Towards A Jurisprudence Of Hybridity, Paul Schiff Gedicks
Towards A Jurisprudence Of Hybridity, Paul Schiff Gedicks
Utah Law Review
Debates about non-state normative communities often devolve into clashes between two polarized positions. On the one hand, we see the desire to eradicate difference through forced obeisance to a single overarching state norm. On the other, we see claims of complete autonomy for non-state lawmaking, as if such non-state communities could plausibly exist in isolation from the communities that both surround and intersect them.
When Is Non-State Global Governance Really Governance?, Steven Bernstein
When Is Non-State Global Governance Really Governance?, Steven Bernstein
Utah Law Review
Looking back, the concept of global governance seems an unlikely candidate to have survived into the twenty-first century. The more recent attention given to non-state global governance might seem even more curious. The terms are hopelessly vague; those who see legitimate political order stemming only from sovereignty and constitutions bristle against them, and what may look like governance beyond the state is much more often regional or sectoral than global. Moreover, despite protestations from its defenders that governance is not the same as government, its purposely close lexical connection to government invokes constant comparisons to the state and state authority, …
Understanding Gravel Beach Dynamics By Measuring And Modelling Annual, Seasonal And Storm-Induced Morphological Response, Amaia Ruiz De Alegria Arzaburu
Understanding Gravel Beach Dynamics By Measuring And Modelling Annual, Seasonal And Storm-Induced Morphological Response, Amaia Ruiz De Alegria Arzaburu
School of Biological and Marine Sciences Theses
The aim of this study is to gain a better understanding of the medium-term (weeks to years) morphological evolution of gravel beaches. In particular, this project aims to better understand and parameterise gravel beach/barrier evolution processes at storm, seasonal and annual time-scales. For this purpose, the morphological variability of the Slapton Sands macrotidal gravel beach/barrier (Devon, UK) was measured over a 3-year period using an Argus video-system, and carrying fortnightly and event-driven RTK-GPS field surveys. Concurrent nearshore hydrodynamic measurements were collected by a directional wave buoy located 2km off Slapton Sands, and tidal data were obtained from a tidal model …

Essential Assessment For Quality Online Learning In Higher Education, Shu-Hsiang Chen
Graduate Research Papers
Linking assessment with learning objectives and outcomes has become significantly important in assessing adult learners in higher education. To better understand how adults learn and their expectations for learning, this paper provides a literature review that examines adult learning theory, learner characteristics, and motivation factors that shape our understanding. Additionally, this paper provides an in-depth review on the definition of assessment, types of assessment, formative versus summative assessment, alternative assessment, self-assessment, and the most appropriate and essential implementing principles and strategies in an online learning environment. The resources were retrieved using the University of Northern Iowa Library's online cataloging system …

