American State Constitutional Equalities, Jeffrey A. Parness
American State Constitutional Equalities, Jeffrey A. Parness
Faculty Articles, Papers, and Other Scholarship
Many American state constitutions contain equality provisions. Some simply promote Equal Protection in ways comparable to the Fifth and Fourteenth Amendments to the federal constitution. Others are worded quite differently, though read in lockstep with federal precedents. Yet others vary both in letter and spirit form federal constitutional equalities. These variations extend at time constitutional equality protections far beyond the federal precedents. Varying American state constitutional equalities are today promoted by phrases and terms like equality, equal protection, nondiscrimination, sameness, and uniformity. They occasionally limit private as well as public actors. And they occasionally limit the roles of legislatures in …
Role Of Gastrointestinal Multidrug Resistance (Mdr1) Gene And P-Glycoprotein (P-Gp) In The Oral Absorption Of Methadone In Horses, Renata Lehn Linardi
Role Of Gastrointestinal Multidrug Resistance (Mdr1) Gene And P-Glycoprotein (P-Gp) In The Oral Absorption Of Methadone In Horses, Renata Lehn Linardi
LSU Doctoral Dissertations
Methadone is a mu-opioid receptor agonist which is a very effective analgesic used to treat moderate to severe acute and chronic pain in humans. Due to methadone’s minimal undesirable side-effects in people, we believed it could be of use in horses as an analgesic agent. As found with the majority of lipophilic drugs, absorption of methadone occurs primarily in the small intestine via transcellular transport and its absorption is regulated by P-glycoprotein. P-glycoprotein is a transmembrane transporter protein encoded by the multidrug resistance gene, which is constitutively expressed in the apical membrane of enterocytes of various species. This protein may …
The Auxiliary System Of Typically Developing Children Acquiring African American English, Brandi Lynette Newkirk
The Auxiliary System Of Typically Developing Children Acquiring African American English, Brandi Lynette Newkirk
LSU Doctoral Dissertations
This study’s purpose was to examine the acquisition and use of BE, DO, and modal auxiliaries by African American English (AAE)-speaking children. The impetus for this work was the lack of information regarding the developmental trajectory of these auxiliary types and their use, in AAE relative to what is known about auxiliary acquisition and use in Mainstream American English (MAE). The study used two datasets of language samples: one that contained 48 language samples from 3 ½-year-old children and one that contained 36 longitudinal language samples of five children who were between 18 and 51 months of age. Results from …
Behaviors And Beliefs Of African American Caregivers As Related To Their Children's Language-Literacy Development, Lekeitha Renee' Morris
Behaviors And Beliefs Of African American Caregivers As Related To Their Children's Language-Literacy Development, Lekeitha Renee' Morris
LSU Doctoral Dissertations
This study examined African American (AA) caregivers’ beliefs about their children’s language-literacy development and their book reading behaviors with their children as a function of socioeconomic status (SES). Caregivers’ behaviors were examined before, during, and after a three-day caregiver training program that targeted four behaviors (i.e., tracking print, reference to print, text to life, and interpretations). Participants were 20 caregiver-child dyads classified as Low-SES (LSES) or Middle-SES (MSES) based on the caregivers’ level of education. Children were typically developing girls between the ages of four and five years. At pre-test, the two groups of caregivers differed in some of their …
Athens And Byzantium: Platonic Political Philosophy In Religious Empire, Jeremiah Heath Russell
Athens And Byzantium: Platonic Political Philosophy In Religious Empire, Jeremiah Heath Russell
LSU Doctoral Dissertations
It is traditionally understood that there is a gap, which spans well over one thousand years, between Plato’s own political philosophy and its successor in medieval Islamic philosophy. A most likely bridge between Plato and these later philosophers is Neoplatonism. However, scholars argue that this philosophic school abandoned its predecessor’s emphasis on political philosophy. This dissertation challenges the traditional interpretation by reconstructing a political philosophy based on a Neoplatonic commentary on Plato’s Gorgias. The first two chapters place this commentary within its historical context, as well as its place within the larger Neoplatonic pedagogy. The remainder of the dissertation reconstructs …
