How Shall I Praise Thee? Brian Leiter On Respect For Religion, Andrew Koppelman
How Shall I Praise Thee? Brian Leiter On Respect For Religion, Andrew Koppelman
San Diego Law Review
In two recent papers, Brian Leiter argues that there is no good reason for law to single out religion for special treatment and religion is not an apt candidate for respect in the "thick" sense of being an object of favorable appraisal. Special treatment would be appropriate only if there were some "moral reason why states should carve out special protections that encourage individuals to structure their lives around categorical demands that are insulated from the standards of evidence and reasoning we everywhere else expect to constitute constraints on judgment and action." Favorable appraisal would be called for "[o]nly if …
Against Freedom Of Conscience, Richard J. Arneson
Against Freedom Of Conscience, Richard J. Arneson
San Diego Law Review
Is there a moral right to freedom of conscience? Should a legal right to freedom of conscience be established in each country on Earth? This essay argues for negative answers to both questions.
Theses On Secularism, Nomi Maya Stolzenberg
Theses On Secularism, Nomi Maya Stolzenberg
San Diego Law Review
Notwithstanding the notorious difficulty of defining religion and the consequent effort on the part of jurists and academics to avoid embracing any particular definition, one model of religion has dominated modern discourse: religion as conscience. Because of the dominance of this model, alternative views - which either subordinate the conscience to other supposedly more fundamental features of religion or dispense with the psychological apparatus of conscience altogether - have been largely submerged in modern political and legal discourse. Yet they will not remain suppressed. As a number of the conference papers have attest, alternatives and challenges to the dominant model …
The First Amendment's Religion Clauses: "Freedom Of Conscience" Versus Institutional Accommodation, Michael J. White
The First Amendment's Religion Clauses: "Freedom Of Conscience" Versus Institutional Accommodation, Michael J. White
San Diego Law Review
The phrase "freedom of conscience" is, of course, not to be found in the United States Constitution: the First Amendment says only that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." However, it seems probable that one, then-contemporary Protestant conception of freedom of conscience was presupposed in these two clauses. Evidence for this conjecture can be found not only in the debate and proposals concerning the Bill of Rights of the United States Constitution but also in the frequently more expansive language of early state constitutions.
Fundamental Questions About The Religion Clauses: Reflections On Some Critiques, Kent Greenawalt
Fundamental Questions About The Religion Clauses: Reflections On Some Critiques, Kent Greenawalt
San Diego Law Review
This Essay responds to some major critiques of my work on the religion clauses. The effort has seemed worth undertaking because many issues the critics raise lie at the core of one's approach to free exercise and nonestablishment, and some of those issues matter greatly for constitutional adjudication more broadly. Like any author, perhaps, my reaction to reading some comments has been that I did not quite say that, but I shall not bore you with these quibbles about how well I explained myself in the past. Rather, I shall try to confront the genuinely basic questions that many of …
Response To Professor Kent Greenawalt's Lecture, Larry Alexander
Response To Professor Kent Greenawalt's Lecture, Larry Alexander
San Diego Law Review
The discussion of law and religion can take various forms. One form is conceptual: What is religion? How are religious claims different from moral claims or metaphysical ones? Is the method of evaluating religious claims for their truth - the epistemology of religious claims - different from the methods of evaluation of moral claims or metaphysical ones?

An Affair To Remember: The State Of The Crime Of Adultery In The Military, Katherine Annuschat
An Affair To Remember: The State Of The Crime Of Adultery In The Military, Katherine Annuschat
San Diego Law Review
The recent cases against Penland and Yee demonstrate with clarity the military's willingness to pursue adultery prosecutions for questionable motives. In light of this fact, and the obsolescence of these statutes in the public mind, adultery should be removed from the enumerated offenses under article 134. Part II will discuss the history of the crime of adultery in American jurisprudence, including the current state of adultery as a crime, as well as the current public opinion on adultery in light of several recent high-profile adultery scandals in the media.
Part III will delve into the history of adultery prosecutions in …

The Law Of Citations And Seriatim Opinions: Were The Ancient Romans And The Early Supreme Court On The Right Track?, Joshua M. Austin
Northern Illinois University Law Review
This article explores the oft forgotten and somewhat misunderstood ancient Roman law methodology known as the Lex Citandi, or Law of Citations. The Law of Citations was a relatively simple theory in which authority was given to the writings of five key jurists from the classical period of Roman law, and the majority won the day. Thus, in a way, the method of separate opinions was born. It was a theory revisited by our Supreme Court in its early days through seriatim, or separate, opinions; and perhaps still seen today in the modern day Supreme Court's concurrences and dissents. This …

