Food Fish, Commercial Fish, And Fish To Support A Moderate Livelihood: Characterizing Aboriginal And Treaty Rights To Canadian Fisheries, Douglas C. Harris, Peter Millerd
All Faculty Publications
The Aboriginal peoples of Canada stand in a different legal relationship to the fisheries than non-Aboriginal Canadians. They do so by virtue of a long history with the fisheries that precedes non-Aboriginal settlement in North America, and because of the constitutional entrenchment of Aboriginal and treaty rights in Canadian law. This article describes the characterizations of Aboriginal and treaty rights to fish in Canadian law and discusses what it means for rights characterized in terms of food fishing, commercial fishing, and fishing to support a moderate livelihood, to receive constitutional protection. The article then problematizes these characterizations and suggests that …
Corporate Social Responsibility In China: Window Dressing Or Structural Change?, Li-Wen Lin
Corporate Social Responsibility In China: Window Dressing Or Structural Change?, Li-Wen Lin
All Faculty Publications
In recent years many indigenous corporate social responsibility (CSR) initiatives have emerged in China. The Chinese CSR initiatives include laws and regulations, governmental instructions and guidelines, non-governmental standards and organizations. The recent growth of the Chinese CSR initiatives deserves an analysis of the CSR development in China, especially given that China’s international image is usually associated with human rights abuses, substandard products, sweatshops, and serious environmental pollution. How sincere and serious are the Chinese CSR measures, simply window dressing or any real structural change? This article overviews major Chinese CSR initiatives and analyzes the Chinese CSR development from the perspectives …
How Much Surveillance Is Too Much? Some Thoughts On Surveillance, Democracy, And The Political Value Of Privacy, Benjamin J. Goold
How Much Surveillance Is Too Much? Some Thoughts On Surveillance, Democracy, And The Political Value Of Privacy, Benjamin J. Goold
All Faculty Publications
Over the past decade it has become increasingly common to speak of the emergence of a surveillance society. Surveillance is an almost inescapable part of 21st century life. There is a very real danger that individual privacy - as it is currently understood - may soon become a thing of the past. Some would argue privacy is already dead and we have no choice but to accept our newly transparent lives. For many, surveillance has become part of daily life during visit banks, stores, shopping malls, and many public streets and parks. Travel through airports subjects our bodies to physical …
Mr. Monk And The Emotion-Reason Dilemma, E. Deidre Pribram Ph.D.
Mr. Monk And The Emotion-Reason Dilemma, E. Deidre Pribram Ph.D.
Communications: Faculty Publications
Adrian Monk (Tony Shalhoub) belongs to a tradition of brilliant but personally flawed detectives. Like others in this tradition, including his television colleague, Dr. Gregory House (Hugh Laurie), Monk’s genius resides in his exceptional, even excessive, rationality. Both Monk and House embody near-perfect detection or diagnostic skills. And, in both cases, the cause of their damaged personalities is excessive emotionality, represented by their respective emotional disorders. In their internal dynamics, emotion is almost always the ‘problem,’ and both shows suggest that troubled emotionality is the price Monk and House must pay for their intense brilliance.
Rethinking Environmental Contracting, Natasha Affolder
Rethinking Environmental Contracting, Natasha Affolder

Environmental contracts occupy an ill-defined middle ground between command and control regulation and voluntary initiatives. These agreements have captured the imagination of policymakers and scholars in the U.S. and Europe in particular. They are heralded as promising examples of “new governance.” This Article explores a little known example of environmental contracting which emerged in the context of a Canadian diamond mine — the Ekati Environmental Agreement. Through a fine-grained case study of the Ekati Agreement, this article challenges some of the assumptions that shape the “environmental contracting literature as well as the wider literature on “new governance.” By debunking the …
The Sexual Assault Of Intoxicated Women, Janine Benedet
The Sexual Assault Of Intoxicated Women, Janine Benedet
All Faculty Publications
This article considers how the criminal law of sexual assault in Canada deals with cases of women who have been consuming intoxicants (e.g. alcohol and or drugs). In particular, it considers under what circumstances the doctrines of incapacity to consent and involuntariness have been applied to cases in which the complainant was impaired by alcohol or drugs. It also reflects on problems of proof in such cases. Finally, it examines whether the treatment of this class of complaints tells us anything about the law’s understanding of consent, and capacity to consent, more generally, in the context of competing social understandings …
Blind Expertise, Christopher Robertson
Blind Expertise, Christopher Robertson

