A Response To The Sounds Of Silence, Andrew King-Ries Jan 2009

A Response To The Sounds Of Silence, Andrew King-Ries

Faculty Law Review Articles

In his article, The Sound of Silence: Holding Batterers Accountable for Silencing Their Victims, Tom Lininger attempts to "facilitate the effective prosecution of domestic violence cases, particularly domestic homicide, while complying with the new requirements announced [for forfeiture by wrongdoing] by the Supreme Court in Giles [v. California]."' In doing so, Lininger tackles a wide array of topics, including analyzing the "theoretical underpinnings" of forfeiture by wrongdoing; explicating the Giles decision, criticizing Justice Scalia's originalist approach for its "selective historical research . . . conflation of evidentiary and constitutional forfeiture theories, and . . . vacillation between objective and subjective …

The Psychology Of Amber Alert: Unresolved Issues And Implications, Monica K. Miller, Timothy Griffin, Samantha S. Clinkinbeard, Rebecca M. Thomas Jan 2009

The Psychology Of Amber Alert: Unresolved Issues And Implications, Monica K. Miller, Timothy Griffin, Samantha S. Clinkinbeard, Rebecca M. Thomas

Criminology and Criminal Justice Faculty Publications

The AMBER alert system is likely affected by a number of psychological processes, yet remains understudied. The system assumes people will remember Alert information accurately and notify police, but psychological research on related phenomena (e.g., memory, willingness to help) indicates that people may not be able or willing to act in ways the promote the success of the system. In addition, the system is intended to deter child abductions, however, the system could prompt copycat crimes from perpetrators seeking publicity. The system could also cause a precipitation effect in which a perpetrator who sees the Alert could decide to murder …

Complementarity In Crisis: Uganda, Alternative Justice, And The International Criminal Court, Alexander K.A. Greenawalt Jan 2009

Complementarity In Crisis: Uganda, Alternative Justice, And The International Criminal Court, Alexander K.A. Greenawalt

Elisabeth Haub School of Law Faculty Publications

In this Article, I take up a focused analysis of the Uganda prosecutions, considering both the interpretive dilemmas facing the Court and the efforts of Prosecutor Luis Moreno-Ocampo to address them. Part I provides a summary of events leading to the LRA arrest warrants and the recent peace negotiations. Part II turns to the text of the Rome Statute, with a focus on Article 19's framework for complementary jurisdiction and the Article 53 dictate that “interests of justice” may trump the admissibility of investigations and cases that otherwise meet all relevant statutory criteria. Although the ICC is structured to give …

The Psychometric Properties Of The Mahan And Ditomasso Anger Scale (Mad-As) And Its Relationship To Cognitive Distortions And Attitudes Among Adults Who Experience Symptoms Of Anger, Dorothy Latella-Zakhireh

PCOM Psychology Dissertations

The influence of cognitive schema on negative emotions such as depression and anger has been investigated in a number of prior studies. This study sought to assess the relationship between anger and various components of anger with cognitive distortions, and dysfunctional attitudes in a nonclinical sample. Subjects were 128 adult males and females who completed several measures related to anger and cognitive distortions. The measures were the Mahan and DiTomasso Anger Scale (MAD-AS), the Inventory of Cognitive Distortions (ICD), and the Dysfunctional Attitudes Scale (DAS). It was hypothesized that cognitive distortions including depressogenic cognitions, as reflected in various subscales of …

An Architecture For High-Performance Privacy-Preserving And Distributed Data Mining, James Secretan Jan 2009

An Architecture For High-Performance Privacy-Preserving And Distributed Data Mining, James Secretan

Electronic Theses and Dissertations

This dissertation discusses the development of an architecture and associated techniques to support Privacy Preserving and Distributed Data Mining. The field of Distributed Data Mining (DDM) attempts to solve the challenges inherent in coordinating data mining tasks with databases that are geographically distributed, through the application of parallel algorithms and grid computing concepts. The closely related field of Privacy Preserving Data Mining (PPDM) adds the dimension of privacy to the problem, trying to find ways that organizations can collaborate to mine their databases collectively, while at the same time preserving the privacy of their records. Developing data mining algorithms for …

Revisiting The Un Protocol On Human Trafficking: Striking Balances For More Effective Legislation, Kalen Fredette Jan 2009

Revisiting The Un Protocol On Human Trafficking: Striking Balances For More Effective Legislation, Kalen Fredette

Cardozo Journal of International and Comparative Law

Human trafficking is a growing global criminal concern. This paper assesses several national and multi-national efforts to combat human trafficking, focusing particularly on the UN Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (Protocol). Ultimately, the rise in trafficking offenses compared to the sparse number of convictions strongly suggests the inadequacy of the national and multinational efforts currently in play. This paper will take a fresh look at key provisions of the recent Protocol in light of newly published data on trafficking, and will explore possible modifications to the instrument which may increase its effectiveness. …

Ineffective Assistance Of Counsel Under People V. Pozo: Advising Non-Citizen Criminal Defendants Of Possible Immigration Consequences In Criminal Plea Agreements, Lindsay Vangilder Jan 2009

Ineffective Assistance Of Counsel Under People V. Pozo: Advising Non-Citizen Criminal Defendants Of Possible Immigration Consequences In Criminal Plea Agreements, Lindsay Vangilder

University of Colorado Law Review

Tens of thousands of non-citizen criminal defendants are removed from the United States each year. The Sixth Amendment of the United States Constitution and United States Supreme Court jurisprudence guarantee that these non-citizen criminal defendants will have effective assistance of criminal defense counsel, whether they elect to proceed to trial or decide to plead guilty. Although prevailing professional norms require that criminal defense counsel advise non-citizen defendants of possible immigration consequences of plea agreements, many courts do not impose a duty to advise on defense counsel. In fact, many courts deem immigration consequences to be collateral consequences rather than direct …

The Clash Of Commitments At The International Criminal Court, Tom Ginsburg Jan 2009

The Clash Of Commitments At The International Criminal Court, Tom Ginsburg

Chicago Journal of International Law

On July 10, 2008, International Criminal Court ("ICC") Prosecutor Luis Moreno-Ocampo informed members of the UN Security Council that he would be issuing an indictment against Sudanese President Omar Hassan al Bashir on charges of genocide and crimes against humanity for events in Darfur. The indictment, issued July 14, brought into stark relief the consequentialist debate over international criminal justice. Opponents of impunity celebrated the possibility that the international community might at last be willing to take concrete steps toward ending the Darfur genocide. On the other hand, aid groups on the ground feared retaliation and expulsion, and diplomats argued …

Outsourcing Immigration Compliance, Eleanor Marie Lawrence Brown Jan 2009

Outsourcing Immigration Compliance, Eleanor Marie Lawrence Brown

Fordham Law Review

Immigration is a hot-button issue about which Americans have sent a clear message. They prefer not to admit more aliens until the government is able to screen credibly for entrants who will abide by the terms of admission and sanction those who do not. While immigration debates now focus almost entirely on undocumented workers, they have overshadowed another critical, yet poorly understood, challenge: designing institutions to screen properly for aliens who are visa-compliant and sanction noncompliant aliens. Because failed guest worker programs unquestionably increase the size of the undocumented population, this Article addresses the difficulty of institutional design by analyzing …
