China Beat Blog: Archive 2008-2012
In this panel, organized by Siyen Fei (University of Pennsylvania), Mark Edward Lewis (Stanford University), Hilde De Weerdt (University of Oxford), and Fei presented papers that creatively engaged the work of G. William Skinner on how to conceptualize empire in time and space. Lewis proposed that the northern capital historically functioned as a peripheral center that connected the agricultural and economic centers found further south with the steppe, and this positioning, a prime concern of the dynasties founded by nomads, helped maintain China as a coherent empire. De Weerdt used social network analysis to mine Song dynastybiji for data that …

China Beat Blog: Archive 2008-2012
The plane burps to a halt and almost immediately everyone is on their feet, jostling to open the over-head lockers, reaching high for their strolleys. My head feels stuffed with lead and I marvel at the nimble alacrity of my fellow travellers, at 3:00 in the morning. Slowly we shuffle off the Air China flight and make it into the inadequately-air conditioned environs of Indira Gandhi International Airport.
The Role Of Lysogenic Bacteriophage In Virulence And Survival Of Streptococcus Pyogenes, Chad W. Euler
The Role Of Lysogenic Bacteriophage In Virulence And Survival Of Streptococcus Pyogenes, Chad W. Euler
Student Theses and Dissertations
This thesis investigates the interactions of lysogenic bacteriophage with Streptococcus pyogenes. We were specifically interested in elucidating novel ways in which the prophage influence GrAS virulence and survival either within the host cell or within the bacterial population. In turn, we also hoped to determine how the bacteria (and possibly other integrated phage) might influence prophage activity or gene expression. Our studies focused on two polylysogenized GrAS strains, a M6 serotype (MGAS10394) and a M1 serotype (SF370). In our M6 studies, we chose a streptococcal strain lysogenized by a chimeric bacteriophage element (Φ10394.4), which contains the erythromycin resistance gene mefA, …

Transnational Legal Pluralism, Peer Zumbansen
Comparative Research in Law & Political Economy
This paper draws out the analogies and connections between long-standing legal sociological insights into pluralistic legal orders and present concerns with the fragmentation of law outside of the nation state. Within the nation-state, the discovery of legal pluralism inspired a larger contestation of concepts of legal formalism, of the alleged unity of the legal order and of the hierarchy of norms against the background of a consistently advancing process of constitutionalization. This research heightened regulators’ sensitivity to blind spots and exclusionary dynamics in the design of rights, leading inter alia to wide-ranging efforts to render more effective access to justice, …

