International Security And International Law In The Northwest Passage, James Kraska
International Security And International Law In The Northwest Passage, James Kraska
Vanderbilt Journal of Transnational Law
Concern over the loss of sea ice has renewed discussions over the legal status of the Arctic and subarctic transcontinental maritime route connecting the Atlantic and Pacific Oceans, referred to as the "Northwest Passage." Over the past thirty years, Canada has maintained that the waters of the Passage are some combination of internal waters or territorial seas. Applying the rules of international law, as reflected in the 1982 United Nations Law of the Sea Convention, suggests that the Passage is a strait used for international navigation. Expressing concerns over maritime safety and security, recognition of northern sovereignty, and protection of …
Outsourcing Immigration Compliance, Eleanor Marie Brown
Outsourcing Immigration Compliance, Eleanor Marie Brown
GW Law Faculty Publications & Other Works
Immigration is a hot button issue about which Americans have sent a clear message. They prefer not to admit more aliens until the government is able to credibly screen for entrants who will abide by the terms of admission and sanction those who do not. While immigration debates now focus almost entirely on undocumented workers, they have overshadowed another critical, yet poorly understood challenge: designing institutions to properly screen for aliens who are visa-compliant and sanction non-compliant aliens. Because failed guest worker programs unquestionably increase the size of the undocumented population, this article addresses the difficulty of institutional design by …

Cultural Cognition Of The Risks And Benefits Of Nanotechnology, Donald Braman, Dan M. Kahan, Paul Slovic, John Gastil, Geoffrey L. Cohen
GW Law Faculty Publications & Other Works
We conducted an experimental public opinion study of the effect of balanced information on nanotechnology risk-benefit perceptions. The study found that subjects did not react in a uniform, much less a uniformly positive manner, but rather polarized along lines consistent with cultural predispositions toward technological risk generally.

In Defense Of Victim Impact Statements, Paul Cassell
In Defense Of Victim Impact Statements, Paul Cassell
Utah Law Faculty Scholarship
This paper provides a comprehensive justification of "victim impact statements" in criminal sentencing, explaining how such statements are important to crime victims and how the critics of such statements fail to grapple with the need for these statements to victims.
Socio-Economic Rights And Refugee Status: Deepening The Dialogue Between Human Rights And Refugee Law, Fatma E. Marouf, Deborah Anker
Socio-Economic Rights And Refugee Status: Deepening The Dialogue Between Human Rights And Refugee Law, Fatma E. Marouf, Deborah Anker
Scholarly Works
Over the past two decades, international human rights law has provided an increasingly useful framework for interpreting key criteria of the definition of a refugee. A human rights-based approach to analyzing refugee status helps to increase consistency and uniformity in decision making by state parties regarding who qualifies for international protection.
Michelle Foster's book, International Refugee Law and Socio-economic Rights: Refuge from Deprivation (Cambridge U. Press 2007), comes at a critical time, not only because of increasing acceptance of the connection between refugee law and human rights law and significant developments in the current understanding of economic and social rights, …

Adaptive Rationality: An Evolutionary Perspective On Cognitive Bias, Martie Haselton, Gregory A. Bryant, Andreas Wilke, David Frederick, Andrew Galperin, Willem E. Frankenhuis, Tyler Moore
Psychology Faculty Articles and Research
A casual look at the literature in social cognition reveals a vast collection of biases, errors, violations of rational choice, and failures to maximize utility. One is tempted to draw the conclusion that the human mind is woefully muddled. We present a three-category evolutionary taxonomy of evidence of biases: biases are (a) heuristics, (b) error management effects, or (c) experimental artifacts. We conclude that much of the research on cognitive biases can be profitably reframed and understood in evolutionary terms. An adaptationist perspective suggests that the mind is remarkably well designed for important problems of survival and reproduction, and not …
Illegal Immigration And Worldview Defense: Distaste For Human Migration In The Context Of Tmt, John Matthew Bergen
Illegal Immigration And Worldview Defense: Distaste For Human Migration In The Context Of Tmt, John Matthew Bergen
UNLV Theses, Dissertations, Professional Papers, and Capstones
This study examines the impact of mortality salience on opinions about illegal immigrants. Participants were asked to write about their own death or a control subject and then presented with scenarios of illegal immigration to the United States. The scenarios included a defendant who was either of Latin American or European origin and had or had not learned to speak English. However, the European condition had to be dropped due to unreliable identification of the origin of the European defendant. The results indicate that mortality salience caused an increase in the preference for deportation of an illegal immigrant who was …
Diversity Leader: Case Study Of A Selected Organization's Transformation, Aileen Guerrero Zaballero
Diversity Leader: Case Study Of A Selected Organization's Transformation, Aileen Guerrero Zaballero
UNLV Theses, Dissertations, Professional Papers, and Capstones
Diversity initiatives have evolved from a focus on compliance-oriented training to a systematic approach which integrates the many dimensions of diversity in all aspects of business to enhance performance through the practice of organization development (OD) (Bendick, Egan, & Lofhjelm, 2001). Many organizations have implemented short term solutions to address the demographic changes in the workforce, but have had minimal results. When diversity interventions are conceptually grounded in organization development practices the results are much more substantial for both the employees and the organization (2001). The purpose of this qualitative case study was to explore the perceived influential factors of …

