From The Dead Sea Scrolls (1qs), Hugh Nibley

Studies in the Bible and Antiquity

Hugh Nibley, late professor of ancient history and religion at Brigham Young University and one of the foremost scholars of the ancient world in the Church of Jesus Christ of Latter-day Saints, discussed the Rule of the Community in an appendix to his 1975 book The Message of the Joseph Smith Papyri. The Joseph Smith Papyri is an initiatory text; the Rule of the Community is both an initiatory text, enumerating details for entrance into the Essene community at Qumran, and a covenant document, listing elements in the covenant made between God and individuals entering the Essene community at Qumran. …

Telling Through Type: Typography And Narrative In Legal Briefs, Derek H. Kiernan-Johnson Jan 2010

Telling Through Type: Typography And Narrative In Legal Briefs, Derek H. Kiernan-Johnson

Publications

Most legal authors today self-publish, using basic word-processing software and letting the software’s default settings determine what their documents will look like when printed. As these settings are not optimized for legal texts, they do so at their peril. The default font Times New Roman, for example, as Chief Judge Frank Easterbrook warns, is "utterly inappropriate for long documents [such as] briefs."

Commentators have started urging a more deliberate approach to legal typography. Their suggestions, however, have been content-neutral, intended for all legal texts and focused on goals such as legibility and readability.

Typography, however, has much greater potential. The …

Beyond Fair Use, Gideon Parchomovsky, Philip J. Weiser Jan 2010

Beyond Fair Use, Gideon Parchomovsky, Philip J. Weiser

Publications

For centuries, the fair use doctrine has been the main--if not the exclusive--bastion of user rights. Originating in the English courts of equity, the doctrine permitted users, under appropriate circumstances, to employ copyrighted content without the rightsholder's consent. In the current digital media environment, however, the uncertainty that shrouds fair use and the proliferation of technological protection measures undermine the doctrine and its role in copyright policy. Notably, the enactment of the Digital Millennium Copyright Act, which prohibits the circumvention of technological protection measures even for fair use purposes, has diminished the ability of fair use to counterbalance a copyright …

Provoking Change: Comparative Insights On Feminist Homicide Law Reform, Carolyn B. Ramsey Jan 2010

Provoking Change: Comparative Insights On Feminist Homicide Law Reform, Carolyn B. Ramsey

Publications

The provocation defense, which mitigates murder to manslaughter for killings perpetrated in the heat of passion, is one of the most controversial doctrines in the criminal law because of its perceived gender bias; yet most American scholars and lawmakers have not recommended that it be abolished. This Article analyzes trendsetting feminist homicide law reforms, including the abolition of the provocation defense in three Australian jurisdictions, places these reforms in historical context, and assesses their applicability to the United States. It ultimately advocates reintroducing the concept of justified emotion, grounded in modern equality principles and social values, as a requirement for …

A Defensible Defense?: Reexamining Castle Doctrine Statutes, Benjamin Levin Jan 2010

A Defensible Defense?: Reexamining Castle Doctrine Statutes, Benjamin Levin

Publications

Recent years have seen a proliferation of so-called “castle doctrine” statutes – laws that provide home dwellers with more expansive self-defense protections if they resort to lethal force in confrontations with intruders. The passage of such laws and subsequent uses of the defense have captured the public imagination, prompting significant media attention, as well as skeptical and critical scholarship from the legal academic community.

Considering the current prevalence of castle laws and the often polarized nature of the debate concerning their application, this Article argues that it is important to excavate the doctrine from the culture wars rhetoric in which …

Privilege And Property: Essays On The History Of Copyright, Ronan Deazley, Martin Kretschmer, Lionel Bently Jan 2010

Privilege And Property: Essays On The History Of Copyright, Ronan Deazley, Martin Kretschmer, Lionel Bently

Copyright, Fair Use, Scholarly Communication, etc.

Includes sixteen essays on the origins of copyright.

First paragraph:

What is Copyright History?