Misclassifying The Insurance Policy: The Unforced Errors Of Unilateral Contract Characterization, Hazel G. Beh, Jeffrey W. Stempel
Misclassifying The Insurance Policy: The Unforced Errors Of Unilateral Contract Characterization, Hazel G. Beh, Jeffrey W. Stempel
Scholarly Works
Insurance policies are traditionally classified as unilateral or “reverse-unilateral” contracts, a characterization we find largely incorrect, with problematic consequences for adjudication of insurance coverage disputes. In addition to the general difficulties attending the unilateral classification, the concept as applied to insurance policies is not only unhelpful but incorrect. Insurance policies are more accurately viewed as bilateral contracts. In addition, the unilateral characterization of insurance policies introduces error and inconsistency into the litigation of insurance controversies. In particular, the unilateral view tends toward excessive formalism and focus on so-called “conditions” precedent to coverage, eschewing material breach analysis and encouraging needless forfeitures …
For Orchestra, David Paul Cortello
For Orchestra, David Paul Cortello
LSU Master's Theses
“For Orchestra” is a four movement symphonic reflection on an unfinished life that ultimately finds redemption and a new beginning. Conflict and questioning are depicted through combinations of tonally ambiguous techniques. Debussian chord planing is combined with elements of twelve-tone technique; symmetrical scales offer hints of the familiar without sounding clear tone centers; rhythmic elements fight each other, resolve, and fight again, leaving questions still unanswered. There are moments of joy and triumph heard through tonal progressions, and a scherzo that is later darkened, first through an augmentation, and then a tritone harmonization. The third movement represents a slow spiral …
Asia's Participation In Global Health Diplomacy And Global Health Governance, David P. Fidler
Asia's Participation In Global Health Diplomacy And Global Health Governance, David P. Fidler
Articles by Maurer Faculty
This article provides a framework for thinking about Asian approaches to and impact on global health diplomacy and governance that might contribute to more sophisticated analyses on Asia in global health politics, diplomacy, and governance. First, the article examines the "rise of Asia" and "rise of health" as overlapping but unconnected developments in international relations. Second, it analyzes how the shift of power and influence towards Asia, largely caused by China's and India's emergence as great powers; affects global health politics and potential Asian contributions to global health diplomacy and governance in the future. Third, the article looks at normative …
Modeling Thermal Phenomena And Searching For New Thermally Induced Monitor Signals In Large Sale Gravitational Wave Detectors, Rupal Shashikant Amin
Modeling Thermal Phenomena And Searching For New Thermally Induced Monitor Signals In Large Sale Gravitational Wave Detectors, Rupal Shashikant Amin
LSU Doctoral Dissertations
The Laser Interferometer Gravitational-wave Observatory (LIGO) array’s 4 km detectors have transitioned from an initial configuration (iLIGO) to an enhanced configuration (eLIGO) [1]. Both configurations relied on high circulating laser powers to achieve sensitivity goals between 150 Hz and 8 kHz. These power levels were sufficient to induce thermally driven focal affects in the primary optics. Since the detectors were designed to achieve maximum sensitivity when laser light was optimally coupled (mode matched) into the antenna, small deviations in focal parameters influenced performance. A laser based thermal compensation system (TCS) was installed for use in both configurations to counteract excessive …

Promoting Distributional Equality For Women: Some Thoughts On Gender And Global Corporate Citizenship In Foreign Direct Investment, Rachel J. Anderson
Promoting Distributional Equality For Women: Some Thoughts On Gender And Global Corporate Citizenship In Foreign Direct Investment, Rachel J. Anderson
Scholarly Works
This essay applies a legal theory of global corporate citizenship to the question of women’s distributional equality in foreign direct investment. It proposes ways that a legal theory of mandatory global corporate citizenship can expand the ways we think about regulating transnational corporations and promoting gender equality.
