Crossroads And Signposts: The Ada Amendments Act Of 2008, Jeannette Cox

Although the apparent purpose of the 2008 amendments to the Americans with Disabilities Act (ADA) is solely to broaden the ADA 's protected class, the manner in which the amendments achieve this purpose erodes the statute's explicit textual support for understanding persons with disabilities as a politically subordinated minority. The amendments also strengthen the statutory link between the biological severity of a person's disability and that person's right to sue for ADA accommodations. Accordingly, for some courts, the amendments will reinforce the perception that the ADA differs from traditional civil rights law.

This Article describes FRCP Rule 8’s origin and explains its intended application; chronicles Rule 8’s history of restriction and misapplication, and the Supreme Court’s contribution to ensuring Rule 8’s treatment in a manner consistent with its drafters’ intentions; then examines Twombly, focusing on the Court’s consideration, expression, and application of Rule 8’s pleading standard in more modern circumstances; and explains how the Twombly Court reaffirmed the intentions of Rule 8’s drafters and re-expressed Rule 8’s liberal pleading requirements

For generations, Western society has taken pride in welcoming all types of discourse in the press, radio, or television; the livelier, the better. Outrage often awaits individuals or institutions suggesting that some passionate rhetoric in the public square invites danger that outweighs the theoretical value of free expression. This Article proceeds from the assumption that—from a less lofty, more grassroots perspective—modern, organized, formal, one-time venues for extremist political speech do not present the most potent threat to physical safety and a stable democracy. This research focused on the to modification of the surface structure of titanium implants with nanostructured morphology of TiO2 nanotubes and studied the interaction of nanotubes with osteoblast cells to understand the parameters that affect the cell growth. The electrical, mechanical, and structural properties of TiO2 nanotubes were characterized to establish a better understanding on the properties of such nanoscale morphological structures.

It will surprise many Americans to learn that before John Brown and his men briefly captured Harper’s Ferry, they authored and ratified a Provisional Constitution. This deliberative act built upon the achievements of the group to establish a Free Kansas, during which time Brown penned an analogue to the Declaration of Independence. These acts of writing, coupled with Brown’s trial tactics after his arrest, cast doubts on claims that the man was a lunatic or on a suicide mission. In April 2010 the International Finance Corporation announced the creation of the African, Latin American, and Caribbean fund, a new co-investment vehicle funded largely with commitments from sovereign wealth and pension funds. The fund's objective was to draw on the IFC and the World Bank's strengths in emerging markets to identify and support enterprises that might not otherwise have come to the attention of large investors and thereby help strengthen the private sector and alleviate poverty in some of the world's poorest countries. Gene therapy approaches delivering fibroblast growth factor-2 (FGF-2) have shown promise as a potential treatment for increasing blood flow to ischemic limbs. Currently, effective noninvasive techniques to deliver plasmids encoding genes of therapeutic interest, such as FGF-2, are limited. We sought to determine if intradermal injection of plasmid DNA encoding FGF-2 (pFGF) followed by noninvasive cutaneous electroporation (pFGFE+) could increase blood flow and angiogenesis in a rat model of hindlimb ischemia. pFGFE+ or control treatments were administered on postoperative day 0. Compared to injection of pFGF alone (pFGFE-), delivery of pFGFE+ significantly increased FGF-2 expression for 10 days. Further, the …

Tourette Syndrome (TS) is a neurodevelopmental disorder consisting of multiple involuntary motor tics and one or more vocal tics. The duration of the disorder is at least one year and not more than three consecutive tic-free months (APA, 2000). The tics associated with TS are frequently more severe than other tic disorders on the spectrum. There are varying degrees of severity of TS disorder, requiring maximum to no treatment. Addressing Negative Effects Of Psychotherapy During The Informed Consent Process : The Licensed Psychologists' Perspectives , Neshe Sarkozy

PCOM Psychology Dissertations

This survey study investigated attitudes and practices of 161 licensed psychologists from a nationwide sample, relative to addressing negative effects of psychotherapy during the informed consent process. Results revealed discrepancies in attitudes toward risk of negative treatment effects in psychotherapy and in addressing risk during the process of informed consent. Information obtained from this study may contribute to research in the area of clinical implementation of the American Psychological Association’s Code of Ethics. Implications for clinical practice are discussed. Limitations of the study and directions for future research are also addressed.

Animal migrations are as familiar as geese in the sky on a fall afternoon and as mysterious as the peregrinations of sea turtles across thousands of miles of open ocean. This article discusses the distinguishing attributes of animal migrations, why they are important to biodiversity conservation, and the legal challenges posed by migration conservation. In particular, the article focuses on those aspects of migration conservation that existing law, dominated by imperiled species protection, fails to address. It consequently suggests law reforms that would better conserve animal migrations. A step toward serious legal efforts to protect the process and function of …
