Exploration Of Ternary Intermetallic Materials Using Tin And Gallium Flux, Edem Kodzo Okudzeto Jan 2009

Exploration Of Ternary Intermetallic Materials Using Tin And Gallium Flux, Edem Kodzo Okudzeto

LSU Doctoral Dissertations

The focus of this dissertation is the structure-property relationships of ternary intermetallic stannides and gallides. We are interested in these compounds because of the wide range of physical properties they possess. While investigating the Ln-Co-Sn system (Ln = lanthanide), we have synthesized single crystals that crystallize in the Yb3Rh4Sn13, Ho7Co6Sn23 and the Tb5Rh6Sn18 structure types. We observe the formation of a particular structure type depending on the size of the lanthanide present. The aforementioned compounds all contain CoSn6 trigonal prisms, which create voids occupied by Ln and Sn polyhedral units. We have also investigated the physical properties of these compounds …

The Problems Solving Styles Of Emergency Operations Center Staffs Of Local And State Government Agencies, Glynn Cavin Jan 2009

The Problems Solving Styles Of Emergency Operations Center Staffs Of Local And State Government Agencies, Glynn Cavin

LSU Doctoral Dissertations

The purpose of this study was to investigate the demographics, leadership styles, and preferred problem solving style of the emergency management career field. The catalyst for the research was recognition that there are few scholarly investigations or theories of the cognitive processes that occur within emergency operations center staffs (EOCs), and to establish the demographic baseline. Demographics of Louisiana participants were compared with similar demographics of participants from the International Association of Emergency Managers (IAEM). The results revealed that the emergency management occupation is older and male dominated. The group is well educated; many IAEM members having advanced degrees. The …

An Examination Of The Effectiveness Of The Mmpi-2 And The Pai In The Detection Of Random Responding, Lesley Ann Hiebing Jan 2009

An Examination Of The Effectiveness Of The Mmpi-2 And The Pai In The Detection Of Random Responding, Lesley Ann Hiebing

Dissertations and Theses @ UNI

Intermittent Random Responding, Front Random Responding, and Back Random Responding were investigated on the MMPI-2 and PAL Random responses were inserted in increasing proportions into profiles from a large clinical sample. Validity scales sensitive to random responding on each scale (VRIN, F, FB, and FP on the MMPI-2 and ICN and INF on the PAI) were evaluated to determine which scale(s) would best detect random responding. Results indicate that validity scales from both measures were more sensitive to random responding in the intermittent random condition and performed worse in the back random condition. Overall, the MMPI-2 validity scales were better …

Youth Volunteerism: By Looking At Who Volunteers And Why Organizations May Be Able To Recruit Youth To Become Long-Standing Volunteers, Kathryn M. Zimmerly Jan 2009

Youth Volunteerism: By Looking At Who Volunteers And Why Organizations May Be Able To Recruit Youth To Become Long-Standing Volunteers, Kathryn M. Zimmerly

Graduate Research Papers

In 1835 Alexis de Tocqueville suggested volunteerism could reduce antisocial or criminal behavior (Uggen and Janikula, 1999). When looking at volunteerism today researchers have concluded similar aspects; for example, Uggen and Janikula found in their 1999 research that volunteers had increased self -acceptance, instrumentality, and civic identity.

Research by the Independent Sector suggests that 70 percent of youth volunteers feel volunteering is important because it gives them a new perspective, allows them to participate for a good cause, and gives them a greater respect for the people they are helping. Youth volunteer levels have increased (to 70 percent from 59 …

Kenny Wheeler: Melody, Harmony And Structure : An Analysis Of The Melodic, Harmonic And Structural Techniques In The Compositions Of Kenny Wheeler, And The Implementation Of Those Techniques Into The Authors Own Creative Process, Alice Humphries Jan 2009

Kenny Wheeler: Melody, Harmony And Structure : An Analysis Of The Melodic, Harmonic And Structural Techniques In The Compositions Of Kenny Wheeler, And The Implementation Of Those Techniques Into The Authors Own Creative Process, Alice Humphries

Theses : Honours

Kenny Wheeler is a Canadian born trumpeter and composer who has gained the respect and admiration of musicians and critics alike for his distinct and beautiful compositions. Despite this acclaim, am extensive search of relevant literature has revealed very little academic study of his compositional technique. Through an analysis of the melodic, harmonic and structural techniques evident in selected compositions by Kenny Wheeler, this dissertation offers insight into what gives Wheeler's music its distinct sound. The influence of these techniques on the author's own creative work is discussed through an exegesis. The dissertation consists of three chapters. The first chapter …

Architects Of The Identity Of Dance: Gender Inequity In Achievement And Acknowledgment In Australian Contemporary Dance, Quindell Orton Jan 2009

Architects Of The Identity Of Dance: Gender Inequity In Achievement And Acknowledgment In Australian Contemporary Dance, Quindell Orton

