Insurance policies are classified as a species of contract. Although this characterization is correct, it is unduly narrow if used as the exclusive lens for assessing insurance policies, which are not merely contracts but also are designed to perform particular risk management, deterrence, and compensation functions important to economic and social ordering. Recognizing this has significant implications regarding the manner in which insurance policies are construed in coverage disputes and suggests that policy construction can be improved by not only performing traditional contract analysis of disputed policies but also by appreciating the particular function of the insurance policy in question …

Transactions that claim inappropriate tax benefits are a perennial problem. When the IRS claims a transaction is abusive, courts generally examine whether the taxpayer had a business purpose and whether the transaction had economic substance (essentially a prospect of profit before taxes). This two-pronged "economic substance doctrine" developed from a series of Supreme Court cases.

Unfortunately, the economic substance doctrine provides a poor proxy for the real question, which was the focus of the early cases-whether the claimed tax results are consistent with Congress's intent. One important drawback of the shift from a focus on congressional intent to a focus …

Informal science education serves as an important source for science education for both individuals and school groups. However, the effectiveness of school visits to informal science education events outside of either museums or science centers has received little investigation. This study explores the short-term effects of a hands-on learning experience on students’ attitude and content knowledge. Specifically, it investigates the impact of Ocean Commotion, a one-day event where exhibitors present information and hands-on demonstrations about marine environments and products, especially those important to Louisiana. Ensuring quality in software development is a challenging process. The concepts of anti-pattern and bad code smells utilize the knowledge of reoccurring problems to improve the quality of current and future software development. Anti-patterns describe recurring bad design solutions while bad code smells describe source code that is error-free but difficult to understand and maintain. Code refactoring aims to remove bad code smells without changing a program’s functionality while improving program quality. The primary purpose of this study was to compare the academic achievement, as measured by scores on the English and math portions of the Graduate Exit Examination (GEE), of public high school students in Louisiana by whether or not they were identified as business education students. The GEE is a high-stakes test that is administered to high school students in Louisiana. Students must pass specific portions of the test to obtain a diploma. School-aged females with Asperger's Disorder (AD) are significantly affected by debilitating anxiety. At present, no empirically validated treatments exist to treat this anxiety. To investigate this affect and treatment gap, a mixed-methods revelatory single-case design, built on evidence-based treatment elements was designed and tested. Solo pianist, David Helfgott rated, performed and provided musical performances by Louis Moreau Gottschalk and Claude Debussy which were listened to once each morning before school by a 10-year-old female with AD. Anxiety was recorded via a self-report Daily Journal and parent-report Spence Child Anxiety Scale for 20 consecutive school days. Results indicated support for the …

Research suggests resilience can be viewed as a dynamic process facilitating positive functioning within the context of significant adversity. A nuclear family type that remains a controversial and stigmatized group is families with same-sex parents. Same-sex families face a great number of challenges, due to the presence of heterosexism in society and they are often heavily criticised within the broad public domain. The current study adopted a phenomenological methodology to identify the family resilience processes utilised by same-sex families. The aim of the current study was to explore public opinion on mentally ill female offenders in Western Australia, and the influence of these views on sentencing decisions. This study aimed to determine whether the mental health of a female offender influenced how people view a crime and the punishment they consider most appropriate for an offender. Australia has recently experienced a punitive swing in sentencing policies and legislation. Consequently, politicians have responded favourably to popular demands for harsher sentencing. A comprehensive review of the current literature has been undertaken to understand why the community has adopted such a punitive position. It has been suggested that the media have hypersensitised the public into believing that crime is much more prevalent than it actually is, resulting in the individual fearing becoming a victim of crime. The next generation of Augmented Reality (AR) games will require real and virtual objects to coexist in motion in immersive game environments. This will require the illusion that real and virtual objects interact physically together in a plausible way. The Motion in Augmented Reality Games (MARG) engine described in this paper has been developed to allow these kinds of game environments. The evolution of MNEs (Multinational Enterprises) from rigid and hierarchical structures to more distributed authority and autonomy led to the theoretical justification for conceptualising them as a federative rather than unitary organisations (Ghoshal and Bartlett, 1990). Fundamental to the Federative MNE is the suggestion that subsidiary units, through their own actions, can modify the power base and influence MNE strategy ‘from below’ (Andersson et al., 2007). Candoluminescence Of Cave Gypsum, John R. Sweet, John W. Hess, William B. White

International Journal of Speleology

A selection of gypsum specimens from a variety of caves as well as CaSO4 synthesized in the laboratory emit both a green and yellow candoluminescence when excited by a hydrogen diffusion flame. The green emission is attributed to dehydration of gypsum to bassanite and the yellow emission appears upon further dehydration to anhydrite. The source of the luminescence is ascribed to minor concentrations of Mn2+ in the gypsum.

"Noise is, by definition, any random and persistent disturbance, which interferes with the clarity of a signal. Modern electronic devices are designed to limit noise, and in most cases the classical forms of noise have been eliminated or greatly reduced through careful design. However, there is a fundamental, quite unavoidable type of noise, called quantum 1/f noise, which occurs at low frequencies and is a fundamental consequence of the discrete nature of the charge carriers themselves. "This dissertation focuses on several problems in neuroscience from the perspective of nonlinear dynamics and stochastic processes. The first part concerns a method to visualize the idea of the power spectrum of spike trains, which has an educational value to introductory students in biophysics. The next part consists of experimental and computational work on drug-induced epileptic seizures in the rat neocortex. In the experimental part, spatiotemporal patterns of electrical activities in the rat neocortex are measured using voltage-sensitive dye imaging. "We conducted geophysical surveys to investigate the source of thermal anomalies and to delineate any potential water transport pathways from the recharge zones in the Oman Mountains to the location of the temporal thermal anomalies within the desert plain of the United Arab Emirates (UAE). In the visible region of the spectrum of both ASTER and MODIS satellite images, the desert plain of the UAE appears as a bare sandy surface. "Deadlock detection for concurrent programs has traditionally been accomplished by symbolic methods or by search of a state transition system. This work examines an approach that uses geometric semantics involving the topological notion of dihomotopy to partition the state space into components, followed by an exhaustive search of the reduced state space. Prior work partitioned the state-space inductively; however, this work shows that a technique motivated by recursion further reduces the size of the state transition system.
