Not long after construction began for an athletic field at City College of New York, school officials conceived the idea of that same field serving as an outdoor concert hall during the summer months. The result, Lewisohn Stadium, named after its principal benefactor, Adolph Lewisohn, and modeled much along the lines of an ancient Roman coliseum, became that and much more. Lewisohn Stadium was for over forty years the summer home of America's oldest symphony orchestra, the New York Philharmonic. In September 1864, Union General William T. Sherman's Savannah Campaign targeted the growing animosity between wealthy and poor Georgians when he proposed that Union forces "arouse the latent enmity of Georgia." This thesis continues the study of the March to the Sea by examining the effect of Sherman's campaign as it pertained to the social divisions between Georgians. Sherman's army alone did not ruin the state's ability to remain a vital contributor to the war effort, but rather focused upon the already growing social disputes between Georgians over economic contributions, military sacrifice, and political support. The Underrepresentation Of Women In Interscholastic Sport Leadership: A Qualitative Study On The Effects Of Role Incongruity, Dana Massengale

The purpose of this study was to investigate the underrepresentation of women in interscholastic sport leadership positions by analyzing perceptions of state association administrators and athletic directors of the function, if any, that role congruity theory plays in the underrepresentation women. Previous research has examined potential causes for this underrepresentation but no previous study had examined this phenomenon from a prejudice toward women in a leadership role perspective. Data were collected through indepth, semi-structured interviews involving nine women leaders in interscholastic athletics. The criteria for participation placed them into one of three categories: (1) participants who were currently working as …

The Federal Music Project and subsequent WPA Music Programs served as components of President Franklin D. Roosevelt's "New Deal" efforts to combat the economic devastation precipitated by the Great Depression. Operating during the years 1936 to 1943, these programs that engaged unemployed musicians mirrored similar efforts of the Federal Theatre, Art and Writers' Projects. Though the Federal Music Project proved to be the largest of the cultural programs in terms of both employment and attendance, to date it has received the least attention from scholars. Focus of attention manipulation has been shown to have an effect on learning and performance of movement tasks. The purpose of this experiment was to determine whether inducing an external or internal focus of attention while learning a Pilates roll-up had an effect on movement technique acquisition. Movement form, movement time, and distance reached served as dependent variables. Participants (n=22) were assigned to either an external or internal focus group and verbally instructed through 2 sets of 6 repetitions of the roll-up per day over two practice days. This thesis is a global comparative study tracing the functions and historical development of Chinese huiguan ["official organization"] and its leadership in China, Indochina, and San Francisco. Early Chinese immigration to America and Indochina involved the formation of huiguan, organizations based on dialect and native place, paralleling the functions and demography of merchant associations originating in China. The merchant elite representing its leadership were preeminent arbitrators of Chinese tradition and authority. French Indochina and America recognized their status as community leaders, further exalting the social standing of merchants and increasing their positions of authority. I will create a transcription for wind ensemble of the "Overture to The Magic Flute " by WA Mozart. By completing this transcription, a standard orchestral work will be available in comparable quality and difficulty for wind ensemble. Although several simplified and one large concert band transcriptions have been made available during the 20th century, these arrangements were not consistent with late 18th century ideals of size and balance. This transcription will remain loyal to the original work through embracing the ideology of the 18th century musical mind. From Feminism means to emphasize a world-view rather than an a-priori eye towards women; the manuscript does occasionally strike a generic feminist-didactic mode, but for the most part its concerns are with humanity/ecology and gender goes un-marked or people are altogether absent. The world is various, and in terms of form, the poems in this book are rangy: sonnets, prose poems, serial fragments, free verse tercets, measured and rhymed tercets, couplets, over-the-top monuments to generation by rhyme. Shadow Precedents And The Separation Of Powers: Statutory Interpretation Of Congressional Overrides, Deborah Widiss

In both judicial decisions and critical commentary on statutory interpretation, the possibility of congressional override is generally considered a significant balance to the countermajoritarian reality that courts, through statutory interpretation, make policy. This Article demonstrates that the "check" on judicial power provided by overrides is not as robust as is typically assumed. One might assume that overridden precedents are functionally erased or reversed. But because Congress technically cannot overrule a prior decision, courts must determine whether the enactment of an override fully supersedes the prior judicial interpretation. Overrides thus raise unique, and previously largely ignored, questions of statutory interpretation. Using …

Taking the hangman's noose hanging in Jena, Louisiana in 2006 as a starting point, this Article begins by placing the hanging of a noose in historical context. The Article then proceeds to explore contemporary manifestations of noose hanging in the workplace, in schools and other settings. The Article examines noose hangings that occurred around the country since the display in Jena to explore the social meaning of a noose. Also examined are media constructions of noose hanging and the perception that some Blacks targeted by noose hanging have had of these incidents. Although many official documents and forms of identification contain a sex or gender identifier, gender, as a category on these documents, is not very helpful in confirming a person's identity. If the purpose of the inclusion of gender on official documents is to accurately identify an individual, technological advances have given us more accurate methods of ensuring a person's identity. Technologies such as fingerprinting, facial recognition and retinal scans are far superior methods of determining whether a person is who they claim to be. The use of gender or sex on identification cards does little to positively identify individuals, and …