Home Sweet Home? The Efficacy Of Rental Restrictions To Promote Neighborhood Stability, Ngai Pindell
Home Sweet Home? The Efficacy Of Rental Restrictions To Promote Neighborhood Stability, Ngai Pindell
Scholarly Works
Homeownership is an enduring and fundamental American tradition whose economic and social benefits are well examined and have received renewed attention in recent articles and books. Tax laws encourage homeownership; debtor-creditor and property laws protect homeowners; and constitutional protections defend homeowners from governmental attempts to exercise eminent domain.
The current economic and housing crises have forced commentators and policymakers to reexamine the connection between traditional conceptions of homeownership and economic stability, particularly for low-income residents. This article questions that traditional conception by exploring how local governments, in an effort to promote regulatory land use goals, frequently limit homeowners' power to …
The Fair Housing Act At Forty: Predatory Lending And The City As Plaintiff, Ngai Pindell
The Fair Housing Act At Forty: Predatory Lending And The City As Plaintiff, Ngai Pindell
Scholarly Works
The availability of credit, to individual borrowers and to communities, is an integral factor shaping the geography of housing opportunity. Cities are shaped by the housing and borrowing choices of their residents and the attendant mobility -- or lack of mobility -- of families. When lenders deny credit to neighborhoods or borrowers because of race, communities suffer. And when lenders flood these same neighborhoods with subprime or predatory loan products, the communities suffer once again. The economic gains of individuals and of communities in cities over the last several decades are threatened by massive property devaluations, loss of equity, and …

Neuroscience is one of the fastest growing scientific fields in terms of the numbers of scientists and the knowledge being gained. In recent years, both the scope of neuroscience and the methodologies employed by nueroscientists have broadly expanded, from biochemical and genetic analysis of individal nerve cells and their molecular constituents, to the recent neuroscientific achievement in the ability of neuroimaging technoloiges, including funtional magnetic resonance imaging (fMRI), to image brain function. Clinicans and scientists use fMRI not only to map sensory, motor, and cognitive function, but also to study the neural correlates of a range of physical and mental …

Acute Effects Of Self-Paced Walking On Smoking Withdrawal And Cravings, Magdalena Katomeri
Acute Effects Of Self-Paced Walking On Smoking Withdrawal And Cravings, Magdalena Katomeri
School of Psychology Theses
High relapse rates among smokers attempting to quit have been linked with failure to cope with cigarette cravings and withdrawal symptoms. Smoking cravings and withdrawal behavior is known to be influenced by stress and exposure to smoking cues. Exercise appears to reduce cigarette cravings and withdrawal symptoms. However no study has investigated the effects of exercise on cue-elicited cravings and withdrawal symptoms, or on ad libitum smoking behavior. Aim: Four experimental studies were designed to examine the effects of exercise on smoking behavior. Initial studies focused on the effects of a single session of brisk walk on cigarette cravings and …
Memory And Metamemory In Patients With Temporal Lobe Epilepsy, Charlotte Emma Howard
Memory And Metamemory In Patients With Temporal Lobe Epilepsy, Charlotte Emma Howard
School of Psychology Theses
It is well established that patients with temporal lobe epilepsy (TLE) commonly report memory difficulties. The aim of this thesis was to use a novel approach adopting Nelson & Narens' (1990) theoretical framework to investigate whether metacognitive knowledge and memory performance were differentially disrupted in patients with TLE. More specifically, investigating to what extent poor memory in TLE could result from inadequate metamemory monitoring, inadequate metamemory control or both. Experiment I employed a combined Judgement-of-Learning and Feeling-of-Knowing task to investigate whether participants could monitor their memory successfully at both the item-by-item and global levels. The results revealed a dissociation between …
Client Activism In Progressive Lawyering Theory, Eduardo R.C. Capulong
Client Activism In Progressive Lawyering Theory, Eduardo R.C. Capulong
Faculty Law Review Articles
In this article the author argues that the aims, contexts, and methods of client activism are paramount in progressive lawyering theory, and as such precede and define the question of how progressives should lawyer. The author suggests precursory paradigms that 1) clarify the ultimate political goals to which activism is and should be directed; 2) analyze the social conditions shaping and defining grassroots activity; and 3) specify and systematize the myriad methods that can and should be used to further these ends. In critiquing prevailing theoretical formulations that relate to these considerations, the author argues that progressive lawyers need to …
Using Paired Comparison Matrices To Estimate Parameters Of The Partial Credit Rasch Measurement Model For Rater-Mediated Assessments, Mary Garner, George Engelhard Jr.
Using Paired Comparison Matrices To Estimate Parameters Of The Partial Credit Rasch Measurement Model For Rater-Mediated Assessments, Mary Garner, George Engelhard Jr.
Faculty Articles
The purpose of this paper is to describe a technique for estimating the parameters of a Rasch model that accommodates ordered categories and rater severity. The technique builds on the conditional pairwise algorithm described by Choppin (1968, 1985) and represents an extension of a conditional algorithm described by Garner and Engelhard (2000, 2002) in which parameters appear as the eigenvector of a matrix derived from paired comparisons. The algorithm is used successfully to recover parameters from a simulated data set. No one has previously described such an extension of the pairwise algorithm to a Rasch model that includes both ordered …

