The ever increasing use and reliance upon computers in both the public and private sector has led to enormous numbers of computers being disposed of at the end of their useful life within an organisation. As the cost of computers has dropped, their use in the home has also continued to increase. In most organisations, computers have a relatively short life and are replaced on a regular basis with the result that, if not properly cleansed of data, they are released into the public domain containing data that can be relatively up to date. This problem is exacerbated by the …
Sex In And Out Of Intimacy, Laura A. Rosenbury, Jennifer E. Rothman
Sex In And Out Of Intimacy, Laura A. Rosenbury, Jennifer E. Rothman
Emory Law Journal
This Article challenges the underlying assumption in Lawrence v. Texas that sex is valuable only when potentially in service to emotional intimacy and proposes a new theory for extending legal protection to a wider range of consensual sexual activities. The current regulation of sex devalues both sexual relationships that lack an intimate component and intimate relationships that lack a sexual component. We argue that the state should independently protect both intimate relationships and sexual interactions because sex can constitute a vital part of individual identity and self-expression even when not channeled into intimacy. We challenge the dominant, almost sacred, understanding …
A View From The Cradle: Tort Law And The Private Regulation Of Assisted Reproduction, Michele Goodwin
A View From The Cradle: Tort Law And The Private Regulation Of Assisted Reproduction, Michele Goodwin
Emory Law Journal
This Article proposes a paradigm shift. It analyzes the viability of tort law to address the private and costly harms resulting from negligent application of ART. These harms include the intentional and negligent conception of children with significant disabilities. This Article articulates the need for a nuanced approach to tort law in the realm of child–parent conflict—an approach that shifts the social and economic burdens of infant and child harms to parents because they are best situated to avoid the risks of harm. This Article addresses a gap in socio-legal scholarship to unpack when, how, and why tort liability should …

Professor Huntington’s exploration of the potentially positive role for emotion and social norms in rethinking the place of the state in family regulation is an important contribution to the field. However, in order to accomplish the ambitious tasks she sets out for herself, I suggest that she should give more attention to clarifying the meaning of key concepts. Elaboration of certain assertions and terms would strengthen her observations and arguments, making both more persuasive. In the following Parts, I raise some key issues and questions regarding the concepts and terms that warrant further development and articulation.
Beauty In The Dark Of Night: The Pleasures Of Form In Criminal Law, Martha Grace Duncan
Beauty In The Dark Of Night: The Pleasures Of Form In Criminal Law, Martha Grace Duncan
Emory Law Journal
I neither defend nor prosecute defendants. I am a law professor, and my contact with flesh-and-blood criminals extends only so far as visiting prisons and interviewing convicts for research purposes. Some of the prisoners I’ve interviewed have become my friends; others, my long-term correspondents, through the process of my learning and writing about them. Mostly, though, I work not with criminals but with criminal law—a field I adore. You could say, following Max Weber, that I live for as well as off my chosen field.
Protecting Preachers From Prejudice: Methods For Improving Analysis Of The Ministerial Exception To Title Vii, Benton C. Martin
Protecting Preachers From Prejudice: Methods For Improving Analysis Of The Ministerial Exception To Title Vii, Benton C. Martin
Emory Law Journal
Instead of the current approach, which defers to religious organizations, this Comment argues that any right to church autonomy should be balanced against the government’s interest in enforcing anti-discrimination laws. The need for an appropriate balancing test is confirmed by recent lower court opinions that have struggled to justify a deferential approach in the face of employment decisions by religious institutions that violate federal law and lack any religious justification. After arguing for a more sound constitutional approach, this Comment ultimately proposes an amendment to Title VII that would protect ministers from non-religious discrimination while shielding religious organizations from intrusion …
The Rule Of Law Unplugged, Daniel B. Rodriguez, Mathew D. Mccubbins, Barry R. Weingast
The Rule Of Law Unplugged, Daniel B. Rodriguez, Mathew D. Mccubbins, Barry R. Weingast
Emory Law Journal
The concept of rule of law has become unplugged from theories of law. Scholars clearly have more work to do in understanding the rule of law and designing institutions to realize the objectives for which this grand project is intended. In this Article, we revisit the concept of the rule of law in order to unpack the theoretical and operational assumptions underlying scholarship and reform efforts. We do so from the perspective of legal and positive political theory, and we interrogate various institutional devices (such as constitutionalism and the independent judiciary) in order to shed light on how the construct …
