Effects Of Case-Based Learning On Preservice Secondary Teachers’ Multicultural Attitudes: A Mixed Methods Study, Kathryn Lee, Emily Summers, Rubén Garza
Effects Of Case-Based Learning On Preservice Secondary Teachers’ Multicultural Attitudes: A Mixed Methods Study, Kathryn Lee, Emily Summers, Rubén Garza
Academic Leadership: The Online Journal (2003-2012)
As our society changes, so must our teacher education practices. In the past decade, the Southwestern U.S. has been transforming into a majority minority region (U.S. Census Bureau 2005), which must in turn reframe the underpinnings of teacher education in this area of our country. As teacher educators, we have known that many preservice teachers lagged in their preparedness to teach students who are culturally, ethnically, and linguistically different from themselves. Teacher education increasingly is being criticized as having inabilities to instruct teacher candidates in ways that produce greater K-12 student learning; diversity awareness will be a cornerstone if we …
Emergence Of Strategic Human Resource Management Historical Perspective, Nadeem Malik
Emergence Of Strategic Human Resource Management Historical Perspective, Nadeem Malik
Academic Leadership: The Online Journal (2003-2012)
Organization today, by necessity have become more focused on exploiting sources of competitive advantage in the face of rapid environmental, technological and global economic changes. According to Pfeffer (1994:14), as other sources of competitive success have become less important, what remains a crucial, differentiating factor is the organization, its employees and how they work. Additionally, he states that the current recognition among strategic management researchers is that sustained competitive advantage arises more from a firms internal resource endowments and resource deployments particularly its human capital that are imperfectly imitable than from a firm’s product market position. These “people” issues used …

Employment Patterns And Job Satisfaction Of Foreign-Born Science And Engineering Doctorate Recipients In The United States, Ketevan Mamiseishvili, Jill Hermsen
Academic Leadership: The Online Journal (2003-2012)
Science and engineering fields are important to a nation’s economy, especially in the areas of innovation and technology development (Committee on Science, Engineering, and Public Policy, 2007). The demand for scientists and engineers is increasing globally, making it more difficult for organizations to attract and retain qualified professionals in these fields as schools and industries compete on a global level for top talent (Committee on Science, Engineering, and Public Policy, 2005). It is not surprising, then, that academia and industry are increasing their focus on the science and engineering workforce. Indeed, a recent National Academies report stated that “identifying the …
The Perceptions Of Female School Leaders Of The Obstacles And Enablers That Affected Their Career Paths To Educational Administration, Linda Noel-Batiste
The Perceptions Of Female School Leaders Of The Obstacles And Enablers That Affected Their Career Paths To Educational Administration, Linda Noel-Batiste
Academic Leadership: The Online Journal (2003-2012)
n 1909 Ella Flagg Young, the first female superintendent of Chicago Public Schools, predicted that more women than men would be at the helm of most twentieth century school systems. Young’s prediction emanated from a belief, held by other influential leaders of her time, that teaching was a woman’s natural vocation, for it advanced a woman’s maternal instincts of caretaking and nurturing. Unfortunately, at the beginning of the twenty-first century, her prediction has not been fulfilled. Almost a hundred years after Young’s prediction, less than five percent of public school superintendents are women and less than twenty-seven percent of public …
Educational Leadership: The Relationship Between Spirituality And Leadership Practices, Gerra Perkins, Nelda Wellman, Wendell Wellman
Educational Leadership: The Relationship Between Spirituality And Leadership Practices, Gerra Perkins, Nelda Wellman, Wendell Wellman
Academic Leadership: The Online Journal (2003-2012)
Throughout American history, schools and educational leaders have been in the spotlight because of the eminent task of preparing the young of our nation for competition within a global economy and the marketplace of ideas. Educational leaders have moved through the stages of management, industrial efficiency, and cultural leadership finally concluding that school management requires more than efficiency and organization (Brickham, 1996). With the advent of tough-minded management and the realization of the difference between a leader and a manager, combined with an increase in the high school dropout rate, awareness developed that something was not working in American Schools …

Theory, Research & Practice Of A Comprehensive Teen Sexuality Education Curriculum, Dawn M. Bowker
Theory, Research & Practice Of A Comprehensive Teen Sexuality Education Curriculum, Dawn M. Bowker
Theses and Graduate Projects
Rates of sexually transmitted disease (STD), teen pregnancy, and teen births are higher in the United States than in most other industrialized countries (Kohler, 2008; Manhart, 2006; Teitelman, 2004; Terry-Humen, 2006). Five years ago, a Christian based, sexuality retreat curriculum was initiated that focused on teen knowledge, attitudes, and beliefs about sexuality. The developmentally appropriate curriculum promoted an increased awareness of self and issues influencing sexuality. The goal was to create a common language and a better understanding of the way adolescent males and females think and behave in matters of sexuality. This paper presents an evaluative retrospective analysis of …

