The Age Of Innocence: A Cautious Defence Of Raising The Age Of Consent In Canadian Sexual Assault Law, Janine Benedet Jan 2010

The Age Of Innocence: A Cautious Defence Of Raising The Age Of Consent In Canadian Sexual Assault Law, Janine Benedet

All Faculty Publications

In 2008, Canada raised the age of consent to sexual activity with an adult from 14 years of age to 16. This change was motivated, in part, by several high profile cases of internet “luring” of younger teenagers. This article considers whether raising the age of consent has had any benefits. It begins by discussing the history and development of age of consent laws in Canada. The justification for a statutory age of consent has shifted from one based on the age at which a girl is deemed to be sexually available to one based on her capacity to give …

Relationship Between Multiple Sources Of Perceived Social Support And Psychological And Academic Adjustment In Early Adolescence: Comparisons Across Gender., Sandra Yu Rueger, Christine K. Malecki, Michelle K. Demaray Jan 2010

Relationship Between Multiple Sources Of Perceived Social Support And Psychological And Academic Adjustment In Early Adolescence: Comparisons Across Gender., Sandra Yu Rueger, Christine K. Malecki, Michelle K. Demaray

Faculty Articles, Papers, and Other Scholarship

The goal of the current study was to investigate gender differences in the relationship between multiple sources of perceived support (parents, teachers, classmates, close friends, and school) and indices of psychological and academic adjustment. As a preliminary analysis, the study provided further psychometric support for the Child and Adolescent Social Support Scale (CASSS: Malecki, Demaray, & Elliott, 2003). The results of the main analyses supported previous findings related to gender differences in mean levels of perceived support and extended findings demonstrating the importance of support from parents and the general peer group for both boys and girls. Overall, these results …

Of Camels And “Ca-Mail”: Engaging Complex Representations Of Bedouins In Activism, Emily Mckee Jan 2010

Of Camels And “Ca-Mail”: Engaging Complex Representations Of Bedouins In Activism, Emily Mckee

Faculty Articles, Papers, and Other Scholarship

While conducting fieldwork with environmental justice activists in the Negev region of Israel, I faced a troubling dilemma regarding representations: Having observed strategic essentialism in activist publicity, how should I uphold both scholarly and socio-political responsibilities? In this article, I suggest that observations of strategic essentialism can help us unmask the power dynamics that shape the rules of public discussion in a society. Taking the example of romantic portrayals of Bedouins as indigenous farmers, I use this image as a springboard in my writing to consider why this essentialization holds rhetorical power in Israel. What does it say about the …

Monetary Recoveries For State Crime Victims, Jeffrey A. Parness, Laura Lee, Ed Laube Jan 2010

Monetary Recoveries For State Crime Victims, Jeffrey A. Parness, Laura Lee, Ed Laube

Faculty Articles, Papers, and Other Scholarship

Crime victim recoveries are typically available in American states through three separate, but related, avenues: a criminal proceeding (with or without a formal charge); a related civil claim (including a pre-suit settlement); and, a related administrative or special court proceeding. Multiple avenues can be pursued simultaneously. These avenues often, but not always, have constitutional as well as statutory foundations. Unfortunately state crime victims often go without recovery. Barriers to recovery include intrastate and interstate confusion over terms like restitution and victim. More can be done for victims, especially during criminal case sentencing. Unlike federal district courts, state criminal courts typically …

Libraries Build Autonomy: A Philosophical Perspective On The Social Role Of Libraries And Librarians, Audrey Barbakoff Jan 2010

Libraries Build Autonomy: A Philosophical Perspective On The Social Role Of Libraries And Librarians, Audrey Barbakoff

Library Philosophy and Practice (e-journal)

An important, overlooked moral contribution of libraries and librarians to the community is the provision of support for autonomy. Philosophers have long considered autonomy a primary moral value, essential to living a flourishing life. Although library scholarship has not often engaged deeply with the philosophical discourse surrounding autonomy, libraries and librarians are uniquely positioned to enact many of the methods for encouraging it. By considering the moral significance of library services as autonomy-building activities, libraries and librarians can provide a valuable social support for their communities, individual users, and ultimately themselves.

