Employees' Decade: Recent Developments Under The Mhra And The Employers' Potential Rebound, The, Dane C. Martin

Missouri Law Review

This Note will identify the considerable changes and varying interpretations of the MHRA over the last decade, analyze the optimal balance between the competing, important interests, and determine any potential need for amendment, including consideration of the various proposals currently before the legislature. Part 11 thus analyzes the four major areas of difficulty in the adjudication of MHRA claims in the last decade, including jury trials, available damages, the burden of proof, and individual liability. Next, Part III recognizes the most recent developments under the MHRA. And lastly, Part IV involves a two-part discussion beginning with the policy and effect …

Functional And Bioactive Components From Mackerel (Scomber Scombrus) And Blue Whiting (Micromesistius Poutassou) Processing Waste, Zied Khiari Nov 2010

Functional And Bioactive Components From Mackerel (Scomber Scombrus) And Blue Whiting (Micromesistius Poutassou) Processing Waste, Zied Khiari

Doctoral

The use of fish processing waste from an oily fish model (mackerel, Scomber
scombrus) and a white fish model (blue whiting, Micromesistius poutassou) as a source of functional and bioactive compounds was investigated.
Gelatines were extracted from fish heads and skins using pre-treatment with
different organic acids (acetic, citric, lactic, tartaric and malic acids). Gelatines from fish bones were extracted after pre-treating the bones either chemically or enzymatically. The type of pre-treatment affected the yield, colour, turbidity, amino acid profiles as well as functional properties of fish gelatines. Mackerel gelatines formed stronger and more stable gels than blue whiting. Acetic …

Article I, Section 11: A Poor "Plan B" For Washington's Religious Pharmacists, Noel E. Horton Nov 2010

Article I, Section 11: A Poor "Plan B" For Washington's Religious Pharmacists, Noel E. Horton

Washington Law Review

In Stormans, Inc. v. Selecky, a group of Washington pharmacists contended their religious beliefs precluded them from dispensing the drug Plan B, a post-coital emergency contraceptive. They based their argument on rights conferred by the Free Exercise Clause of the First Amendment to the United States Constitution. A United States District Court found in the pharmacists’ favor and enjoined enforcement of rules issued by the Washington State Board of Pharmacy requiring pharmacies to deliver medications. The Ninth Circuit reversed, finding that the district court erroneously applied a heightened level of scrutiny to a neutral law of general applicability. Interestingly, …

Perfect Little Feminists? Young Girls In The Us Interpret Gender, Violence, And Friendship In Cartoons, Spring-Serenity Duvall

Faculty Publications

Girls’ studies has emerged as a dynamic area of scholarship that examines the cultural construction of girlhood, the role that girls play in society, their identity formation, and their representation in media. This paper extends previous research by interviewing young girls about their interactions with each other as they view and interpret animated cartoons. Expanding claims that Girl Power programs such as The Powerpuff Girls empower viewers, I also discuss the role of third wave, commodity, and post feminism in influencing girls’ expectations of gender equality even as they embrace gender role differences. In discussing the importance of researchers engaging …

Moon Rocks And Mediations: Cooperation And Competition In Space Race Diplomacy, Christopher S. Dinkel Nov 2010

Moon Rocks And Mediations: Cooperation And Competition In Space Race Diplomacy, Christopher S. Dinkel

Master's Theses or Doctor of Nursing Practice

While the Space Race is often discussed in terms of international competition and Cold War tension, the fact that both Soviet and American forays into space remained peaceful and scientifically driven throughout the 1950s and 1960s points to a more complicated reality that indicates a significant amount of international cooperation during the Space Race. The International Geophysical Year (IGY), which was a collaborative effort among scientists from around the world, served as a catalyst for beginning the Space Race in the late 1950s, and the importance of scientific cooperation emphasized by the IGY remained central to space exploration throughout the …

Effects Of Flooding On Photosynthesis And Root Respiration In Saltcedar (Tamarix Ramosissima), An Invasive Riparian Shrub, Kristen Polacik Nov 2010

Effects Of Flooding On Photosynthesis And Root Respiration In Saltcedar (Tamarix Ramosissima), An Invasive Riparian Shrub, Kristen Polacik

Master's Theses or Doctor of Nursing Practice

The introduced shrub Tamarix ramosissima Lebed. invades riparian zones, but loses competitiveness under flooding. This was tested in Tamarix ramosissima by examining responses to flooding by soil type in a greenhouse setting. A field study examined responses of Tamarix ramosissima and other species to natural flooding. Leaf level photosynthesis rates, stomatal conductance, transpiration, and root alcohol dehydrogenase (ADH) activity were measured weekly to assess oxygen stress. In the field, stomatal conductance, leaf water potential, transpiration, canopy cover, and δ13C were measured as responses to soil water potential, soil moisture, Julian date, relative humidity, and water depth. In the greenhouse study, …