Pets In Print Advertising - Are We Seeing More Of Rover And Fluffy? A Content Analysis Of Four Popular Magazines, Charles M. Mayo, Donna T. Mayo, Marilyn M. Helms
Faculty Articles
This content analysis of advertising in four popular magazines investigates whether the role of pets-specifically dogs and cats-has changed as they have grown in popularity and power in American culture. Analysis of print advertisements from 1994 and 2004 suggests that although the frequency with which household pets appear in print advertisements has declined slightly, portrayals of "Rover" and "Fluffy" have changed to reflect society's growing fascination with and devotion to our furry family members.
Structural Relations Among Negative Affect, Mate Value, And Mating Effort, Beth Randi Kirsner, Aurelio Jose Figueredo, W. Jake Jacobs
Structural Relations Among Negative Affect, Mate Value, And Mating Effort, Beth Randi Kirsner, Aurelio Jose Figueredo, W. Jake Jacobs
Faculty Articles
We compared the ability of models based on evolutionary economic theory and Life History (LH) Theory to explain relations among self-reported negative affect, mate value, and mating effort. Method: Two hundred thirty-eight undergraduates provided multiple measures of these latent constructs, permitting us to test a priori predictions based on Kirsner, Figueredo, and Jacobs (2003). We compared the fit of the initial model to the fit of five alternative theory-driven models using nested model comparisons of Structural Equations Models. Rejecting less parsimonious and explanatory models eliminated the original model. Two equally parsimonious models explained the data pattern well. The first, based …
Environmental Enrichment Effects On The Activity Of A Nearctic River Otter, Kenneth O. Nelson
Environmental Enrichment Effects On The Activity Of A Nearctic River Otter, Kenneth O. Nelson
Theses
Environmental enrichment has been used to identify and change a stimulus in a captive environment to increase the animal's welfare by bring out species-appropriate behaviors and combating stereotypic behaviors. One captive North American river otter (Lontra canadensis) was presented four enrichment initiatives (live fish, frozen fish, swim tube, PVC scent tubes) in a random order and placement throughout the exhibit. Baseline data showed that the otter preferred to spend mornings in the lower level of the exhibit and the afternoons in the upper level. Food initiatives (i.e. live fish, and a lesser degree frozen fish) were most effective in deterring …

Gothic Cordelias: The Afterlife Of "Lear" And The Construction Of Femininity, Diane Hoeveler
English Faculty Research and Publications
Addresses the gap for an analysis of Shakespeare's relation to the Gothic.
The Gothic novel transports you to a strange and fascinating world quite unlike your own, far away from the calm drawing rooms of Regency England. It is the ultimate escapist literature. It is this world, and its mutually beneficial relationship with Catholicism, that Dr Maria Purves so beautifully illuminates for the reader.
Development Of Cognitive Capabilities In Humanoid Robots, Vadim Tikhanoff
Development Of Cognitive Capabilities In Humanoid Robots, Vadim Tikhanoff
School of Engineering, Computing and Mathematics Theses
Building intelligent systems with human level of competence is the ultimate grand challenge for science and technology in general, and especially for the computational intelligence community. Recent theories in autonomous cognitive systems have focused on the close integration (grounding) of communication with perception, categorisation and action. Cognitive systems are essential for integrated multi-platform systems that are capable of sensing and communicating. This thesis presents a cognitive system for a humanoid robot that integrates abilities such as object detection and recognition, which are merged with natural language understanding and refined motor controls. The work includes three studies; (1) the use of …
Revealing Choices: Using Taxpayer Choice To Target Tax Enforcement, Alex Raskolnikov
Revealing Choices: Using Taxpayer Choice To Target Tax Enforcement, Alex Raskolnikov
Faculty Scholarship
People pay their taxes for many different reasons. Some choose to game the system, paying only when the cost of noncompliance outweighs its benefits. Others comply out of habit, a sense of duty or reciprocity, a desire to avoid feelings of guilt or shame, and for many other reasons. Our tax enforcement system has ignored this variety of taxpaying motivations for decades. It continues to rely primarily on audits and penalties, at least where information reporting and withholding are impossible. Fines and audits deter those rationally playing the tax compliance game, but are wasteful or even counterproductive when applied to …
