A novel and state-of-the-art approach for the analysis of cardiac arrhythmias is proposed. Currently, the analysis of the electrocardiogram is only performed in the time-domain. The proposed method improves the electrocardiogram analysis by adding spatial properties. The spatial properties added to the electrocardiogram allow for the analysis of specific regions inside the human heart where cardiac arrhythmias are suspected to have occurred. In this Dissertation, the concept of electrocardiography was extended using advanced bioelectromagnetism theory. The purpose of this study was to examine an extra-legal variable that may affect the credibility of a defendant and the alibi corroborator's testimonies. In this study, the facial appearance of the alibi corroborator was manipulated to resemble the defendant or the trial judge to different degrees using facial morphing software. Participants serving as mock jurors provided verdicts for a trial summary and rated the credibility of an alibi corroborator. It was hypothesized that as the facial resemblance shared between an alibi corroborator and a defendant increased, the less credible the alibi corroborator's testimony would be perceived, resulting in an …

Combating Global White Supremacy In The Digital Era, Jessie Daniels

This chapter explores both the ability of white supremacists to connect globally through Internet technologies, and considers international efforts to combat white supremacy. The United States is not a willing partner in fighting white supremacy online due to certain interpretations of the first amendment. However, absolutist views of free speech contradict the Supreme Court of the US which has ruled that there is a burning cross is not protected by the first amendment. Failing to take action against white supremacy online, the US functions as a global haven for hate speech.

Clarence X?: The Black Nationalist Behind Justice Thomas's Constitutionalism, Stephen F. Smith

The opinions of Justice Thomas reflect a jurisprudence that is uniquely his own. His well-known commitment to textualism and originalism combines with a weak commitment to stare decisis on constitutional questions. This often puts Thomas at odds with Justice Scalia and other Justices who are far more willing to defer to precedents with which they disagree. The most distinctive aspect of Thomas's jurisprudence, however, involves cases of particular concern to black Americans. In these cases, his originalism and textualism are powerfully supplemented by another -ism—namely, "black nationalism."

This Essay, prepared for a NYU Journal of Law and Liberty symposium on “The Unknown Justice Thomas,” challenges the oft-repeated criticism that Justice Clarence Thomas’s opinions reflect a lack of empathy for the less fortunate. The Essay argues that, on the contrary, Justice Thomas’s opinions are replete with expressions of concern for the “little guy,” which are frequently overlooked or misinterpreted. The Essay explores three themes reflecting this concern in Thomas’s opinions.

Synergies And Tensions Between Rural Social Movements And Professional Researchers, Marc Edelman

This essay outlines approaches to analysing and managing relations between rural activists and academic researchers. It suggests (a) that contemporary social movements engage in knowledge production practices much like those of academic and NGO-affiliated researchers and (b) that the boundaries between activists and researchers are not always as sharp as is sometimes claimed. These blurred boundaries and shared practices can create synergies in activist– academic relations. The essay then examines tensions in the relationship, including activists’ expectation that academic research will be immediately applicable to their struggles and researchers’ expectation that movement participants will accommodate their needs. Disagreeing with Jerrold Levinson’s claim that being conscious of broad span musical form is not essential to understanding music, I will argue that our awareness of musical architecture is significant to achieve comprehension. I will show that the experiential model is not incompatible with the analytic model. My main goal is to show that these two models can be reconciled through the identification of a broader notion of understanding. More than fifty years ago, Congress enacted a prohibition against political campaign intervention for all charities, including churches and other houses of worship, as a condition for receiving tax deductible contributions. Yet the IRS has never taken a house of worship to court for alleged violation of the prohibition through political comments from the pulpit, presumably at least in part because of concerns about the constitutionality of doing so. This article analyzes the grounds, procedures, and conditions required by International Human Rights Law for preventive detention of suspected terrorists as threats to security. Such detention is generally permitted, provided it is based on grounds and procedures previously established by law; is not arbitrary, discriminatory, or disproportionate; is publicly registered and subject to fair and effective judicial review; and the detainee is not mistreated and is compensated for any unlawful detention. In their article, Land Assembly Districts, Professors Michael Heller and Rick Hills address the collective action problem arising from excessively fragmented land. They propose an innovative solution: Land Assembly Districts (or LADs). In this Article, I raise several concerns regarding LADs in particular and majoritarian land assembly in general. LADs rely on majority voting by a neighborhood's existing owners. Yet majority voting, coupled with the possibility of heterogeneity, means that LADs may both approve socially undesirable assemblies and disapprove socially desirable ones. LADs also permit owners to bargain over a project's surplus. But such bargaining creates additional costs for developers, …

Pretextual Takings: Of Private Developers, Local Governments, And Impermissible Favoritism, Daniel B. Kelly

Since Kelo v. City of New London, the preferred litigation strategy for challenging a condemnation that benefits a private party is to allege that the taking is pretextual. This Article contends that, although pretextual takings are socially undesirable, the current judicial test for identifying such takings is problematic. Yet an alternative, intent-based test might be impracticable, as well as underinclusive: condemnors often have mixed motives, particularly when confronted with a firm's credible threat to relocate. Instead, the Article develops a framework that emphasizes informational differences between local governments and private developers. Sandel has treated us to an elegant argument against efforts by athletes to use medicine to "enhance" their bodies or by parents, in effect, to genetically engineer their children. I cannot agree with him more that "playing God" (my phrase, not his) in these ways is fundamentally an exercise in hubris, a rejection of the gifts that we have been given. The article discusses the inclusion of the free exercise of religion among a society's constitutional guarantees in the U.S. It cites Christopher Eisgruber and Lawrence Sager, authors of the book "Religious Freedom and the Constitution," who hold that religion does not deserve constitutional mention on account of any special value. It disputes this view and states that religion does deserve constitutional mention and that the constitution should protect a citizen's right to practice his or her religion.

This article traces the origins of various proposals to nationalize Islam in Turkey. The initial Turkish proposals failed because none of them had a feasible philosophical base to facilitate the co-existence of Islam and secularism. Aside from the previous studies on the nationalization of Islam, this article carries the topic to the Cold War by arguing that the Turkish-Islamic Synthesis was the last stage on the nationalization of Islam. This study examined cleft lip and palate from the sociological point of view. It looked at the social aspects of a health issue by examining the social problems that may emanate from cleft lip/palate deformity. Questionnaires were administered in northern Nigeria to 32 patients between the ages of 10 and 60 who had been born with the defect. Oral interviews using the same set of questions were conducted with 18 patients with similar defects of cleft lip/palate deformity in southern Nigeria.
