Pharmaceutical Innovation: Law & The Public's Health, Kevin Outterson

At last count, global pharmaceutical spending exceeded $750 billion. Unlike most medical products and services, many pharmaceuticals are sold at a price that greatly exceeds marginal cost. AIDS medicines that retail for over $10,000 per person per year in the United States can be produced generically at a marginal cost of less than $150. Patents and other related IP rights create these significant gaps between marginal cost and retail price, generating many billions of dollars in profits (patent rents) for companies.

A Tale Of Two Debtors: Bankruptcy Disparities By Race, Rory Van Loo

This article offers the first quantitative evidence on race and bankruptcy. Minority debtors fare worse overall in bankruptcy — blacks are 40% and Hispanics 43% less likely than whites to receive a discharge in Chapter 13 after controlling for variables such as education, income, and employment. While the data do not allow for causal inference, Chapter 13 trustees were twice as likely to have made a motion to dismiss even against black debtors who ultimately completed their multi-year bankruptcy plans than against similar white debtors. The concept of nationality traditionally mediated the relationship between the individual and the state in a bygone era in which international law regarded only the latter as a genuine subject of the law; today, its international legal functions have expanded. Yet, as in the past, it remains unclear whether and how international law limits the otherwise almost plenary competence of states to confer their nationality by their internal laws in a way entitled to international recognition. This brief essay is the edited transcript of the author’s opening remarks for a panel on jurisprudence in international law at the conference entitled Realistic Idealism in International Law, held at Yale Law School on April 24, 2009, in honor of W. Michael Reisman. It canvasses some of the animating factors and features of the New Haven School of jurisprudence with which Reisman is identified, and it seeks to explain and clarify some of his signature contributions to the School’s methodology.

Much post-9/11 scholarship asks whether modern transnational terrorist networks, the increasing availability of catastrophic weapons to nonstate actors, and other novel threats require changes to either or both of the two traditional branches of the law of war: (i) the jus ad bellum, which governs resort to war, and (ii) the jus in bello, which governs the conduct of hostilities. Scant recent work focuses on the equally vital question whether the relationship between those branches-and, in particular, the traditional axiom that insists on their analytic independence-can and should be preserved in contemporary international law. This dissertation is a document based administrative study of the British occupation of Germany, 1945–49, and its impact on specific areas of the lives of German women who were living in the British zone. The study examines the effect of British occupation policy on the regulation of marriage, prostitution and venereal disease, and German women’s organizations. British occupation strategies were unique; although the British worked with the Americans on many levels they maintained separate policy approaches. The British brought their own social perspectives and systems to Germany and attempted to impose them on German social and civil procedures. German women …

Russia’s seamless presidential succession produced no major changes in domestic politics or foreign policy. Ties with Asia remained strong, though several key relationships—with China, Japan, and the Central Asian states—frayed under the impact of Russia’s military action in Georgia. Impressive economic performance in the first half of the year boosted Russian confidence as a great power, but its vulnerability to the global financial crisis together with the heavy-handed operation in the Caucasus undermined Moscow’s standing with both Asia and Europe by the end of the year.

How Do Animal Mitochondria Tolerate Water Stress?, Michael Menze, Steven Hand

The vast majority of animal species do not tolerate severe water stress, but the encysted embryo of the brine shrimp Artemia franciscana is an exceptionally useful organism to investigate physiological mechanisms for enduring extreme environmental insults. Any substantial reduction in cellular water poses a threat to survival. Nevertheless anhydrobiotic animals survive virtually complete loss of cellular water. The mechanisms that govern “life without water” (anhydrobiosis) are still not well understood. With certain exceptions, it seems that a recurring strategy for tolerating severe water loss involves the accumulation of both low molecular weight solutes (e.g. trehalose or other polyol) and highly …

Die Veränderung von mit psychischen Problemen verbundenen negativen automatischen Gedanken und Grundüberzeugungen ist zentraler Bestandteil jeder Kognitiven Verhaltenstherapie. Daher ist die Aufdeckung dieser dem Bewusstsein oft nur wenig zugänglichen kognitiven Prozessen von entscheidender Bedeutung für den Erfolg einer Psychotherapie. Im vorliegenden Artikel werden neben dem ABCDE-Protokoll, welches die Standardmethode zur Identifikation und Veränderung negativer automatischer Gedanken ist, unterschiedliche Methoden zur Exploration von Grundüberzeugungen (Beispielsituationen sammeln, Imaginationsmethode, Pfeil-abwärts-Technik) detailliert dargestellt. Hierbei wird das eher induktive Vorgehen zur Aufdeckung von Grundüberzeugungen von Albert Ellis mit den mehr deduktiven Strategien von Aaron Beck und den Weiterentwicklungen von Judith Beck verglichen.

When Networks Matter : Mexican Migrants' Access To The Welfare State Through Social Ties, Margaret Louise Ralston

In this thesis, I examine the relationship between social networks among Mexican migrants and usage of welfare benefits. For this research, I use the Mexican Migration Project (MMP) dataset and logistic regression to assess whether social capital plays a significant role in connecting individuals to information and resources that affect their access to public systems of social protection, including welfare benefits. Recent welfare reform legislation has made it increasingly difficult for noncitizens to access the welfare state. Following the work of Massey and Aguilera (2003), I have conceptualized social capital as respondents' connection to their U.S. community and their ties …

According to the National Center for Health Statistics, approximately forty-five million people in the United States, including nearly nine million children, were without health insurance in 2007 ("Fast Stats A to Z" 1). Additionally, in 2007, nearly 30% of young adults, ages 18-24, in the United States were uninsured ("Income, Poverty, and Health Insurance Coverage" 22). Sadly, none of these figures includes the countless individuals who have insufficient healthcare coverage caused by their high out-of pocket costs compared to their wages.

Research has shown that Americans rate non-accented English speakers more favorably than accented English speakers (e.g., Cargile & Giles, 1997; Frumkin, 2007); however this is not always the case ( e.g., Cargile, 2000; Singer & Eder, 1988). Other factors may be involved when people are processing other people's messages. One motivating factor may be the extent to which people like to think, or have a high need for cognition (NCS; Cacioppo & Petty, 1982). Imagine playing a game of catch with three people, and all the things that would influence to whom you throw. Were thoughts of death included as one of those factors? The hypothesis that mortality salience motivates avoidant behavior toward a worldviewthreatening target was empirically tested on a sample of 200 undergraduate Caucasian college students from a Midwestern university. I induced participants to write about either their own death or dental pain, and presented them with summer descriptions of three fictitious male African American targets that they believed they were going to interact with later in the study. Teacher quality is a widely discussed topic in education. States, districts, schools, parents, and other stakeholders want to know how to measure, improve, and reward teacher quality. A major factor in the rise in interest about teacher quality is clear evidence that individual teachers are able to positively affect student achievement, specifically in relationship to students' standardized test scores (No Child Left Behind Legislation). Even a cursory look at statewide student achievement data reveals that students with disabilities are achieving at lower levels in comparison to their peers without disabilities.

It is well known that patients can vary in their normal tissue response to radiotherapy, and this can be problematic. As a result, radiobiologists have been using in vitro models to assess variation in response and elucidate the genetic determinants of this variation. However, the clinical relevance of these models is currently unknown. In this study, blood samples from healthy controls (n 20) and colorectal carcinoma patients (n 60) were cultured in vitro to assess two radiobiological end points in parallel: intrinsic radiosensitivity assayed by chromosomal aberrations (G2 scores) and radiation-induced bystander effects assayed by viability testing.