History has normative force. There was no history of colonialism, gender, fashion or crime until there were contemporary demands to explain and justify certain values. During much of the twentieth century, ‘copyright’ history (the history of legal, particularly proprietary, mechanisms for the regulation of the reproduction and distribution of cultural products – as opposed to the history of art, literature, music, or the history of publishers and art-sellers) was not thought of as a coherent, or even necessary field of inquiry. It was a pursuit of …

Ways Of Seeing In Environmental Law: How Deforestation Became An Object Of Climate Governance, William Boyd Jan 2010

Ways Of Seeing In Environmental Law: How Deforestation Became An Object Of Climate Governance, William Boyd

Publications

Few areas of law are as deeply implicated with science and technology as environmental law, yet we have only a cursory understanding of how science and technology shape the field. Environmental law, it seems, has lost sight of the constitutive role that science and technology play in fashioning the problems that it targets for regulation. Too often, the study and practice of environmental law and governance take the object of governance--be it climate change, water pollution, biodiversity, or deforestation--as self-evident, natural, and fully-formed without recognizing the significant scientific and technological investments that go into making such objects and the manner …

What's Love Got To Do With It?: Contemporary Lessons On Lawyerly Advocacy From The Preacher Martin Luther King, Jr., Deborah J. Cantrell Jan 2010

What's Love Got To Do With It?: Contemporary Lessons On Lawyerly Advocacy From The Preacher Martin Luther King, Jr., Deborah J. Cantrell

Publications

Lawyers have long been inspired by the advocacy work of Martin Luther King, Jr. From his work on the Montgomery bus boycott, to lunch counter sit-ins, to his March on Washington, Dr. King demonstrated skilled advocacy that resulted in important legal advancements. While lawyers give primacy to Dr. King as an advocate, Dr. King gave primacy to his work as a preacher. This article challenges the legal profession to consider the ways in which Dr. King, the preacher, may be as inspirational and instructive as Dr. King, the civil rights icon. Just as Dr. King's religious values were not abstracted …

The Terrorist Informant, Wadie E. Said Jan 2010

The Terrorist Informant, Wadie E. Said

Publications

A man sets himself on fire in front of the White House in a dispute with the Federal Bureau of Investigation (FBI). He has been working as an informant for the FBI in a high-profile terrorism prosecution and is unhappy with the $100,000 he has been paid so far. He has also been recently convicted of bank fraud. As a result, the government declines to call him as a witness, given the damage his actions have on his credibility and trustworthiness. This incident underscores the difficulty inherent in relying on paid informants to drive a prosecution, where material considerations such …

Effects Of Peer & Familial Ethnic Socialization On Processes Of Ethnic Identity Development In Mexican-Descent Adolescents, Christine M. Reinhard Jan 2010

Effects Of Peer & Familial Ethnic Socialization On Processes Of Ethnic Identity Development In Mexican-Descent Adolescents, Christine M. Reinhard

Electronic Theses and Dissertations

The current cross-sectional study had two goals: present the Peer Ethnic Socialization Measure, (PESM) to assess peer contributions to the process of ethnic socialization (the promotion of pride, cultural knowledge and cultural traditions), and explore how family and peer (in-group and out-group peers) ethnic socialization uniquely contributes to the process of ethnic identity development in Mexican descent adolescents (N=111, M age = 14.5 years, SD = 1.2 years). The PESM is a modified version of the Umaña-Taylor Familial Ethnic Socialization Scale (2001). Results indicated that the PESM is a reliable scale, but that it will benefit from refinement and additional …

Primacy Of Conscience: A Pastoral Theological Construction Of Agency For Catholic Moral Decision-Making, Donald Augustine Rickard Jan 2010

Primacy Of Conscience: A Pastoral Theological Construction Of Agency For Catholic Moral Decision-Making, Donald Augustine Rickard

Electronic Theses and Dissertations

A significant pastoral problem for some Catholics flows from the dissonance they experience when attempting to integrate certain Church teachings with the leading of their conscience as they make moral decisions. All Catholics do not accept every established moral answer or position provided by the Church and integrating those differences between the Church teaching and one's conscience can be difficult--a difficulty affecting parishioner, priest, and Church. This problem is, in part, rooted in and reinforced by the fact that there are two theological strands in the Church's tradition regarding morality. One strand suggests that the moral response is to obey …

Pedagogy In Teacher Education: Art Without Fram, Alexander Cuenca Jan 2010

Pedagogy In Teacher Education: Art Without Fram, Alexander Cuenca

Journal of Inquiry and Action in Education

The term pedagogy has been appropriated in education discourse as simply strategies of instruction. This instrumental understanding of pedagogy has reified the term both in the vernacular of education and in research of teaching and teacher education, leading the scientific pursuit of pedagogy to exclude the relationship between pedagogy and pedagogue. Based on this concern, this paper will consider the artistic and relational dimensions of pedagogy in teacher education. Drawing on the work of Max van Manen, John Dewey, and Mikhail Bakhtin, this paper seeks to sketch a more holistic understanding of pedagogy in teacher education. Afterwards, I suggest self-study …

