The Dna Of An Argument: A Case Study In Legal Logos, Colin Starger
The Dna Of An Argument: A Case Study In Legal Logos, Colin Starger
All Faculty Scholarship
This Article develops a framework for analyzing legal argument through an in-depth case study of the debate over federal actions for post-conviction DNA access. Building on the Aristotelian concept of logos, this Article maintains that the persuasive power of legal logic depends in part on the rhetorical characteristics of premises, inferences, and conclusions in legal proofs. After sketching a taxonomy that distinguishes between prototypical argument logo (formal, empirical, narrative, and categorical), the Article applies its framework to parse the rhetorical dynamics at play in litigation over post-conviction access to DNA evidence under 42 U.S.C. § 1983, focusing in particular on …

Collateral Damage? Juvenile Snitches In America’S 'Wars' On Drugs, Crime And Gangs, Andrea L. Dennis
Collateral Damage? Juvenile Snitches In America’S 'Wars' On Drugs, Crime And Gangs, Andrea L. Dennis
Scholarly Works
The government’s use of children as informants in America’s 'wars' on drugs, crime, and gangs is little recognized and rarely discussed by scholars, policymakers, and the public. As with many governmental practices, only notorious instances make headlines, such as when a child is killed in retaliation for informing. Because public attention rarely is focused on the practice, it has not generated consistent documentation of, regulation of, or accountability for such use of child informants. As a starting point for discussion, this article illuminates the experiences of child informants, describing a facet of the snitching institution that generally operates under the …

Activating Victim Constituency In International Criminal Justice, Mark Findlay
Activating Victim Constituency In International Criminal Justice, Mark Findlay
Research Collection Yong Pung How School Of Law
This article lays out why in the context of global crime, crime control and the legitimacy of global governance, a victim constituency makes sense in terms of the stated aims of international criminal justice and of a wider ‘new morality’ on which it should be grounded. The incapacity to confront appropriately the consequences to victims of global crime has tended to mean that international criminal justice and the governance that flows from it are unsatisfactorily entwined with sectarian international relations and narrow cultural inclusion. Therefore, in governance terms alone, the conceptualization of global crime victims should be expanded and emancipated …
A Test Of Direct And Partially Mediated Relationships Between Leader Member Exchange, Job Embeddedness, Turnover Intentions, And Job Search Behaviors In A Southern Police Department, Mark D. Bowman
School of Public Service Theses & Dissertations
Job embeddedness has been found to predict turnover intentions, job search behaviors and turnover, and job embeddedness researchers assert, but have not tested, that job embeddedness is a mediator of other organizationally significant factors relative to organizational outcomes. A relationship not previously explored is the role of a supervisor in job embeddedness, which was operationalized in this study as leader-member exchange. A single panel survey was conducted in a police department in the southern United States with 276 current members holding the rank of police officer. Usable surveys were completed by 128 of those police officers, which is a response …
From Clampdown To Limited Empowerment: Hard And Soft Law In The Calibration And Regulation Of Religious Conduct In Singapore, Tan K. B. Eugene
From Clampdown To Limited Empowerment: Hard And Soft Law In The Calibration And Regulation Of Religious Conduct In Singapore, Tan K. B. Eugene
Research Collection Yong Pung How School Of Law
The focus of Singapore's response to terrorism post 9/11 has been to reach out to the “moderate, mainstream” Muslims as a bulwark against societal implosion. This article examines the broad-based endeavor toward “religious moderation.” While coercive draconian legislation remain the mainstay against extremists and radicals, the mobilization of soft law, aspirational norms, and values are consciously woven into the state's endeavors to enhance society's resilience and cohesion. They also seek to regulate religious conduct at a time when the state wishes to entrench secularism as a cornerstone of the governance of a multi-racial, multireligious society. Rights and regulation are not …
Collaborative Governance: Emerging Practices And The Incomplete Legal Framework For Public And Stakeholder Voice, Lisa Blomgran Bingham
Collaborative Governance: Emerging Practices And The Incomplete Legal Framework For Public And Stakeholder Voice, Lisa Blomgran Bingham
Journal of Dispute Resolution
This article describes the broad range of processes through which citizens and stakeholders collaborate to make, implement, and enforce public policy. First, it briefly reviews collaborative and new governance. Second, it describes deliberative democracy; collaborative public or network management; and appropriate dispute resolution in the policy process. These three separate fields are part of a single phenomenon, namely the changing nature of citizen and stakeholder voice in governance. Third, it describes how these new forms of participation operate across the policy continuum. Fourth, it briefly reviews existing legal infrastructure for collaborative governance primarily from the perspective of federal administrative law. …

This thesis is a content analysis of internet pornography websites. Also coded for were each sex act performed in the video as well as the number of performers, their race and sex. Key words describing each video were recorded in addition to user comments about the videos when available.
The goal of this study was …
Massachusetts Youth Screening Instrument Long-Term Outcomes And Scale Stability, Elise Christina Simonds Bisbee
Massachusetts Youth Screening Instrument Long-Term Outcomes And Scale Stability, Elise Christina Simonds Bisbee
Psychology Theses & Dissertations
The Massachusetts Youth Screening Instrument-2 (MAYSI-2; Grisso & Barnum, 2006) was developed in 1998 to offer an efficient measure for identifying adolescents within the juvenile justice system in need of further psychiatric evaluation, treatment, or specialized care. Since the instrument's publication, several studies have evaluated the psychometric properties and clinical utility of the MAYSI-2. The current study adds to the literature examining the reliability and validity of this measure. Specifically, the current study sought to evaluate the long-term characteristics and predictive utility of the MAYSI-2 scale scores. This study utilized a sample of 8,929 boys (n = 6.780) and …
Abusive Supervision, Intentions To Quit, And Employees' Workplace Deviance: A Power/Dependence Analysis, Bennett J. Tepper, Jon C. Carr, Denise M. Breaux, Sharon Geider, Changya Hu, Wei Hua
Abusive Supervision, Intentions To Quit, And Employees' Workplace Deviance: A Power/Dependence Analysis, Bennett J. Tepper, Jon C. Carr, Denise M. Breaux, Sharon Geider, Changya Hu, Wei Hua
Research Collection Lee Kong Chian School Of Business
We conducted a two-study examination of relationships between abusive supervision and subordinates’ workplace deviance. Consistent with predictions derived from power/dependence theory, the results of a cross-sectional study with employees from three organizations suggest that abusive supervision is more strongly associated with subordinates’ organization deviance and supervisor-directed deviance when subordinates’ intention to quit is higher. The results also support the prediction that when intention to quit is higher, abusive supervision is more strongly associated with supervisor-directed deviance than with organization-directed deviance. These results were replicated in a second study, a two-wave investigation of people employed in a variety of industries and …
