The Safety Of A Nation Versus The Rights Of Suspected Terrorists, Michaela Clark Jan 2009

The Safety Of A Nation Versus The Rights Of Suspected Terrorists, Michaela Clark

Undergraduate Review

On January twenty-second, 2009, newly elected President Barack Obama issued an executive order requiring the detention center holding alleged terrorists at Guantanamo Bay to be closed within one year. This proposal may potentially close a chapter on one of America’s most controversial efforts to combat terrorism. Throughout the Bush Administration’s “War on Terror” numerous laws were passed that gave the President and the Department of Defense power to determine who was an enemy combatant and detain indefinitely those they decided fit that profile. The issue of holding people the military deems a threat without giving them a traditional trial continues …

Rethinking Categorical Prohibitions On Capital Punishment: How The Current Test Fails Mentally Ill Offenders And What To Do About It, Pamela A. Wilkins Jan 2009

Rethinking Categorical Prohibitions On Capital Punishment: How The Current Test Fails Mentally Ill Offenders And What To Do About It, Pamela A. Wilkins

Articles

My aim in this short Article is both specific and general. Specifically, I examine whether the Eighth Amendment should be held to prohibit imposition of death sentences upon offenders with severe mental illnesses, as is the case with mentally retarded and juvenile offenders. More generally, and perhaps more importantly, I examine the current Eighth Amendment test for categorical prohibitions, find it wanting, and propose a different test that, at least in my view, more neatly captures what the Eighth Amendment is intended to accomplish.

I believe the key to an Eighth Amendment analysis of categorical prohibitions lies in two dilemmas …

Predicting Juvenile Delinquency: The Nexus Of Childhood Maltreatment, Depression And Bipolar Disorder, Christopher A. Mallett, Patricia A. Stoddard Dare, Mamadou M. Seck

Social Work Faculty Publications

Background It is important to identify and provide preventative interventions for youth who are most at risk for offending behaviour, but the connection between early childhood or adolescent experiences and later delinquency adjudication is complicated. Aim To test for associations between specified mental disorders or maltreatment and later delinquency adjudication. Method Participants were a random sample of youth before the juvenile courts in two Northeast Ohio counties in the USA (n = 555) over a 4-year time frame (2003 to 2006). Results Logistic regression analysis identified a lifetime diagnosis of depression and/or bipolar disorder to be predictive of later youth …

The Computer Fraud And Abuse Act: Reassessing The Damage Requirement, 27 J. Marshall J. Computer & Info. L. 279 (2009), Matthew Andris

UIC John Marshall Journal of Information Technology & Privacy Law

This comment explores whether a civil plaintiff needs to claim actual damage to a protected computer to recover against a defendant under the CFAA. Several courts have noted that there is little case law regarding damages, and the case law that exists does not help define the reach of damages. Currently, courts are split as to whether a computer system needs to have actual physical damage in order for recovery under the CFAA. Additionally, courts have not adequately addressed how to assess damages, including whether damages may be aggregated across multiple computer systems. The Third, Fifth, and Ninth Circuit Courts …

Are There Instructional Differences Between Fulltime And Parttime Faculty?, R. Eric Landrum Jan 2009

Are There Instructional Differences Between Fulltime And Parttime Faculty?, R. Eric Landrum

Psychological Sciences Faculty Publications and Presentations

Using data from 8 academic departments and 361 courses taught during a semester, I examined differences between fulltime and parttime faculty in the areas of general demographic variables, student evaluation of teaching outcomes, and the distribution of grades earned. I expected fulltime faculty to exhibit higher teaching evaluations and less lenient grade distributions, yet neither hypothesis was supported. However, substantial differences exist in the support mechanisms provided to parttime and fulltime faculty. These results are discussed in the context of a growing national reliance on parttime faculty, and the potential implications of this trend.

Peacemaking Criminology, Joseph Moloney Jan 2009

Peacemaking Criminology, Joseph Moloney

Undergraduate Review

This article is focused on exploring the practical implications of applying Pepinsky and Quinney’s (1991) theory of ‘peacemaking criminology’ to criminal justice policies. Peacemaking criminology is a perspective on crime that suggests that alternative methods can be used to create peaceful solutions to crime. Peacemaking criminology can be implemented in society to reduce the amount of violence in the criminal justice field, and I argue that this perspective on crime can improve the administration of equitable justice more so than the current approach. The implementation of peacemaking criminology would be a radically different approach than current practices and methods of …

International Criminal Law: Taking Stock Of A Busy Decade, Mark Drumbl Jan 2009

International Criminal Law: Taking Stock Of A Busy Decade, Mark Drumbl

Scholarly Articles

To commemorate the 10th anniversary of the Melbourne Journal of International Law, the Editors have asked for a reflection on major developments in international criminal law over the past decade and the challenges it faces for the future. I begin by setting out four such developments and then identify four challenges. The four major developments that I identify are: institution-building; judicial and jurisprudential output; trendsetting and epistemic communities; and political management.

Children Of Foster Care: Elevating Their Voices, Nancy A. Cristadoro Jan 2009

Children Of Foster Care: Elevating Their Voices, Nancy A. Cristadoro

Regis University Student Publications (comprehensive collection)

The purpose of this paper was to discuss how through research and an internship with Douglas County Child Welfare, elevating children"â„¢s voices in decisions of placement is a vital component of child welfare reform today. This paper examines some of the negative outcomes of the foster care system on children who age out of the system. The negative impact further deteriorates children"â„¢s self esteem and increases the occurrence of homelessness and incarceration in our society. The internship further validated the difficulty inherent in including children in decisions of placements and the importance of allowing extra time, planning and changing mind …

Analysis Of Factors Influencing West Virginia Secondary Biology And Science Teacher Attrition Rates, Seth Perry Jan 2009

Analysis Of Factors Influencing West Virginia Secondary Biology And Science Teacher Attrition Rates, Seth Perry

Theses, Dissertations and Capstones

The high rate of attrition for beginning teachers has been blamed on many factors. Nationally these include low pay, urban versus rural school settings, age, with younger teachers leaving sooner, and other variables making a complex problem with no clear component responsible for the loss of teachers. This study examined the self reported variables that contribute to high school teachers in West Virginia leaving their profession. An electronic survey instrument was distributed to current secondary teachers across the state. Teachers were asked to respond to questions related to professional satisfaction, perceived value from students and parents, administrative support, content versus …

Can Paraphrasing Increase The Amount And Accuracy Of Reports From Child Eyewitnesses?, Angela D. Evans, Kim P. Roberts Jan 2009

Can Paraphrasing Increase The Amount And Accuracy Of Reports From Child Eyewitnesses?, Angela D. Evans, Kim P. Roberts

Psychology Faculty Publications

Young children’s descriptions of sexual abuse are often sparse thus creating the need for techniques that elicit lengthier accounts. ‘Paraphrasing’, or repeating information children have just disclosed, is a technique sometimes used by forensic interviewers to clarify or elicit information. (e.g., if a child stated “He touched me”, an interviewer could respond “He touched you?”). However, the effects of paraphrasing have yet to be scientifically assessed. The impact of different paraphrasing styles on young children’s reports was investigated. Overall, paraphrasing per se did not improve the length, richness, or accuracy of reports when compared to open-ended prompts such as …
