Reduced Hours, Full Success: Part-Time Partners In U.S. Law Firms, Cynthia Thomas Calvert, Linda Bray Chanow, Linda Marks Jan 2010

Reduced Hours, Full Success: Part-Time Partners In U.S. Law Firms, Cynthia Thomas Calvert, Linda Bray Chanow, Linda Marks

UC Law SF Journal on Gender and Justice

When the Project for Attorney Retention ("PAR") was founded a decade ago, part-time partners were rare. Most associates who reduced their hours were taken off the partnership track either expressly or de facto; regardless of what the policy said, in most firms no part-time associate had ever been elevated to partner. Recognizing reduced hours work could not be a real option as long as it was a career ender, PAR developed a best practice balanced-hours policy, which helps eliminate the stigma associated with part-time and keeps those associates who work reduced hours developing professionally toward partnership. As the number of …

The Nature Of The Refutation Text Effect: An Investigation Of Attention Allocation, Suzanne H. Broughton, G.M. Sinatra, R.E. Reynolds Jan 2010

The Nature Of The Refutation Text Effect: An Investigation Of Attention Allocation, Suzanne H. Broughton, G.M. Sinatra, R.E. Reynolds

Teacher Education and Leadership Faculty Publications

Students often hold misconceptions that conflict with scientific explanations. Research has shown that refutation texts are effective for facilitating conceptual change in these cases (Guzzetti, Snyder, Glass, & Gamas, 1993). The process through which refutation texts have their effect is not clear. The authors replicated and extended previous research investigating cognitive processes involved in the refutation text effect. Undergraduates read either a refutation or an expository text on seasonal change. Individual reading times were recorded. Participants’ conceptions were measured at pretest, posttest, and delayed posttest. Results showed that readers spent less time reading the refutation paragraph compared to the expository …

The Occurrence Of Chestnut Lamprey (Lchthyomyzon Castaneus; Pisces: Petromyzontidae) In The Chariton River In South-Central Iowa, Mark K. Flammang, John R. Olson Jan 2010

The Occurrence Of Chestnut Lamprey (Lchthyomyzon Castaneus; Pisces: Petromyzontidae) In The Chariton River In South-Central Iowa, Mark K. Flammang, John R. Olson

Journal of the Iowa Academy of Science: JIAS

In the mid-1990s, Iowa Department of Natural Resources (IDNR) Fisheries Bureau biologists began receiving reports from anglers of a parasitic lamprey attached to fish taken immediately downstream from Rathbun Lake on the Chariton River in south-central Iowa; these reports have continued to present. In 2002, the IDNR received and identified a chestnut lamprey (Ichthyomyzon castaneus Girard) from an angler who removed the lamprey from a common carp (Cyprinus carpio Linnaeus) he captured. This record was the first for a lamprey from the Chariton River drainage in Iowa. Five additional specimens of chestnut lamprey have been collected and identified …

Evasive Writing: Resistance To The Government And Modernization Hidden In Taiwanese Fiction, Harrison Paul Jan 2010

Evasive Writing: Resistance To The Government And Modernization Hidden In Taiwanese Fiction, Harrison Paul

BYU Asian Studies Student Journal

Sometimes, it is best not to speak the truth—at least not directly. Under an authoritarian regime, the truth—whether of events or opinions—often hurts the one who reveals it more than anyone else. For this reason, writers throughout the world have long employed evasive writing tactics not only to avoid censorship of their ideas but also to escape imprisonment or execution at the government’s hand. Taiwanese writers under the period of Nationalist-imposed martial law were no different. Nativist writers, characterized by “use of the Taiwanese dialect, depiction of the plight of country folks or small-town dwellers in economic difficulty, and resistance …

Locating Fault Using Voltage Sags Profile For Underground Distribution System, Hazlie Mokhlis, H.Y. Li, A.H.A. Bakar, H. Mohamad Jan 2010

Locating Fault Using Voltage Sags Profile For Underground Distribution System, Hazlie Mokhlis, H.Y. Li, A.H.A. Bakar, H. Mohamad