The Impact Of Tsunamis On The Island Of Majorca Induced By North Argelian Seismic Sources, José A. Álvarez-Gómez, Maitane Olabarrieta, Mauricio González, Luís Otero, Emilio Carreño, José M. Martínez-Solares
Turkish Journal of Earth Sciences
The north of Algeria is the main earthquake-related tsunami generation zone that threatens the Balearic Islands. In this work we review the major seismic series of the area -the 1980 El Asnam and the 2003 Boumerdes-Zemmouri earthquakes– in order to obtain a probable worst characteristic earthquake rupture. We estimate rupture dimensions of 55 km x 16 km, reaching the fault plane a depth of 13 km. The dip and rake have been taken as constants, with values of 50° and 90° respectively, while the strike is adjusted to the local tectonic structure. With these characteristics a magnitude M_w= 7.3 earthquake …
Morphology, Taxonomy And Lifestyle Of The Maastrichtian Rudist Bivalve Thyrastylon, Simon Francis Mitchell
Morphology, Taxonomy And Lifestyle Of The Maastrichtian Rudist Bivalve Thyrastylon, Simon Francis Mitchell
Turkish Journal of Earth Sciences
The rudist bivalve Thyrastylon is redescribed based on extensive material collected from Jamaica. The new material shows that the left valve contains slits, and that this is the diagnostic feature of the genus. The genus is redefined as follows: a radiolitid rudist with no ligamental infold, stretched cellular microstructure and compact layers in the outer layer of the right valve; the radial bands are partially infolded into the shell layer of the right valve; the left valve has oscules developed above the radial bands and has concentric, slit-like pores that penetrate the shell and open out onto the inner part …
The Unforgettable June 2008 Cedar River Flood, Keri Annis
The Unforgettable June 2008 Cedar River Flood, Keri Annis
Graduate Research Papers
Natural disasters such as flooding cause emotional and financial strains. Among those directly affected are children. Communities are forever changed after suffering loses due to flooding. Informational text provides discussion and comprehension for children. An informational booklet about the devastating June 2008 Cedar River flood and the effects it has had on the Cedar Rapids community would benefit third graders in the Cedar Rapids Community School District. Due to the recency of this flood, no informational books about it have been published for children. The purpose of this research project was to create an informational booklet using a non-fiction expository …
A Research Project Contributing To African American Children's Literature Based In The 1950s Time Period In Midwestern Culture, Paula Noelle Bolander
A Research Project Contributing To African American Children's Literature Based In The 1950s Time Period In Midwestern Culture, Paula Noelle Bolander
Graduate Research Papers
African American characters have been portrayed in children's literature since the 1800s. There is a lack of information available for children to learn about African Americans from the 1950s time period in the Midwest. Therefore, a nonfiction trade book based on African American culture in Burlington, Iowa will alleviate the gap in children's literature for the United States in the Midwest. The nonfiction trade book was based on Evangeline Ray's life growing up in Burlington, Iowa, in the 1950s. The vignettes portrayed in the book were created on the basis of 15 interviews with the researcher over a period of …
The Portrayal Of Grandparents As Caregivers In Young Adult Fiction, Susan Christine Bunch
The Portrayal Of Grandparents As Caregivers In Young Adult Fiction, Susan Christine Bunch
Graduate Research Papers
The number of children and young adults being raised primarily by their grandparents continues to increase (Landry-Meyer & Newman, 2004). If either the grandchild or grandparent is suddenly thrust into a different family structure it can create challenges. Some young adults turn to the characters in literature as models for how to cope with life challenges (Hughes-Hassell & Rodge, 2007). It was the purpose of this quantitative study to explore physical health, mental and emotional health, and lifestyle and social challenges faced by grandparents and grandchildren when the grandparents are the primary caregivers, and how those challenges are portrayed in …
Waging Word Wars: A Discourse Analysis Of The Patterns Of Norse Masculinity Presented Through Mannjafnaor In The Icelandic Sagas, Jonathan Mark Broussard
Waging Word Wars: A Discourse Analysis Of The Patterns Of Norse Masculinity Presented Through Mannjafnaor In The Icelandic Sagas, Jonathan Mark Broussard
LSU Master's Theses
The mannjafnaðr is a verbal dueling competition containing boasts and insults through which Norse men compare their achievements and exploits against those of other men in bids to prove themselves more honorable in the eyes of the Norse community. This thesis examines the structure, content, and themes of the mannjafnaðr presented in the Morkinskinna, Magnussona, Brennu-Njals, and the Orvar-Oddr sagas as manifestations of the Norse conception of masculinity. My analysis reveals that these encounters are highly structured and provide interactants opportunities to evaluate adherence to culturally dictated strictures of honor – their own and their opponents’. Through a complex discourse …

Dramatic Literacy Lessons: Meeting The Speaking Standard Of The Iowa Core Curriculum, Ashley Brandt
Honors Program Theses
The Iowa Core Curriculum is a relatively new concept in Iowa, having just been approved May 21, 2009, and is designed to align with the subjects math and language arts with the National Common Core State Standard Initiative. There are currently very few resources available for teachers to gain the knowledge, expertise, and Iowa Core Curriculum specific lesson plans they may need to teach "essential concepts and skills". The focus of this thesis is to create a unit of lessons that are directly linked to the new ideas presented in the Iowa Core Curriculum for the Speaking skill sets of …

Sheldon Community History Traveling Trunk Project, Jan M. Kinderknecht
Graduate Research Papers
National, state, and local standards guide education in what is taught in the classrooms today. A lack of resources is often a problem in teaching these standards, especially at the local level. The Sheldon third grade teachers needed resources to fulfill the teaching expectations about their local community. The purpose of this project was to develop a traveling trunk filled with primary and secondary resources to be used in the teaching of a social studies unit on the community of Sheldon. Deciding what people, places, and events to include in these resources is often a concern. Another concern was what …

Impact Of Time Reduction In Physical Education Class, Ada Potratz
Graduate Research Papers
Time is a precious commodity for school personnel, especially teachers. Teachers are talking about needing more time to teach and less time to consume administering standardized tests. The No Child Left Behind legislation has put pressure on teachers, schools, and districts to perform in Math and Reading. As a result, students are tested daily, weekly and monthly so data can be collected. This data is not used to put school and/or districts on the No Child Left Behind list of making progress or in need of assistance. Instead, it is used in districts to plot progress. To comply with the …
Assessing Cumulative Human Impacts On Northern Woodland Caribou With Traditional Ecological Knowledge And Resource Selection Functions, Jean Lieppert Polfus
Assessing Cumulative Human Impacts On Northern Woodland Caribou With Traditional Ecological Knowledge And Resource Selection Functions, Jean Lieppert Polfus
Graduate Student Theses, Dissertations, & Professional Papers
Woodland caribou (Rangifer tarandus caribou) are federally listed and declining across Canada because of the cumulative impacts of human infrastructure development. The Atlin northern mountain herd, in the territory of the Taku River Tlingit First Nation (TRTFN), British Columbia, is less affected by development than southern herds. However, recent low productivity in this herd suggests that the impacts of development (i.e., roads, mines, cabins and towns) may be accumulating. To predict the cumulative impact of human development on the Atlin herd, we developed seasonal resource selection functions (RSF) at 2 spatial scales with data from 10 global positioning system collared …
Toward The Geography Of Business Incubator Formation In The United States, Junbo Yu, Mark Middleton, Randall Jackson
Toward The Geography Of Business Incubator Formation In The United States, Junbo Yu, Mark Middleton, Randall Jackson
Regional Research Institute Working Papers
The geography of business incubators has seldom been examined against the public aspirations and beliefs that incubators should either inhabit economically distressed areas to alleviate unemployment and poverty (in the case of empowerment business incubators) or proliferate in technologically capable regions to adequately unleash and exploit local high-technology potentials (in the case of technology business incubators). In this paper, the geographic distribution of 719 U.S. business incubators, which are located in 465 out of the 3,141 counties, is examined drawing upon a newly built incubator population database. In addition, the location factors underlying the formation of business incubators are also …

