The 60th Anniversary Of The Prc: A Retrospective On The Chinese Legal System – Introduction, Benjamin L. Liebman
The 60th Anniversary Of The Prc: A Retrospective On The Chinese Legal System – Introduction, Benjamin L. Liebman
Faculty Scholarship
Since its establishment in 1987, the Columbia Journal of Chinese Law and its successor, the Columbia Journal of Asian Law, have played an important role in publishing English language scholarship about the law of China and Asia. An important part of this mission has been the publication of scholarship not only by scholars in the United States and Europe, but also by scholars from China and elsewhere in Asia. I am delighted that this special edition of the Journal, marking the sixtieth anniversary of the establishment of the People's Republic of China and thirty years of legal reforms in China, …
Religious Law Schools: Tension Between Conscience And Academic Freedom, Kent Greenawalt
Religious Law Schools: Tension Between Conscience And Academic Freedom, Kent Greenawalt
Faculty Scholarship
My comments this afternoon are responsive to John Garvey’s Presidential
Address on Institutional Pluralism at last year’s meeting. The gist of his
address, delivered gracefully, undogmatically, and persuasively, is that it may
be desirable to have law schools that are devoted substantially to particular
endeavors and points of view. Dean Garvey mentioned law schools that
concentrate on teaching particular subjects, such as law and economics, or
training for geographical areas, such as northern New York, or preparing
for forms of practice, such as clinical work, or helping a particular group of
potential lawyers, such as African‑Americans, or reflecting a special …
The Cultural Defense: Reflections In Light Of The Model Penal Code And The Religious Freedom Restoration Act, Kent Greenawalt
The Cultural Defense: Reflections In Light Of The Model Penal Code And The Religious Freedom Restoration Act, Kent Greenawalt
Faculty Scholarship
I wrote this essay after participating in a 2006 workshop on Criminal Law and Cultural Diversity, which discussed, among other subjects, the wisdom of providing a "cultural defense." Uncertain just how far such a defense might expand on defenses already available, I undertook to explore that topic.
The phrase "a cultural defense" suggests an either/or choice that any legal system might make. That matters are much more complex than this is part of the burden of this essay. A "cultural defense" in its most general sense refers to a wide range of ways in which evidence about a defendant's cultural …
Tax Policy Challenges, Michael J. Graetz
Tax Policy Challenges, Michael J. Graetz
Faculty Scholarship
In 1995, when the late, great Jack Nolan asked me to deliver the inaugural lecture in honor of Larry Woodworth, I was both honored and flattered. I had come to know Larry Woodworth beginning in 1969, when I was a rookie treasury tax policy staffer. At that time, he had already served the Joint Committee on Taxation for 25 years and had been the third Chief of Staff in its history beginning as chief of staff in 1964. Larry Woodworth was not only as knowledgeable about the tax law as anyone you would ever hope to meet, and as savvy …
Experience And Consciousness: Enhancing The Notion Of Musical Understanding, Adriana Renero
Experience And Consciousness: Enhancing The Notion Of Musical Understanding, Adriana Renero
Publications and Research
Abstract:
Disagreeing with Jerrold Levinson’s claim that being conscious of broad span musical form is not essential to understanding music, I will argue that our awareness of musical architecture is significant to achieve comprehension. I will show that the experiential model is not incompatible with the analytic model. My main goal is to show that these two models can be reconciled through the identification of a broader notion of understanding. After accomplishing this reconciliation by means of my new conception, I will close the paper by discussing some reasons to accept an enhancing notion of musical understanding that includes levels …
Imaginative Instruction: What Master Storytellers Can Teach Instructional Designers, Jason K. Mcdonald
Imaginative Instruction: What Master Storytellers Can Teach Instructional Designers, Jason K. Mcdonald
Faculty Publications
Good instructional storytelling engages students’ attention and cognitive abilities to the end of more effective learning, and instructional researchers have discussed whether the principles of storytelling could lead to the same or similar results if applied to educational situations beyond only telling traditional stories. But despite this potential, the principles of storytelling are seemingly underutilized by today’s instructional designers. This study investigates what instructional designers might learn from another design field that is more experienced in the art of storytelling, specifically that of film production. Eight filmmakers who have successfully produced films that motivate, inspire, and educate were interviewed to …
Intra-Speaker Variability In Palatometric Measures Of Consonant Articulation, Christopher Dromey, Marybeth Sanders
Intra-Speaker Variability In Palatometric Measures Of Consonant Articulation, Christopher Dromey, Marybeth Sanders
Faculty Publications
Electropalatometry is a useful clinical and research tool for measuring linguapalatal contact. The goal of this study was to examine intra-speaker variability in performance. Twenty individuals spoke VCV nonsense words using a schwa in the initial position, the 15 palatal consonants, and three corner vowels, /ɑ/, /i/, /u/. A variability index was created to examine speaker consistency.
Different aspects of articulation (i.e. place, manner, voicing, coarticulation) were compared. Significant differences for variability were found for place of articulation in the /i/ vowel context and for manner of articulation in the /ɑ/ vowel context. Also for the /ɑ/ vowel, significant differences …

