The Relationship Between Parental Influence And Christian Spiritual Practices Among Adventist Youth In Puerto Rico, Obed Jiménez
The Relationship Between Parental Influence And Christian Spiritual Practices Among Adventist Youth In Puerto Rico, Obed Jiménez
Dissertations
Problem. Typically, parents do not realize how influential they are in fostering spiritual growth in their children and are not aware of key influential factors that can motivate their children in practicing spiritual disciplines such as prayer, Bible reading, meditation, and church attendance.
Method. This study used data from the Avance PR study conducted during the months of March and October 1995. The population for this study was high-school students enrolled in Seventh-day Adventist academies and youth who attended Seventh-day Adventist churches in Puerto Rico. The youth sample (ages 13-25) consisted of 1,377 single, never-married subjects: 586 males and 775 …
An Investigation Of The Perceptions Of Clergy And Laity On Race-Based Organizational Segregation In The Southern Union Conference Of Seventh-Day Adventists, David K. Penno
Dissertations
Problem
The Seventh-day Adventist Church in the United States maintains a racially segregated organization in a society that has intentionally dismantled segregation in most of its organizations. The church needs to evaluate its current conference organization in light of this reality. The purpose of this study was to describe the perceptions of Seventh-day Adventist clergy and members in two conferences in the Southern Union concerning race-based organizational segregation in the church.
Method
This study used a mixed method and was descriptive in design. Four focus groups were conducted to explore the dimensions of the research problem. This step was followed …
A Narrative Case Study Describing The Support Culture For The Change Process In A Small Parochial, Boarding Secondary School, Stanley M. Rouse
A Narrative Case Study Describing The Support Culture For The Change Process In A Small Parochial, Boarding Secondary School, Stanley M. Rouse
Dissertations
Problem. History acknowledges that change in education is difficult. Literature suggests that the educational system plays a critical role in individual school-change initiatives. Educators need to seek for better understanding of the influence that system issues have on the change process. This study describes a change process experienced by one small boarding school in a parochial school system. It describes the change process as experienced by teachers in the school, administrators at various systemic levels, and parents of students in the school. Their story brings greater understanding of how culture of the system impacts school change.
Method. This research used …

Community College Online Course Retention And Final Grade: Predictability Of Social Presence, Simon Y. Liu, Joel Gomez, Cherng-Jyh Yen
Educational Leadership & Workforce Development Faculty Publications
This study employed a quantitative research design to examine the predictive relationships between social presence and course retention as well as final grade in community college online courses. Social presence is defined as the degree of one's feeling, perception and reaction to another intellectual entity in the online environment. Course final grades included A, B. C, D, F, I, or W. Course retention was defined as successfully completed a course with an A to C grade. The results of the binary and ordinal logistic regression analyses suggest that social presence is a significant predictor of course retention and final grade …
Connected Coordination: Network Structure And Group Coordination, Mathew D. Mccubbins, Ramamohan Paturi, Nicholas Weller
Connected Coordination: Network Structure And Group Coordination, Mathew D. Mccubbins, Ramamohan Paturi, Nicholas Weller
Faculty Scholarship
Networks can affect a group’s ability to solve a coordination problem. We utilize laboratory experiments to study the conditions under which groups of subjects can solve coordination games. We investigate a variety of different network structures, and we also investigate coordination games with symmetric and asymmetric payoffs. Our results show that network connections facilitate coordination in both symmetric and asymmetric games. Most significantly, we find that increases in the number of network connections encourage coordination even when payoffs are highly asymmetric. These results shed light on the conditions that may facilitate coordination in real-world networks.
Why The Chinese Public Prefer Administrative Petitioning Over Litigation, Taisu Zhang
Why The Chinese Public Prefer Administrative Petitioning Over Litigation, Taisu Zhang
Faculty Scholarship
In recent years, the Chinese public, when facing disputes with government officials, have preferred a non-legal means of resolution, the Xinfang system, over litigation. Some scholars explain this by claiming that administrative litigation is less effective than Xinfang petitioning. Others argue that the Chinese have historically eschewed litigation and continue to do so habitually. This paper proposes a new explanation: Chinese have traditionally litigated administrative disputes, but only when legal procedure is not too adversarial and allows for the possibility of reconciliation through court-directed settlement. Since this possibility does not formally exist in modern Chinese administrative litigation, people tend to …
The Deterrent Effect Of Death Penalty Eligibility: Evidence From The Adoption Of Child Murder Eligibility Factors, Michael D. Frakes, Matthew Harding
The Deterrent Effect Of Death Penalty Eligibility: Evidence From The Adoption Of Child Murder Eligibility Factors, Michael D. Frakes, Matthew Harding
Faculty Scholarship
We draw on within-state variations in the reach of capital punishment statutes between 1977 and 2004 to identify the deterrent effects associated with capital eligibility. Focusing on the most prevalent eligibility expansion, we estimate that the adoption of a child murder factor is associated with an approximately 20% reduction in the homicide rate of youth victims. Eligibility expansions may enhance deterrence by (1) paving the way for more executions and (2) providing prosecutors with greater leverage to secure enhanced non-capital sentences. While executions themselves are rare, this latter channel is likely to be triggered fairly regularly, providing a reasonable basis …

