Ica And The Writing Requirement: Following Modern Trends Towards Liberalization Or Are We Stuck In 1958?, Jack Graves Jan 2009

Ica And The Writing Requirement: Following Modern Trends Towards Liberalization Or Are We Stuck In 1958?, Jack Graves

Scholarly Works

Article 7 of the Model Law was revised in 2006 to liberalize any requirements of form, consistent with modern commercial practices and modern legal trends reflected in national laws. To the extent adopted by national legislatures, either of the two available options under this revision will effectively eliminate any requirement of a “record of consent,” thus making arbitration agreements more easily enforceable in the adopting jurisdiction. However, any such revision of national laws on arbitration based on the revisions of Article 7 of the Model Law will not necessarily have any effect on enforcement of awards in other jurisdictions under …

Images Of Egypt In Early Biblical Literature: Cisjordan-Israelite, Transjordan-Israelite, And Judahite Portrayals, Stephen C. Russell Jan 2009

Images Of Egypt In Early Biblical Literature: Cisjordan-Israelite, Transjordan-Israelite, And Judahite Portrayals, Stephen C. Russell

Publications and Research

This book suggests a regional paradigm for understanding the development of the traditions about Egypt and the exodus in the Hebrew Bible. It offers fresh readings of the golden calf stories in 1 Kgs 12:25-33 and Exod 32, the Balaam oracles in Num 22-24, and the Song of the Sea in Exod 15:1b-18 and from these paints a picture of the differing traditions about Egypt that circulated in Cisjordan Israel, Transjordan Israel, and Judah in the 8th century B.C.E. and earlier.
In the north, an exodus from Egypt was celebrated in the Bethel calf cult as a journey of Israelites …

It Takes Two: The Interplay Of Individual And Group Theology On Social Embeddedness, Christopher P. Scheitle, Amy Adamczyk Jan 2009

It Takes Two: The Interplay Of Individual And Group Theology On Social Embeddedness, Christopher P. Scheitle, Amy Adamczyk

Publications and Research

Prior research argues that religious homophily in social networks is a product of overlapping interests and activities unintentionally leading to relationships or the intentional seeking of relationships with people of similar religious beliefs. This article advances research on religious homophily by including the role that exclusive theological beliefs play in explaining religious homophily among friends. We lay out three propositions for individual-, congregational-, and cross-level effects on the relationship between exclusive theology and embeddedness within one's congregation. Using multilevel models and data from the U.S. Congregational Life Survey (USCLS), we find support for our three propositions. We discuss our findings …

Shaping Attitudes About Homosexuality: The Role Of Religion And Cultural Context, Amy Adamczyk, Pitt Cassidy Jan 2009

Shaping Attitudes About Homosexuality: The Role Of Religion And Cultural Context, Amy Adamczyk, Pitt Cassidy

Publications and Research

Across the globe, the debate over homosexuality continues, with great variation in public opinion about the acceptability of homosexuality, laws regulating same-sex unions and penalties for homosexual sex behaviors. Religion is often seen as an important predictor of attitudes about homosexuality. However, cross-national differences in cultural orientations suggest that the role religion has in explaining homosexual attitudes may depend on a nation’s cultural context. In this study, we merge ideas from cultural sociology and religious contextual effects to explain cross-national variation in public opinion about homosexuality. Using data from the fourth wave of the World Values Survey and Hierarchical Modeling …

Edgar Degas's Fan-Shaped Designs: Art, Decoration, And The Modern Woman In Late-Nineteenth-Century France, Alicia Mccaghren Cook

All ETDs from UAB

French modernist Edgar Degas is one of the most well-known artists of the nineteenth century and his ballet paintings are among the most identifiable works in the history of art. However, surprisingly little scholarship exists on the twentyfive mixed-media fan-shaped designs he created sporadically throughout his career. This thesis focuses on the circumstantial factors surrounding the fans’ creation, in particular the mid-nineteenth-century Japonisme craze, the connotations of the fan as an historical item, and the intersection of commodity, fashion, and gender. Degas created nineteen of the twenty-five fans from 1878-1879 for the Fourth Impressionist Exhibit. This dazzling and sumptuous group …

