This thesis is a qualitative case study about two children with autism spectrum disorder and the role of music in their lives. It explores how music serves as a non-threatening medium for learning and developing skills necessary to function successfully in life. The stories of the children and their parents are shared through their personal account and the author's observations. The literature in the field reveals that a structured/functional use of music helps communication, social interaction, appropriate behavior, motor skills, and academics in children with autism. Making Sense Of Schaumburg: Seeking Coherence In First Amendment Charitable Solicitation Law, John D. Inazu

The Supreme Court shaped its approach to charitable solicitation in a trilogy of cases in the 1980s: Schaumburg v. Citizens for a Better Environment (1980), Secretary of State of Maryland v. Joseph H. Munson Co. (1984), and Riley v. National Federation of the Blind of North Carolina (1988). Owing largely to ambiguity surrounding the concepts of content analysis, tiered scrutiny, and commercial speech emerging during that era, the Court failed to articulate a coherent framework for evaluating regulations of charitable solicitation. The result has left the Court without a clear understanding of the value of charitable solicitation. It has also …

This thesis provides a sociological examination of the personal experiences of beauty pageant participants in the South. By deconstructing the ideal view of women in beauty pageants, I attempted to answer how pageant contestants view their individual participation in the oppressive framework of the beauty pageant contest. In order to provide an in-depth analysis on the role of gender in beauty pageants, I conducted personal interviews and field study observations. Acoustics In Highly Concentrated Wormlike Micellar Materials, Najat Ahmad Al-Sherri

The purpose of this project is to verify the results of a previous study (Gladden and Mobley, 2008) conducted to determine the acoustical parameters, attenuation and sound speed, in the viscoelastic material of wormlike micelles. In this experiment, narrowband acoustic waves at ultrasonic frequencies were propagated through worm-like micellar solutions of varying concentrations (50 mM, 75 mM, 100 mM, 200 mM) across a range of temperatures. The measurements were performed using a pulse-echo technique and the echoes (representing wavelets that have traversed the sample twice) were then analyzed for signal loss and sound speed utilizing the Hilbert transform. As great admirers of The Boss and as fans of live entertainment, we share in the popular dismay over rising ticket prices for live performances. But we have been asked as antitrust scholars to examine the proposed merger of Live Nation and Ticketmaster, and we do so with the objectivity and honesty called for by The Boss’s quotes above. The proposed merger has been the target of aggressive attacks from several industry commentators and popular figures, but the legal and policy question is whether the transaction is at odds with the nation’s antitrust laws.

Shanghai and Singapore are two economically vibrant Asian cities that have recently adopted creative/cultural economy strategies. In this article I examine new spatial expressions of cultural and economic interests in the two cities: state-vaunted cultural edifices and organically evolved cultural spaces. I discuss the simultaneous precariousness and sustainability of these spaces, focusing on Shanghai's Grand Theatre and Moganshan Lu and on Singapore's Esplanade-Theatres by the Bay and Wessex Estate. Their cultural sustainability is understood as their ability to support the development of indigenous content and local idioms in artistic work. In Defense Of “Footnote Four”: A Historical Analysis Of The New Deal’S Effect On Land Regulation In The U.S. Supreme Court, Christopher S. Dodrill

Law and Contemporary Problems

At the turn of the nineteenth century, the US Supreme Court established and reinforced numerous so-called "economic rights." During the Lochner v. New York era, the Court invalidated almost 200 federal and state economic and labor regulations for interfering with the right to contract and for violating substantive due process. In 1937, however, Justice Stone's famous "footnote four" in United States v. Carolene Products Co. closed the coffin on Lochner. After Carolene Products, the Court stopped applying heightened scrutiny to economic legislation, and it began consciously protecting "discrete and insular minorities." In this article the author argues that the aims, contexts, and methods of client activism are paramount in progressive lawyering theory, and as such precede and define the question of how progressives should lawyer. The author suggests precursory paradigms that 1) clarify the ultimate political goals to which activism is and should be directed; 2) analyze the social conditions shaping and defining grassroots activity; and 3) specify and systematize the myriad methods that can and should be used to further these ends. This dissertation addresses the place of music in circuit chautauqua, the place of circuit chautauqua in American culture, and the role of music in defining that place. It takes into account the perception of chautauqua as a conduit by which higher culture and urban intellectual discourse could reach rural Americans, and the implications of this perception on musical programming.

Patent Exhaustion And Implied Patent License In Connection With Free And Open Source Software, Anna Haapanen

This study examines the patent law doctrines of patent exhaustion and implied patent license, and their application to the commercial use of free and open source software (FOSS), an area not thoroughly examined despite the doctrines' otherwise well-established preconditions. The analysis first clarifies the preconditions, scope and key differences of the two doctrines, then applies them to the sale and licensing of FOSS components under the BSD, MIT and GPLv2 licenses. The study addresses the risk that technology companies distributing patented FOSS components may inadvertently dilute their own patent portfolios through exhaustion or implied licensing.