Theses : Honours

Evidence suggests that males receive more opportunities, awards and dominate the dance scene in terms of artistic directorship of high visibility, large budget contemporary dance companies within Australia. This research investigates why and how males have come to be the architects of the identity of dance and the factors which may inhibit a counterpart female's likelihood of assuming the same role. Much of this paper deals with constructing hypotheses for how gender disparities in contemporary dance may have come about. In order to devise informed hypotheses, I have gathered data on government funding and national dance awards. In addition interviews …

Gender Performativity In H.D.'S Sea Garden, Angela Sanigar Jan 2009

Gender Performativity In H.D.'S Sea Garden, Angela Sanigar

Theses : Honours

Sea Garden was the first book of poetry written by H.D. in 1916. Read through the lens of Judith Butler's theory of performativity, the book can be interpreted as an investigation of gender and identity in ways that challenge the confines of heteronormativity. Ultimately, I will argue that the poems work in ways close to Judith Butler's sense of 'queer', although as will become clear, my 'queer' reading of H.D.'s Sea Garden differs from the dominant queer readings of her work that currently exist. To this end, I will then discuss how Sea Garden operates as a community of different …

The Validity Of Deal Protection Devices Under Anglo-American Law, Wai Yee Wan Jan 2009

The Validity Of Deal Protection Devices Under Anglo-American Law, Wai Yee Wan

Research Collection Yong Pung How School Of Law

This paper analyzes deal protection devices, specifically termination fees and lockup agreements, that are entered into by publicly listed target companies in favor of the bidders, under Anglo-American law. U.S. (specifically Delaware) and U.K. law and regulation differ markedly in the regulation of these devices. Delaware law generally gives more leeway for the target board to enter into deal protection devices. The U.K. regime is much more shareholder-centric and severely restricts most types of deal protections. This paper examines the differences and argues that the U.K. regime is the result of the strong influence of institutional share ownership. In contrast, …

Cases And Materials On Patent Law, Martin J. Adelman, Randall R. Rader, John R. Thomas Jan 2009

Cases And Materials On Patent Law, Martin J. Adelman, Randall R. Rader, John R. Thomas

GW Law Faculty Publications & Other Works

This casebook provides a thorough overview of the fundamentals of U.S. patent law. The book is organized in fourteen chapters. The casebook starts with the current statute in Title 35 of the United States Code. It then considers the requirement of “usefulness” necessary to receive patent protection. The book proceeds to explain the requirement of “novelty” as well as the “nonobviousness standard.” The book also examines the various roles of the United States Patent and Trademark Office (“USPTO”), as well as the basics of the patent acquisition process.

After its discussion of the USPTO, the book provides an overview of …

The Enforcement Of Wto Judgments, Steve Charnovitz Jan 2009

The Enforcement Of Wto Judgments, Steve Charnovitz

GW Law Faculty Publications & Other Works

This essay examines the WTO’s dispute resolution system known as the Dispute Settlement Understanding (“DSU”). Inspiration for this essay comes from an influential article written by Michael Reisman four decades ago titled “The Enforcement of International Judgments.” Professor Reisman’s article presented a model for improving enforcement of international judicial decisions in cases between states. My essay shows that the DSU has achieved much of what Professor Reisman envisioned with respect to systematic enforcement of multilateral tribunal decisions. My essay begins by summarizing the institutional improvements recommended by Professor Reisman. Then the essay demonstrates how the DSU achieves many of those …

The Three Or Four Approaches To Financial Regulation: A Cautionary Analysis Against Exuberance In Crisis Response, Lawrence A. Cunningham, David T. Zaring Jan 2009

The Three Or Four Approaches To Financial Regulation: A Cautionary Analysis Against Exuberance In Crisis Response, Lawrence A. Cunningham, David T. Zaring

GW Law Faculty Publications & Other Works

Unprecedented interest in financial regulation reform accompanies the nearly-unprecedented scale of financial calamity facing the world. Dozens of elaborate reform proposals are in circulation, most determined to revolutionize financial regulation. No doubt, the crisis makes reevaluation essential, but we contribute a cautionary analysis amid the exuberant atmosphere. Reforms should not discount the value of traditional financial regulation, overlook the functional regulatory reform that has already occurred, or overstate ultimate differences between contending reform proposals. Despite proliferation of dozens of reform proposals, our analysis leads us to conclude that there are ultimately only three or four principal alternatives: (1) the traditional …

Treatment Differences And Political Realities In The Gaap-Ifrs Debate, Lawrence A. Cunningham, William W. Bratton Jan 2009

Treatment Differences And Political Realities In The Gaap-Ifrs Debate, Lawrence A. Cunningham, William W. Bratton

GW Law Faculty Publications & Other Works

The Securities Exchange Commission has introduced a Roadmap that describes a process leading to mandatory use of IFRS by domestic issuers by 2014. The SEC justifies this initiative on the grounds that global standardization yields cost savings and an ultimate gain in comparability, facilitating the search for global opportunities by U.S. investors and making U.S. capital markets more attractive to foreign issuers.