Toward A Development Of A Cosmopolitan Aesthetic, Nalini Bhushan Jan 2009

Toward A Development Of A Cosmopolitan Aesthetic, Nalini Bhushan

Contemporary Aesthetics (Journal Archive)

In this essay I explore the interaction between race and aesthetics in colonial India (1857-1947). In the context of nation building and the Indian independence movement, the Indian art world struggles to articulate conditions for the very possibility of an artist who would be authentically Indian while remaining authentically artistic, a seemingly impossible accomplishment. And yet a chosen few are somehow are able to do just this: cosmopolitan Indian artists, transcending the parochial boundaries of nation, race, ethnicity, and religion as set by tradition, while remaining rooted in something that is nonetheless fundamentally Indian. I focus on three artists from …

Immortal Fame: Publicity Rights, Taxation, And The Power Of Testation, Joshua C. Tate Jan 2009

Immortal Fame: Publicity Rights, Taxation, And The Power Of Testation, Joshua C. Tate

Georgia Law Review

Several states now recognize survivable publicity rights, allowing the heirs of a deceased celebrity to inherit the rights to her image and likeness. Under the default U.S. rule of testamentary freedom, a celebrity could also freely devise such survivable rights to persons of his or her choosing. Nevertheless, some scholars have recently proposed the adoption of state statues under which survivable publicity rights would pass automatically to specified statutory heirs regardless of the celebrity's wishes. This Article concludes that no such interference with testamentary freedom is warranted. There is admittedly some historical precedent for protecting the interests of surviving family …

Discounting Works: A Structural Approach To Understanding Why, Robertico R. Croes, Kelly J. Semrad Jan 2009

Discounting Works: A Structural Approach To Understanding Why, Robertico R. Croes, Kelly J. Semrad

Dick Pope Sr. Institute Publications

Hotel managers have long toiled over a course of action that would help them preserve hotel revenue during diminished demand seasons. They have responded to this challenge by discounting hotel room rates to sustain revenue and the means by which they could determine how discounting could increase hotel financial performance. That revenue would otherwise be lost when supply of rooms exceeds the demand. Their need to find a procedure to aid them in solving hotel occupancy problems that threaten that revenue has been a source of discussion throughout the industry. However, most of the studies are more prescriptive and normative …

Restorative Justice: A Systematic Review Of The Social Work Literature, Edward J. Gumz, Cynthia L. Grant Jan 2009

Restorative Justice: A Systematic Review Of The Social Work Literature, Edward J. Gumz, Cynthia L. Grant

Social Work: School of Social Work Faculty Publications and Other Works

Restorative justice is an alternative paradigm for dealing with the effects of crime and wrongdoing that seeks to bring healing to victims, offenders, and the community. Although a key element of social work’s ethical code is the obligation to work toward social justice, this has been viewed primarily as efforts to ensure a fair distribution of resources and opportunities. Yet justice is also restorative in nature—seeking to restore and enhance victims, offenders, and communities to fuller functioning. This article systematically reviews 80 social work peer-reviewed articles dealing with restorative justice. The role of social workers in restorative justice programs remains …

Korean Older Intimate Partner Violence Survivors In North America: Cultural Considerations And Practice Recommendations, Woochan Shim, Holly Nelson-Becker

Social Work: School of Social Work Faculty Publications and Other Works

While literature on elder abuse has expanded, elder abuse by intimate partners has been less investigated. Even less is known about intimate partner violence among older Koreans living in North America. This article identifies important cultural considerations for individuals helping the Korean older adult community beginning with the definition of intimate partner violence in this community and barriers to leaving that include traditional views of the East Asian self. Current practice interventions are discussed and recommendations for future practice such as healing han, the accumulated suffering from years of abuse, are suggested. The ultimate goal of this paper is …