A Dynamic Shift Share Analysis Of Economic Growth In West Virginia, Janaranjana Herath, Tesfa Gebremedhin, Blessing M. Maumbe
Regional Research Institute Working Papers
A regional economy consists of industries with a variety of economic potentials. A growth or decline in any of these sectors affects the overall growth of the economy. Analysis of economic growth by sector of a particular region helps policy makers, community leaders and researchers in better decision making and problem solving. This study attempts to analyze the employment growth pattern and policy implications in the economic development of West Virginia using a dynamic shift share analysis. The study uses employment data for 38 years from 1970 to 2007 for the empirical analysis. Results indicate that agriculture, mining and manufacturing …
Who Generates Hazardous Wastes? Attribution Of Producer And Consumer Responsibility Within The Us, Christa D. Jensen
Who Generates Hazardous Wastes? Attribution Of Producer And Consumer Responsibility Within The Us, Christa D. Jensen
Regional Research Institute Working Papers
Amid changing attitudes about the environment and increasing sustainability concerns, many countries around the world aim to curb waste generation, especially the generation of hazardous wastes. Beginning in the late 1970’s and occurring increasingly since, governments and international bodies are passing legislation and treaties dealing with the reduction of hazardous waste generation and waste minimization in general. For future waste minimization policies to have an impact on hazardous waste generation, methods for determining where the ultimate responsibility for hazardous waste generation lies need to be explored. This paper examines hazardous waste generation in the United States at the industry level …
African Renaissance? The Emerging Security Structure Of The African Union, Lensa Kwadjo
African Renaissance? The Emerging Security Structure Of The African Union, Lensa Kwadjo
Theses & ETDs
The African Union, through its embrace of the Responsibility to Protect doctrine, has embarked on an ambitious peace and security agenda that allows it to intervene in crises that involve genocide, crimes against humanity, or war crimes. However, the institutions lack of adequate financial and logistical capacity has made external donors necessary partners in the new emerging security structure of the African Union. By comparing how the African Union and its external donors have decided on, and implemented peacekeeping missions in Burundi, Sudan, and Somalia, this thesis seeks to gauge the progress the institution has made towards building a security …

Works on the Founding generation consistently inhabit national bestseller lists. For instance, David McCullough’s book 1776 placed fifth on Publishers Weekly’s 2005 list, beating out pop culture favorites Blink and Freakonomics. Over the last decade, other similarly successful titles have included His Excellency, Founding Brothers, and John Adams. In fact, McCullough’s hagiographic biography of our nation’s second President was later transformed into an Emmy Award-winning mini-series on HBO—to say nothing of President Obama’s decision to add it to his 2009 summer reading list. In short, Americans revere their eighteenth-century Founders. ...
Mixed-Race Ancestry And Its Impact On The Facial Reconstruction Process, Jermaine Carl Robinson
Mixed-Race Ancestry And Its Impact On The Facial Reconstruction Process, Jermaine Carl Robinson
LSU Master's Theses
Various facial reconstruction techniques are used by forensic artists to assist in the identification of human remains. In establishing the biological profile for completion of a facial reconstruction, often the most difficult yet most important determination to make is that of race and/or ancestry of the decedent. By purposefully creating a facial reconstruction of an unidentified presumed mixed-race female decedent, staying true to the tissue depth information arrived at as a result of this researcher’s tests to determine her race, this author plans to investigate if any biases arise among any potential parties involved in the forensic identification process. This …

Allocation Of Fishing Opportunities In Regional Fisheries Management Organizations: A Legal Analysis In The Light Of Equity, Maria Cecilia Engler Palma
Allocation Of Fishing Opportunities In Regional Fisheries Management Organizations: A Legal Analysis In The Light Of Equity, Maria Cecilia Engler Palma
LLM Theses
The allocation of fishing opportunities is one of the most difficult challenges for high seas fisheries management. There is an ongoing search for equitable and transparent allocation frameworks. This thesis explores whether, under what conditions, and with what shortcomings, a legal concept of equity can provide assistance in the development of such a framework. To this end, it reviews the historical origins of allocation of quotas in international fisheries, and summarizes the current global and regional legal frameworks for allocation and regional practices. It then analyzes whether intergenerational and intra-generational equity is considered in the international legal framework for high …