Another Can Of "Crawford" Worms: Certificates Of Nonexistence Of Public Record And The Confrontation Clause, Keith Hollingshead-Cook
Another Can Of "Crawford" Worms: Certificates Of Nonexistence Of Public Record And The Confrontation Clause, Keith Hollingshead-Cook
Vanderbilt Law Review
The Confrontation Clause of the Sixth Amendment to the U.S. Constitution provides that "[i]n all criminal prosecutions, the accused shall enjoy the right .. . to be confronted with the witnesses against him."' When the Supreme Court decided Crawford v. Washington in 2004, it established a new standard for assessing the scope of this right and determining when hearsay is admissible as trial evidence against a criminal defendant. Rather than basing decisions regarding a defendant's right to confrontation on a judicial inquiry into the reliability of a particular statement, an approach typified by the Court's earlier decision of Ohio v. …
A Randomized Controlled Trial Of Quetiapine Versus Placebo In The Treatment Of Delirium, Tayyeb Tahir, Eamonn Eeles, Venugopal Karapareddy, Prem Muthuvelu, Sian Chapple, Bethan Phillips, Toyin Adyemo, Daniel Farewell, Jonathan I. Bisson
A Randomized Controlled Trial Of Quetiapine Versus Placebo In The Treatment Of Delirium, Tayyeb Tahir, Eamonn Eeles, Venugopal Karapareddy, Prem Muthuvelu, Sian Chapple, Bethan Phillips, Toyin Adyemo, Daniel Farewell, Jonathan I. Bisson
Brain and Mind Institute
Background
Delirium is a commonly occurring complex neuropsychiatric disorder. Evidence for its treatment based on randomized controlled trials (RCTs) is poor.
Aims
To determine the efficacy and acceptability of quetiapine in the treatment of delirium.
Method
A double-blind, RCT was conducted. A total of 42 patients were randomized to quetiapine or a placebo group. The primary outcome measure was the Delirium Rating Scale Revised 98. Other scales used were the Brief Psychiatric Rating Scale, Mini-Mental State Examination and Clinical Global Improvement. In order to account for missing data, a nonlinear mixed-effects model was used to estimate the difference …

The Strange Case Of The Courts, A Car, And The 1910 Batting Title, Steven Gietschier
The Confluence (2009-2020)
Ty Cobb and Napoleon Lajoie were fighting for the 1910 American League batting title right down to the end of the season. Who won was under dispute, and it landed the St. Louis Browns in court. Gietschier looks at the case files involving the Browns manager who was fired over accusations that he tried to let Lajoie win the title—and a new car.

Estimates of survival for the young of a species are critical for population models. These models can often be improved by determining the effects of management actions and population abundance on this demographic parameter. We used multiple sources of data collected during 1982–2008 and a live-recapture dead-recovery modeling framework to estimate and model survival of Florida panther (Puma concolor coryi) kittens (age 0–1 year). Overall, annual survival of Florida panther kittens was 0.323 ± 0.071 (SE), which was lower than estimates used in previous population models. In 1995, female pumas from Texas (P. c. stanleyana) were …
An Anatomy Of Conflict Resolution In Africa’S Civil Conflicts, George Klay Kieh Jr.
An Anatomy Of Conflict Resolution In Africa’S Civil Conflicts, George Klay Kieh Jr.
Peace and Conflict Studies
The crises of the post-colonial state in Africa have led to civil wars in various African states. In several of these war affected countries, the state has disintegrated and occasioned myriad adverse consequences, including deaths, injuries, the mass displacement of people, and the collapse of the systems of governance. Against this background, this article examines the methods that have been used to terminate civil wars in Africa, and to set into motion the processes of peacebuilding. The article argues that in order to build durable peace in Africa’s post-conflict societies, the post-colonial state needs to be democratically reconstituted.

