Colorblind, Deaf And Dumb: Examining Race In A Contemporary American High School, Brendan Bedell Jan 2009

Colorblind, Deaf And Dumb: Examining Race In A Contemporary American High School, Brendan Bedell

Dissertations

Despite rhetoric of a meritocratic education system, there is little doubt that race still plays a significant role in advantaging white students while disadvantaging black students in school. These advantages and disadvantages are subtly carried out. The root causes of racial disparities in schools are not easily identified and often considered taboo outside of the academy. There is little research that assesses the ways in which students understand the relationship between race and schooling when compared to professional educators. Therefore, the research question for this project was: What language and perspectives do school personnel use in discussing race and what …

[Black] Regional Conferences In The Seventh-Day Adventist (Sda) Church Compared With United Methodist [Black] Central Jurisdiction/Annual Conferences With White Sda Conferences, From 1940 - 2001, Alfonzo Greene, Jr.

Dissertations

This study compares the historical development of [Black] Regional Conferences in the Seventh-day Adventist (SDA) Church with [Black] Central Jurisdiction/Black Annual Conferences in Methodism (now known as the United Methodist Church) and White SDA Conferences--specifically through the prism of race, religion, and to a lesser degree gender. Secondly, emphasis is given to the salient events surrounding [Black] Regional SDA Conferences and [Black] Methodist Central Jurisdiction/Annual Conferences, and White SDA Conferences in order to discern the thread of historical development that emerged in these religious entities. What were the reasons the Methodist and Seventh-day Adventists decided it was essential to set …

Impact Of Interest Group Testimony On Lawmaking In Congress, Nina Therese Kasniunas Jan 2009

Impact Of Interest Group Testimony On Lawmaking In Congress, Nina Therese Kasniunas

Dissertations

Building on interest group and congressional committee literature, the interest group impact theory is created to explicate the role of interest groups in congressional committee hearings. This theory applies not only to the influence interest groups have in congressional hearings, but also to the access given to them to be able to participate. The theory maintains that interest groups are necessary to legislators in this capacity since they provide valuable information relating to politics, elections and policy. Resource rich interest groups with visibility as experts in a policy area are expected to be given more access and influence particularly to …

Social Support And Work-School Conflict: A Daily Study, Eric John Faurote Jan 2009

Social Support And Work-School Conflict: A Daily Study, Eric John Faurote

Dissertations and Theses @ UNI

The goal of this study was to examine within-person associations between work-school conflict (WSC), social support at work, job satisfaction, and negative affect. There were 108 undergraduates for a Midwest university that participated in this study. Greater WSC was associated with decreased job satisfaction and increased negative affect (NA). Social support buffered the relationship between WSC and job satisfaction such that individuals with low social support experienced a decrease in job satisfaction when WSC was high, but they did not experience this decrease with social support was high. Greater social support from co-workers was associated with increased job satisfaction and …

Dissertations and Theses @ UNI

The purpose of this study was to investigate the growth trajectory of college and/or university students in core competencies from entry to exit in the Camp Adventure™ Youth Services (CAYS) experience using the lens offered by Bok's framework. Specifically, students' growth patterns in core competencies were charted at three phases, namely, (1) baseline of their core competencies at entry level; (2) after receiving knowledge and practical training on the theory and implementation of CAYS' course but before its field experience; and (3) immediately after the CAYS' field experience. The core competencies included in the study were, according to Bok's framework, …

Judicial Disciplinary Systems For Incorrectly Decided Cases: The Imperial Chinese Heritage Lives On, Carl F. Minzner Jan 2009

Judicial Disciplinary Systems For Incorrectly Decided Cases: The Imperial Chinese Heritage Lives On, Carl F. Minzner

Faculty Scholarship

Local Chinese courts commonly use responsibility systems (mubiao guanli zeren zhi, zeren zhuijiu zhi) to evaluate and discipline judges. Judges receive sanctions under these systems for a wide range of behavior, such as illegal or unethical dealings with parties and lawyers, inappropriate courtroom behavior, and neglect of duty.

