The Eyewitness Conundrum: How Courts, Police And Attorneys Can Reduce Mistakes By Eyewitnesses, Bennett L. Gershman Jan 2009

The Eyewitness Conundrum: How Courts, Police And Attorneys Can Reduce Mistakes By Eyewitnesses, Bennett L. Gershman

Elisabeth Haub School of Law Faculty Publications

Reducing the incidence of wrongful convictions based on eyewitness mistakes poses a difficult challenge to the criminal justice system. There is near-unanimity among courts and commentators that eyewitness mistakes account for more erroneous convictions than any other type of proof. It is therefore incumbent on every key participant in the criminal justice system - judge, prosecutor, police, and defense counsel - to use every available tool to protect an accused from being mistakenly identified by an eyewitness. For the judge, protecting the accused requires a willingness to give the jury special instructions on eyewitness identification and a willingness to allow …

The second part includes specific questions on headache, and whether there had been headache in the year …

The Sec And The Madoff Scandal: Three Narratives In Search Of A Story, Donald C. Langevoort Jan 2009

The Sec And The Madoff Scandal: Three Narratives In Search Of A Story, Donald C. Langevoort

Georgetown Law Faculty Publications and Other Works

This essay, part of a symposium on narrative in corporate law, considers various portrayals of the complicity of the SEC in the Bernard Madoff scandal--including the Commission's own Inspector General's report issued in September 2009. It considers possible explanations (revolving door problems, incompetence and sloth, etc.) but suggests that the story is deeper and more frustrating, arising out of the relative poverty in which the SEC operates, which in turn leads to habits of thought and action that leave too much unnoticed and undone. The interesting question, then: why the poverty? The essay concludes with a political explanation. While by …

Maturation Of The Human Fetal Startle Response: Evidence For Sex-Specific Maturation Of The Human Fetus, Claudia Buss, Elyssia Poggi Davis, Quetzal A. Class, Matt Gierczak, Carol Pattillo, Laura M. Glynn, Curt A. Sandman Jan 2009

Maturation Of The Human Fetal Startle Response: Evidence For Sex-Specific Maturation Of The Human Fetus, Claudia Buss, Elyssia Poggi Davis, Quetzal A. Class, Matt Gierczak, Carol Pattillo, Laura M. Glynn, Curt A. Sandman

Psychology Faculty Articles and Research

Despite the evidence for early fetal experience exerting programming influences on later neurological development and health risk, very few prospective studies of human fetal behavior have been reported. In a prospective longitudinal study, fetal nervous system maturation was serially assessed by monitoring fetal heart rate (FHR) responses to vibroacoustic stimulation (VAS) in 191 maternal/fetal dyads. Responses were not detected at 26 weeks gestational age (GA). Sex-specific, age-characteristic changes in the FHR response to VAS were observed by 31 weeks' GA. Males showed larger responses and continued to exhibit maturational changes until 37 weeks'GA, females however, presented with a mature FHR …

The First Amendment Right Against Compelled Listening, Caroline Mala Corbin Jan 2009

The First Amendment Right Against Compelled Listening, Caroline Mala Corbin

Articles

This Article argues for a new First Amendment right: the right against compelled listening. Free speech jurisprudence - which already recognizes the right to speak, the right to listen, and the right against compelled speech - is incomplete without the right against compelled listening. The same values that underlie the other free speech rights also lead to this right. Furthermore, this claim holds true regardless of whether one conceives of the primary purpose of the Free Speech Clause as creating a marketplace of ideas, enhancing participatory democracy, or promoting individual autonomy. The Article starts by examining the protection afforded to …

Bullying In Public Schools In Missouri, David A. Copeland

Doctoral Dissertations and Projects

The research conducted sought to find evidence and data to support or lack of support to the following questions: Do school administrators perceive a problem with bullying in their schools in Missouri? Is there a relationship between the victim of bullying and the learning process? Do female adolescents engage in cyber bullying more than male adolescents? Do public schools in Missouri have policies in place that address bullying? The researcher used the Olweus Bullying Prevention Program survey on bullying. The study examined the perceptions and beliefs of the superintendents in the State of Missouri concerning bullying and student responses from …

Analytical Jurisprudence And The Concept Of Commercial Law, John Linarelli Jan 2009

Analytical Jurisprudence And The Concept Of Commercial Law, John Linarelli

Scholarly Works

Commercial lawyers working across borders know that globalization has changed commercial law. To think of commercial law as only the law of states is to have an inadequate understanding of the norms governing commercial transactions. Some have argued for a transnational conception of commercial law, but their grounds of justification have been unpersuasive, often grounded on claims about the common content among national legal systems. Legal positivism is a rich literature on the concept of a legal system and the validity conditions for rules in legal systems, but it has not been used to understand legal order outside or beyond …

