The Nrc Report And Its Implications For Criminal Litigation, Paul C. Giannelli Jan 2009

The Nrc Report And Its Implications For Criminal Litigation, Paul C. Giannelli

Faculty Publications

The National Research Council, an arm of the National Academy of Sciences, issued a landmark report on forensic science in February 2009. In the long run, the report’s recommendations, if adopted, would benefit law enforcement and prosecutors. The recommendations would allow forensic science to develop a strong scientific basis and limit evidentiary challenges regarding the reliability of forensic evidence. In keeping with its congressional charge, however, the NRC Committee did not directly address admissibility issues. Nevertheless, given its content, the report will inevitably be cited in criminal cases. Indeed, within months, the United States Supreme Court cited the report, noting …

Judicial Nullification Of Juries: Use Of Acquitted Conduct At Sentencing, Eang L. Ngov Jan 2009

Judicial Nullification Of Juries: Use Of Acquitted Conduct At Sentencing, Eang L. Ngov

Faculty Scholarship

At trial, defendants are afforded a panoply of rights right to counsel, to proof beyond a reasonable doubt, to confront witnesses, and to exclude inadmissible evidence. However, these rights, except for the right to counsel, disappear at sentencing. In deciding a defendant’s sentence, a court may consider conduct that has not been proven beyond a reasonable doubt and even conduct of which the jury has acquitted the defendant. Consideration of acquitted conduct has resulted in dramatic increases in the length of defendants’ sentences sometimes resulting in life imprisonment based merely on a judge’s finding that a defendant more likely than …

Appellate Review Of Sentence Explanations: Learning From The Wisconsin And Federal Experiences, Michael M. O'Hear Jan 2009

Appellate Review Of Sentence Explanations: Learning From The Wisconsin And Federal Experiences, Michael M. O'Hear

Marquette Law Review

For at least half a century, reformers have urged American appellate courts to play a more active role in the sentencing process. Outside a small number of jurisdictions with binding sentencing guidelines, however, the appellate courts have generally failed to establish a meaningful role for themselves. The present article focuses on one particular function that appellate courts might usefully perform: that is, reviewing the adequacy of the explanations given by trial-court judges to justify their sentencing decisions. Such “explanation review” is conceptually distinct from substantive review of the sentence: the former asks whether the sentence has been adequately justified, while …

Pretend Gun-Free School Zones: A Deadly Legal Fiction, David B. Kopel Jan 2009

Pretend Gun-Free School Zones: A Deadly Legal Fiction, David B. Kopel

Connecticut Law Review

Most states issue permits to carry a concealed handgun for lawful protection to an applicant who is over twenty-one years of age, and who passes a fingerprint-based background check and a safety class. These permits allow the person to carry a concealed defensive handgun almost everywhere in the state. Should professors, school teachers, or adult college and graduate students who have such permits be allowed to carry firearms on campus? In the last two years, many state legislatures have debated this topic. School boards, regents, and administrators are likewise faced with decisions about whether to change campus firearms policies. This …

Research And Action On Intimate Partner Violence: Interdisciplinary Convergence Of Cultural Community Psychology And Cross-Cultural Psychology, Eric S. Mankowski, Gino Galvez, Nancy Glass

Papers from the International Association for Cross-Cultural Psychology Conferences

An analysis of the respective organizational histories, missions, and scholarly activity of the International Association for Cross-cultural Psychology (IACCP) and the Society for Community Research and Action (SCRA) indicates many points of shared values and actions, as well as some important differences. Both scholarly organizations developed out of a similar historical and cultural zeitgeist in the late 1960s and early 1970s. Our missions emphasize the role of culture/diversity in psychological phenomena, adopting an interdisciplinary orientation, the value of collaboration, the importance of research methods and ethics, and the value of action research. However, community psychology generally lacks an adequate treatment …

Gender And The Rule Of Law In Transitional Societies, Fionnuala Ní Aoláin, Michael Hamilton

Articles

This article examines a unique relationship—specifically, the connection between the rule of law, as it is imported and experienced in post-conflict/post-repression societies, and gender. We assert that some of the most gendered and problematic dimensions of rule of law discourse and practice can arise with intensity in post-conflict or post-repressive societies. In particular, we explore a fundamental contradiction. Transitional societies bring powerful and transformative moments to global attention.

The Biochemical Reactions Of Dry State Dna, April Marrone Jan 2009

The Biochemical Reactions Of Dry State Dna, April Marrone

Electronic Theses and Dissertations

The biochemistry of dry state DNA is of interest to the fields of forensics, ancient DNA, and DNA storage. The exact chemical nature of the degradation of the DNA molecule in the dry state has not been studied prior. If determined what chemical changes the DNA molecule undergoes, to what degree and in what time frame then protocols can be implemented to bypass the impact of this damage or to repair it when necessary. It is suspected that similar reactions occur to the dry state DNA molecule as does to the hydrated molecule. It cannot be assumed, however that these …

Defeating Biometric Fingerprint Systems: An Applied Testing Methodology, David J. Brooks Jan 2009

Defeating Biometric Fingerprint Systems: An Applied Testing Methodology, David J. Brooks

Australian Security and Intelligence Conference

Biometric access control systems are becoming more common and may be considered high-security, due to their ability to identify and validate that the person is who they purport to be. Therefore, such biometric systems are often installed into critical infrastructure facilities as a means to gain high security protection. To date, there has been considerable research into the effectiveness of biometric devices to recognise valid users and reject invalid users, and to develop standards for interoperability. However, biometric systems are vulnerable to many categories of attack and there has been restricted research into such defeat vulnerabilities.

This article presents an …

Information Overload: Cctv, Your Networks, Communities And Crime, Vandra Harris, Crispin Harris Jan 2009

Information Overload: Cctv, Your Networks, Communities And Crime, Vandra Harris, Crispin Harris

Australian Security and Intelligence Conference

Electronic surveillance continues to play a central but often unobserved role in contemporary Western societies and attempts to police them. This paper focuses on closed circuit television (CCTV) footage and its technological implications, particularly relating infrastructure and data storage and integrity. While CCTV might appear attractive in augmenting law enforcement systems, the authors argue that the debate on use of CCTV in crime prevention remains incomplete without an effective understanding of the diverse costs. This discussion reveals startling ICT resource needs and associated costs, together with very specific technological capacity. These contribute significantly to the costs of such systems, reinforcing …

Impact Of A Proposed Federal Shield Law, Lisa Dahlke Jan 2009

Impact Of A Proposed Federal Shield Law, Lisa Dahlke

Honors Program Theses

This study will examine how current proposals for a federal shield law compare to protections offered by state legislatures and state courts. My research will address the effectiveness of current state-level protections for journalists' use of confidential sources using analysis of data from a national survey of news outlets. By determining how different aspects of state protections influence subpoena frequency and compliance, I attempt to evaluate the key aspects of legislation currently being considered in Congress, the Free Flow of Information Act of 2009. I find clear evidence that the presence of a statute and a number of its provisions …