The Rule Of Law And The Exemption Strategy, Kent Greenawalt
The Rule Of Law And The Exemption Strategy, Kent Greenawalt
Faculty Scholarship
Do exemptions from ordinary legal requirements for religious individuals and groups contravene the rule of law? If they do only sometimes, rather than always or never, under what circumstances do they do so? This Article explores these intriguing questions, raised powerfully by Marci Hamilton's important and challenging book God vs. the Gavel.
I offer some general observations about the concept of the rule of law, sketch problems posed by religious exemptions, survey various accepted features of our legal order that may seem similarly in tension with the rule of law, and consider in detail the significance of certain kinds of …
Intervention To Stop Genocide And Mass Atrocities: International Norms And U.S. Policy, Matthew C. Waxman
Intervention To Stop Genocide And Mass Atrocities: International Norms And U.S. Policy, Matthew C. Waxman
Faculty Scholarship
The collective international failure to stop genocidal violence and resulting humanitarian catastrophe in Sudan prompts the familiar question of whether the United States or, more broadly, the international community has the political will and capabilities necessary to deter or stop mass atrocities. It is well understood that mobilizing domestic and international political support as well as leveraging diplomatic, economic, and maybe even military tools are necessary to stop mass atrocities, though they may not always be enough. Other studies have focused, therefore, on what steps the United States and its international partners could take to build capabilities of the sort …

A Semester Of Global Health & Human Diversity Among United States Veterans In Rural Utah, Kent D. Blad, Janelle Jackson, Petr Ruda, Angelynn Singley, Paula; Ulberg, Ron S.; Speirs, Ron S. Ulberg
Faculty Publications
Patients and health care providers in rural communities face a unique combination of factors which create disparities in healthcare when compared with urban areas, such as economic factors, cultural values, reduced rates of formal education, lack of recognition by legislators, and isolation. There are more veterans per capita in rural than in urban areas. Health care for the rural population is coupled with the unique challenges of caring for veterans. Because of this, we chose to devote a semester to the study of improving health care to the rural veteran population.

As nursing students, we specifically chose to devote our time to learning how to better care for the veteran population. We worked with veterans as we traveled to Washington, D.C. and completed clinical experiences in Utah. These experiences greatly altered our perspective toward the armed forces and our appreciation for our nation’s freedom.
Corruption And Development: The Armenian Case, Phillip J. Bryson, Sevak Tsaturyan
Corruption And Development: The Armenian Case, Phillip J. Bryson, Sevak Tsaturyan
Faculty Publications
To determine the relationship between corruption and economic growth variables, we undertake a general analysis of those relationships for 39 countries over an eleven year period. Since the data on corruption specific to Armenia are insufficient for an econometric analysis, we undertake a case study of that country to illuminate the relationships determined by the empirical analysis. We find corruption to be a hindrance for overall economic performance, since there is a strong negative correlation between corruption indices and real per capita GDP. Regressing real Foreign Direct Investment on corruption, however, we found no strong relationship between the two. Nor …