Acadiana And The Cajun Cultural Landscape: Adaption, [Sic] Accommodation Authenticity, Joseph Jerome Mckernan
Acadiana And The Cajun Cultural Landscape: Adaption, [Sic] Accommodation Authenticity, Joseph Jerome Mckernan
LSU Master's Theses
The following points are important for this discussion of Acadiana and the Cajun Cultural Landscape: First, in order to fully understand the Cajun nature and what makes the Cajuns distinct, we must explore their history from the time they arrived on the shores of North America to the present. Without doing this, we cannot truly understand their way of life and where it came from; Second, what and where is Acadiana--the Cajun homeland--and what are its socioeconomic and demographic characteristics; Third, how have folk culture and celebration of heritage mediated Cajun culture; Fourth, why are these traditions manifested in what …
Holding The World Bank Accountable For The Leakage Of Funds From Africa's Health Sector, Fatma E. Marouf
Holding The World Bank Accountable For The Leakage Of Funds From Africa's Health Sector, Fatma E. Marouf
Scholarly Works
This article explores the accountability of international financial institutions (IFIs), such as the World Bank, for human rights violations related to the massive leakage of funds from sub-Saharan Africa’s health sector. The article begins by summarizing the quantitative results of Public Expenditure Tracking Surveys performed in six African countries, all showing disturbingly high levels of leakage in the health sector. It then addresses the inadequacy of good governance and anticorruption programs in remedying this problem. After explaining how the World Bank’s Inspection Panel may serve as an accountability mechanism for addressing the leakage of funds, discussing violations of specific Bank …
In Sickness And In Health: Experiencing Medical Spaces In Mbarara (Uganda), Kara E. Miller
In Sickness And In Health: Experiencing Medical Spaces In Mbarara (Uganda), Kara E. Miller
LSU Master's Theses
This thesis is a contribution to cross-cultural studies on health and medicine explored through the material and symbolic facets of health care in a region of Southwest Uganda. Research conducted in the healing spaces of Mbarara reflects traditions in the anthropology of the body and brings a lived perspective to conditions of sickness and wellness. By tracing the biographies of treatment spaces, the medical landscape is evaluated in terms of participants’ perceptions, convictions, and knowledge sets. Phenomenological methodology is employed in this exploration of ill states and curative places, which braids concepts and academic work in the areas of medicine, …
An Annotated Catalogue Of Selected Cuban Piano Works From The 18th-20th Centuries, Nikie Oechsle
An Annotated Catalogue Of Selected Cuban Piano Works From The 18th-20th Centuries, Nikie Oechsle
LSU Doctoral Dissertations
The piano music of Cuba encompasses a large body of valuable music that is yet to be explored fully on the international scene by performers and teachers. The purpose of this volume is to provide a guide that will enable performers and teachers to quickly reference, and more fully investigate the available music of Cuban composers. This is accomplished by providing description and levels of selected Cuban piano works from the eighteenth through twentieth centuries in catalogue format, as well as by providing descriptions of dances and dance forms found in the included literature.