Information Flow Patterns In Organizations: The Library In Focus, Joyce Chinyere Oyadonghan Jan 2010

Information Flow Patterns In Organizations: The Library In Focus, Joyce Chinyere Oyadonghan

Library Philosophy and Practice (e-journal)

The paper discusses information flow in organizations with special reference to the library of tertiary institutions. The vaccine or function of any academic institution is given a special consideration. The study employs an essential qualitative analysis approach to unravel the critical role played by information in the relationship between librarian and the clientele. In the study, the Shannon and Weaver model of communication (or information dissemination and sharing) was deployed for this purpose). In this study, we were able to establish that the free flow of information among library staff as well as between them and the clientele is necessary …

American State Constitutional Equalities, Jeffrey A. Parness Jan 2010

American State Constitutional Equalities, Jeffrey A. Parness

Faculty Articles, Papers, and Other Scholarship

Many American state constitutions contain equality provisions. Some simply promote Equal Protection in ways comparable to the Fifth and Fourteenth Amendments to the federal constitution. Others are worded quite differently, though read in lockstep with federal precedents. Yet others vary both in letter and spirit form federal constitutional equalities. These variations extend at time constitutional equality protections far beyond the federal precedents. Varying American state constitutional equalities are today promoted by phrases and terms like equality, equal protection, nondiscrimination, sameness, and uniformity. They occasionally limit private as well as public actors. And they occasionally limit the roles of legislatures in …

Ancestral Determination From Foramen Magnum, Stephanie Marie Crider Jan 2010

Ancestral Determination From Foramen Magnum, Stephanie Marie Crider

LSU Master's Theses

Ancestry estimation is a crucial part of the biological profile creation in forensic anthropology. Without proper classification of ancestry, other aspects of the biological profile, such as stature, can be affected. Several techniques are used by forensic anthropologists to determine ancestry of unidentified remains. Some anthropologists believe the cranium to be an excellent indicator of ancestry (Rhine 1990). The focus of this research was to determine the utility of the foramen magnum region on the cranial base as a positive indicator of ancestry. Previous studies have explored the effectiveness of using the cranial base’s occipital condyles for ancestry assignment of …

A Portable Phonatory Feedback Device For Patients With Speech Disorders, Richie Sajan Jan 2010

A Portable Phonatory Feedback Device For Patients With Speech Disorders, Richie Sajan

LSU Master's Theses

Vocal intensity-related speech disorders such as dysarthria and vocal nodules can limit quality of life and reduce the patient’s ability to interact with family, socialize, or pursue employment. Behavioral speech therapies exist to address these issues but have limited effectiveness because they are expensive and clinic-based. The ability to monitor vocal intensity outside of the clinical setting will greatly aid in the treatment of these speech disorders, enabling patients to make quicker progress by reinforcing techniques learned in the clinic. The Voice Volume Monitor (VVM) is a portable and cost-effective therapeutic aid designed for this purpose, providing real-time feedback regarding …

The Auxiliary System Of Typically Developing Children Acquiring African American English, Brandi Lynette Newkirk Jan 2010

The Auxiliary System Of Typically Developing Children Acquiring African American English, Brandi Lynette Newkirk

LSU Doctoral Dissertations

This study’s purpose was to examine the acquisition and use of BE, DO, and modal auxiliaries by African American English (AAE)-speaking children. The impetus for this work was the lack of information regarding the developmental trajectory of these auxiliary types and their use, in AAE relative to what is known about auxiliary acquisition and use in Mainstream American English (MAE). The study used two datasets of language samples: one that contained 48 language samples from 3 ½-year-old children and one that contained 36 longitudinal language samples of five children who were between 18 and 51 months of age. Results from …

Behaviors And Beliefs Of African American Caregivers As Related To Their Children's Language-Literacy Development, Lekeitha Renee' Morris Jan 2010

Behaviors And Beliefs Of African American Caregivers As Related To Their Children's Language-Literacy Development, Lekeitha Renee' Morris

LSU Doctoral Dissertations

This study examined African American (AA) caregivers’ beliefs about their children’s language-literacy development and their book reading behaviors with their children as a function of socioeconomic status (SES). Caregivers’ behaviors were examined before, during, and after a three-day caregiver training program that targeted four behaviors (i.e., tracking print, reference to print, text to life, and interpretations). Participants were 20 caregiver-child dyads classified as Low-SES (LSES) or Middle-SES (MSES) based on the caregivers’ level of education. Children were typically developing girls between the ages of four and five years. At pre-test, the two groups of caregivers differed in some of their …

Athens And Byzantium: Platonic Political Philosophy In Religious Empire, Jeremiah Heath Russell Jan 2010

Athens And Byzantium: Platonic Political Philosophy In Religious Empire, Jeremiah Heath Russell