Many local court Chinese responsibility systems also discipline judges for simple legal error. Judges may face sanctions linked to the number of cases that are reversed on appeal, simply because the interpretation of law made by a higher court differs from that of the original trial judge. Sanctions include monetary fines and …

Lifting The Museum's Burden From The Backs Of The University: Should The Art Collection Be Treated As Part Of The Endowment Symposium: Tax-Exempt Organizations And The State: New Conditions On Exempt Status, Linda Sugin

Faculty Scholarship

A few universities in economic straits have recently attempted to sell artwork to address their financial woes, causing much consternation in the museum community. This Article relates the stories of some institutions' attempts to deaccession artworks, and explains why universities may suddenly perceive their art collections as important assets to monetize. It contends that the universities and their critics have fundamentally divergent conceptions of the role of the art collection in the university, which explains why they cannot agree on the legal responsibilities of universities vis-a-vis their art. The critics have a strong cultural-property conception that privileges art, while these …

Rethinking Criminal Law And Family Status , Dan Markel, Ethan J. Leib, Jennifer M. Collins Jan 2009

Rethinking Criminal Law And Family Status , Dan Markel, Ethan J. Leib, Jennifer M. Collins

Faculty Scholarship

In our recent book, Privilege or Punish: Criminal Justice and the Challenge of Family Ties (OUP 2009), we examined and critiqued a number of ways in which the criminal justice system uses family status to distribute benefits or burdens to defendants. In their review essays, Professors Alafair Burke, Alice Ristroph & Melissa Murray identify a series of concerns with the framework we offer policymakers to analyze these family ties benefits or burdens. We think it worthwhile not only to clarify where those challenges rest on misunderstandings or confusions about the central features of our views, but also to show the …

Supreme Court As Interstitial Actor: Justice Ginsburg's Eclectic Approach To Statutory Interpretation Symposium: The Jurisprudence Of Justice Ruth Bader Ginsberg: A Discussion Of Fifteen Years On The U.S. Supreme Court, James J. Brudney

Faculty Scholarship

The Supreme Court is in the midst of an extended debate regarding the proper approach to construing federal statutes. A number of Justices have engaged in heated dialogue addressing the pros and cons of textualism or intentionalism, as well as the virtues and limitations of Chevron deference. Although Justice Ginsburg has not participated in these judicial exchanges, she has adopted her own approach to the challenge of interpreting federal statutes. This Article explores Ginsburg’s approach by focusing on four opinions that construe federal criminal laws and three that interpret labor relations and anti-discrimination laws. The Article’s central thesis is that …

From Here To Beijing: Public/Private Overlaps In Trade And Their Effects On U.S. Law, Elizabeth Trujillo Jan 2009

From Here To Beijing: Public/Private Overlaps In Trade And Their Effects On U.S. Law, Elizabeth Trujillo

Faculty Scholarship

Recent news involving contaminated pet food and unsafe toys imported from China makes us question the legal frameworks that facilitated such incidences and stirs anti-globalization sentiment. While consumers wonder about the role of their governments in this context and look for judicial remedies, deeper questions arise regarding the international forces lying beneath the surface of the legal remedial work of our domestic courts. This paper explores the international trade paradigm in place that facilitates the inner workings of private investors and has trickling effects on domestic law. Furthermore, it will show that the trade regime is transnational in nature, consisting …

When Does Might Make Right? Using Force For Regime Change, John Linarelli Jan 2009

When Does Might Make Right? Using Force For Regime Change, John Linarelli

Scholarly Works

Should states use force to bring about regime change? International law recognizes no such grounds. This paper seeks to provide guidance from moral theory. The aim of this paper is to identify the moral grounds for the use of armed force by one state or a group of states, against another state, when the intention of the intervening states is to achieve a fundamental change in the character of the political and legal institutions of the other state. Lawyers tend to place the argument for regime change intervention within putative humanitarian intervention doctrines. The moral justification for humanitarian intervention is …

Community Benefits Agreements And Comprehensive Planning: Balancing Community Empowerment And The Police Power, Patricia E. Salkin, Amy Lavine Jan 2009

Community Benefits Agreements And Comprehensive Planning: Balancing Community Empowerment And The Police Power, Patricia E. Salkin, Amy Lavine

Scholarly Works

Traditionally, the states have empowered local governments to develop plans and implement regulations for neighborhood and community development. When accomplished at the local or regional level, the interests and benefits of the community as a whole are to be weighed against the detriments to individuals. Much has been studied and written about the lack of meaningful public participation in the planning and land use regulatory process, suggesting that often low-income and minority communities are not fully engaged in the process, even when it may result in decisions negatively impacting their neighborhoods. Case studies have also shown that governments are sometimes …

Sustainability And Land Use Planning: Greening State And Local Land Use Plans And Regulations To Address Climate Change Challenges And Preserve Resources For Future Generations, Patricia E. Salkin

Scholarly Works

Although a coordinated national policy on climate change should be developed, initiatives at the local government level through the land use planning and regulatory control processes have tremendous potential to dramatically contribute to the reduction of green house gas emissions, leading to a reduction in the carbon footprint and ultimately to a more sustainable environment. Part I of this article discusses opportunities for using the comprehensive land use planning process to address sustainability and provides examples of how this is being accomplished across the country. Part II mentions the growing number of state and local climate action plans (and cross-references …

Linking Land Use With Climate Change And Sustainability Topped State Legislative Land Use Reform Agenda In 2008, Patricia E. Salkin

Scholarly Works

Linking land use with climate change and sustainability topped state legislative land use reform agenda in 2008. The only discernible state land use reform trends in 2008 have focused primarily on themes surrounding sustainability. Many states pursued statutory reforms to address the strong linkages between land use and climate change, green development and affordable housing. Only one state, Michigan, focused on recodification of its planning and zoning enabling acts.