Trademark Intersectionality , Sonia K. Katyal Jan 2009

Trademark Intersectionality , Sonia K. Katyal

Faculty Scholarship

Even though most scholars and judges treat intellectual property law as a predominantly content neutral phenomenon, trademark law contains a statutory provision, Section 2(a) that provides for the cancellation of marks that are “disparaging,” “immoral,” or “scandalous,” a provision that has raised intrinsically powerful constitutional concerns. The constitutional tensions surrounding Section 2(a), invariably, affect two central metaphors that are at war within trademark law: the marketplace of goods, which premises itself on the fixedness of intellectual properties, and the marketplace of ideas, which is premised on the very fluidity of language itself. Since the architecture of trademark law focuses only …

Hidden Taxes, Brian Galle Jan 2009

Hidden Taxes, Brian Galle

Georgetown Law Faculty Publications and Other Works

The idea of hidden taxes is as old as John Stuart Mill, but convincing evidence of their existence is new. In this Article, I survey and critique recent studies that claim to show that there are some taxes that can go unnoticed by those who pay them. I also develop the array of unanswered theoretical questions and policy implications that potentially follow from the studies' results.

Probably the central question for hidden taxes is whether they might enable government to raise revenue without also distorting the economy. If so, I argue, they have the potential to radically refashion the architecture …

Postracial Discrimination, Girardeau A. Spann Jan 2009

Postracial Discrimination, Girardeau A. Spann

Georgetown Law Faculty Publications and Other Works

Claims of racial injustice can be challenged by arguing that the culture makes it possible for minorities to compete with whites on a level playing field. Under this reasoning, racial disparities that continue to inhere in the allocation of societal benefits and burdens must be caused by the attributes of individual minority group members themselves, rather than by any invidious consideration of their race. The election of President Obama now gives this argument more apparent plausibility than it has had in the past. Indeed, if one were inclined to preserve the nation’s tradition of privileging white interests over the interests …

Comments On Roger Cotterrell's Essay, 'The Struggle For Law: Some Dilemmas Of Cultural Legality', Robin West

Georgetown Law Faculty Publications and Other Works

First, many thanks to Carrie Menkel-Meadow, the editors of The International Journal of Law In Context and the sponsors of this series for facilitating this lecture, and for inviting my participation. And a special thank you to Professor Roger Cotterrell for sharing with us such a generous, humanistic and hopeful account of law’s moral possibilities, when faced with multicultural conflict within a society governed by a liberal rule of law. I very much appreciate the opportunity to reflect on this set of claims, although I feel somewhat an outsider to the task, as I’ll explain below. I understand Professor Cotterrell …

Discourses For Social Justice Education: The Web Of Racism And The Web Of Resistance, Lisa Werkmeister Rozas, Joshua Miller Jan 2009

Discourses For Social Justice Education: The Web Of Racism And The Web Of Resistance, Lisa Werkmeister Rozas, Joshua Miller

School for Social Work: Faculty Publications

This article presents two conceptual frames to help with teaching about issues of race and racism. First the concept of the web of racism describes a matrix that helps students understand the depth of damage racism has instilled in contemporary U.S. society. Second, the web of resistance offers a model of anti-racist activities to help students participate in the fight to end systemic racism. The importance of placing racism in a historical context is emphasized as are the differential reactions of white students and students of color to this material.

Evaluating Task-Technology Fit And User Performance For An Electronic Health Record System, Matthew J. Wills, Omar F. El-Gayar, Amit Deokar

Research & Publications

Assessing user satisfaction, acceptance and performance impacts of information systems have long traditions in information systems research. With an increasing focus on broader adoption and implementation of electronic health records (EHR’s), research examining user evaluation and performance impacts will play an essential role in the successful design, implementation, and efficient use of these systems. In this study, we analyze user evaluations of an EHR system and assess the impact on individual performance of such systems using the Task-technology Fit (TTF) theory. TTF postulates that individual performance is more likely to be positively impacted if there is a “fit” between the …

The Paradox Of Victim-Centrism: Victim Participation At The Khmer Rouge Tribunal, Mahdev Mohan Jan 2009

The Paradox Of Victim-Centrism: Victim Participation At The Khmer Rouge Tribunal, Mahdev Mohan

Research Collection Yong Pung How School Of Law

It has been claimed - though not proved - that victims will be benefited by participation in international criminal tribunals. This article interrogates this claim in the context of victim participation at the Extraordinary Chambers in the Courts of Cambodia (ECCC), commonly referred to as the Khmer Rouge Tribunal. Based on interviews with Cambodian victims and Tribunal affiliates, it examines why and how the Tribunal permits victims to intervene as les parties civile, pulling together the normative and legal basis for this mode of victim participation. This article does not purport to generalize with confidence about Cambodian victims in general, …