The United States And The Overthrow Of Kwame Nkrumah, Eric Quaidoo Nov 2010

The United States And The Overthrow Of Kwame Nkrumah, Eric Quaidoo

Master's Theses or Doctor of Nursing Practice

February 24, 1966 is regarded by many Ghanaians as the Waterloo in the history of Ghana, and Ghanaians would not like it to be mentioned so as to rekindle old wounds considering the hardships the country went through from that period until accepting democratic rule in the early 1990s. On that fateful day the first Republic of Ghana was overthrown in a military coup d’état when the first President, Dr. Kwame Nkrumah, was on a peacemaking mission in Vietnam. Most Ghanaians and Africans continue to point accusing fingers at the United States for this unfortunate incident that brought not only …

Note – Invalidating Gene Patents: Association For Molecular Pathology V. U.S. Patent & Trademark Office, Ashley Mchugh Nov 2010

Note – Invalidating Gene Patents: Association For Molecular Pathology V. U.S. Patent & Trademark Office, Ashley Mchugh

UC Law Journal

Biotechnology companies and research institutions have patented thousands of genes based on the idea that a gene in an isolated and purified form is a patentable invention. The biotechnology industry has since grown to a multibillion dollar industry using gene patents as a basis for targeting new drugs, researching genetic disease, and developing diagnostics. One company, Myriad Genetics, faces the threat of having their patents invalidated because of their monopolistic use of their patents on human breast cancer genes. In Association for Molecular Pathology v. U.S. Patent & Trademark Office, the district court found Myriad’s gene patents invalid and unenforceable. …

Match–Mismatch Regulation For Bluegill And Yellow Perch Larvae And Their Prey In Sandhill Lakes, Jeffrey C. Jolley, David W. Willis, Richard S. Holland Nov 2010

Match–Mismatch Regulation For Bluegill And Yellow Perch Larvae And Their Prey In Sandhill Lakes, Jeffrey C. Jolley, David W. Willis, Richard S. Holland

Nebraska Game and Parks Commission: Staff Research Publications

Food availability may regulate fish recruitment, both directly and indirectly. The availability of zooplankton, especially to newly hatched larvae, is thought to be crucial to their early growth and survival. We examined stomach contents of larval bluegill Lepomis macrochirus and yellow perch Perca flavescens in Pelican Lake and Cameron Lake, Nebraska, in 2004 and 2005. We also determined zooplankton availability and calculated prey selection using Chesson’s a. In addition, we investigated potential match–mismatch regulation of recruitment from 2004 to 2008. Bluegill positively selected copepod nauplii and Bosmina spp., and yellow perch often selected copepods. Abundant zooplankton populations were available for …

Octomom And Multi-Fetal Pregnancies: Why Federal Legislation Should Require Insurers To Cover In Vitro Fertilization, Camille M. Davidson Nov 2010

Octomom And Multi-Fetal Pregnancies: Why Federal Legislation Should Require Insurers To Cover In Vitro Fertilization, Camille M. Davidson

William & Mary Journal of Race, Gender, and Social Justice

This article examines the public health, legal, and policy implications of multi-fetal pregnancies resulting from in vitro fertilization (IVF), using the 2009 “Octomom” case as a catalyst for discussion. Camille M. Davidson argues that the high rate of multi-fetal pregnancies in the United States is a direct consequence of the unregulated fertility industry, the financial burden of IVF on patients, and the incentive structures created by the Fertility Clinic Success Rate and Certification Act. She contends that lack of mandated insurance coverage compels patients and physicians to transfer multiple embryos per cycle to maximize pregnancy chances, increasing the risks of …

The Challenges Of Understanding Animal Minds, Jeffrey R. Stevens Nov 2010

The Challenges Of Understanding Animal Minds, Jeffrey R. Stevens

Department of Psychology: Faculty Publications

Comparative psychology is by nature an interdisciplinary science that lies at the crossroads of psychology and biology but also draws from other fields in the natural, social, and cognitive sciences. The study of the psychology of animals has been labeled animal cognition, comparative cognition, animal learning, animal psychology, and animal intelligence. Here, comparative psychology is used interchangeably with these terms, encompassing all fields that explore the psychological mechanisms underlying animal behavior, including human behavior.

The primary goal of comparative psychology is to understand the cognitive, emotional, and motivational processes of the animal mind. How do other animals perceive, learn about, …

Learning Computational Thinking From Rapid Digital Game Creation, Praveen Kuruvada, Daniel Asamoah, Nikunj Dalal, Subhash Kak

Management Information Systems Faculty Publications

Computational Thinking (CT) has been described as a universally applicable ability such as reading and writing. In this paper, we describe an innovative pedagogy using Rapid Digital Game Creation (RDGC) for learning CT skills. RDGC involves the rapid building of digital games with high-level software that requires little or no programming knowledge. We analyze how RDGC supports various CT concepts and how it may be mapped to equivalent Java concepts by building the same game using both RDGC and Java. We discuss the potential benefits of this approach for attracting computing majors, as a precursor to learning formal programming languages, …

Parental Investment Decisions In Response To Ambient Nest-Predation Risk Versus Actual Predation On The Prior Nest, Anna D. Chalfoun, Thomas E. Martin Nov 2010

