The Girl From Ipanema At Risk: Women's Health And The Physical Environment, Becky Jacobs Jan 2010

The Girl From Ipanema At Risk: Women's Health And The Physical Environment, Becky Jacobs

College of Law Faculty Scholarship

This essay explores the issue of women’s health in Rio de Janeiro, a topic at the intersection of the physical and human environments and one that is inextricably intertwined with the environmental justice and social inclusion concerns. A society often can be defined by its citizens’ health indicators and access to health, particularly those of the most vulnerable members of its society, including the poor, women, and children. Health has been included in the panoply of human rights which aspirationally all nations should recognize and promote (Kuszler 2007), and it is a prominent item on the agenda of many international …

Climate Change And Indigenous Peoples In Latin America, Amy C. Rademacher Jan 2010

Climate Change And Indigenous Peoples In Latin America, Amy C. Rademacher

Electronic Theses and Dissertations

This research focused on the detrimental effects of climate change on indigenous peoples in Latin America. Indigenous peoples throughout the region tend to live subsistence livelihoods, which tie them closely to their land and the surrounding environment. This close relationship often means that indigenous peoples acutely experience the effects of climate change and are more susceptible to its negative outcomes than other populations. Further, indigenous peoples in the region lack the mitigation and adaptation capacities to deal with damaging climatic effects.

This research was designed to view the impacts of climate change on indigenous peoples through a human rights framework, …

Rehabilitate Failing Park Sewage System Environmental Assessment, United States Department Of The Interior, National Park Service Jan 2010

Rehabilitate Failing Park Sewage System Environmental Assessment, United States Department Of The Interior, National Park Service

Environmental Assessments (UT)

The National Park Service (NPS) proposes to rehabilitate the failing sewage system within Bryce Canyon National Park, Utah. The rehabilitation would provide a safe, healthy, and functional environment, and maintain public health and future service for park visitors and staff. Portions of the sanitary sewage collection system were originally constructed in 1958 of clay pipe and currently service the lodge, staff housing, and visitor center before feeding into sewage treatment lagoons. Sections of the sewage system have deteriorated significantly with age. These sections of the system and appurtenant manholes are deteriorating into pieces that regularly clog the system and cause …

Linking Health Inequality And Environmental Justice: Articulating A Precautionary Framework For Research And Action, Sarah Wakefield, Jamie Baxter Jan 2010

Linking Health Inequality And Environmental Justice: Articulating A Precautionary Framework For Research And Action, Sarah Wakefield, Jamie Baxter

Geography & Environment Publications

This article draws together three issues—the environment, health, and (in)justice—with the overall purpose of articulating an agenda for policy and research that works towards improved justice and sustainability in the environmental health arena. Considerable research in the United States and elsewhere has shown that both environmental exposures and poor health are more prevalent in populations that are marginalized by race and social class (typically measured as income). The logical next step has been to attempt to establish concrete cause-effect links between health effects and environmental exposures in order to mobilize government action to reduce these disparities. However, we caution against …

Reaching For Environmental Health Justice: Canadian Experiences For A Comprehensive Research, Policy And Advocacy Agenda In Health Promotion, Jeffrey R. Masuda, Blake Poland, Jamie Baxter

Geography & Environment Publications

Spatial disparities in environmental quality and practices are contributing to rising health inequalities worldwide. To date, the field of health promotion has not contributed as significantly as it might to a systematic analysis of the physical environment as a determinant of health nor to a critique of inequitable environmental governance practices responsible for social injustice-particularly in the Canadian context. In this paper, we explore ways in which health promotion and environmental justice perspectives can be combined into an integrated movement for environmental health justice in health promotion. Drawing on Canadian experiences, we describe the historical contributions and limitations of each …

Bridging Social Capital Formation In A Faith-Based Organization, Angela Kaiser Jan 2010