Research Publications (2006 to 2010)

This paper presents an alternative fault location algorithm to estimate short-circuit faults location in electrical distribution networks using only voltage sags data. The proposed algorithm uses voltage sags profile as a means to locate fault. The possible fault locations is estimated by incorporating the measured voltage sags magnitude and its corresponding phase angle into an equation of voltage sag as a function of fault distance. A ranking procedure is also introduced to rank possible fault locations due the same electrical distance. The uncertainty of fault resistance is also considered in this algorithm. The performance of the technique is presented by …

The New Digital Dating Behavior - Sexting: Teens' Explicit Love Letters: Criminal Justice Or Civil Liability, Terri Day Jan 2010

The New Digital Dating Behavior - Sexting: Teens' Explicit Love Letters: Criminal Justice Or Civil Liability, Terri Day

UC Law SF Communications and Entertainment Journal

This paper proposes a unique response to the explosive combination of teens, sex and technology. It discusses why most teen sexting does not meet the Ferber definition of child pornography; therefore, a civil remedy for the dignitary and emotional harm caused by the public dissemination of private sexual pictures is far superior to imposing criminal sanctions. The proposed statutory civil cause of action would hold parents vicariously liable for the harms caused by their children's sexting when done with actual malice. Recognizing that common law tort liability is legally unsustainable, this approach strikes a balance between protecting First Amendment rights …

Estrus Synchronization And Periconceptual Supplementation Affect The Profitability Of A Replacement Heifer Enterprise, D. M. Larson, R. D. Richardson, K. H. Ramsay, R. N. Funston Jan 2010

Estrus Synchronization And Periconceptual Supplementation Affect The Profitability Of A Replacement Heifer Enterprise, D. M. Larson, R. D. Richardson, K. H. Ramsay, R. N. Funston

West Central Research and Extension Center, North Platte

Experiments evaluated estrus synchronization and periconceptual supplementation on pregnancy rate and calf production. Approximately one-half of heifers in 2 pastures (yr 1) or 4 pastures (yr 2) were injected with prostaglandin F2α (PGF; n = 1,182) or not (NPGF; n = 1,208) 5 d after fertile bulls were introduced for 25 d. In yr 2, a total of 1,230 heifers were randomly assigned to 1 of 4 pastures; 2 received a supplement providing 100 g/d of Ca propionate (1.4 kg/d, 20% CP) 2 d before through 19 d after bull exposure and 2 did not in a 25-d breeding …

Pollen Interception By Linyphiid Spiders In A Corn Agroecosystem: Implications For Dietary Diversification And Risk-Assessment, Julie A. Peterson, Susan Romero, James D. Harwood Jan 2010

Pollen Interception By Linyphiid Spiders In A Corn Agroecosystem: Implications For Dietary Diversification And Risk-Assessment, Julie A. Peterson, Susan Romero, James D. Harwood

West Central Research and Extension Center, North Platte

Dietary diversification, including consumption of plant tissues such as pollen, can enhance the fecundity of generalist predators, resulting in improved control of pest prey. Supplemental pollen feeding has been observed in many natural enemies, including sheet-web spiders (Araneae: Linyphiidae), which represent a major component of food webs in agroecosystems. Their horizontal, ground-based webs have the potential to intercept pollen grains during anthesis of crop plants, providing the opportunity for consumption of pollen to occur. In laboratory feeding trials, Frontinella communis and Tennesseellum formicum (Araneae: Linyphiidae) readily fed on pollen grains dusted on their webs, with 82 and 92% of spiders …

Beyond The Schoolhouse Gates And Into The Virtual Playground: Moderating Student Cyberbullying And Cyberharassment After Morse V. Frederick, Jessica Moy

