The objective of this study was to develop a family of car-following models that address the shortcomings of car-following models developed by General Motors (GM) in the 1950s. The developed models consist of separate models for acceleration, deceleration, and steady-state responses for congested freeway traffic conditions. The study calibrated the models using individual vehicle trajectory data collected on a segment of Interstate 101 in Los Angeles, California. Furthermore, the study validated the models using individual vehicle trajectory data collected on a segment of Interstate 80 in Emeryville, California. Lead poisoning remains a public health concern due to leads persistence in the environment from anthropogenic uses. Initial efforts to address the impacts of lead on vulnerable communities have included secondary prevention measures which typically occur after a child has been poisoned. However, in recent years there has been a pragmatic shift toward primary prevention efforts.

Cemented carbonate deposits (known locally as "caliche") in Las Vegas have been used to support shallow and deep foundations with relatively high bearing pressures compared to soil. Most high rise structures in Las Vegas are founded on either a large mat or a long pile foundation. Recently, a new foundation type consisting of a short pile system bonded to shallow cemented layers was utilized for a large high rise building in Las Vegas and settlements during construction were recorded. In this work, a LED and two types of Compact fluorescent lamps were investigated for the intensity variation due to mechanical vibrations in the range of 0 to 30 HZ. In general, subjecting the lamps to 24-hour vibration affects the total intensity percentage variations of peak intensities after vibrations is in the range of -25 to +15% compared to those of no vibrations for the light emitting diode luminaires. For the case of compact fluorescent lamps (Nuvue) the variations are in range from +10 to +35%, whereas for the Compact fluorescent lamps (Ecosmart) the intensity peaks range from -10 to …

This study involved an investigation of the effects of strategy instruction integrated with the concrete-representational-abstract teaching sequence on students with learning disabilities. A multiple probe design across subjects with one replication was used in this study. Two sets of data were analyzed to determine effectiveness of the independent variable (intervention lessons). The first data set consisted of pre and posttest percentage scores and the second data set consisted of baseline, intervention, and maintenance probe scores that were collected throughout the study per the parameters of a multiple probe design. This thesis introduces an empirically developed formula to predict the comfort conditions and thermal performance of a Skytherm(TM) Southwest Roofpond placed over a light-weight un-insulated structure built at the School of Architecture at the University of Nevada, Las Vegas.

The predictive formula introduced in this study may be used in different parts of the world (particularly developing nations where insulation and air-conditioning are rarely used) to predict the performance of a Skytherm(TM) Southwest Roofpond using minimal climate data.

In the last decade, the statistics about Black health disparities show no improvement. The caustic history of slavery, racism and segregation hasn't been completely undone. Fundamental changes are still necessary to repair deficits in Black health.

Contemporaneous grants of both stock and at-the-money options to individual employees of U.S. public companies indicates demand for equity compensation packages that are in the money, i.e., packages of equity pay instruments that in aggregate have payoff profiles and incentive properties that are similar to explicit in-the-money employee stock options. However, several tax rules (and formerly accounting rules) strongly discourage grants of explicit in-the-money options, including recently enacted IRC - 409A, which essentially precludes the use of explicitly discounted options by taxing these instruments at vesting, rather than at exercise, and adding a 20% penalty tax. The decision of contracting authorities regarding which projects will proceed to the bidding stage depends, in part, upon the early estimates of probable cost. One of the most controversial areas of modern tort law is that of the duty of landowners toward people who visit their land. The common law divided land visitors into three types: invitees, licensees, and trespassers. The highest duty of care was owed to the invitee and the lowest to the trespasser. The distinctions led courts to hand down harsh decisions and to draw formal lines between the categories that seemed to defy common sense at times. The concept of nationality traditionally mediated the relationship between the individual and the state in a bygone era in which international law regarded only the latter as a genuine subject of the law; today, its international legal functions have expanded. Yet, as in the past, it remains unclear whether and how international law limits the otherwise almost plenary competence of states to confer their nationality by their internal laws in a way entitled to international recognition. A Tale Of Two Debtors: Bankruptcy Disparities By Race, Rory Van Loo

This article offers the first quantitative evidence on race and bankruptcy. Minority debtors fare worse overall in bankruptcy — blacks are 40% and Hispanics 43% less likely than whites to receive a discharge in Chapter 13 after controlling for variables such as education, income, and employment. While the data do not allow for causal inference, Chapter 13 trustees were twice as likely to have made a motion to dismiss even against black debtors who ultimately completed their multi-year bankruptcy plans than against similar white debtors. Congress may reform drug pricing policies under Medicare Part D as part of a larger health reform effort. Currently, the "noninterference" provision prevents the government from negotiating drug prices on behalf of Medicare Part D prescription drug plans. Commonly considered reform proposals borrow ideas from Medicaid, either through returning dual eligibles to Medicaid drug pricing or by imposing mandatory rebates across the Part D population. We examine a menu of other options, including value-based pricing; expansion of generic and therapeutically equivalent substitution; increased formulary diversity; importation; and limited antitrust waivers. Much post-9/11 scholarship asks whether modern transnational terrorist networks, the increasing availability of catastrophic weapons to nonstate actors, and other novel threats require changes to either or both of the two traditional branches of the law of war: (i) the jus ad bellum, which governs resort to war, and (ii) the jus in bello, which governs the conduct of hostilities. Scant recent work focuses on the equally vital question whether the relationship between those branches-and, in particular, the traditional axiom that insists on their analytic independence-can and should be preserved in contemporary international law. In his recent article in the Texas Law Review, Ben Roin advances the claim that pharmaceutical innovation and the public’s health are harmed by the doctrines of non-obviousness and novelty. He does not mince words, labeling the nonobvious requirement as “perversity” with a “pernicious” effect on drug development. In his view, these standards pose an insurmountable barrier for drug companies seeking to commercialize inventions already in the public domain. This article analyzes and applies to Labor Board decision making the Court’s oft-cited 1984 decision in Chevron U.S.A. v. Natural Resources Defense Council. The article argues that judicial review of Board decision making under Chevron, though limited, can still be sufficiently meaningful to control excessive shifts in Board lawmaking criticized by many commentators. Because tort law generally and healthcare regulation specifically are traditional state functions and because medical, legal, and insurance practices are highly localized, legal scholars have long believed that medical malpractice falls within the states' exclusive jurisdiction and sovereignty. Indeed, this view is so widely held that modern legal scholarship takes it for granted.
