Comparative Constitutional Epics, Penelope J. Pether Mar 2009

Comparative Constitutional Epics, Penelope J. Pether

Working Paper Series

This essay takes up Robert Cover’s account, in “Nomos and Narrative” of Constitutional Epics. Ranging across legal and literary texts including Toni Morrison’s Beloved, David Malouf’s An Imaginary Life, the Canadian Arar Commission Report, and Bringing Them Home, the Report of the Australian Human Rights and Opportunity Commission’s National Inquiry into the Separation of Aboriginal and Torres Strait Islander Children from Their Families, it concludes that what comparative study of Constitutions and their Epics might yield are brutal truths and the judgments of history, but also insights into how we might make of that unpromising material a nomos and a …

Between Fragmentation And Unity: The Uneasy Relationship Between Global Administrative Law And Global Constitutionalism, Ming-Sung Kuo Mar 2009

Between Fragmentation And Unity: The Uneasy Relationship Between Global Administrative Law And Global Constitutionalism, Ming-Sung Kuo

San Diego International Law Journal

This paper aims to critically examine the status of global administrative law within the already widely acknowledged notion of global constitutionalism. While global constitutionalism describes the processual "constitutionalization" of an increasingly globalized world through the values emerging from cross-border regulatory cooperation, the global regulatory process at the heart of global administrative law appears to take the place of "We the People" as the creative force behind global constitutionalism. Contrary to the domestic/national context, the identitarian relationship between global administrative law and global constitutional law suggests the unity of global legality, whether it be called administrative law or constitutionalism. The paper …

Empowering, Degrading Or A ‘Mutually Exploitative’ Exchange For Women?: Characterising The Power Relations Of The Strip Club, Katy Pilcher Mar 2009

Empowering, Degrading Or A ‘Mutually Exploitative’ Exchange For Women?: Characterising The Power Relations Of The Strip Club, Katy Pilcher

Journal of International Women's Studies

This paper seeks to characterise the gendered and sexualised power relations of both female and male strip clubs, and to signal what this means for establishing positive definitions of female desire. It is argued that while it is not useful to present female strippers, or female patrons of male strip clubs as purely passive victims of male heterosexism within these venues, it is equally damaging to assume that these venues represent a whole-scale challenge to conventional oppressive gender and sexual relations for women. Some research has even suggested that both strippers and their patrons are engaged in a ‘mutually exploitative’ …

Pedestrian Environments And Transit Ridership, Sherry Ryan, Lawrence F. Frank Mar 2009

Pedestrian Environments And Transit Ridership, Sherry Ryan, Lawrence F. Frank

Journal of Public Transportation

This paper explores how the quality of the pedestrian environment around transit stops relates with transit ridership. The primary hypothesis tested is that transit tripmaking is higher in urban environments that are more conducive to non-motorized travel, given that bus transit systems are most frequently accessed via walking or biking. A secondary goal is to contribute to an improved understanding of the measurement of the built environment in geographic information systems (GIS). A composite measure of walkability—incorporating land use mix, density and street patterns—was developed for all transit stops in San Diego’s Metropolitan Transit Systems service area and used as …

The Long War, The Federal Courts, And The Necessity / Legality Paradox, Stephen I. Vladeck Mar 2009

The Long War, The Federal Courts, And The Necessity / Legality Paradox, Stephen I. Vladeck

Book Reviews

This paper is a solicited review of Ben Wittes's book "Law and the Long War: The Future of Justice in the Age of Terror," which rightly suggests that there would be far less legal uncertainty today vis-a-vis the conduct of the war on terrorism had the Bush Administration sought - and had Congress provided - framework legislation governing issues ranging from the detention of "enemy combatants" to surveillance and even interrogation. Nevertheless, the review takes issue with Wittes's critique of the role of the courts thus far, especially his contention that the Supreme Court's decisions to date may be seen …

The Modernizing Mission Of Judicial Review, David A. Strauss Mar 2009

The Modernizing Mission Of Judicial Review, David A. Strauss

University of Chicago Law Review

Constitutional interpretation, as it is usually conceived, looks to the past—to an old text, to history, to precedent, to tradition—in an effort to limit political majorities. But over the last generation or so, a different approach to the Constitution has emerged. That approach, which might be called modernization, tries to anticipate trends in public opinion instead of taking lessons from the past; and a modernizing court, instead of facing down popular majorities, yields when it finds out that it has misgauged public opinion. This modernizing approach has characterized the Supreme Court's recent work in many disparate areas, including, among others, …

Reality Bites: The Illusion Of Science In Bite-Mark Evidence, Erica Beecher-Monas Mar 2009

Reality Bites: The Illusion Of Science In Bite-Mark Evidence, Erica Beecher-Monas

Cardozo Law Review

More than a decade after Daubert, years after the amendments to the Federal Rules of Evidence, and long after the courts in Frye jurisdictions started examining the empirical basis for expert claims before permitting such testimony in their courtrooms, judges are still evading their gatekeeping duties when it comes to criminal cases. A prime example of this can be found in bite-mark testimony. Although it comes dressed in the illusion of science, having experts with advanced degrees, a fancy name (forensic odontology), professional associations, and professional journals, that illusion belies the reality that bite-mark evidence utterly lacks empirical support …

The Importance Of Responsivity Factors In Predicting Reductions In Antisocial Attitudes And Cognitive Distortions Among Adult Male Offenders, Dana Jones Hubbard, Jennifer Pealer Mar 2009

The Importance Of Responsivity Factors In Predicting Reductions In Antisocial Attitudes And Cognitive Distortions Among Adult Male Offenders, Dana Jones Hubbard, Jennifer Pealer

Sociology & Criminology Faculty Publications

The research has demonstrated that cognitive-behavioral treatment programs for offenders work to reduce recidivism. One reason these programs have been found to be effective is that they target one of the “number one” predictors of crime, antisocial attitudes and values. Unfortunately, these programs may not “work” for all offenders. The literature suggests that personal characteristics of offenders, although not directly related to recidivism, may in fact interfere or hinder the ability for the program to “work.” This is referred to in the literature as the “responsivity principle.” This study seeks to understand the role that personal or responsivity characteristics of …
