The Year In Economics At The Fcc: A National Plan For Broadband, Jonathan Baker, Paul De Sa Oct 2010

The Year In Economics At The Fcc: A National Plan For Broadband, Jonathan Baker, Paul De Sa

Scholarly Articles in Law Reviews & Journals

The past year in economics at the Federal Communications Commission (FCC) has focused on encouraging the adoption and deployment of high capacity Internet access and the associated networks, commonly termed “broadband.” Our article sketches important economic themes in the FCC’s National Broadband Plan to show how the application of basic principles of regulatory economics takes account of rapid technological change. We discuss natural monopoly regulation, externalities and cross-subsidies, network effects and interconnection, the allocation of scarce inputs, protecting and fostering competitive markets, and consumer protection and transparency as they apply to the development of broadband.

Geographic Isolation And Poverty Among Indigenous Peoples In Nepal, Gyanesh Lama, Marth N. Ozawa, Palsang Lama Oct 2010

Geographic Isolation And Poverty Among Indigenous Peoples In Nepal, Gyanesh Lama, Marth N. Ozawa, Palsang Lama

Himalayan Research Papers Archive

This study analyzed nationally representative sample of women (N =10793) to quantify the magnitude and predictors of poverty among indigenous peoples of Nepal. The study estimated the risk of poverty among the major ethnic groups in Nepal. Cross-sectional data from the Nepal Demographic and Health Survey 2006 (NDHS 2006) was used. Step-wise multivariate logistic regressions were conducted. The results show that significant variations exist in the risk of poverty between indigenous and non-indigenous peoples. Tamang were at the highest risk of poverty among the indigenous peoples. Controlling for geography further exacerbated the disparity between indigenous and non-non indigenous peoples. Attentions …

Re-Examining Acts Of God, Jill M. Fraley Oct 2010

Re-Examining Acts Of God, Jill M. Fraley

Pace Environmental Law Review

Applying recent critiques of the construction of nature as distinct from and excluding all that is human, this article examines the concept of an act of God, which exculpates defendants when a disaster is “solely caused” by a “natural” event. The doctrine incorporates a classical separation of the human from the natural—a separation that is now refuted in geography and philosophy. While other areas of law such as patents, food and drug law, and land use policy have begun to acknowledge our changing understandings of human and nature, we have yet to re-examine the acts of god doctrine, which is …

Path Dependence, Institutions And The Density Of Economic Activities: Evidence From Italian Cities, Marco Percoco Oct 2010

Path Dependence, Institutions And The Density Of Economic Activities: Evidence From Italian Cities, Marco Percoco

Fondazione Eni Enrico Mattei Working Papers

In recent years a growing body of literature has begun to consider the possible presence of path dependence in the development processes of countries. This phenomenon has always been recognized in regional and urban studies because the path of development almost naturally follows a history-dependent spatial diffusion influenced by both physical geography and the quality of institutions. In this paper, I consider the case of firm concentration in Italy and its impact on local development. A large and growing literature has argued in favour of persisting effects of past institutions on current outcomes. Hence, in order to identify the impact …

Environmental Performance And Regional Innovation Spillovers, Valeria Costantini, Massimiliano Mazzanti, Anna Montini

Fondazione Eni Enrico Mattei Working Papers

The achievement of positive environmental performance at national level could strongly depend on differences in local capabilities of both institutions and the private business sector. Environmental regulation alone is a weak instrument if the institutional and business environment cannot transform regulation strengths into opportunities. In this paper, we use the new environmental accounting matrix for polluting emissions now available for the 20 Italian Regions that covers 24 sectors and combines a shift-share approach with spatial econometric modelling. We provide evidence of the role played by internal innovation, innovation spillovers and regional policies in shaping the geographical distribution of environmental performance …

Redescription Of The Tyee Sucker, Catostomus Tsiltcoosensis (Catostomidae), Jes Kettratad, Douglas F. Markle Oct 2010

Redescription Of The Tyee Sucker, Catostomus Tsiltcoosensis (Catostomidae), Jes Kettratad, Douglas F. Markle

Western North American Naturalist

We resurrect Catostomus tsiltcoosensis, the Tyee sucker of Oregon coastal rivers, from the synonymy of Catostomus macrocheilus and compare it with its congeners. Catostomus tsiltcoosensis is superficially similar to disjunctly distributed Catostomus occidentalis of the Sacramento drainage and Catostomus ardens of the Upper Snake River and Bonneville Basin. However, the gill raker structure, wide frontoparietal fontanelle, location of the ninth cranial foramen, scale radii patterns, and cytochrome b sequences clearly align C. tsiltcoosensis with C. macrocheilus rather than C. occidentalis. Differences in counts of infraorbital pores and dorsal fin rays, in body depth proportions, and in cytochrome b sequences distinguish …

Hispid Cotton Rat (Sigmodon Hispidus) In Nebraska: Distribution, Reproduction, And Seasonal Activity, Greg D. Wright, Keith Geluso, Russell A. Benedict Oct 2010

Hispid Cotton Rat (Sigmodon Hispidus) In Nebraska: Distribution, Reproduction, And Seasonal Activity, Greg D. Wright, Keith Geluso, Russell A. Benedict