Lawless By Design: Jurisdiction, Gender And Justice In Indian Country, Laura E. Pisarello
Lawless By Design: Jurisdiction, Gender And Justice In Indian Country, Laura E. Pisarello
Emory Law Journal
To reduce crime, and sexual violence in particular, in Indian Country, Congress should “overturn” Oliphant and grant tribes direct criminal jurisdiction over all people—Indian or not—in Indian Country. Congress should also remove sentencing limits and explicitly grant tribal courts authority to adjudicate all crimes. Accordingly, this Comment discusses the effects of present legal hurdles to prosecuting those who commit crimes in Indian Country. It shows how Congress could remove these legal barriers and addresses possible constitutional concerns about this proposal. This Comment outlines the legal benefits of this proposal, including a more harmonized and modern legal framework that enhances tribal …
Test At Your Own Risk: Your Genetic Report Card And The Direct-To-Consumer Duty To Secure Informed Consent, Deepthy Kishore
Test At Your Own Risk: Your Genetic Report Card And The Direct-To-Consumer Duty To Secure Informed Consent, Deepthy Kishore
Emory Law Journal
Selling access to individual genetic information has transposed the physician-patient relationship into a company-consumer context, calling for a novel examination of how consumer and patient protections overlap and where federal regulation ends and tort law begins. This Comment applies principles of products liability and informed consent to the context of genetic testing to argue that tort liability, rather than greater regulation of genetic tests, is the best way to protect consumers of DTC genetic testing. This Comment demonstrates that without professional assistance, consumers risk misinterpreting the meaning of their genetic test results and may even be driven to take drastic …
A Lack Of Resolution, David Zaring
A Lack Of Resolution, David Zaring
Emory Law Journal
The failure to resolve¿that is, impose a quick death penalty on¿enormous financial intermediaries such as Lehman Brothers and AIG damaged the ability of the government to respond to the financial crisis. But expanding resolution authority to cover new systemically significant institutions¿which is one of the lynchpins of financial regulatory reform¿poses a problem of legitimacy with constitutional implications, as resolution authority is usually exercised with almost no predeprivation process and little postdeprivation compensation. At the same time, banking regulators have failed, every time they have been given more resolution authority, to exercise that authority when it is needed. This Article reassesses …
The Vulnerable Subject And The Responsive State, Martha Albertson Fineman
The Vulnerable Subject And The Responsive State, Martha Albertson Fineman
Emory Law Journal
Equal protection law under the United States Constitution requires that in order to be treated equally, individuals must be treated the same. This sameness-of-treatment version of equality ignores contexts, as well as differences in circumstances and abilities on the part of those whose treatment is compared. Most perplexing is the way in which the equal protection doctrine ignores existing inequalities of circumstances and presumes an equivalence of position and possibilities. Such a narrow approach to equality cannot be employed to combat the growing inequality in wealth, position, and power that we have experienced in the United States over the past …
Overcoming Fragmentation In Disability And Health Law, Ani B. Satz
Overcoming Fragmentation In Disability And Health Law, Ani B. Satz
Emory Law Journal
Legal structures respond to human need by defining situations in which specific rights or entitlements attach. Legal protections usually depend on whether an individual is operating within a particular time period, physical space, or other context. The assumption underlying this targeted approach to state response is that the law must make distinctions between individuals that both determine eligibility for legal protections and possible remedies. In litigation, this approach may be perceived as necessary to promote fairness amongst adversarial parties. Targeted approaches may also facilitate desired judicial outcomes, by expanding, contracting, or reframing liability. Laws structuring social welfare programs or other …
Federalization Of The Mosquito: Structural Innovation In The New Deal Administrative State, Polly J. Price
Federalization Of The Mosquito: Structural Innovation In The New Deal Administrative State, Polly J. Price
Emory Law Journal
Malaria was a significant problem in the southern United States during the early decades of the twentieth century. Part of President Franklin D. Roosevelt¿s New Deal focused on economic development of the South, with improvement of public health in that region as an integral part. This Article is a case study of increased federal public health efforts during the New Deal and World War II eras, which replaced some traditionally state and local areas of control as well as private philanthropic efforts.