Toward A New Approach To Disability Law, David A. Weisbach
Toward A New Approach To Disability Law, David A. Weisbach
Articles
This Article argues that a new approach to the laws governing disabilities is needed. Existing approaches, largely based on the "social model" of disabilities are unable to answer basic questions, such as the extent to which resources should be devoted to the disabled. The Article argues that basing disability policy directly on welfarist theories of distributive justice offers a better approach and begins the task of developing what such an approach would look like. Under a welfarist approach, policy toward the disabled depends on how a given disability affects the well-being of an individual. Under reasonable assumptions, redistribution toward individuals …
The Disintegration Of Intellectual Property - A Classical Liberal Response To A Premature Obituary, Richard A. Epstein
The Disintegration Of Intellectual Property - A Classical Liberal Response To A Premature Obituary, Richard A. Epstein
Articles
This Article plays off the title of Thomas Grey's well-known article, The Disintegration of Property, which argued in part that the ceaseless consensual fragmentation and recombination of property rights revealed some inner incoherence of the underlying private property institutions. I take the opposite position and treat this supposed disintegration of private property as evidence of its robust nature, not only for land but for all forms of intellectual property. Low transaction costs facilitate the creation of efficient regimes of property rights. I use this framework to critique modern intellectual property rights cases that limit the use of injunctive relief in …
Effects Of Liberalization On Litigation: Notes Toward A Theory In The Context Of Japan, Tom Ginsburg, Glenn Hoetker
Effects Of Liberalization On Litigation: Notes Toward A Theory In The Context Of Japan, Tom Ginsburg, Glenn Hoetker
Articles
This Essay examines the under-studied relationship between liberalization and litigation. Liberalization should lead to expanded civil litigation for four reasons: (1) new market entrants are less subject to informal sanctions and may have a greater propensity to go to court, (2) privatization transfers resources away from the state, expanding the number of transactions subject to civil law regimes, (3) liberalization reduces the government's ability to resolve disputes outside the courts; and (4) liberalization leads to economic development, which is generally litigation-enhancing. We test these propositions using a unique dataset of prefecture-level civil litigation data in Japan during the 1990s. Using …

Visualizing spatial information has a long history in the field of cartography. Though there are generally accepted forms of spatial data visualization to represent different types of spatial data, the interpretation of the resulting maps tends to be subjective at best and incorrect, at worst. Cartograms are an increasingly popular form of spatial data visualization, recently applied in political and epidemiological analyses in an attempt to better represent the spatial data under analysis. We use the cartogram procedure to map crime rates and location quotients. Using this visualization approach, we are able to show the usefulness of cartograms to represent …