LSU Doctoral Dissertations

It is traditionally understood that there is a gap, which spans well over one thousand years, between Plato’s own political philosophy and its successor in medieval Islamic philosophy. A most likely bridge between Plato and these later philosophers is Neoplatonism. However, scholars argue that this philosophic school abandoned its predecessor’s emphasis on political philosophy. This dissertation challenges the traditional interpretation by reconstructing a political philosophy based on a Neoplatonic commentary on Plato’s Gorgias. The first two chapters place this commentary within its historical context, as well as its place within the larger Neoplatonic pedagogy. The remainder of the dissertation reconstructs …

Setting Foot On Enemy Ground: Cease-And-Desist Letters, Dmca Notifications And Personal Jurisdiction In Declaratory Judgment Actions, Marketa Trimble Jan 2010

Setting Foot On Enemy Ground: Cease-And-Desist Letters, Dmca Notifications And Personal Jurisdiction In Declaratory Judgment Actions, Marketa Trimble

Scholarly Works

In declaratory judgment actions brought by alleged infringers against rights holders, such as actions for declaration of invalidity or non-infringement of intellectual property rights, U.S. courts have long maintained that sending a cease-and-desist letter alone, absent other acts in an alleged infringer's forum, is not a sufficient basis for personal jurisdiction over the rights holder who mailed them to the alleged infringer's forum. Notwithstanding the similarities between cease-and-desist letters and notifications under the Digital Millennium Copyright Act (DMCA), the Tenth Circuit Court of Appeals recently decided that sending a notification alone does establish a basis for personal jurisdiction over the …

Asia's Participation In Global Health Diplomacy And Global Health Governance, David P. Fidler Jan 2010

Asia's Participation In Global Health Diplomacy And Global Health Governance, David P. Fidler

Articles by Maurer Faculty

This article provides a framework for thinking about Asian approaches to and impact on global health diplomacy and governance that might contribute to more sophisticated analyses on Asia in global health politics, diplomacy, and governance. First, the article examines the "rise of Asia" and "rise of health" as overlapping but unconnected developments in international relations. Second, it analyzes how the shift of power and influence towards Asia, largely caused by China's and India's emergence as great powers; affects global health politics and potential Asian contributions to global health diplomacy and governance in the future. Third, the article looks at normative …

Inspire: The Confluence Of Art & Design, John Mark Lawler Jan 2010

Inspire: The Confluence Of Art & Design, John Mark Lawler

LSU Master's Theses

Inspire: The Confluence of Art & Design seeks to untangle the inextricable link between graphic design and art. Graphic design has always been seen simply as an informational or sales tool; rarely is it seen as art. The work presented in this show illustrates that works created with typography can, in fact, be one and the same.

Similarities And Differences In Self-Disclosure And Friendship Development Between Fact-To-Face Communication And Facebook, Pavica Sheldon Jan 2010

Similarities And Differences In Self-Disclosure And Friendship Development Between Fact-To-Face Communication And Facebook, Pavica Sheldon

LSU Doctoral Dissertations

This research identified the patterns of self-disclosure between face-to-face and Facebook friends’ interactions. A survey of 317 participants was conducted to compare the hypothesized relationships among social attraction, self-disclosure, predictability and trust in three types of relationships: recently added Facebook friend, exclusive Facebook friend, and an exclusive face-to-face friend. Data was analyzed using structural equation modeling (SEM), multivariate analysis of variance (MANOVA), t-tests and correlations. Results indicated that individuals reporting high levels of social attraction also reported having greater self-disclosure with their latest added Facebook friend, exclusive Facebook friend and an exclusive face-to-face friend. This supports a theorem of Uncertainty …

Acadiana And The Cajun Cultural Landscape: Adaption, [Sic] Accommodation Authenticity, Joseph Jerome Mckernan Jan 2010

Acadiana And The Cajun Cultural Landscape: Adaption, [Sic] Accommodation Authenticity, Joseph Jerome Mckernan

LSU Master's Theses

The following points are important for this discussion of Acadiana and the Cajun Cultural Landscape: First, in order to fully understand the Cajun nature and what makes the Cajuns distinct, we must explore their history from the time they arrived on the shores of North America to the present. Without doing this, we cannot truly understand their way of life and where it came from; Second, what and where is Acadiana--the Cajun homeland--and what are its socioeconomic and demographic characteristics; Third, how have folk culture and celebration of heritage mediated Cajun culture; Fourth, why are these traditions manifested in what …