Law And The Social Control Of American Capitalism, William J. Novak
Law And The Social Control Of American Capitalism, William J. Novak
Emory Law Journal
This Essay is part of a larger, ongoing investigation of the role of law in the creation of a modern American state from 1877 to 1932. That project charts the decline of an early nineteenth-century world of local, common law self-government (what I called in a previous work a ¿well-regulated society¿) and the rise of a distinctly modern administrative regulatory state in the United States. This new legal-political regime was rooted in three interlinked developments: the centralization of public power; the individualization of private right; and the constitutionalization of the rule of law. Beginning soon after the Civil War, nineteenth-century …
Smoking Out Big Tobacco: Can The Family Smoking Prevention And Tobacco Control Act Equip The Fda To Regulate Tobacco Without Infringing On The First Amendment?, Matt Shechtman
Emory Law Journal
Tobacco use is one of the most catastrophic public health issues facing the world today. The recently passed Family Smoking Prevention and Tobacco Control Act (FSPTCA) gives the United States Food and Drug Administration (FDA) unprecedented power to regulate tobacco products. These provisions, however, may unconstitutionally infringe on First Amendment commercial speech under the judicially crafted commercial speech doctrine governed by Central Hudson Gas & Electric Corp. v. Public Service Commission. Indeed, after the FSPTCA¿s passage, several tobacco companies filed suit, arguing that these advertising restrictions violate the First Amendment. If these provisions are not modified to fall within the …
The Doctrine Of Equivalents: Fairness And Uncertainty In An Era Of Biologic Pharmaceuticals, D. Alan White
The Doctrine Of Equivalents: Fairness And Uncertainty In An Era Of Biologic Pharmaceuticals, D. Alan White
Emory Law Journal
Research in the rapidly developing area of biologic pharmaceuticals promises to improve the lives of millions of patients suffering from disorders that were, until very recently, untreatable. The staggering potential market for such treatments has attracted enormous investment from the pharmaceutical industry, with a concomitant increase in related patent disputes. This investment, coupled with proposed legislation that would pave the way for the creation of ¿follow-on¿ biologic treatments via a statutory pathway similar to the one created for generic pharmaceuticals by the Hatch¿Waxman legislation of the early 1980s, should ensure that the number of patent disputes involving biologic pharmaceuticals will …
All Things In Proportion? American Rights Review And The Problem Of Balancing, Jud Mathews, Alec Stone Sweet
All Things In Proportion? American Rights Review And The Problem Of Balancing, Jud Mathews, Alec Stone Sweet
Emory Law Journal
This Article describes and evaluates the evolution of rights doctrine in the United States, focusing on the problem of balancing. In the current Supreme Court, deep conflict over whether, when, and how courts balance rights is omnipresent. Elsewhere, we find that the world¿s most powerful constitutional courts have embraced a stable analytical procedure for balancing, known as proportionality. Today, proportionality analysis (PA) constitutes the defining doctrinal core of a transnational, rights-based constitutionalism. This Article critically examines alleged American exceptionalism, from the standpoint of comparative constitutional law and practice.