Transit-Based Emergency Evacuation Modeling With Microscopic Simulation, Hana H. Naghawi
Transit-Based Emergency Evacuation Modeling With Microscopic Simulation, Hana H. Naghawi
LSU Doctoral Dissertations
Several recent mass evacuations, including those in advance of Hurricane Katrina in New Orleans and Hurricane Rita in Houston, have demonstrated the effects of limited planning for carless populations. The lack of planning left a significant portion of the mobility-limited population of both these cities unable to flee in advance of the storms. Since 2005 however, both of these cities (as well as others across the United States) have developed transit assisted mass evacuation plans at various levels of detail. Since these plans are relatively recent and do not have a history of experience on which to base their performance, …
"To Liberate Communication": The Realist And Paul Krassner's 1960s, Terry Joel Wagner
"To Liberate Communication": The Realist And Paul Krassner's 1960s, Terry Joel Wagner
LSU Master's Theses
Paul Krassner began publishing a small-circulation magazine called The Realist in New York City in 1958 because he believed there existed excessive restraints on speech in American culture. The publication began with a combination of earnest critiques and good-humored satires on such topics as organized religion, sexual mores, Cold War paranoia, and civil rights. By the mid-sixties, the magazine was enlarging the space not just for what opinions could be expressed but also for the way those opinions were expressed and, in the process, testing the boundaries of obscenity. As Krassner became a bitter opponent of the Vietnam War and …
Studying And Teaching “Law As Rhetoric”: A Place To Stand, Linda L. Berger
Studying And Teaching “Law As Rhetoric”: A Place To Stand, Linda L. Berger
Scholarly Works
This article proposes that law students may find a better fit within the legal culture of argument if they are introduced to rhetorical alternatives to counter narrowly formalist and realist perspectives on how the law works and how judges decide cases. To support this proposal, the article describes and evaluates an upper-level elective course in Law & Rhetoric, which I have offered at two law schools since 2003.
The article makes a two-part argument: first, introducing law students to rhetorical alternatives allows them to envision their role as lawyers as constructive, effective, and imaginative while grounded in law, language, and …

Fraction Competency And Algebra Success, Coretta Thomas
Fraction Competency And Algebra Success, Coretta Thomas
LSU Master's Theses
Abstract In this thesis, I investigated the importance of fraction competence to success in algebra. I studied 107 of the students whom I teach. These students were all enrolled in Algebra I. A fraction pretest and an algebra pretest were given at the beginning of the 2009-2010 school year. A comparison was done to study the connection between the fraction pretest score and the semester grade as well as the algebra pretest score and the semester grade. The strongest correlation was between the fraction pretest and the semester grade. This supported the theory that fraction competence is a strong predictor …
The Influence Of Two Estrogens On The Sex And Ovarian Development Of Eastern Oysters (Crassostrea Virginica) Maintained In A Closed Recirculating System, Wesley Michael Burnside
The Influence Of Two Estrogens On The Sex And Ovarian Development Of Eastern Oysters (Crassostrea Virginica) Maintained In A Closed Recirculating System, Wesley Michael Burnside
LSU Master's Theses
As a multi-million dollar industry, production of the eastern oyster Crassostrea virginica is significant to the economy of the nation’s coastal regions. The cost of commercial oyster aquaculture has higher inputs than the oyster fishery, but larger, better quality oysters can be produced for culture by the stable availability of triploid individuals.
The goal of this project was to determine if the use of an estrogen, estradiol-17β or estradiol-3-benzoate, at a consistent environmental temperature would increase the percentage of females in a population, as well as ovarian development of eastern oysters. Ultimately, this could be applied to triploids to increase …
"Teach Us Incessantly": Lessons And Learning In The Antebellum Gulf South, Sarah L. Hyde
"Teach Us Incessantly": Lessons And Learning In The Antebellum Gulf South, Sarah L. Hyde
LSU Doctoral Dissertations
Before 1860 people in the Gulf South valued education and sought to extend schooling to residents across the region. Southerners learned in a variety of different settings – within their own homes taught by a family member or hired tutor, at private or parochial schools as well as in public free schools. Regardless of the venue, the ubiquity of learning in the region reveals the importance of education in Southern culture. In the 1820s and 1830s, legislators in Louisiana, Mississippi, and Alabama sought to increase access to education by offering financial assistance to private schools in order to offset tuition …