Optimization Of A Convective Air Flow Solar Food Dryer, Jonathan K. Russon, Michael L. Dunn, Frost M. Steele
Faculty Publications
A solar food dryer, previously developed for personal and small community use, was the object of this optimization study. Based on previous research of convective solar food dehydrators, several dryer parameters were identified for this study. Chimney height and dryer product load were two factors tested in a central composite experimental design. Dryer product load was found to produce a maximum efficiency of the dryer when fifteen product-filled trays were inserted in the dryer. Maximum efficiency was observed at the maximum chimney height tested. Post-optimization configuration compared with pre-optimization configuration resulted in a 40% increase in final dry product production …
Happy Families? Translating Positive Psychology Into Family Law, Clare Huntington
Happy Families? Translating Positive Psychology Into Family Law, Clare Huntington
Faculty Scholarship
Despite the well-documented finding in the field of positive psychology that close interpersonal relationships are significantly correlated with subjective well-being and thriving communities, scholars have yet to bring together positive psychology and family law. And what is family law if not the law of close interpersonal relationships? Positive psychology and related work have the potential to inform the what, the why, and the how of family law, but realizing the potential of positive psychology as a guide for family law involves challenges. In particular, it requires translating the descriptive science of psychology into the prescriptive policies of family law. This …
Constitutional Limits On Punitive Damages Awards: An Analysis Of Supreme Court Precedent, Dorothy S. Lund
Constitutional Limits On Punitive Damages Awards: An Analysis Of Supreme Court Precedent, Dorothy S. Lund
Faculty Scholarship
Over the last fifteen years, the Supreme Court has formulated new constitutional principles to constrain punitive damages awards imposed by state courts, invoking its authority under the Due Process Clause of the Fourteenth Amendment. This intervention has been controversial from the start, generating dissents from several Justices asserting that the actions of the Court are unwarranted and amount to unjustified judicial activism. Over the ensuing years lower courts and commentators have criticized the Court’s prescription of procedural and substantive limitations, finding them to be vague and unnecessarily restrictive of state common law prerogatives. Some observers with an economic orientation have …
A Comparative Look At Domestic Enforcement Of International Tribunal Judgments, Lori Fisler Damrosch
A Comparative Look At Domestic Enforcement Of International Tribunal Judgments, Lori Fisler Damrosch
Faculty Scholarship
Problems of compliance with international arbitral and judicial decisions have been with us for as long as such tribunals have existed. In general, the consensual foundations for the jurisdiction of international tribunals have ensured that the parties were in principle willing to have their disputes resolved by the tribunal and thus were usually prepared to carry out the resulting award or judgment. Commentators on international arbitration generally characterize the compliance record as favorable.
Occasions when states refuse to carry out arbitral awards are rare, but when they do occur, states have sometimes asserted the nullity of the award on the …

Natural Disorder: The Animal Image In French And British Art Before Darwin, C. 1790-1859, Noelle Paulson
All Theses and Dissertations (ETDs)
This study of the animal form in French and British art reveals humanity's shifting self-image as new theories of species transmutation replaced hierarchical models of nature in the half-century before the publication of Charles Darwin's On the Origin of Species in 1859. To assert various qualities of difference, distance, similitude, and proximity between species, visual artists represented animals either in humanized guises or in contexts of encounter with humans. Animal imagery was especially malleable during this period when science and pseudo-science both confronted the possibility that species were susceptible to gradual change over time rather than fixed in form since …