Law, Economics, And Evolutionary Theory: State Of The Art And Interdisciplinary Perspectives, Peer Zumbansen, Gralf-Peter Calliess
Comparative Research in Law & Political Economy
This paper is the introduction essay to an edited collection entitled “Law, Economics, and Evolutionary Theory”, forthcoming with Edward Elgar. The volume brings together work by legal scholars, economists, historians and sociologists and aims at a critical investigation of the parallel and often competing theoretical architectures of legal and economic governance from an evolutionary perspective. By reconstructing discussions in law over the relationship between legal realism, law & society, and law & economics, and in economics over the merits and prospects of institutional and neo-institutional economics from an evolutionary perspective, the introduction argues that a theory of governance must today …
Outside, Hidden And In Between: Locating The Migrant Exotic Dancer In Canadian Legal Discourse And Regulatory Practice, Carolina Santos Ruiz Austria
Outside, Hidden And In Between: Locating The Migrant Exotic Dancer In Canadian Legal Discourse And Regulatory Practice, Carolina Santos Ruiz Austria
Comparative Research in Law & Political Economy
This article examines how objections against commercial sex, re-positioned from religious and moral to secular and modernist stances, converge with Canada’s broader economic and immigration policies. It focuses specifically on immigrant women in exotic dancing and on the exotic dancer visa alongside other temporary work permits issued to women in the “dirty, dangerous and difficult” or “3-D” sectors. This intervention in feminist legal theory draws upon spatial analysis to provide a more profound engagement of the law’s discursive power beyond the rhetorical and symbolic by drawing attention to how law creates and shapes spaces in material terms.
Writing The Rules Of Socio-Economic Impact Assessment: Adaptation Through Participation, Sari M. Graben
Writing The Rules Of Socio-Economic Impact Assessment: Adaptation Through Participation, Sari M. Graben
Comparative Research in Law & Political Economy
New governance initiatives like co-management can be made effective through the use of agency rulemaking. Using the Mackenzie Valley Environmental Assessment Board as a case study, this paper affirms that it is possible for marginalized stakeholders to participate in new governance arrangements like co-management and to alter decision-making. The study of participation presented here illustrates: 1) that a high level of agency support for community participation in rule-making can lead to rules which reflect community values, and 2) that agency implementation of community values has led to the increased use of stakeholder collaboration through private agreement. Nonetheless, the paper also …
Extraterritoriality By Other Means: How Labor Law Sneaks Across Borders, Conquers Minds, And Controls Workplaces Abroad, Harry W. Arthurs
Extraterritoriality By Other Means: How Labor Law Sneaks Across Borders, Conquers Minds, And Controls Workplaces Abroad, Harry W. Arthurs
Comparative Research in Law & Political Economy
This Article challenges the state-centered description of labor law and impoverished view of extraterritoriality. It suggests that transnational flows of technology and capital, goods and services, and ideas and information have brought in their wake changes in political economy and social relations that have transformed regimes of public and workplace governance in all countries. It proposes that the extraterritoriality doctrine operates, if at all, only in the formal sense of not allowing one state to overtly project its law into the territory of another. But extraterritoriality does little to prevent the rules governing employment relations in one country from taking …
The Conundrum Of Order: The Concept Of Governance From An Interdisciplinary Perspective, Peer Zumbansen
The Conundrum Of Order: The Concept Of Governance From An Interdisciplinary Perspective, Peer Zumbansen
Comparative Research in Law & Political Economy
The term governance has made an impressive career in a number of disciplines concerned with regulation, order and law. This chapter draws on insights from legal studies, sociology, political science, anthropology, history and geography to paint a multifaceted picture of existing, competing and complementing approaches to the concept of governance. For reasons of space, the chapter can but point to the different variations on a theme, as governance occupies an ambivalent place in past and present discourses on political (or, legal or economic) order and society. It is argued that beyond pointing to crucial phases of methodological and theoretical transformation …

Making Space For Grandma: The Emancipation Of Traditional Knowledge And The Dominance Of Western-Style Intellectual Property Rights Regimes, Ikechi Mgbeoji
Comparative Research in Law & Political Economy
The question that this paper seeks to tackle is whether the patent system is of any relevance or pertinence to the search for mechanisms for the protection of traditional knowledge (TK) of the medicinal uses of biodiversity possessed by traditional knowledge practitioners across different parts of the world. Allegations of biopiracy have been made against researchers, bioprospectors and other entities actively scouring indigenous peoples’ cornucopia for the next miracle drug. The objective of this paper will be achieved through two main approaches. The first analyzes the historical and philosophical roots of the divide between dominant regimes of intellectual property rights …

New Technology And Representation Elections: Don't Go Mistaking Paradise For Technology Across The Road, Sara Slinn, William A. Herbert
Comparative Research in Law & Political Economy
Amid dialogue on amending labor certification procedures are calls for the adoption of internet, electronic and/or telephone representation voting (IETV) procedures in representation elections. To date, most labor relations agencies in the United States and Canada have not implemented IETV. Two notable exceptions are the National Mediation Board (NMB), and the United States Federal Labor Relations Authority (FLRA). This article explores strengths and weaknesses of IETV and the potential for wider adoption of this technology in the representation election context. The article examines the NMB's rationale in adopting IETV, and its experience with this new election format. Insight from interview …

