Dream Cities And Cardboard Worlds: Sayers' Moral Vision In Murder Must Advertise, Frances Fowler-Collins

Murder Must Advertise represents a turning point in Dorothy L. Sayers’s development as a writer and Christian thinker. Previously, she had depicted sinful individuals, but here she expands her moral vision to encompass social sin on a grand scale, focusing on advertising. The novel’s major structural device is the comparison of two groups: an advertising agency and a drug trafficking ring. Although these groups differ superficially, Sayers suggests they are fundamentally similar, as each is a “dream city” based on an illusion. They resemble each other in three ways. Private suits have long been championed as a necessary mechanism not only to compensate investors for harms they suffer from financial frauds but also to enhance the deterrence of wrongdoing. But many critics have claimed that there is a hidden dark side to the successful prosecution of a securities class action. In this paper, we shed light on these issues by examining whether the revelation of earlier misstatements, the initiation of private suit, and the payment of a substantial settlement, weaken the defendant firm so that the firm is permanently worse off as a consequence of the settlement.

The ongoing Great Recession has triggered numerous proposals to improve the regulation of financial markets and, most importantly, the regulation of organizations such as credit rating agencies, underwriters, hedge funds, and banks, whose behavior is believed to have caused the credit crisis that spawned the economic collapse. The Multienforcer Approach To Securities Fraud Deterrence: A Critical Analysis, Amanda M. Rose

Participants in the U.S. capital markets can be sued for securities fraud by a mishmash of enforcers, including the SEC, class action plaintiffs, and state regulators. Does this multi-enforcer approach make sense from a deterrence perspective? This Article suggests that the answer is probably no. Although in theory there are conditions under which a multi-enforcer approach would promote optimal deterrence, it is unclear at best that those conditions exist in the United States. Advocatus, Et Non Latro? Testing The Supplier-Induced-Demand Hypothesis For Italian, Paolo Buonanno, Matteo M. Galizzi

We explore the relationship between litigation rates and the number of lawyers, in a typical supplier-induced demand (SID) frame. Drawing on an original panel dataset for the 169 Italian courts of justice between 2000 and 2007, we first document that the number of lawyers is positively correlated with different measures of litigation rate. Then, using an instrumental variables strategy we find that a 10 percent increase of lawyers over population is associated with an increase between 1.6 to 6 percent in civil litigation rates. The financial market crisis of 2008 continues to plague the United States and countries around the world. The underlying causes of the 2008 collapse are numerous, intricate and complex. Academic scholars, investigative reporters and leading economists are now deconstructing the multiplicity of failures that enabled the breathtaking meltdown that nearly collapsed the global economy. Race And Crime: Social Perceptions, Diana Teverovskaya

This study looked at whether White offenders are more likely to be socially accepted back into society as compared to their counterpart Black offenders, when both offenders commit the same crime. A sample of 120 Pace University undergraduate students were recruited. Acceptance of offenders was determined by using the Bogardus Social Distance Scale, which measures how much an individual would allow a criminal into their social circle. Participants received one of four fictional vignettes of either a White male or Black male committing one of two crimes: a white collar crime or a drug-related crime. Elder abuse is a recognized social problem in the United States. First labeled as "granny battering" and originally studied under the umbrella of family violence, maltreatment of the elderly has received more funding and research in recent years. Multiple aspects of elder abuse have been examined in the literature including measures for detection, assessment, and documentation. Although studies have examined the circumstances surrounding abuse as well as theories of causation and characteristics of the abuser and the abused, studies of the relationship between the abuser and the abused are less well documented. Malware, malicious software written for the purpose of causing computer-related damage, has existed for many years. Only recently have the monetary advantages of perpetrating malware begun to gain interest from increasingly malicious groups. Industry and law enforcement have a difficult and time-consuming job to do with respect to investigating computer-based crimes. The Malware Research Team (MRT) at Purdue University has helped the Indianapolis branch of the FBI locate malware in dozens of computer crime cases, and analyzed that malware using documented and approved standard operating procedures. Inadequate law enforcement against corporate criminals appears to have created perverse incentives leading to an economic crisis — this time in the context of the subprime mortgage crisis. Prioritizing Justice proposes institutional reform at the Department of Justice (DOJ) in pursuing corporate crime. Presently, corporate crime is pursued nationally primarily through the DOJ Financial Fraud Enforcement Task Force and other task forces, the DOJ Criminal Division Fraud Section, and the individual U.S. Attorneys' Offices. This Article is based on the 2009 Kenneth M. Piper Lecture at the Chicago-Kent College of Law. The 2008–2009 financial meltdown and ensuing economic developments have shown three things about modern capitalism: First, that unfettered financial markets remain the Achilles heel of capitalism with the capability of destroying economic stability and bringing misery to all. Second, that high-powered incentives paid to "talent" in finance are a fundamental cause of the excessive risk-taking, chicanery, and financial fraud that contributes to instability.