Ica And The Writing Requirement: Following Modern Trends Towards Liberalization Or Are We Stuck In 1958?, Jack Graves

Scholarly Works

Article 7 of the Model Law was revised in 2006 to liberalize any requirements of form, consistent with modern commercial practices and modern legal trends reflected in national laws. To the extent adopted by national legislatures, either of the two available options under this revision will effectively eliminate any requirement of a “record of consent,” thus making arbitration agreements more easily enforceable in the adopting jurisdiction. However, any such revision of national laws on arbitration based on the revisions of Article 7 of the Model Law will not necessarily have any effect on enforcement of awards in other jurisdictions under …

Images Of Egypt In Early Biblical Literature: Cisjordan-Israelite, Transjordan-Israelite, And Judahite Portrayals, Stephen C. Russell Jan 2009

Images Of Egypt In Early Biblical Literature: Cisjordan-Israelite, Transjordan-Israelite, And Judahite Portrayals, Stephen C. Russell

Publications and Research

This book suggests a regional paradigm for understanding the development of the traditions about Egypt and the exodus in the Hebrew Bible. It offers fresh readings of the golden calf stories in 1 Kgs 12:25-33 and Exod 32, the Balaam oracles in Num 22-24, and the Song of the Sea in Exod 15:1b-18 and from these paints a picture of the differing traditions about Egypt that circulated in Cisjordan Israel, Transjordan Israel, and Judah in the 8th century B.C.E. and earlier.
In the north, an exodus from Egypt was celebrated in the Bethel calf cult as a journey of Israelites …

It Takes Two: The Interplay Of Individual And Group Theology On Social Embeddedness, Christopher P. Scheitle, Amy Adamczyk Jan 2009

It Takes Two: The Interplay Of Individual And Group Theology On Social Embeddedness, Christopher P. Scheitle, Amy Adamczyk

Publications and Research

Prior research argues that religious homophily in social networks is a product of overlapping interests and activities unintentionally leading to relationships or the intentional seeking of relationships with people of similar religious beliefs. This article advances research on religious homophily by including the role that exclusive theological beliefs play in explaining religious homophily among friends. We lay out three propositions for individual-, congregational-, and cross-level effects on the relationship between exclusive theology and embeddedness within one's congregation. Using multilevel models and data from the U.S. Congregational Life Survey (USCLS), we find support for our three propositions. We discuss our findings …

Shaping Attitudes About Homosexuality: The Role Of Religion And Cultural Context, Amy Adamczyk, Pitt Cassidy Jan 2009

Shaping Attitudes About Homosexuality: The Role Of Religion And Cultural Context, Amy Adamczyk, Pitt Cassidy

Publications and Research

Across the globe, the debate over homosexuality continues, with great variation in public opinion about the acceptability of homosexuality, laws regulating same-sex unions and penalties for homosexual sex behaviors. Religion is often seen as an important predictor of attitudes about homosexuality. However, cross-national differences in cultural orientations suggest that the role religion has in explaining homosexual attitudes may depend on a nation’s cultural context. In this study, we merge ideas from cultural sociology and religious contextual effects to explain cross-national variation in public opinion about homosexuality. Using data from the fourth wave of the World Values Survey and Hierarchical Modeling …

Edgar Degas's Fan-Shaped Designs: Art, Decoration, And The Modern Woman In Late-Nineteenth-Century France, Alicia Mccaghren Cook

All ETDs from UAB

French modernist Edgar Degas is one of the most well-known artists of the nineteenth century and his ballet paintings are among the most identifiable works in the history of art. However, surprisingly little scholarship exists on the twentyfive mixed-media fan-shaped designs he created sporadically throughout his career. This thesis focuses on the circumstantial factors surrounding the fans’ creation, in particular the mid-nineteenth-century Japonisme craze, the connotations of the fan as an historical item, and the intersection of commodity, fashion, and gender. Degas created nineteen of the twenty-five fans from 1878-1879 for the Fourth Impressionist Exhibit. This dazzling and sumptuous group …