Global Legal Pluralism, Ralf Michaels
Global Legal Pluralism, Ralf Michaels
Faculty Scholarship
Some challenges of legal globalization closely resemble those formulated earlier for legal pluralism: the irreducible plurality of legal orders, the coexistence of domestic state law with other legal orders, the absence of a hierarchically superior position transcending the differences. This review discusses how legal pluralism engages with legal globalization and how legal globalization utilizes legal pluralism. It demonstrates how several international legal disciplines---comparative law, conflict of laws, public international law, and European Union law---have slowly begun to adopt some ideas of legal pluralism. It shows how traditional themes and questions of legal pluralism---the definition of law, the role of the …
Civil Justice Systems In Europe And The United States, Hein Kötz
Civil Justice Systems In Europe And The United States, Hein Kötz
Faculty Scholarship
Professor Kötz delivered the inaugural Herbert L. Bernstein Memorial Lecture in Comparative Law in 2002 and this article is based on his remarks. The article is included in the inaugural volume of CICLOPs that collects the first six Bernstein lectures. In order to highlight the similarities and differences in legal regimes between Europe and the United States, Professor Hein Kötz analyzes the German and American civil legal systems and, to a minor extent, the British civil legal system. Specifically, Kötz focuses on one of the distinguishing features of the American legal system, the civil jury, and its impact on the …

CICLOPs, the Center for International & Comparative Law Occasional Papers, could not be launched with a better issue than one dedicated to Duke Law's named lecture series in the field, the Annual Herbert L. Bernstein Memorial Lecture in Comparative Law. Herbert Bernstein was Duke's much-beloved professor of comparative law. The lecture series, established in Prof. Bernstein’s honor after his sudden death in 2001, has drawn leading scholars from all around the world to speak at Duke Law School on comparative law. This first issue of CICLOPs contains the text of the first six lectures, some of them previously published in …
Making Good On Good Intentions: The Critical Role Of Motivation In Reducing Implicit Workplace Discrimination, Katharine T. Bartlett
Making Good On Good Intentions: The Critical Role Of Motivation In Reducing Implicit Workplace Discrimination, Katharine T. Bartlett
Faculty Scholarship
Discrimination in today’s workplace is largely implicit, making it ambiguous and often very difficult to prove. Employment discrimination scholars have proposed reforms of Title VII to make implicit discrimination easier to establish in court and to expand the kinds of situations to which liability attaches. The reform proposals reflect a broad consensus that strong legal norms are crucial to addressing the problem. Yet it is mistaken to assume that strengthening plaintiffs’ hands in implicit discrimination cases will necessarily achieve the long-term goal of reducing its occurrence. This Article brings together several strands of social science research showing that (1) implicit …
After The Revolution – Decline And Return Of U.S. Conflicts Of Laws, Ralf Michaels
After The Revolution – Decline And Return Of U.S. Conflicts Of Laws, Ralf Michaels
Faculty Scholarship
Scholars in the US have become uninterested in conflict of laws, at least in the core issues that spurred the conflict of laws revolution, especially questions of method and areas of tort and contract law. Proposals for a new (third) Restatement have not yet led very far. By contrast, new interest comes from the fringes: special political questions and interdisciplinarity. As to the first, I use the example of same‑sex marriages to discuss the extent to which discussions about politics are inseparably linked with discussions over conflict of laws. Conflict of laws is here not a mere additional field in …