Advising In A Multidisciplinary Master's Program: An Evaluation, Kimberly Jackson Jan 2010

Advising In A Multidisciplinary Master's Program: An Evaluation, Kimberly Jackson

Journal of Inquiry and Action in Education

Multidisciplinary programs have begun to complement traditional models of graduate and professional education. The development of these programs has begun to reflect the change in graduate student advisement. Multidisciplinary programs necessitate the need for quality advisement approaches. This study assessed faculty satisfaction and commitment to advising graduate students in the Multidisciplinary Studies Individualized (MDSI) program at a metropolitan college in New York State. The intent was to examine faculty level of satisfaction, level of commitment and identify barriers to advising MDSI students. This quantitative study employed a paired samples t – test to compare faculty advising groups. The findings revealed …

A Kachina By Any Other Name: Linguistically Contextualizing Native American Collections, Rachel Elizabeth Maxson Jan 2010

A Kachina By Any Other Name: Linguistically Contextualizing Native American Collections, Rachel Elizabeth Maxson

Electronic Theses and Dissertations

Museums collect and care for material culture, and, increasingly, intangible culture. This relatively new term for the folklore, music, dance, traditional practices, and language belonging to a group of people is gaining importance in international heritage management discourse. As one aspect of intangible cultural heritage, language is more relevant in museums than one might realize. Incorporating native languages into museum collections provides context and acts as appropriate museology, preserving indigenous descriptions of objects. Hopi katsina tihu are outstanding examples of objects that museums can re-contextualize with native terminology. Their deep connection to Hopi belief and ritual as well as their …

Graduate Curricula In Software Engineering And Software Assurance: Need And Recommendations, T. B. Hilburn, Andrew J. Kornecki

Department of Electrical Engineering and Computer Science - Daytona Beach

In discussions about the development and use of computer systems and software products, the term “professional software engineer” is used repeatedly. In the last two decades there has been significant effort devoted to enhancing and advancing the state of professional software engineering (SwE) – new software engineering processes, methods, tools, and practices; creation of a software engineering body of knowledge [1]; development of a code of ethics and professional conduct [2], and software certification and licensing programs [3] . In 1989 the Software Engineering Institute (SEI) of Carnegie Mellon University published a landmark report on graduate education in software engineering …

Values In Transition: The Chiricahua Apache From 1886-1914, John W. Ragsdale Jr.

American Indian Law Review

Law confirms but seldom determines the course of a society. Values and beliefs, instead, are the true polestars, incrementally implemented by the laws, customs, and policies. The Chiricahua Apache, a tribal society of hunters, gatherers, and raiders in the mountains and deserts of the Southwest, were squeezed between the growing populations and economies of the United States and Mexico. Raiding brought response, reprisal, and ultimately confinement at the loathsome San Carlos Reservation. Though most Chiricahua submitted to the beginnings of assimilation, a number of the hardiest and least malleable did not. Periodic breakouts, wild raids through New Mexico and Arizona, …

Adieu Raimon, A Dieu, Joseph Prabhu Jan 2010

Adieu Raimon, A Dieu, Joseph Prabhu

Journal of Hindu-Christian Studies

Raimon Panikkar, known to many in this Society of Hindu-Christian Studies as a teacher, scholar, mentor or friend, died at his home in Tavertet, near Barcelona, on August 26, 2010. He was ninety-one and had been in poor health for some time, but he did live to see the day when his Gifford Lectures, originally delivered in Edinburgh in 1989, and over which he had agonized ever since [he produced some nineteen different versions of parts of the texts], finally saw the light of day in June of this year as The Rhythm of Being (Orbis Books).

Automated Theorem Proving In Quasigroup And Loop Theory, J.D. Phillips Jan 2010

Automated Theorem Proving In Quasigroup And Loop Theory, J.D. Phillips

Journal Articles

We survey all known results in the area of quasigroup and loop theory to have been obtained with the assistance of automated theorem provers. We provide both informal and formal descriptions of selected problems, and compare the performance of selected state-of-the art first order theorem provers on them. Our analysis yields some surprising results, e.g., the theorem prover most often used by loop theorists doesn’t necessarily yield the best performance.