Rights As Footprints: A New Metaphor For Contemporary Human Rights Practice, Katharine Young, Jeremy Perelman
Rights As Footprints: A New Metaphor For Contemporary Human Rights Practice, Katharine Young, Jeremy Perelman
Northwestern Journal of Human Rights
As the discourse of human rights becomes ever more widespread, the analysis of contemporary human rights practice must contend with its pluralistic and contradictory features. In this Article, we introduce the metaphor of rights as "footprints." We suggest that this metaphor captures the expressive and constitutive role of rights, and provides a critical tool with which to understand the accomplishments of the human rights field. In doing so, we document a right-to-health campaign in Accra, Ghana, which sought to end the human rights infringements that arose from the financing of health care through user fees. These infringements occurred when public …
Practically Grounded: Convergence Of Land Use Law Pedagogy And Best Practices, John R. Nolon
Practically Grounded: Convergence Of Land Use Law Pedagogy And Best Practices, John R. Nolon
Elisabeth Haub School of Law Faculty Publications
The changing dynamics in the field of land use and sustainable community development law demand that land use law professors rethink the way in which we prepare law students to practice law in this area. This needed paradigm shift converges with the growing momentum of the best practices movement which urges law schools to dramatically revise the curricular approach to legal education, arguing that traditional models are no longer effectively serving the goal of producing competent and fully prepared new lawyers. A perfect storm is present and a unique opportunity exists through the application of many “best practices” concepts for …

Description Of The Tadpole Of Proceratophrys Renalis (Miranda-Ribeiro, 1920) (Anura: Cycloramphidae), Filipe Augusto C. Do Nascimento, Barnagleison S. Lisboa, Gabriel O. Skuk, Rafael O. De Sá
Biology Faculty Publications
The tadpole of Proceratophrys renalis is described based on specimens from Maceió, State of Alagoas, northeastern Brazil. At stage 35 the body is slightly dorso-ventrally depressed, ovoid in lateral, dorsal, and ventral views. Oral disc is ventral with lateral emarginations, surrounded by a single row of marginal papillae with a large gap on the upper labium. Labial tooth row formula is 2(2)/3(1). The analysis of internal oral anatomy revealed two possible characters that readily distinguish P. renalis from P. boiei, supporting the recent ressurection of P. renalis. Comparisons with available descriptions of the larvae for other species in the …

Transborder Licensing: A New Frontier For Job Creation, Andrea L. Johnson
Faculty Scholarship
This Article explores why entrepreneurs should consider transborder licensing as a way to increase markets and create jobs. While transborder licensing can involve both goods and services, this Article focuses on exporting nondefense, non-security-related services and intellectual capital, and it explores how the U.S. government can facilitate the development of an industry of support professionals to help U.S. companies navigate through the regulatory complexities.
Part II of this Article will discuss exports generally and explain the life cycle of a typical patent. Part III will show how current population and foreign business ownership trends necessitate studying how trade is conducted …

Religious Actors, Civil Society, And The Development Agenda: The Dynamics Of Inclusion And Exclusion, Duncan Mcduie-Ra, John A. Rees
Arts Papers and Journal Articles
This article uses the World Bank's engagement with religious actors to analyse their differentiated role in setting the development agenda raising three key issues. First, engagements between international financial institutions (IFIs) and religious actors are formalised thus excluding many of the actors embedded within communities in the South. Secondly, the varied politics of religious actors in development are rarely articulated and a single position is often presented. Thirdly, the potential for development alternatives from religious actors excluded from these engagements is overlooked, due in part to misrecognition of the mutually constitutive relationship between secular and sacral elements in local contexts.

Transnational Students' Perspectives On Schooling In The United States And Mexico: The Salience Of School Experience And Country Of Birth, Edmund T. Hamann, Víctor Zúñiga, Juan Sánchez García
Department of Teaching, Learning, and Teacher Education: Faculty Publications
Students in Mexican schools with previous experience in US schools are transnational students. To the extent their Mexican schooling does not recognize or build on their US life and school experience and their American school experience did not anticipate their later relocation to Mexico, these students are incompletely attended to by school. Yet these students, like all students, are agentive and have some control over how they make sense of their schooling.
As schooling becomes an increasingly common institutional presence across the world and as decided majorities of children now attend at least some version of primary school, it is …