Head Shaping Of The Ancient Maya At Wild Cane Cay And Moho Cay, Belize, Kellye Alyse French Jan 2010

Head Shaping Of The Ancient Maya At Wild Cane Cay And Moho Cay, Belize, Kellye Alyse French

LSU Master's Theses

As a sign of beauty or status, the ancient Maya shaped the skulls of their infants, resulting in what modern researchers see as several forms of cranial modification. My project consists of the study of cranial modification of the coastal Maya from two trading ports, including an Early Classic (A.D. 300-600) sample Moho Cay, Belize, and a Postclassic (A.D. 900-1300) sample from Wild Cane Cay, Belize. Using the classification set forth by Dembo and Imbelloni, I calculate the type of cranial modification found at each site. I then create gender, temporal, and spatial distributions and compare the results to other …

Mass Transfer And Mergers In Double White Dwarf Binaries, Wesley Paul Even Jan 2010

Mass Transfer And Mergers In Double White Dwarf Binaries, Wesley Paul Even

LSU Doctoral Dissertations

We have developed a self consistent field (SCF) technique similar to the one described by Hachisu, Eriguchi, & Nomoto (1986b) that can be used to construct detailed force-balanced models of synchronously rotating, double white dwarf (DWD) binaries. This SCF technique can be used to construct model sequences that mimic the last portion of the detached inspiral phase of DWD binary evolutions, and semi-detached model sequences that mimic a phase of conservative mass transfer. In addition, the SCF models can be used to provide quiet initial starts for dynamical studies of the onset of mass transfer in DWD systems. We present …

Model Based Analysis Of Some High Speed Network Issues, Suman Kumar Jan 2010

Model Based Analysis Of Some High Speed Network Issues, Suman Kumar

LSU Doctoral Dissertations

The study of complex problems in science and engineering today typically involves large scale data, huge number of large-scale scientific breakthroughs critically depends on large multi-disciplinary and geographically-dispersed research teams, where the high speed network becomes the integral part. To serve the ongoing bandwidth requirement and scalability of these networks, there has been a continuous evolution of different TCPs for high speed networks. Testing these protocols on a real network would be expensive, time consuming and more over not easily available to the researchers worldwide. Network simulation is well accepted and widely used method for performance evaluation, it is well …

Research conducted in the healing spaces of Mbarara reflects traditions in the anthropology of the body and brings a lived perspective to conditions of sickness and wellness. By tracing the biographies of treatment spaces, the medical landscape is evaluated in terms of participants’ perceptions, convictions, and knowledge sets. Phenomenological methodology is employed in this exploration of ill states and curative places, which braids concepts and academic work in the areas of medicine, …

Identifying Historic Storm Surges And Calculating Storm Surge Return Periods For The Gulf Of Mexico Coast, Hal Needham Jan 2010

Identifying Historic Storm Surges And Calculating Storm Surge Return Periods For The Gulf Of Mexico Coast, Hal Needham

LSU Master's Theses

Tropical cyclone-generated storm surges inflict natural disasters that are among the most catastrophic globally. The surges observed along the U.S. Gulf of Mexico are among the highest in the world, second only to the Bay of Bengal. Storm surge activity along the U.S. Gulf Coast remains poorly understood, however, in part, due to the absence of credible research that accurately depicts the maximum height and location of historic surge events. This research addresses this gap in the scientific literature by creating a database of storm surge observations along the Gulf Coast between the years 1880 to 2009. A total of …

Dopaminergic Input To The Equine Pituitary: Seasonal And Estradiol Effects, Sarah Case Clavier Jan 2010

Dopaminergic Input To The Equine Pituitary: Seasonal And Estradiol Effects, Sarah Case Clavier