German Enemy Aliens And The Decine Of British Liberalism In World War I, Ansley L. Macenczak
German Enemy Aliens And The Decine Of British Liberalism In World War I, Ansley L. Macenczak
LSU Master's Theses
After the start of World War I in 1914, the British government began internment of enemy alien men, disrupting the large German population settled in the country. This move seemed to be in complete contrast in comparison to the lax immigration laws during the long nineteenth century, when Great Britain had one of the most liberal immigration laws of any country in Europe. The British public was proud of this tradition and Britain’s image as an open haven for refugees and individuals seeking a better life. Foreigners were attracted to Britain by its liberal traditions, most clearly exemplified by the …
Invisible Links, Abject Chains: Habit In Nineteenth-Century British Literature, Daniel R. Mangiavellano
Invisible Links, Abject Chains: Habit In Nineteenth-Century British Literature, Daniel R. Mangiavellano
LSU Doctoral Dissertations
“Invisible Links, Abject Chains: Habit in Nineteenth-Century British Literature” argues that habit is a central characteristic of both Romantic and Victorian theories of imagination, originality, literary production, and subjectivity. Certainly, nineteenth-century culture often treats habit with suspicion, invoking language of bondage, slavery, and dangerous unconscious imitation to apply to everything from reading habits to opium use. However, by tracing a discourse of habit from association theory to pragmatism and drawing from philosophical, educational, medical, and psychological texts, I foreground how Romantic and Victorian texts redeploy habit as a paradoxical form of imaginative agency. In nineteenth-century culture, habit makes possible what …

The Interactions Between Sentence Complexity, Working Memory, And Additional Working Memory Load: An On-Line Measure, Christy Seidel
The Interactions Between Sentence Complexity, Working Memory, And Additional Working Memory Load: An On-Line Measure, Christy Seidel
LSU Master's Theses
This experiment takes an on-line look at syntactical complexity, external loads, and working memory, and how the three influence one another. Based on off-line data looking at the interactions between these three factors, we have discovered that syntactic complexity and span have main effects, while the effect of load is most interestingly seen in a three way interaction representing the hardest possible combination of factors. Through this new design, we were able to see whether the off-line results of sentence processing are replicated with an on-line measure. Our new off-line findings replicate past results, which show that working memory impacts …
The Insurance Policy As Statute, Jeffrey W. Stempel
The Insurance Policy As Statute, Jeffrey W. Stempel
Scholarly Works
Insurance policies are classified as a subspecies of contract. Although the taxonomy is correct, rigid adherence to this classification system limits the legal system's ability to deal with some of the most problematic and frequently litigated questions of insurance coverage. Restricting conception of insurance policies to the contract model unduly limits analysis of the meaning and function of the policies. In addition, restricting characterization of insurance as a matter of “contract” does not necessarily produce swift, inexpensive, efficient, or uniform decisions (to say nothing about accuracy, justice, or fairness). Within contract law, scholars, and courts differ over the respective primacy …
A Performance Guide To Lori Laitman's Living In The Body, Kathryn Mary Drake
A Performance Guide To Lori Laitman's Living In The Body, Kathryn Mary Drake
LSU Doctoral Dissertations
The purpose of this document is to provide a complete performer’s guide to American composer Lori Laitman’s Living in the Body, a song cycle consisting of six songs for soprano and saxophone set to the poetry of Joyce Sutphen. Living in the Body is one of very few cycles written for soprano and saxophone, and the combination is both unusual and interesting to investigate. The cycle explores letting go of the past and focusing on what will happen in the second half of life. The text is set expertly for soprano, bringing important words to the listener’s attention while keeping …

A Survey And Guide To The Most Frequently Programmed Lieder In The Undergraduate Studios Of Selected Major Music Institutions In The United States, Joseph Christopher Turner
LSU Doctoral Dissertations
Among the many challenges faced by the new collegiate voice teacher is the assigning of appropriate music literature. There are numerous published guides to aid in this area, but they vary greatly. Some provide large amounts of literature and very little information, while others give more information but deal with a predetermined set of songs. What if the young teacher knew the core literature being used by veteran voice teachers from around the country? In order to address this problem, information was gathered from eight major music institutions chosen by a survey of voice faculty at Louisiana State University. At …