Batf Regulates Previously Unknown Ap-1 Target Genes To Control Th17 Differentiation, Barbara Schraml
All Theses and Dissertations (ETDs)
Activator protein 1: AP-1) transcription factors are dimers of Jun, Fos, musculoaponeurotic fibrosarcoma: MAF) and activating transcription factor: ATF) family proteins that are characterized by a basic region and a leucine zipper domain. While many AP-1 proteins also contain defined transcriptional activation domains: TADs), some consist only of a basic region and leucine zipper and are thought to function as inhibitors of AP-1 activity. We found that the AP-1 protein Batf, which lacks a TAD, is highly expressed in T helper cells compared to various other immune cells and tissues. IL-17-producing T helper: TH17) cells are a CD4+ T cell …
Identification And Characterization Of Novel Astroviruses, Stacy Finkbeiner
Identification And Characterization Of Novel Astroviruses, Stacy Finkbeiner
All Theses and Dissertations (ETDs)
Approximately 1.8 million children die from diarrhea annually, and millions more suffer multiple episodes of nonfatal diarrhea. Despite the availability of improved molecular diagnostics to detect the known viral agents, the etiology of a large proportion of diarrheal cases is unknown. In fact, it is estimated that no causative agent can be identified in up to 40% of sporadic cases or in gastroenteritis outbreaks. Detection of novel or unexpected viruses is the first step in identifying agents that could potentially close the diagnostic gap and pave the way for the development of more comprehensive preventative measures and better treatments. This …

In Vivo Function Of Otopetrin 1 In The Vestibular Sensory Epithelium, Euysoo Kim
In Vivo Function Of Otopetrin 1 In The Vestibular Sensory Epithelium, Euysoo Kim
All Theses and Dissertations (ETDs)
Otopetrin family genes encode multi-transmembrane domain proteins with three highly conserved domains. In mice, three Otopetrin paralogues are found. One of its members, Otopetrin 1: Otop1) has been previously shown to be essential for the formation of otoconia in the vestibular system of the inner ear. Otoconia are calcium carbonate biominerals that are required for normal balance and the sensation of linear acceleration with respect to gravity. The mechanism by which OTOP1 mediates otoconia biosynthesis is not known, but the ability of OTOP1 to modulate [Ca2+]i in response to purinergic signals in heterologous systems suggest that OTOP1 may be involved …
Hiv-1 Envelope-Induced Signaling Mediates Actin Cytoskeleton Rearrangements Necessary For Fusion And Entry, Brooke Harmon
Hiv-1 Envelope-Induced Signaling Mediates Actin Cytoskeleton Rearrangements Necessary For Fusion And Entry, Brooke Harmon
All Theses and Dissertations (ETDs)
Human immunodeficiency virus type-1: HIV-1) initiates infection by direct fusion of the virus membrane with the plasma membrane of the target cell. This fusion event is a multi-step process mediated by the envelope: Env) surface subunit gp120 and the transmembrane subunit gp41 which anchors gp120 into the viral membrane. First the surface subunit gp120 binds to the primary receptor CD4. This interaction promotes actin cytoskeletal rearrangements in the target membrane that bring the chemokine coreceptor, CCR5 or CXCR4, into close proximity for binding and induces conformational changes in gp120 that allow it to couple to the coreceptor. Formation of the …

Regulation Of Bax/Bak-Dependent Cell Death Program, Hyungjin Kim
Regulation Of Bax/Bak-Dependent Cell Death Program, Hyungjin Kim
All Theses and Dissertations (ETDs)
Mammals have evolved an intricate regulation of a genetically programmed apoptotic cell death that involves mitochondria. Diverse apoptotic signals converge on mitochondria, which causes the release of cytochrome c into the cytosol to activate Apaf-1. This initiates caspase activation, which results in irreversible cellular demise. The BCL-2 family proteins constitute a critical checkpoint in mitochondrion-dependent apoptosis. Multidomain proapoptotic BAX/BAK promotes mitochondrial outer membrane permeabilization, whereas anti-apoptotic BCL-2/BCL-XL/MCL-1 protects mitochondrial integrity and prevents cytochrome c release. The proapoptotic activity of BAX/BAK is triggered by BH3-only molecules: BH3s) which are upregulated by upstream death signals. However, how these subfamilies interact …