Europeanization As A Process: Thoughts On The Europeanization Of Private Law, Christian Joerges
Faculty Scholarship
Professor Christian Joerges delivered the Second Annual Herbert L. Bernstein Memorial Lecture in Comparative Law in 2003 and this article is based on his remarks. The article is included in the inaugural volume of CICLOPs that collects the first six Bernstein lectures. Professor Joerges puts forth a three part thesis concerning the “Europeanization of Private Law”, the process by which the European Community influences the legal and political policies of its member states within a framework of transnational cooperation. Joerges first establishes the eroding importance of the idea that legal systems operating at the national level fulfill the goals of …
Developing Enterprise Budgets For Sustainable School Gardens: Service Learning In A Global Context, Ashley D. Jones, Jennie S. Popp
Developing Enterprise Budgets For Sustainable School Gardens: Service Learning In A Global Context, Ashley D. Jones, Jennie S. Popp
Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences
Service learning programs are becoming a part of curricula in universities throughout the United States. The University of Arkansas, Fayetteville, (UAF) established a service learning program that targeted the educational, health, social, and agricultural needs of a community. The focus of this research aimed to provide students, faculty, community members, school officials, and students with a template for crop budgets. These crop budgets are used to evaluate the costs and returns of producing multiple crops at a school. Crops produced in a sustainable garden must meet three criteria: 1) have minimal negative environmental impact, 2) provide just-in-time production of quality …
From Nationalization Of Islam To Privatization Of Nationalism: Islam And Turkish National Identity, Tamer Balci
From Nationalization Of Islam To Privatization Of Nationalism: Islam And Turkish National Identity, Tamer Balci
History Faculty Publications
This article traces the origins of various proposals to nationalize Islam in Turkey. The initial Turkish proposals failed because none of them had a feasible philosophical base to facilitate the co-existence of Islam and secularism. Aside from the previous studies on the nationalization of Islam, this article carries the topic to the Cold War by arguing that the Turkish-Islamic Synthesis was the last stage on the nationalization of Islam. Since TIS had no vision to alter the official ideology, Kemalism, and it claimed the compatibility of Islam, nationalism, secularism as well as Kemalism, it fulfilled the need of a national …
Unhitching The Horse From The Carriage: Love And Marriage Among The Mosuo, Judith Stacey
Unhitching The Horse From The Carriage: Love And Marriage Among The Mosuo, Judith Stacey
Utah Law Review
In the end, however, the fate of Mosuo kinship will not depend on this sort of cost-benefit analysis of its upsides and downsides. Somewhat poignantly, the very factor that dooms durable relationships between the Mosuo and outsiders now threatens the survival of the Mosuo kinship system itself. To reconcile the pure relationship and family stability, tisese depends upon a high degree of geographic immobility, and perhaps on social and economic stability as well. Cultural conformity also is crucial to sustain intergenerational, extended families. Inherent Mosuo family conflicts over whether or when to divide households due to size and discord seem …

Worse Than Exemption, J. Clifton Fleming Jr., Robert J. Peroni, Stephen E. Shay
Emory Law Journal
Customary international law recognizes that every country has the right to impose both source-based taxation on income earned within its borders by foreign persons and residence-based taxation on the worldwide income of its own residents. Thus, so far as international law is concerned, the legitimacy of these taxing rights is fully accepted, and neither of these forms of taxation represents overreaching by governments. Nevertheless, unless ameliorative steps are taken, their full exercise may produce double taxation of international income. This is because, in the absence of mitigation, international income could be subject to source-based taxation in the country where it …
