State-Created Property And Due Process Of Law: Filling The Void Left By Engquist V. Oregon Department Of Agriculture, Michael L. Wells, Alice E. Snedeker

Georgia Law Review

Several years ago, in Village of Willowbrook v. Olech, the Supreme Court recognized a "class-of-one"equal protection theory, under which individuals charging that they were singled out for arbitrary treatment by officials may sue for vindication. Last term, in Engquist v. Oregon Department of Agriculture, the Court barred recourse to this type of claim on the part of government employees. The reasoning of Engquist, which emphasizes the discretionary nature of employment decisions, threatens to eliminate a wide range of class-of-one claims outside the employment area as well. There is a pressing need for an alternative. This Article proposes another basis on …

CASE DESCRIPTION: The primary objective of this case is to describe realistic capital budgeting issues within a large organization. The case illustrates ways that staff inside a corporate finance department (and in related departments) position themselves in the capital planning process. The case also stresses steps that a large firm can take to leverage its size to gain the maximum benefit of investment projects. Further,, the case demonstrates sensitivity analyses in the capital budgeting process, and the resulting internal rates of return. We suggest the case be used to follow the related case “HDTV Systems”, which shows the firm as …

The Future Of Tourism In Aruba: Part One, Kevin S. Murphy

Dick Pope Sr. Institute Publications

Global issues dominated the discussion at the Aruba Timeshare Association (ATSA) sponsored think tank on visioning the future of Aruba. Global competition, global foreign policy, changing demographics and the global environment emerged as primary concerns by participants at the ATSA event on November 30, 2006. They also expressed major concerns over the lack of public-private cooperation to assist the Aruba tourism industry in addressing the challenges in these areas. Additionally, they also were quick to identify the lack of serious industry-wide leadership in moving the industry's collective level of understanding of these challenges to the next level. While discussion and …

Beauty photoproduction in dijet events has been measured at HERA with the ZEUS detector using an integrated luminosity of 126 pb-1. Beauty was identified in events with a muon in the final state by using the transverse momentum of the muon relative to the closest jet. Lifetime information from the silicon vertex detector was also used; the impact parameter of the muon with respect to the primary vertex was exploited to discriminate between signal and background. Cross sections for beauty production as a function of the muon and the jet variables as well as dijet correlations are compared to QCD …

The charm fragmentation function has been measured in D* photoproduction with the ZEUS detector at HERA using an integrated luminosity of 120 pb-1. The fragmentation function is measured versus z = (E +p||)D* /2Ejet, where E is the energy of the D * meson and p|| is the longitudinal momentum of the D * meson relative to the axis of the associated jet of energy Ejet. Jets were reconstructed using the kT clustering algorithm and required to have transverse energy larger than 9GeV. The D* meson associated with the jet was required to have a transverse momentum larger than 2GeV. …

Stakeholder Participation In New Governance: Lessons From Chicago, Lisa T. Alexander Jan 2009

Stakeholder Participation In New Governance: Lessons From Chicago, Lisa T. Alexander

Faculty Scholarship

The efficacy of the public-private partnership as a tool for social reform is the subject of continued scholarly and public debate. New governance theory, an increasingly popular form of jurisprudence, constructs an optimistic vision of stakeholder collaboration in public-private partnerships that justifies the use of the public-private partnership in regulatory reform. New governance scholars contend that recent governance trends such as devolution, deregulation, decentralization, and privatization create opportunities for previously marginalized stakeholders to more fully participate in public problem-solving. New governance scholars expect that both public and private stakeholders, with differing interests, skills and objectives, will effectively collaborate to solve …

This paper discusses the features of the PSP browser and suggests best practices for extracting digital evidence.

Law From Above: Unmanned Aerial Systems, Use Of Force, And The Law Of Armed Conflict, Chris Jenks Jan 2009

Law From Above: Unmanned Aerial Systems, Use Of Force, And The Law Of Armed Conflict, Chris Jenks

Faculty Journal Articles and Book Chapters

The United States employing armed unmanned aerial systems (UAS) or “drones” against al qaeda and Taliban targets in northwest Pakistan continues to spur discussion and disagreement. Some label UAS “armed robotic killers,” while others describe them as providing a much greater degree of distinction between intended targets and the surrounding population and infrastructure, thus limiting civilian casualties and property damage. The overt disagreement as to whether the strikes are legal masks that the discussants are utilizing wholesale different methodologies, talking past each other in the process. The origin of this divergence is to what extent the law of armed conflict …

We present data from the Floating Potential Measurement Unit (FPMU) that is deployed on the starboard truss of the International Space Station. The FPMU is a suite of instruments capable of redundant measurements of various plasma parameters. The instrument suite consists of a floating potential probe, a wide-sweeping spherical Langmuir probe, a narrow-sweeping cylindrical Langmuir probe, and a plasma impedance probe. This paper gives a brief overview of the instrumentation and the received data quality, and then presents the algorithm used to reduce I-V curves to plasma parameters. Several hours of data are presented from August 5, 2006 and March …

The present study provides the results from a comparative study of the 3 commonly used methods for total protein (TP) measurement. The experiments were carried out with 6 dogs (4-7 year-old, weighing 12.8 ± 1.4 kg). Five blood samples were obtained by saphena venepuncture from all dogs, during the time course of the experimentally induced infection with Staphylococcus intermedius, administered subcutaneously at a dose rate of 5 ml of 1.10^9 CFU/ml within 14 days. TP concentration was measured by 2 macro protein techniques - biuret method (commonly used) and method of Lowry, and a modified version of biuret method (micro …