Western North American Naturalist

The hispid cotton rat (Sigmodon hispidus) has occurred in Nebraska for about 50 years and entered the state from the south via northward movements through Kansas. However, little is known about its status or distribution in the state in recent decades. We conducted surveys for S. hispidus in southern Nebraska at historical sites and sites without previous records to determine its current status. From 2004 to 2008, we documented cotton rats at 9 of 12 historical sites in south-central and extreme southeastern parts of the state, and we captured this species at 13 new sites in southwestern and …

High Levels Of Gene Flow In The California Vole (Microtus Californicus) Are Consistent Across Spatial Scales, Rachel I. Adams, Elizabeth A. Hadly Oct 2010

High Levels Of Gene Flow In The California Vole (Microtus Californicus) Are Consistent Across Spatial Scales, Rachel I. Adams, Elizabeth A. Hadly

Western North American Naturalist

Gene flow links the genetic and demographic structures of species. Despite the fact that similar genetic and demographic patterns shape both local population structure and regional phylogeography, the 2 levels of population connectivity are rarely studied simultaneously. Here, we studied gene flow in the California vole (Microtus californicus), a small-bodied rodent with limited vagility but high local abundance. Within a 4.86-km2 preserve in central California, genetic diversity in 6 microsatellites was high, and Bayesian methods indicated a single genetic cluster. However, individual-based genetic analysis detected a clear signal for isolation-by-distance (IBD) and fine-scale population structure. Mitochondrial cytochrome …

Deer Mouse (Peromyscus Maniculatus) Home-Range Size And Fidelity In Sage-Steppe Habitat, Britta A. Wood, Lin Cao, M. Denise Dearing Oct 2010

Deer Mouse (Peromyscus Maniculatus) Home-Range Size And Fidelity In Sage-Steppe Habitat, Britta A. Wood, Lin Cao, M. Denise Dearing

Western North American Naturalist

Within a species, home-range size can vary due to factors such as sex, mass, age, and breeding condition of individuals as well as habitat type, food availability, population density, and season. The objectives of this study were to estimate home ranges of deer mice (Peromyscus maniculatus) in sage-steppe habitat and to test the hypothesis that several factors (sex, mass, reproductive status, and seasonality) affect home-range size. We also tested the hypothesis that deer mice exhibit home-range fidelity over time. Passive integrated transponder (PIT) technology was used to estimate home ranges in June and September 2006. Home-range estimates varied …

Nesting Ecology Of Yellow Warblers (Dendroica Petechia) In Montane Chaparral Habitat In The Northern Sierra Nevada, Diana L. Humple, Ryan D. Burnett Oct 2010

Nesting Ecology Of Yellow Warblers (Dendroica Petechia) In Montane Chaparral Habitat In The Northern Sierra Nevada, Diana L. Humple, Ryan D. Burnett

Western North American Naturalist

The Yellow Warbler (Dendroica petechia) is considered a riparian specialist in much of western North America, but in California it also breeds in a second habitat type: montane chaparral of the Sierra Nevada and southern Cascades. We monitored Yellow Warbler nests in montane chaparral and assessed their poorly known nesting ecology in this habitat. We also conducted point counts in upland habitat throughout the region. We determined habitat associations for Yellow Warblers based on nest site and point-count vegetation data; nests were predominantly in bush chinquapin (Chrysolepis sempervirens) and greenleaf manzanita (Arctostaphylos patula), and …

Transqueer Representations And How We Educate, Kay Siebler Oct 2010

Transqueer Representations And How We Educate, Kay Siebler

English Faculty Publications

This article examines the representations of transqueers (specifically female to male transsexuals) in popular media and how these representations shape attitudes of transqueers both with those outside the LBGT community and those within the community. The article discusses how these cultural images of FTM transqueers imply that being accepted often means surgery and hormones in order to “pass” as male, and it challenges educators to work more overtly and diligently to educate toward critical consciousness regarding the sex/gender system and the rigidity of the binary that removes transgendered people as nonentities. The article offers an argument about how to approach …

Hidden In Plain View: Legal Geography From A Visual Perspective, Irus Braverman Oct 2010

Hidden In Plain View: Legal Geography From A Visual Perspective, Irus Braverman

Journal Articles

Law, with a capital “L” at least, is not particularly fond of hiding itself. In order to be effective, law must be asserted in the world; it must be acknowledged; and, most importantly, it must be visually seen. Why, then, would law hide itself in space? And, perhaps more importantly, how would it do so? And why would such hidden places of law be of importance to us? This paper explores the dual project of seeing and concealing within the context of legal geography. It examines how law sees the physical landscape and how it is seen from a spatial …

Individual Contributions To Stigma And Attitudes Toward Help-Seeking Among Rural Emerging Adult College Students, Margaret Gsell Oct 2010

Individual Contributions To Stigma And Attitudes Toward Help-Seeking Among Rural Emerging Adult College Students, Margaret Gsell

Theses and Dissertations

Rural communities are by definition less densely populated and more geographically isolated than non-rural communities, which often translates into higher rates of poverty and poor access to health care, especially mental health care. Previous research has found that persons residing in rural communities endorse higher rates of stigmatized beliefs towards individuals with mental illness and subsequently lower rates of professional help-seeking when compared to persons residing in non-rural communities. This study evaluated whether these attitudes were also present among emerging adults (18-24 years old) who had lived in a rural community for at least 10 years and were currently enrolled …