The United States spends many billions of dollars on its system of civil litigation, and expert witnesses appear in a huge portion of cases. Yet litigants select and retain expert witnesses in ways that create the appearance of biased hired guns on both sides of every case, thereby depriving factfinders of a clear view of the facts. As a result, factfinders too often arrive at the wrong conclusions, thus undermining the deterrence and compensation functions of litigation. Court-appointment of experts has been widely proposed as a solution, yet it raises legitimate concerns about accuracy and has failed to gain traction …
Systemic Risk Assessment Using A Non-Stationary Fractional Dynamic Stochastic Model For The Analysis Of Economic Signals, Jonathan Blackledge
Systemic Risk Assessment Using A Non-Stationary Fractional Dynamic Stochastic Model For The Analysis Of Economic Signals, Jonathan Blackledge
Articles
This paper considers the Fractal Market Hypothesis (FMH) for assessing the risk(s) in developing a financial portfolio based on data that is available through the Internet from an increasing number of sources. Most financial risk management systems are still based on the Efficient Market Hypothesis which often fails due to the inaccuracies of the statistical models that underpin the hypothesis, in particular, that financial data are based on stationary Gaussian processes. The FMH considered in this paper assumes that financial data are non-stationary and statistically self-affine so that a risk analysis can, in principal, be applied at any time scale …
Using Virtual Reality To Enhance Electrical Safety And Design In The Built Environment, Martin Barrett, Jonathan Blackledge, Eugene Coyle
Using Virtual Reality To Enhance Electrical Safety And Design In The Built Environment, Martin Barrett, Jonathan Blackledge, Eugene Coyle
Articles
Electricity and the inherent risks associated with its use in the built environment have long since been a priority for the electrical services industry and also the general public who must live and work in this environment. By its nature virtual reality has the advantage of being safe for both the user and equipment. In addition, it offers the user an opportunity to be exposed to a range of scenarios and conditions that either occur infrequently or are hazardous to replicate. This paper presents a prototype desktop virtual reality model, to enhance electrical safety and design in the built environment. …
Strategic By Design Iterative Approaches To Educational Planning, Shannon Chance
Strategic By Design Iterative Approaches To Educational Planning, Shannon Chance
Articles
Today’s tumultuous economic and political conditions require universities to adapt—fast. Leaders must attend to unforeseen crises, events, and opportunities in ways that align with their core missions, promote their universities’ continued existence, and help achieve disparate goals (Rowley, Lujan, and Dolence 1997). Good planning and good plans involve iteration; simple cause-and-effect thinking is no longer enough.

This paper provides a student perspective on the variety of forms of design critique available to educators. In architecture and landscape architecture, the design jury remains the dominant format for providing feedback to students. In recent years this format has come under scrutiny and its effectiveness called into question. However, little research has been done into the variety of alternative or supplemental formats available to educators. This paper explores an array of techniques that the authors have employed in design studio courses (which include techniques suggested by students in Webster’s 2007 article in the Journal of Architectural Education). These include …

Liquid Crystal Display Modes In A Nontilted Bent-Core Biaxial Smectic Liquid Crystal, Mamatha Nagaraj, Yuri Panarin, J. K. Vij, C. Keith, C. Tschierske
Articles
Liquid crystal display (LCD) modes associated with the rotation of the secondary director in nontilted, biaxial smectic phase of an achiral bent-core compound are demonstrated. For LCDs, we find that at least four display modes are possible using SmAPA phase of the studied material, in which the minor directors in adjacent layers are aligned antiferroelectrically. The advantages of these modes include low driving field (1–2 V/ µm), high contrast ratio 1000:1, relatively fast switching time of 0.5 ms and continuous gray scale. The molecular short axis or the polar axis in a negative dielectric, biaxial material is oriented by the …
Electric Field Induced Biaxiality And The Electro-Optic Effect In A Bent-Core Nematic Liquid Crystal, Mamatha Nagaraj, Yuri Panarin, U. Manna, J. K. Vij, C. Keith, C. Tschierske
Electric Field Induced Biaxiality And The Electro-Optic Effect In A Bent-Core Nematic Liquid Crystal, Mamatha Nagaraj, Yuri Panarin, U. Manna, J. K. Vij, C. Keith, C. Tschierske
Articles
We report the observation of a biaxial nematic phase in a bent-core molecular system using polarizing microscopy, electro-optics, and dielectric spectroscopy, where we find that the biaxiality exists on a microscopic scale. An application of electric field induces a macroscopic biaxiality and in consequence gives rise to electro-optic switching. This electro-optic effect shows significant potential in applications for displays due to its fast high-contrast response. The observed electro-optic switching is explained in terms of the interaction of the ferroelectric clusters with the electric field. © 2010 American Institute of Physics.