Engendering Fairness In Domestic Violence Arrests: Improving Police Accountability Through The Equal Protection Clause, Niji Jain
Emory Law Journal
When police decline to respond to reported violations of restraining orders, victims of gender-based violence and their children suffer tragic consequences. Congress enacted 42 U.S.C. § 1983 to remedy problems of this sort by lifting the shield of immunity when a state actor violates an individual¿s constitutional rights. A credible threat of liability for police officers is imperative to encourage police to act in a way that protects individuals from harm. However, the Supreme Court has substantially limited the possible § 1983-based causes of action a victim of gender-based violence can bring against a police officer. The only remaining avenue …

Contemporary Grouping In Mixed-Size Dairy Herds Experiencing Four Seasons, Mohammad Ali̇ Nilforooshan
Contemporary Grouping In Mixed-Size Dairy Herds Experiencing Four Seasons, Mohammad Ali̇ Nilforooshan
Turkish Journal of Veterinary & Animal Sciences
Countries with different herd structures and climates use different combinations of herd, year, and season to define the effect of their climatic conditions and management. Estimates of variance components and Akaike information criterion values resulting from 8 analytical models differentiated by different combinations of herd, year and season effects were compared for milk and fat yields. Data consisted of pedigree and records of 11,850 Holsteins freshening in 38 dairy herds of Isfahan, Iran, between January 1994 and October 2001. Heritability estimates were lowest for the models that used herd-year combination as a random effect. Moreover, the use of these models …

Immune Response To Type-2 Porcine Circovirus In Weaned Pigs, Hong Chen, Ke-Ying Zhang, Xue-Mei Ding, Zhi-Wen Xu, Dai-Wen Chen, Gang Tian
Turkish Journal of Veterinary & Animal Sciences
Sixteen crossbred barrows (Duroc × Landrace × Yorkshire) weaned at 28 days with an initial body weight of 5.12-8.64 kg and no antibodies to PCV2 were used in a 5-week trial to evaluate the immune response after intranasal inoculation with type-2 porcine circovirus. The percentage of peripheral blood ANAE+ T cells, PCV2 antibody titer, immunoglobulins, and serum IFN-\gamma, IL-2, and sIL-2R levels were determined. The results show that the percentage of peripheral blood ANAE+ T cells was notably higher in inoculated pigs 5 days post-inoculation (dpi) and significantly lower 21 dpi than in the control group. The anti-PCV2 titer in …

The Performance Of A Small-Scale, High-Density, Continuous System For Culturing The Rotifer Brachionus Plicatilis, Umur Önal, İhsan Çeli̇k, Sebahatti̇n Ergün
Turkish Journal of Veterinary & Animal Sciences
The performance of a high-density continuous system was evaluated as an alternative to conventional low-density batch-culture systems for culturing the rotifer Brachionus plicatilis. Rotifer densities ranging from 1700 to 3760 individuals/mL were achieved in 4 different trials that lasted 10-18 days. Problems associated with NH_3-N and pH were controlled by increasing the water exchange rate and periodic addition of ammonia remover. While NH_3-N and pH values were 0-8.8 mg/L and 6.9-9.3, respectively, the most important problem was the accumulation of TSS at concentrations of up to 85 mL/L within a very short time after start-up. Further studies are required to …

Turkish Journal of Veterinary & Animal Sciences
Ticks are obligate blood sucker arthropods that infect animals and humans. A common tortoise tick, Hyalomma aegyptium, was collected from a young and an adult male hedgehog, Erinaceus concolor, from Central Anatolia in July 2008. More ticks were determined on the young one. This is the second record of tortoise tick that parasitizes a hedgehog.
Conception Rates For Standing Estrus And Fixed-Time Insemination In Dairy Heifers Synchronized With Gnrh And Pgf_{2\Alpha}, Samir Z. El-Zarkouny
Conception Rates For Standing Estrus And Fixed-Time Insemination In Dairy Heifers Synchronized With Gnrh And Pgf_{2\Alpha}, Samir Z. El-Zarkouny
Turkish Journal of Veterinary & Animal Sciences
The objective of this study was to evaluate the effectiveness of GnRH PGF-based protocols on reproductive outcome in Holstein heifers. Heifers were randomly assigned to the control group (n = 14), or treatment groups (n = 50) treated with GnRH (day -7) and PGF_{2\alpha} (day 0). Heifers that exhibited estrus were inseminated (Select Synch, n = 34) and heifers that did not exhibit estrus up to 48 h after PGF_{2\alpha} injection received a second GnRH injection and were fixed-time inseminated (Ovsynch, n = 16). Conception rates were 40%, 55.9%, and 31.3%, and overall pregnancy rates (P < 0.05) were 64.3%, 97%, and 87.5% in the control, Select Synch, and Ovsynch groups, respectively. Ovsynch heifers had 1.8 ± 0.5 and 3.2 ± 0.6 ng mL^{–1} of serum P4, versus 3.3 ± 0.5 and 3.8 ± 0.6 ng mL–1 in the Select Synch heifers at the time of the first GnRH and PGF_{2\alpha} injection, respectively. Conception rates were 55.6% and 58.3% when P4 concentrations were high, and were 50% and 25% when P4 concentrations were low at the time of the first GnRH and PGF_{2\alpha} injection, respectively. Dairy heifers synchronized with GnRH and PGF_{2\alpha} should be inseminated when estrus is observed, and heifers that do not exhibit estrus up to 48 h after PGF_{2\alpha} injection should be given a second GnRH injection and fixed-time inseminated 16-20 h later.
