It is widely recognized that alcoholism and relationship violence often have serious consequences for adults; however, children living with alcoholic parents are susceptible to the deleterious familial environments these caregivers frequently create. Given the prevalence of IPV among patients entering substance abuse treatment, coupled with the negative familial consequences associated with these types of behavior, this review explores what have been, to this point, two divergent lines of research: (a) the effects of parental alcoholism on children, and (b) the effects of children's exposure to intimate partner violence. An Analysis Of The Current United States And State Of Washington's Mental Health Policies Serving Children And Families, Maile M. Bay

Due to continued fragmentation and gaps in mental health services and the increase in the prevalence of mental health problems for children, youth, and their families, these populations remain underserved. In 2003, the federal New Freedom Commission (Commission) responded by publishing policies to address these concerns. As directed in 2005, the Substance Abuse and Mental Health Services Administration (SAMHSA) funded planning incentive grants to states to transform their delivery of care.

The study reviewed the federal policy, specifically the recommendations of the Commission’s Subcommittee on Children and Families, and Washington State’s policy and implementation actions of its five-year SAMHSA incentive …

Robert Greenleaf believed the best leadership results from a desire to serve others (Greenleaf, 1991). Servant-leaders approach others with humble spirits, seeking to serve rather than to be served. In his essay The Servant as Leader, Greenleaf (1991) asserted, "Not everything that is old and worn, or even corrupt, can be thrown away. Some of it has to be rebuilt and used again. So it is with the words serve and lead" (p. 1). For that reason, the message of the "leader-as-servant" (Greenleaf, 1998, p. 4) exemplifies the spirit of faith-based correctional volunteers. Forensic scientists are using different kinds of systems and techniques for the identification of missing and deceased individuals. Researchers from West Virginia University, Michigan State University, and University of Miami proposed an Automated Dental Identification System (ADIS) which utilizes dental features for the post mortem identification process. A web-based ADIS, namely Web-ADIS, was developed. The initial testing shows that the system can be used efficiently with a small database.;A new and improved system design has been proposed in this research enabling practical use of the ADIS with a large database. This essay offers first a sketch (by a student and colleague) of H.L.A. Hart's life; second an account of the political philosophy which he explicitly articulated in The Concept of Law (1961), and of its relation to the main currents of Oxford political philosophy in the 1950s; and thirdly an exposition and critical assessment of the normative political theory deployed, to widespread acclaim, in his Law, Liberty & Morality (1963).

The Effects Of Wife-Abuser Socio-Economic Level, Type Of Abuse, And Rater Gender, On Attribution Of Blame For Wife Abuse, Hayley Y. Golden

This study examined how wife abuse is constructed within the non-professional population, with an emphasis on the role of gender, as reflected in men's and women's differing attributions of blame for wife abuse to several possible causes (perpetrator, victim, situation, and societal attitudes). Fictional vignettes featuring married couples were used to vary two other potential influences on allocation of blame: socioeconomic status (SES) and physical vs. emotional abuse type. Four blame attribution scales in the Domestic Violence Blame Scale (DVBS) (Petretic-Jackson, Sandberg, & Jackson, 1994) served as dependent variables, with two levels of SES and abuse type portrayed in four …

The Future Of The Grave Breaches Regime: Segregate, Assimilate Or Abandon, James G. Stewart

Grave breaches of the Geneva Conventions are one type of war crime. In this Article, I argue that the grave breaches regime has three possible futures. In the first, the regime remains segregated from other categories of war crimes in deference to the historical development of these crimes. This future, however, is one that will see a relatively dramatic decline in the use of grave breaches in practice, primarily because other offences cover the same acts more efficiently. In the second possible future, the grave breaches are entirely abandoned, but this eventuality seems both improbable and undesirable. Even though judicial …

On March 1, 2009, the Special Tribunal for Lebanon (STL) commenced operations in the Netherlands. The mandate of the STL is to try those allegedly responsible for the 2005 bombing in Beirut which killed former Lebanese Prime Minister Rafiq Hariri. A collaborative effort between Lebanon and the United Nations, the STL is to be of “international character based on the highest standards of justice.” However, the STL’s in absentia trial provisions are based on a far different, and lower, standard. · A highly publicized incident served as a catalyst for the Austin, Texas, community, convened by the Hogg Foundation for Mental Health, to address gaps in the behavioral health system.