Bridging Social Capital Formation In A Faith-Based Organization, Angela Kaiser

Wayne State University Dissertations

Previous research on faith-based organizations suggest that these organizations are highly effective at forging relationships between individuals from different racial, ethnic, and religious backgrounds, known as bridging social capital. This study examines the process of bridging social capital formation within MOSES, a faith-based organization located in Detroit, Michigan. Through the use of in-depth interviews, participant observation, archival research, and a member survey, I documented the forms of social capital present within the organization. I also explored whether bridging relationships were forming within the organization and the strategies that facilitated their formation. Diversity within the organization, recognition of member differences, and …

The Role Of Adaptive Capacity In Creating Fire-Adapted Human Communities, Pamela J. Jakes, Matthew S. Carroll, Travis B. Paveglio, Soren Newman Jan 2010

The Role Of Adaptive Capacity In Creating Fire-Adapted Human Communities, Pamela J. Jakes, Matthew S. Carroll, Travis B. Paveglio, Soren Newman

Joint Fire Science Program Research Project Reports

In this research we sought answers to the question: What are the social characteristics and conditions of human communities that promote adaptive capacity for wildfire? The Quadrennial Fire Review (USDA and USDI 2009) promotes a goal of “achieving fire-adapted communities” in the wildland urban interface (WUI), and identifies metrics for determining whether a community is fire-adapted. While these metrics address some of the biophysical conditions necessary for fire-adapted human communities, they offer little insight into the social elements that promote or sustain adaptive capacity. Adaptive capacity refers to the individual and collective resources, capabilities, and actions that alleviate the risk …

Unfortunately I do not have space to address individually each issue these four papers raise. Then, building on comments from Professors Wilkerson and Al-Saji, I will offer some remarks about aims, methods, and shortcomings.

2001 Supreme Court Redux, Mary Stevens

PEEL Alumni Scholarship

In 1959, petitioner and his fellow corporate associates purchased a waterfront parcel of land in Rhode Island that was primarily a salt marsh plagued by tidal flooding. Over a period of many years, the corporation filed several petitions seeking to develop the land with various government agencies and was consistently denied. In 1971, Rhode Island promulgated regulations designating salt marshes, such as petitioner's, as protected coastal wetlands. In 1978, petitioner became the corporation's sole shareholder and received title for the land. In the 1980's, he applied to the state to fill in his marshland and was rejected based on the …

Cultural Norms And Race Discrimination Standards: A Case Study In How The Two Diverge, Derek W. Black Jan 2010

Cultural Norms And Race Discrimination Standards: A Case Study In How The Two Diverge, Derek W. Black

Connecticut Law Review

The legal standard for race discrimination—the intent standard—has been scrutinized and justified for decades, but that conversation has occurred almost entirely within the legal community. Relatively little effort has been made to engage the public. This Article posits that the discussion of discrimination standards must account for and include public understandings of race and discrimination because race is a socially constructed concept and discrimination is culturally contingent. Race discrimination standards based solely upon the legal community’s perceptions are susceptible to significant flaws. This Article begins the incorporation of public understandings of race and discrimination by examining the public’s reaction to …

Bona Fide Protection: Fulfilling Cercla's Legislative Purpose By Applying Differing Definitions Of Disposal Note, Emilee Mooney Scott Jan 2010

Bona Fide Protection: Fulfilling Cercla's Legislative Purpose By Applying Differing Definitions Of Disposal Note, Emilee Mooney Scott

Connecticut Law Review

In the late 1970s, the Love Canal disaster brought toxic contamination into the American consciousness as never before. In response, Congress passed the Comprehensive Environmental Response and Liability Act of 1980 (“CERCLA”), with the aim of cleaning up contaminated sites and making the polluters pay. Unfortunately, the draconian liability scheme imposed by CERCLA has made investors wary of redeveloping possibly contaminated industrial property. To combat this problem, Congress passed the Small Business Liability Relief and Brownfields Revitalization Act. The Brownfields Act amends CERCLA to provide liability protection for landowners who would otherwise be liable, but who did not own the …