Role And Regulation Of Escrt-Iii In Multivesiculr Body Biogenesis, Soomin Shim
All Theses and Dissertations (ETDs)
Endosomal sorting complex required for transports: ESCRT) machinery responsible for multivesicular body: MVB) biogenesis is essential for receptor downregulation, viral budding and cytokinesis. ESCRT-III is a large polymer built from related ESCRT-III proteins that is thought to help generate intralumenal vesicles: ILVs) within the MVB. How ESCRT-III functions is poorly understood. Although ESCRT-III assembles on the endosomal membrane, its components are predominantly soluble in the cytoplasm. I found that the transition between these two states is controlled by autoinhibitory domains within ESCRT-III proteins, which I identified by structure/ function analysis in four human ESCRT-III proteins - Charged multivesicular body protein2A: …
The Role Of Astrocyte Activation In Infantile Neuronal Ceroid Lipofuscinosis, Shannon Macauley-Rambach
The Role Of Astrocyte Activation In Infantile Neuronal Ceroid Lipofuscinosis, Shannon Macauley-Rambach
All Theses and Dissertations (ETDs)
Infantile neuronal ceroid lipofuscinoses: INCLs), or Batten Disease, is an inherited neurodegenerative lysosomal storage disorder affecting the central nervous system: CNS) during infancy or childhood. Hallmark pathological changes include accumulation of autofluorescent material, neuronal loss, cortical thinning, and brain atrophy, which ultimately lead to cognitive deficits, motor dysfunction, seizure activity, and blindness. INCL is the result of mutations in the CLN1 gene leading to a deficiency in the lysosomal enzyme, palmitoyl protein thioesterase 1: PPT1). A mouse model of INCL, the PPT1-deficient: PPT1-/-) mouse, was recently created by a targeted disruption in the CLN1 gene. The phenotype of the PPT1-/- …
Runx1 In Primitive Hematopoiesis And Characterization Of Hematopoietic Stem Cells In A Mouse Chronic Inflammatory Arthritis Model, Yunglin Ma
All Theses and Dissertations (ETDs)
Hematopoietic cells are essential for growth and survival throughout adult life. Two different aspects of hematopoiesis are addressed in this dissertation. I. The regulation of primitive hematopoiesis by Runx1 and TGF-beta signaling. Primitive hematopoiesis, occurring exclusively in the yolk sac, is characterized by its transient nature. As the primitive hematopoiesis declines in the yolk sac, definitive hematopoietic progenitors generated in the yolk sac and/or embryo take over in blood cell production. Whether the transition from primitive to definitive hematopoietic program reflects a mere shift in hematopoietic sites or whether it is an actively regulated process is currently unknown. Runx1 is …
The Evolution And Regulation Of Dna-Binding By The Nickel-Dependent Transcription Factor Nikr, Erin Benanti
The Evolution And Regulation Of Dna-Binding By The Nickel-Dependent Transcription Factor Nikr, Erin Benanti
All Theses and Dissertations (ETDs)
Transition metal homeostasis is critical for all cells to balance cellular metal requirements with metal availability. One common homeostatic mechanism in bacteria is metal-dependent transcriptional regulation. The Ni2+-dependent transcription factor NikR is a member of the ribbon-helix-helix: RHH) family of DNA-binding proteins and is widespread among bacteria and archea with vastly different nickel physiologies. The goal of this thesis was to better understand basic aspects of cellular transition metal homeostasis by examining the activity and regulatory properties of NikR family members from different bacterial species. One organism that exhibits a prominent and well-defined nickel physiology is Helicobacter pylori, making it …