Parental Investment Decisions In Response To Ambient Nest-Predation Risk Versus Actual Predation On The Prior Nest, Anna D. Chalfoun, Thomas E. Martin

Wildlife Biology Faculty Publications

Theory predicts that parents should invest less in dependent offspring with lower reproductive value, such as those with a high risk of predation. Moreover, high predation risk can favor reduced parental activity when such activity attracts nest predators. Yet, the ability of parents to assess ambient nest-predation risk and respond adaptively remains unclear, especially where nest-predator assemblages are diverse and potentially difficult to assess. We tested whether variation in parental investment by a multi-brooded songbird (Brewer's Sparrow, Spizella breweri) in an environment (sagebrush steppe) with diverse predators was predicted by ambient nest-predation risk or direct experience with nest predation. Variation …

The Illusory Right To Abandon, Eduardo M. Peñalver Nov 2010

The Illusory Right To Abandon, Eduardo M. Peñalver

Cornell Law Faculty Publications

The unilateral and unqualified nature of the right to abandon (at least as it is usually described) appears to make it a robust example of the law’s concern to safeguard the individual autonomy interests that many contemporary commentators have identified as lying at the heart of the concept of private ownership. The doctrine supposedly empowers owners of chattels freely and unilaterally to abandon them by manifesting the clear intent to do so, typically by renouncing possession of the object in a way that communicates the intent to forgo any future claim to it. A complication immediately arises, however, due to …

A New Carnosaur (Dinosauria: Theropoda) From The Upper Morrison Formation (Late Jurassic, Tithonian) Of Colorado, Sebastian Dalman Nov 2010

A New Carnosaur (Dinosauria: Theropoda) From The Upper Morrison Formation (Late Jurassic, Tithonian) Of Colorado, Sebastian Dalman

Master's Theses or Doctor of Nursing Practice

A disarticulated skeleton of a theropod from the Late Jurassic (Tithonian) strata of McElmo Canyon in Montezuma County, Colorado was discovered in 1953 by the late J. T. Gregory and D. Techter. For nearly 55 years the specimen remained unnoticed in the collection of the Yale Peabody Museum of Natural History in New Haven, Connecticut. Several cranial and postcranial elements are relatively well preserved and include the premaxilla, maxilla, dentary, teeth, quadratojugal, braincase, metacarpals, partial pubis and ischium, astragalus, partial tibia and fibula, metatarsals, pedal phalanges, and several partially preserved ribs. The specimen represents a new genus and species of …

Genetic Analysis Of Vancomycin-Resistant Gram-Positive Cocci Isolated From Wild Songbirds, Shingo Ishihara Nov 2010

Genetic Analysis Of Vancomycin-Resistant Gram-Positive Cocci Isolated From Wild Songbirds, Shingo Ishihara

Master's Theses or Doctor of Nursing Practice

The antibiotic vancomycin was developed by Eli Lilly in the 1950s in response to the growing number of Staphylococcus aureus infections that were resistant to penicillin. Vancomycin was not widely used at the time because of its high toxicity. However, use of vancomycin in the United States has increased dramatically since the 1980s because of the emergence of methicillin resistant Staphylococcus aureus (MRSA) and Enterococcus species. There are three known mechanisms for vancomycin resistance: 1) target site modification by van genes, 2) biofilm formation, and 3) bacterial cell wall thickening. Of these mechanisms, target site modification is the most common. …

Development Of An Enzyme-Linked Immunosorbent Assay (Elisa) For The Detection Of Pistachio Residues In Processed Foods, Pei Wen Lim

Department of Food Science and Technology: Dissertations, Theses, and Student Research

Pistachios (Pistacia vera) are popular snacks and consumption of pistachios is notably increasing due to their usage as ingredients for confections, ice cream, and baked goods. The increased consumption of pistachios may lead to a higher frequency of allergic sensitization and an increased prevalence of allergic reactions to pistachios. Trace amounts of undeclared pistachio allergens can pose serious health risks for food-allergic consumers, including severe anaphylactic reactions. A highly sensitive analytical method, sandwich-type enzyme-linked immunosorbent assay (ELISA) is applied as a critical tool for food manufacturers and food scientists to detect minute amounts of allergenic food residues in …

Multi-Scale Perspectives On Paddlefish Populations: Implications For Species Conservation And Management, Brenda M. Pracheil Nov 2010

Multi-Scale Perspectives On Paddlefish Populations: Implications For Species Conservation And Management, Brenda M. Pracheil

School of Natural Resources: Dissertations, Theses, and Student Research

The Order of fishes containing paddlefish and sturgeon has been named the most endangered group of organisms on the planet by the International Union of Conservation of Nature (IUCN). Population trajectories of paddlefish, whose native range is entirely encompassed within the United States of America, are currently unknown, although the IUCN has considered them to have a high extinction risk in the wild. The declaration of the vulnerability of paddlefish to extinction, coupled with the global plight of other sturgeon species create urgency to establish population and species-level population trajectories. Moreover, this declaration creates a great need for swift management …