LSU Master's Theses

Two experiments were conducted to study the effects of season and estradiol administration on dopaminergic input to the equine adenohypophysis. Experiment 1 began in the spring with 8 mares and 8 stallions and was repeated again in the summer, fall, and winter. Horses were given sulpiride injections of eight incremental doses (0.25 to 32 µg/kg BW). Within each group of 8 horses, half received the sulpiride in an increasing manner, the other half in a decreasing manner. Prolactin concentrations peaked in the first 15 to 30 min in all horses in all seasons. Prolactin areas under the curve increased (P < 0.001) with increasing doses of sulpiride, and were highest (P < 0.05) in March for stallions, but in June for mares. The calculated half-maximum values, which should be proportional to the dopaminergic input to the pituitary, were lowest (P < 0.05) in June and greatest in September. The variation in half-maximum values with season indicated a change in dopaminergic input to the pituitary, with lowest input occurring in June in both sexes. Experiment 2 was designed to determine if the degree of dopaminergic input to the adenohypophysis is altered by estradiol administration. Twelve geldings were used. On day 0, geldings received an i.m. injection of either estradiol cypionate (ECP; n = 6) or vegetable oil (n = 6) at one of two dose volumes (2 vs. 10 mL). On day 6, all geldings received an injection of sulpiride at 0.082 µg/kg BW in saline. Sulpiride injections were repeated every other day with the dose increasing each day, from 0.164 to 100 µg/kg BW. Estradiol pretreatment increased (P < 0.05) the prolactin response to sulpiride at the 2.56 µg/kg dose and higher. However, the half-maximum values for ECP-treated and control geldings did not differ, indicating that the amount of sulpiride needed to counterbalance the amount of dopamine reaching the pituitary was unaltered by estradiol treatment. It was concluded that estradiol likely stimulates prolactin production and secretion after sulpiride directly at the lactotrope level, rather than by decreasing hypothalamic dopamine input to the lactotropes.

Synthesis And Characterization Of Rare Earth-Nickel-Gallium Ternary Intermetallics, Kandace R. Thomas Jan 2010

Synthesis And Characterization Of Rare Earth-Nickel-Gallium Ternary Intermetallics, Kandace R. Thomas

LSU Doctoral Dissertations

The structural and physical characterization of several early and latter rare earth Ln-Ni-Ga systems, which include Ln2NiGa12 (Ln = Pr, Nd, Sm), alpha-LnNiGa4 (Ln = Y, Gd – Yb) and beta-LnNiGa4 (Ln = Tb – Ho) will be presented in this work. These systems are thermodynamically located within a copious, robust phase space and provide a rich understanding of how slight modifications to synthetic preparations can yield the adoption of different structure types in a Ga-rich regime. Each of these phases is made up of well-studied substructures which lend an additional angle of apperception as to how their structure and …

Constructing The Constitutional Canon: The Metonymic Evolution Of Federalist 10, Ian C. Bartrum Jan 2010

Constructing The Constitutional Canon: The Metonymic Evolution Of Federalist 10, Ian C. Bartrum

Scholarly Works

This paper is part of larger symposium convened for the 2010 AALS annual meeting. In it the author adapts some of his earlier constitutional theoretical work to engage the topic of that symposium: the so-called “interpretation/construction distinction.” The author makes two related criticisms of the distinction: (1) it relies on a flawed conception of linguistic meaning, and (2) while these flaws may be harmless in the “easy” cases of interpretation, they are much more problematic in the difficult cases of most concern. Thus, the author doubts the ultimate utility of the distinction as part of a “true and correct” model …

Non-Axisymmetric Instabilities In Self-Gravitating Tori Around Black Holes, And Solving Einstein Constraints With Superconvergent Finite Element Methods, Oleg Korobkin Jan 2010

Non-Axisymmetric Instabilities In Self-Gravitating Tori Around Black Holes, And Solving Einstein Constraints With Superconvergent Finite Element Methods, Oleg Korobkin

LSU Doctoral Dissertations

This thesis contains results on two related projects. In the first project, we explore non-axisymmetric instabilities in general relativistic accretion disks around black holes. Such disks are created as transient structures in several astrophysical scenarios, including mergers of compact objects and core collapse of massive stars. These disks are suggested for the role of cenral engines of gamma-ray bursts. We address the stability of these objects against the runaway and non-axisymmetric instabilities in the three-dimensional hydrodynamical fully general relativistic treatment. We explore three slender and moderately slender disk models with varying disk-to-black hole mass ratio. None of the models that …

Transit-Based Emergency Evacuation Modeling With Microscopic Simulation, Hana H. Naghawi Jan 2010

Transit-Based Emergency Evacuation Modeling With Microscopic Simulation, Hana H. Naghawi

LSU Doctoral Dissertations

Several recent mass evacuations, including those in advance of Hurricane Katrina in New Orleans and Hurricane Rita in Houston, have demonstrated the effects of limited planning for carless populations. The lack of planning left a significant portion of the mobility-limited population of both these cities unable to flee in advance of the storms. Since 2005 however, both of these cities (as well as others across the United States) have developed transit assisted mass evacuation plans at various levels of detail. Since these plans are relatively recent and do not have a history of experience on which to base their performance, …