Loo Law: The Public Washroom As A Hyper-Regulated Space, Irus Braverman
Loo Law: The Public Washroom As A Hyper-Regulated Space, Irus Braverman
Journal Articles
The article suggests that the public washroom is the most regulated of all public spaces, at least in the United States. It offers several possible explanations for this hyper-juridical attention. First and foremost, the article argues, such hyper-regulation of the public washroom has to do with the sanitary and moral significance of this space. Secondly, the intensity of washroom regulation is due to its ambiguous public/private properties. Finally, the intense regulation of the public washroom is the result of physio-anatomical functions performed in it. Utilizing the State of New York as a lens through which to observe the various issues …
The Arts Of Persuasion In Science And Law: Conflicting Norms In The Courtroom, Herbert M. Kritzer
The Arts Of Persuasion In Science And Law: Conflicting Norms In The Courtroom, Herbert M. Kritzer
Law and Contemporary Problems
Epistemology is important in the debate about science and technology in the courtroom. The epistemological issues and the arguments about them in the context of scientific and technical evidence are now well developed. Of equal importance, though, is an understanding of norms of persuasion and how those norms may differ across disciplines and groups. Norms of persuasion in the courtroom and in legal briefs differ from norms at a scientific conference and in scientific journals. Here, Kritzer examines the disconnect between science and the courtroom in terms of the differing norms of persuasion found within the scientific community and within …
Inverting The Inverted Pyramid: A Conversation About The Use Of Feminist Theories To Teach Journalism, Danna L. Walker, Margaretha Geertsema, Barbara Barnett
Inverting The Inverted Pyramid: A Conversation About The Use Of Feminist Theories To Teach Journalism, Danna L. Walker, Margaretha Geertsema, Barbara Barnett
Scholarship and Professional Work - Communication
Teaching is always challenging, and for some of us who are feminists, teaching journalism is particularly difficult. The tenets of good journalism—objectivity and neutrality—are often antithetical to our feminist values. We face the dilemma of how to incorporate feminist sensibilities into teaching journalism—a profession that strives for detachment and, at times, seems oblivious to its own position of power.
Ethnic Politics, Political Corruption And Poverty: Perspectives On Contending Issues And Nigeria's Democratization Process, Dewale Adewale Yagboyaju
Ethnic Politics, Political Corruption And Poverty: Perspectives On Contending Issues And Nigeria's Democratization Process, Dewale Adewale Yagboyaju
Ethnic Studies Review
It is common to interpret African politics in tribal or ethnic terms. In the case of Nigeria, the dominant political behaviour can be defined, on the one hand, in terms of "incessant pressures on the state and the consequent fragmentation or prebendalizing of state-power" (Joseph, 1991:5). On the other hand, such practices can also be related to "a certain articulation of the factors of class and ethnicity" (ibid). For a better understanding of the essentials of Nigerian politics and its dynamics, it is necessary to develop a clearer perspective on the relationship between the two social categories mentioned above and …

Since the passing of two high-profile state legislative bills aimed at Arizona's Latino residents this past April, the significance of ethnicity for American citizens has once again surfaced as a topic for national debate. Whether to legitimize, or just as frequently deny, what defines American identity, the question and meaning of one's ethnic roots continues to be a contested matter for many Americans. In particular, HB 2281, a bill targeting the restriction of ethnic studies curricula in Arizona's K- 12 educational system, has prompted accusations that Ethnic Studies scholarship and teachings work against a unified sense of nationhood by encouraging …

Nisei Politics Of Identity And American Popular Music In The 1930s And 1940s, Susan Miyo Asai
Ethnic Studies Review
Growing nationalist thinking and anti-immigration legislation in American politics today calls for a critical historicizing of the continuing ambiguities of U.S. citizenry and notions of what it is to be an American. The identity crisis of Nisei-second generation Japanese Americansresulted from the complex intersection of America's racialized ideology toward immigrants, California's virulent anti-Asian agitation, and the economic and political power struggles between the United States and Japan in gaining dominance of the Pacific region.

"If You're Black, Get Back!" The Color Complex: Issues Of Skin-Tone Bias In The Workplace, Letisha Engracia Brown Cardoso
Ethnic Studies Review
Skin-tone has always played a role in the socioeconomic lives of African-Americans, and while there are always successes, there are also those who are not as fortunate. A major success for African Americans has come in the shape of the election of the nation's first AfricanAmerican President, Barack Obama, and, by extension, the first African-American First Lady, Michelle Obama. Among the cries of happiness and hope after the election, there lingers a feeling among many Americans whether Barack Obama would have been elected if he were darker rather than lighter skinned. Though the question is rhetorical at this point the …

Predictors Of Engagement In The Community Affected By Hiv And Aids, Benjamin J. Marcus
Predictors Of Engagement In The Community Affected By Hiv And Aids, Benjamin J. Marcus
CGU Theses & Dissertations
The goal of this study was to explore factors that lead to engagement in the community affected by HIV and AIDS (CAHA). An additional goal of this study was to better understand the relationships between psychological sense of community (PSOC) and social identification (SI), and their connections to two classes of motivations: community concern motivations (CCM) and esteem enhancement motivations (EEM). These constructs predicted two types of engagement in CAHA: AIDS activism and intentions for future participation in community related activity. Analyses were conducted on existing data (Omoto, 2005). The results indicate that PSOC and SI should be considered as …

Some Thoughts On The Methodological Approach To Ec Consumer Law Reform, Cristina Poncibo
Loyola Consumer Law Review
The reform of the Consumer Acquis is underway. In this paper, I aim to contribute to the current debate by focusing upon methodological questions. In particular, I claim that - in order to understand the current problems in consumer protection - comparative private scholarship needs to broaden its horizon and develop a dialogue with public law scholars involved in the field of New Governance. I propose to rely on a methodology that I call the "hybrid approach", a method that could bridge the current divide between private and public lawyers. I also stress the need to focus on comparative studies, …