The words Dublin or Ireland do not immediately come to mind when haute cuisine is mentioned. However, two leading French chefs, the brothers Francois and Michel Jammet, opened a restaurant in Dublin in 1901 which, up until its closure in 1967, remained one of the best restaurants serving haute cuisine in the world (Mac Con Iomaire 2005a; Mac Con Iomaire 2006). Haute cuisine was served in many Dublin hotels, clubs and restaurants during the twentieth century and came under similar influences as London and other European cities, moving from the Escoffier orthodoxy to the influence of nouvelle cuisine. Research has revealed that underutilization of breast cancer screening by ethnic minorities often is related to language difficulties and cultural values and beliefs about cancer. The problem addressed in this secondary data analysis was the late diagnosis of breast cancer in the Chinese immigrant community. The purpose of the quasi-experimental study was to test the efficacy of a theatrical preschool performance, guided by the diffusion of innovation theory, in educating Chinese American women about breast cancer detection. On the eve of independence from European colonialism, Egypt, like most other developing countries, undertook the project of de-linking itself from colonial economy by initiating domestic industrialization. The economic project known as Import Substitution Industrialization (“ISI”) was designed to liberate Egypt from raw commodity production--specifically, agricultural and mineral--servicing its previous colonial master, Great Britain. The engine of development would be an expanding public sector with nationalization and socialism as leitmotifs. In re-orienting the economy towards industrial production, Egypt hoped that the terms of trade with the international economy would significantly improve, thereby leading to an improvement in the living standards …

Professor Mallat delivered the Third Annual Herbert L. Bernstein Memorial Lecture in Comparative Law in 2004 and this article is based on his remarks. The article is included in the inaugural volume of CICLOPs that collects the first six Bernstein lectures. Strong moments in constitution-making often result from traumas; the breakthroughs by the European Union and constitutional achievements by both Iraq and Afghanistan stand as modern examples. The traumas of Europe, Afghanistan, and Iraq have been typified by violent conflict over the past century, including two World Wars, the Cold War, and the ‘war on terrorism’. The Antitrust Of Reputation Mechanisms: Institutional Economics And Concerted Refusals To Deal, Barak D. Richman

An agreement among competitors to refuse to deal with another party is traditionally per se illegal under the antitrust laws. But coordinated refusals to deal are often necessary to punish wrongdoers, and thus to deter undesirable behavior that state-sponsored courts cannot reach. When viewed as a mechanism to govern transactions and induce socially desirable cooperative behavior, coordinated refusals to deal can sustain valuable reputation mechanisms. This paper employs institutional economics to understand the role of coordinated refusals to deal in merchant circles and to evaluate the economic desirability of permitting such coordinated actions among competitors. The Supreme Court shaped its approach to charitable solicitation in a trilogy of cases in the 1980s: Schaumburg v. Citizens for a Better Environment (1980), Secretary of State of Maryland v. Joseph H. Munson Co. (1984), and Riley v. National Federation of the Blind of North Carolina (1988). Owing largely to ambiguity surrounding the concepts of content analysis, tiered scrutiny, and commercial speech emerging during that era, the Court failed to articulate a coherent framework for evaluating regulations of charitable solicitation. As great admirers of The Boss and as fans of live entertainment, we share in the popular dismay over rising ticket prices for live performances. But we have been asked as antitrust scholars to examine the proposed merger of Live Nation and Ticketmaster, and we do so with the objectivity and honesty called for by The Boss’s quotes above. The proposed merger has been the target of aggressive attacks from several industry commentators and popular figures, but the legal and policy question is whether the transaction is at odds with the nation’s antitrust laws.

This Article uncovers the forgotten complex of relationships between the U.S. Constitution, citizenship and the laws of war. The Supreme Court today believes that both noncitizens and citizens who are military enemies in a congressionally-authorized war are entitled to judicially-enforceable rights under the Constitution. The older view was that the U.S. government’s military actions against noncitizen enemies were not limited by the Constitution, but only by the international laws of war. On the other hand, in the antebellum period, the prevailing view was U.S. citizenship should carry with it protection from ever being treated as a military enemy under the …

In the African American experience of the twentieth century, cultural modes of expression became the primary outlet for a politics of resistance, a politics of fulfillment, and a politics of transfiguration within the context of a modem Western nation-state that marginalized and discriminated against the African American subject through ideology and cultural hegemony. This collective African American experience is one based on a reality of life-threatening racial violence that has plagued African Americans from the earliest days of the New Republic.

DPAC partners with New Mexico Main Street, a national nonprofit community organization that is administered in the State of New Mexico through the New Mexico Economic Development Department. Main Street's goal is to revitalize downtown centers. This revitalization comes in terms of physical infrastructure and aesthetic improvements, as well as economic stimulation. Thirteen students from the 2009 DPAC Studio were given the opportunity to work with the community of Lovington, NM.

To be sure, there are at least a few problems with the approach of drawing upon the Framers for guidance with respect to the issues of the day. First, the Framers did not reach consensus on all matters.