UC Law Constitutional Quarterly

Student blogs, social-networking sites, YouTube, and the Internet blur the line between high school students' public and private selves. Amid a world of rapid technological development and cloaked in the anonymity of cyberspace, cyberbullies are emboldened to utilize particularly cruel, and often psychologically damaging, tactics to victimize their peers. This Note examines the way in which the Supreme Court's decision in Morse v. Frederick has affected and changed the way lower courts evaluate the reach of school disciplinary authority in student Internet-posting cases and how the concept of what constitutes "on-campus" and "off-campus" activities has evolved over time. In light …

Obscenity On The Internet: Nationalizing The Standard To Protect Individual Rights, Sarah Kagan Jan 2010

Obscenity On The Internet: Nationalizing The Standard To Protect Individual Rights, Sarah Kagan

UC Law Constitutional Quarterly

This note was written in response to the Ninth Circuit Court of Appeals' 2009 decision in United States v. Kilbride. The Court's opinion called for the application of a "national obscenity standard" when evaluating speech transmitted online or through e-mail. This note seeks to address some of the practical issues raised by a national standard, including identifying the relevant national community, the need for empirical research on community standards for obscenity, implications for free speech under a national standard and mechanisms to ensure consistent application of a national standard in a diverse country.

Dangerous Terrain: Mapping The Female Body In Gonzales V. Carhart, B. Jessie Hill Jan 2010

Dangerous Terrain: Mapping The Female Body In Gonzales V. Carhart, B. Jessie Hill

Faculty Publications

The body occupies an ambiguous position within the law. It is, in one sense, the quintessential object of state regulatory and police power, the object that the state acts both upon and for. At the same time, the body is often constructed in legal discourse as the site of personhood - our most intimate, sacred, and inviolate possession. The inherent tension between these two concepts of the body permeates the law, but it is perhaps nowhere more prominent than in the constitutional doctrine pertaining to abortion. Abortion is one of the most heavily regulated medical procedures in the United States, …

The Essential Unity Of Shareholders And The Myth Of Investor Short-Termism, George W. Dent Jan 2010

The Essential Unity Of Shareholders And The Myth Of Investor Short-Termism, George W. Dent

Faculty Publications

The separation of ownership and control publicized by Berle and Means in 1932 persists today. Domination of public companies by self-serving and ineffective executives costs America billions of dollars every year and contributed to the current economic meltdown. Repeated efforts to solve this problem--including the Sarbanes-Oxley Act, expanded disclosure duties, and more stringent requirements for director independence--have had little benefit and have sometimes made matters worse. The flaws in our corporate governance system are a growing problem for America’s economy as disillusioned investors increasingly place their capital in other countries.

Nonetheless, proposals for greater shareholder power have encountered criticisms: various …

Consciousness And Society: Societal Aspects And Implications Of Transpersonal Psychology, Harry T. Hunt Jan 2010

Consciousness And Society: Societal Aspects And Implications Of Transpersonal Psychology, Harry T. Hunt

International Journal of Transpersonal Studies

Although transpersonal psychologies of self realization emphasize individual

development, earlier shamanic traditions also showed a central societal aspect and group based

consciousness. Indeed, many have understood the transpersonal movement as developing

towards an abstract globalized neo-shamanism. That altered states of consciousness, whether

as integrative realizations of the numinous or as dissociative “hypnoid” states, could be felt

and shared collectively was a familiar concept to the first generation of sociologists, who saw

all consciousness as social and dialogic in form. Durkheim, in particular, foresaw a globalized

spirituality of the future, his “cult of man,” in which modern individuation would progress

to …

Ambivalent Posthumanism: A Few Of Stevens’ Animals, Brian Glaser Jan 2010

Ambivalent Posthumanism: A Few Of Stevens’ Animals, Brian Glaser

English Faculty Articles and Research

This essay focuses on several categories of Wallace Stevens' use of animals in his poetry that is arguably posthumanist. It argues on the emotional ambivalence made by "Mountains Covered with Cats" which points out that animals are also living entities to experience and know with a mixture of positive and negative emotions. It cites Sigmund Freud's concept of ambivalence where he transcribe and reflect on the most well-known dream of a predatory animal in the modernist milieu.