Engagement in the immediate community has long been a stated goal of most colleges and universities. Grand university mission statements (including our own) often convey a “commitment to community service.” While our rhetoric is lofty, how do we actually commit ourselves to pursuing this objective? How might we truly “engage” a community of scholars with the larger community? Is “true” service-learning sustainable in a college classroom? This paper addresses one method of engagement that exists on our campus: one section of the Core Curriculum “Human Behavior in Perspective,” has been transformed into a service-learning course. This course integrates the model …

The Importance Of Open Access In Technology Transfer For Marine Ornamental Aquaculture: The Case Of Hobbyist-Led Breeding Initiative, Andrew L. Rhyne
Arts & Sciences Faculty Publications
Access to peer-reviewed literature is often restricted to a limited segment of the target audience. Barriers are in place to prevent open access information. Here, I present a case study of how the internet and hobbyists are transforming both access and flow of information from closed circles to open dialogue within the field of marine ornamental fish rearing. This open approach is leading to innovation a rate remarkably faster and at a lower costs than could have been accomplished by traditional methods. Aquaculture societies, aquarium professionals, hobbyists, and scientists pursuing the captive production of species should embrace this movement. Whether …

Effects Of Salinity On Reproduction And Survival Of The Calanoid Copepod Pseudodiaptomus Pelagicus, Cortney L. Ohs, Andrew L. Rhyne, Scott W. Grabe, Matthew A. Dimaggio, Erik Stenn
Arts & Sciences Faculty Publications
Four experiments were conducted on the calanoid copepod, Pseudodiaptomus pelagicus, to determine the effects of salinity on survival, development time, reproductive output, and population growth in order to define the optimal salinity for culture. To determine the appropriate experimental salinity range we exposed nauplii and adults to abrupt salinity changes from 35 g/L to 5, 10, 15, 35, 42, and 48 g/L at 30 °C and determined survival after 24 hours. The second experiment stocked early stage nauplii into 1 L beakers after which they were cultured using standard procedures for 10 days at six salinities (10, 15, 20, …

An Exploration Of Counselling Practices With Women Survivors Of Childhood Sexual Abuse: Should Therapists Ask About Thoughts Or Behaviour Involving Sex With Children?, Angela Karen Hovey
Theses and Dissertations (Comprehensive)
Helping professionals and women, themselves, have been reluctant to recognize or acknowledge that females can and do sexually abuse children and adolescents. Research has also demonstrated that females most at risk to abuse children are those who were themselves victims of severe child sexual abuse (CSA) The purpose of this research was to explore whether or not current counselling practices with women survivors of CSA reflect the belief that women do not sexually abuse children. This study also focuses on whether or not therapists create space for discussion about thoughts and behaviour involving sexual abuse of children and adolescents with …
Place And Food: A Relational Analysis Of Personal Food Environments, Meanings Of Place And Diet Quality, Ellen Desjardins
Place And Food: A Relational Analysis Of Personal Food Environments, Meanings Of Place And Diet Quality, Ellen Desjardins
Theses and Dissertations (Comprehensive)
This study investigates the relational layers of meanings that people experience at places in their food environment, and how individuals express a sense of place through their collective interactions with, and understandings of, food places. It also explores the patterns of difference among these meanings of place and sense of place in terms of their potential association with dietary quality. The context of this inquiry was two-fold: first, the need identified by several population health researchers and to re-imagine place as relational and include it in the study of behavioural responses to the changing food environment; and secondly, my interest …