All Faculty Scholarship for the College of the Sciences
The academic world has come to place enormous weight on bibliometric measures to assess the value of scientific publications. Our paper has two major goals. First, we discuss the limits of numerical assessment tools as applied to computer science publications. Second, we give guidelines on how to write a good paper, where to submit the manuscript, and how to deal with the reviewing process. We report our experience as editors of International Journal of Computers Communications & Control (IJCCC). We analyze two important aspects of publishing: plagiarism and peer reviewing. As an example, we discuss the promotion assessment criteria used …

The research on the potential relationship of the Northwest Evaluation Association's Measures of Academic Progress (NWEA MAP) and the Illinois Standards Achievement Test (ISAT) was conducted in two phases and focused on middle schools with a grade configuration of 6-8 in the state of Illinois. The first phase of the research examined whether or not a significant relationship existed between NWEA MAP test participation by middle schools in Illinois, and ISAT growth over time. A total of 86 schools were involved in the research associated with Phase 1. The second phase of the study aimed to find out if the …
Parental Involvement In A New Environment: Igbo Families In Chicago And The Education Of Their Children—A Narrative Inquiry, Obiefuna Onwughalu
Parental Involvement In A New Environment: Igbo Families In Chicago And The Education Of Their Children—A Narrative Inquiry, Obiefuna Onwughalu
College of Education Theses and Dissertations
Parents, family, school and community have overlapping spheres of influence in the education of children (Epstein, 2001). Schooling isolated from the home will have significant consequences for child behavior and development (Bronfenbrenner, 1979). A fact of life is that a people’s socio-political, cultural and historical life situation, context or environment, or ecological systems (Bronfenbrenner, 1977) affects their way of life.
This study seeks to understand the nature of parental engagement of Igbo families, a newer immigrant community in Chicago, in the education of their children. All immigrants are not the same, and knowing about Igbo experiences will enable scholars and …
The Effect Of Enrollment In Middle School Challenge Courses On Advanced Placement Exams In Social Studies And Science, Katherine Glaude-Bolte
The Effect Of Enrollment In Middle School Challenge Courses On Advanced Placement Exams In Social Studies And Science, Katherine Glaude-Bolte
Dissertations
Educators seek to guide students through appropriate programs and courses that prepare them for future success, in more advanced coursework and in other challenges of life. Some middle schools offer Challenge, or honors, courses for students who have demonstrated high ability. High schools often offer Advanced Placement (AP) courses, which are taught at the college level. This study examined the correlation between enrollment in middle school Challenge courses and subsequent AP exam category scores in social studies and science in a suburban school district. The independent variables were the number of years of enrollment in middle school social studies or …

Admitting Guilt By Professing Innocence: When Sentence Enhancements Bases On "Alford" Pleas Are Unconstitutional, Anne D. Gooch
Vanderbilt Law Review
A few days before Christmas in 1994, in Vineland, New Jersey, Charles Apprendi, Jr. was drunk. At 2:04 a.m., he fired several shots from a .22 caliber gun into the home of an African-American family in his neighborhood. By 3:05 a.m., he had been arrested and had admitted that he was the shooter. Apprendi was interrogated for several hours after these events. At 6:04 a.m., he apparently stated that he committed the crime because the victims were black, but he later retracted this statement. Apprendi was indicted on twenty-three counts in connection with the shooting, and eventually pleaded guilty to …

On The Evidence For Species Coexistence: A Critique Of The Coexistence Program, Adam M. Siepielski, Mark A. Mcpeek
Dartmouth Scholarship
A major challenge in ecology is to understand how the millions of species on Earth are organized into biological communities. Mechanisms promoting coexistence are one such class of organizing processes, which allow multiple species to persist in the same trophic level of a given web of species interactions. If some mechanism promotes the coexistence of two or more species, each species must be able to increase when it is rare and the others are at their typical abundances; this invasibility criterion is fundamental evidence for species coexistence regardless of the mechanism. In an attempt to evaluate the level of empirical …

Automated Classification Of Breast Pathology Using Local Measures Of Broadband Reflectance, Ashley M. Laughney, Venkataramanan Krishnaswamy, Pilar Beatriz Garcia-Allende, Olga M. Conde, Wendy A. Wells, Keith D. Paulsen, Brian W. Pogue
Dartmouth Scholarship
We demonstrate that morphological features pertinent to a tissue's pathology may be ascertained from localized measures of broadband reflectance, with a mesoscopic resolution (100-μm lateral spot size) that permits scanning of an entire margin for residual disease. The technical aspects and optimization of a k-nearest neighbor classifier for automated diagnosis of pathologies are presented, and its efficacy is validated in 29 breast tissue specimens. When discriminating between benign and malignant pathologies, a sensitivity and specificity of 91 and 77% was achieved. Furthermore, detailed subtissue-type analysis was performed to consider how diverse pathologies influence scattering response and overall classification efficacy. The …
