Interpretation Of Injury And Causation, David M. Engel
Journal Articles
Empirical studies of the tort law system suggest that "lumping, " or decisions by victims to do without adequate remedies, should be regarded as the predominant response to injury in American society and elsewhere. Yet research on lumping remains conceptually impoverished and gives insufficient attention to the culturalftameworks victims use to interpret their experiences and determine their responses. This Article presents the stories of injury victims in Thailand and compares their common-sense understandings of torts and tort law to those of injured Americans. It argues that analyses of lumping in America as well as Asia should take into account the …
How The Biological/Social Divide Limits Disability And Equality, Martha T. Mccluskey
How The Biological/Social Divide Limits Disability And Equality, Martha T. Mccluskey
Journal Articles
What is disability - a biological or social condition? In the conventional equality frameworks, the division between biology and social identity puts disability at the bottom of the formal equality hierarchy, but at the top of the substantive equality hierarchy. Compared with race and then gender, disability deserves the least protection against formal discrimination, on the theory that disadvantages are based on real and relevant functional differences more than on suspect social judgments. But turning to substantive equality, disability’s supposed greater biological basis justifies affirmative accommodation of difference, compared to the social differences of race, with gender in the middle …
Navigating Tricky Ethical Shoals In Environmental Law: Parameters Of Counseling And Managing Clients, Kim Diana Connolly
Navigating Tricky Ethical Shoals In Environmental Law: Parameters Of Counseling And Managing Clients, Kim Diana Connolly
Journal Articles
This article explores some of the ethical situations that environmental and natural resource lawyers can encounter when counseling clients. It begins by exploring the Model Rule of Professional Conduct (MRPC) 2.1, regarding counsel’s role as “advisor,” which provides that appropriate client counseling refers not only to law, but also to moral, economic, social, and political factors, when making decisions. It also explores the environmental lawyer’s ability to withdraw from representation pursuant to MRPC 1.16. It places the obligations and options under these rules and other mandates in the environmental and natural resource context, and encourages attorneys practicing in the area …