Spatial And Temporal Patterns In Nitrous Oxide Flux From Agricultural Soil In Southern Ontario, Michelle E. Zurbrigg
Spatial And Temporal Patterns In Nitrous Oxide Flux From Agricultural Soil In Southern Ontario, Michelle E. Zurbrigg
Theses and Dissertations (Comprehensive)
This research examines spatial and temporal variations in N2O flux from agricultural clay loam in corn-wheat and corn-oat rotations in southern Ontario. Gas samples are collected by the chamber method following significant precipitation events, thaw events, fertilization events, and otherwise every two weeks over a two-year period. Crop type appears to influence the magnitude of N2O emisions, whereas N2O fluxes do not otherwise seem to vary by landscape position. The seasonal pattern of in situ N2O flux at Strawberry Creek (SC) indicates that the highest N2O emissions are occuring during …
Conjunction Search Onset Following Single-Feature Preview: Equating Visual Transients, Wafa Saoud
Conjunction Search Onset Following Single-Feature Preview: Equating Visual Transients, Wafa Saoud
Theses and Dissertations (Comprehensive)
What happens to visual selection if the features of objects in a scene are viewed incrementally rather than simultaneously? According to Olds et al. (2009), it depends upon which feature is presented first. Olds et al. (2009) used the feature-preview search paradigm to cue conjunction search items by presenting observers with a preview display that contained 1 of 2 features for all of the search items. Prior exposure to some features facilitated subsequent visual selection more than prior exposure to others; overall, size-preview offered the greatest search facilitation, followed by color-preview, and lastly, orientation-preview. Some feature-preview conditions, however, contained luminance …
Spiritual Empowerment Through Buddhist Practice, Adam Mckenzie Hodgins
Spiritual Empowerment Through Buddhist Practice, Adam Mckenzie Hodgins
Theses and Dissertations (Comprehensive)
The Buddhist practice of eight Waterloo, Ontario residents are explored in this study, highlighting the relationship between the reported outcomes of Buddhist practice and individual empowerment. By employing a heuristic research methodology, as described by Moustakas (1994), I use my own experience as a Buddhist practitioner to contribute to the research data and elicit detailed descriptions from the participants. The findings of the interviews reveal four common themes of the participants’ Buddhist practice: 1) increased awareness of unconscious habits; 2) peace from letting go of control; 3) a change in their perspective of self; and 4) enhanced connection with others. …

Computational And Theoretical Aspects Of N-E.C. Graphs, Alexandru Costea
Theses and Dissertations (Comprehensive)
We consider graphs with the n-existentially closed adjacency property. For a positive integer n, a graph is n-existentially closed (or n-e.c.) if for all disjoint sets of vertices A and B with \A∪ B\ = n (one of A or B can be empty), there is a vertex 2 not in A∪B joined to each vertex of A and no vertex of B. Although the n-e.c. property is straightforward to define, it is not obvious from the definition that graphs with the property exist. In 1963, Erdos and Rényi gave …

The intent was to explore the nature of touch, and the protective and risk factors of this alternative care setting, to promote a safe and respectful environment that enhanced protective factors and minimized risk. The author was interested in the scientific research on the value of touch, ethics in relationships with power differences, the prevention of abuse, and the prevalence of respectful expressive/affectionate touch between people with disabilities and their caregivers. The study engaged one L’Arche community in Ontario, Canada, through a …
Attentional Biases In Social Anxiety: An Investigation Of Rumination, Katie L. Walters
Attentional Biases In Social Anxiety: An Investigation Of Rumination, Katie L. Walters
Theses and Dissertations (Comprehensive)
Cognitive models of anxiety posit that socially anxious individuals’ attention is disproportionally biased for threatening information in the environment. One component in the cognitive model of social anxiety that has not been examined, in terms of the attentional bias, is rumination (i.e., the dwelling on perceived inadequacies). The purpose of the present research was to examine the impact that rumination had on attentional biases in social anxiety as measured through the use of a Rapid Serial Visual Presentation (RSVP) stream. When two target stimuli (T1 and T2) are presented amongst distractor stimuli in rapid succession it is hard to process …
Living On Breath And Spirit: Spiritual Intelligence And Spiritual Journey In The Christian Faith Tradition, Maria Zinsstag
Living On Breath And Spirit: Spiritual Intelligence And Spiritual Journey In The Christian Faith Tradition, Maria Zinsstag
Theses and Dissertations (Comprehensive)
In the last decade, one observes an increased interest in applied spirituality that takes into account the fact that spirituality has left the boundaries of religion. Psychologists and neuroscientists postulate a spiritual intelligence. As a scientific concept it adopts an etic perspective on spirituality. It is used in healthcare, management and education. It is interested in spirituality but not in religion. Christian spirituality on the other hand is rooted in a particular religion. Lytta Basset offers guidance for spiritual growth in the Christian faith tradition. Because spiritual growth is very personal, Basset adopts an emic perspective on spiritual experiences. This …