· The foundation worked with the local behavioral health authority, the mayor’s office, police and sheriff’s departments, and the city health department to design the Austin Mayor’s Mental Health Task Force. The task force was succeeded by a monitoring committee that identified six focus areas in which to develop action plans and monitor community progress.

This Essay argues that federal habeas review of state criminal cases squanders resources the federal government should be using to help states reform their systems of defense representation. A 2007 empirical study reveals that federal habeas review is inaccessible to most state prisoners convicted of non-capital crimes, and offers no realistic hope of relief for those who reach federal court. As a means of correcting or deterring constitutional error in non-capital cases, habeas is failing and cannot be fixed. Drawing upon these findings as well as the Supreme Court's most recent decision applying the Suspension Clause, the authors propose that …

Looking back on US and coalition detention operations in Afghanistan to date, three key issues stand out: one substantive, one procedural and one policy. The substantive matter – what are the minimum baseline treatment standards required as a matter of international law? – has clarified significantly during the course of operations there, largely as a result of the US Supreme Court’s holding in Hamdan v. Rumsfeld. The contributions of order-maintenance policing and broken windows theory to New York City’s remarkable crime decline have been the subject of contentious debate. The dominant policing tactic in New York since the 1990s has been aggressive interdiction of citizens through street encounters in the search for weapons or drugs. Research showed that minority citizens in the 1990s were disproportionately stopped, frisked and searched at rates significantly higher than would be predicted by their race-specific crime rates, and that this excess enforcement was explained by the social structure of predominantly minority neighborhoods than by either their disorder or their crime rates. …

In this Criminal Law Conversation (Robinson, Ferzan & Garvey, eds., Oxford 2009), the authors debate whether there is a role for randomization in the penal sphere - in the criminal law, in policing, and in punishment theory. In his Tanner lectures back in 1987, Jon Elster had argued that there was no role for chance in the criminal law: “I do not think there are any arguments for incorporating lotteries in present-day criminal law,” Elster declared. Although possession of small quantities of marijuana has been decriminalized in New York State since the late 1970s, arrests for marijuana possession in New York City have increased more than tenfold since the mid-1990s, and remain high more than ten years later. This rise has been a notable component of the City’s “Order Maintenance Policing” strategy, designed to aggressively target low-level offenses, usually through street interdictions known as “Stop, Question, and Frisk” activity. We analyze data on 2.2 million stops and arrests carried out from 2004 to 2008, and identify significant racial disparities in the implementation of marijuana enforcement. These …

A string of recent studies has documented significant racial disparities in police stops, searches, and arrests across the country. The issue of racial profiling, however, did not receive national attention until the arrest of Professor Henry Louis Gates, Jr., at his home in Cambridge. This raises three questions: First, did Sergeant Crowley engage in racial profiling when he arrested Professor Gates? Second, why does it take the wrongful arrest of a respected member of an elite community to focus the attention of the country? Third, why is racial profiling so pervasive in American policing?

This Article presents a legal theory of legal justification. It examines the elements of offense definitions and justification defensesor, more accurately, the conjunctions and disjunctions between these elements-to resolve a longstanding issue in the theory of legal punishment. The unjustified actor who believes she is justified seems to deserve an acquittal, while the justified actor who does not know he is justified seems to deserve conviction. How might we think about reforming abortion regulation in a world in which the basic legality of abortion may, as a matter of constitutional law, at last be relatively secure?