This paper enters an objection, noting that the stakes include more than the choice of the framework for standard setting. The accounting treatments themselves are at issue, treatments that for the most part concern domestic reporting firms and …

Wrong Incentives From Financial System Fixes, F. Scott Kieff, Stephan Harber Jan 2009

Wrong Incentives From Financial System Fixes, F. Scott Kieff, Stephan Harber

GW Law Faculty Publications & Other Works

Few doubt the seriousness of the recent crisis afflicting the financial systems of the United States and the world. Few claim that nothing needs to be fixed. And few have missed the major debates about what types of solutions are best - often conducted at high volume, intensity, and frequency. So rather than try to add to one side or the other of the well-rehearsed arguments about each type of proposed reform, we try to refocus the analysis on some core incentives: when the basic rules of the game are changing, property rights and the rule of law are too …

Comment On Intellectual Property, Concentration And The Limits Of Antitrust In The Biotech Seed Industry, F. Scott Kieff Jan 2009

Comment On Intellectual Property, Concentration And The Limits Of Antitrust In The Biotech Seed Industry, F. Scott Kieff

GW Law Faculty Publications & Other Works

This comment was filed with the Department of Justice Antitrust Division on December 31, 2009, as "Comments Regarding Agriculture and Antitrust Enforcement Issues in Our 21st Century Economy" in response to the DOJ/USDA request for public comments for the agencies' joint workshops on antitrust issues in the agricultural sector.

Regarding firm size and integration, it must be kept in mind that the agriculture industry in the U.S. has, for good reasons, moved beyond the historic, pastoral image of small family farms operating in quiet isolation, devoid of big business and modern technologies. The genetic traits that give modern seeds their …

How Not To Invent A Patent Crisis, F. Scott Kieff, Henry E. Smith Jan 2009

How Not To Invent A Patent Crisis, F. Scott Kieff, Henry E. Smith

GW Law Faculty Publications & Other Works

This short essay written for a broad audience addresses the problems that are at the center of current debates in academic and policy circles about the patent system. Most current patent reform proposals are designed to give officials and courts more power to weaken or eliminate ‘‘unworthy’’ patents and take primary aim at so-called patent trolls. This essay argues that in light of the rapid, and excessive, changes that have already occurred in the courts, what patent law needs is a tweaking of existing safety valves and processes - not opening the floodgates to more discretion and uncertainty.

The Second American Revolution In The Separation Of Powers, David Fontana Jan 2009

The Second American Revolution In The Separation Of Powers, David Fontana

GW Law Faculty Publications & Other Works

The American Constitution creates three branches of government and ensures that there will be sufficiently great amounts of ideological diversity among these branches of government. Despite this regime ensuring external heterogeneity, the American system, uniquely among the world's major constitutional democracies, rarely creates the same degree of heterogeneity at the highest levels of the Executive Branch that it does among the highest levels of the various branches of government. This Article discusses the distinctiveness of the homogeneous high-level American Executive Branch and the events that led to such a situation. At the first key moment defining the separation of powers …

The International Legality Of U.S. Military Cross-Border Operations From Afghanistan Into Pakistan, Sean D. Murphy Jan 2009

The International Legality Of U.S. Military Cross-Border Operations From Afghanistan Into Pakistan, Sean D. Murphy

GW Law Faculty Publications & Other Works

To date, U.S. cross-border operations from Afghanistan into Pakistan have taken three forms: the use of Predator drones to target Al Qaeda fighters (although such drones may be launched solely from within Pakistan); the "hot pursuit" of militants who engaged in raids from Pakistan against U.S. and allied forces in Afghanistan, as well as the Afghan government; and the deployment of special operations forces into Pakistan as a means of striking at Al Qaeda. These types of cross-border operations clearly implicate the jus ad bellum, in that they entail one state projecting highly coercive military force into another state. Arguably …

Which Original Meaning Of The Constitution Matters To Justice Thomas?, Gregory E. Maggs Jan 2009

Which Original Meaning Of The Constitution Matters To Justice Thomas?, Gregory E. Maggs

GW Law Faculty Publications & Other Works

This essay was published as part of a symposium hosted by the New York University Journal of Law and Liberty in March 2009. The journal citation is: Gregory E. Maggs, Which Original Meaning Matters to Justice Thomas?, 4 N.Y.U. J. L. & Liberty 494 (2009).

The essay addresses a basic question about Justice Clarence Thomas’s originalist jurisprudence. When Justice Thomas looks for the original meaning of the Constitution, does he seek (a) the meaning intended by the Framers at the Constitutional Convention in Philadelphia (“original intent”), (b) the meaning as understood by the delegates to the thirteen state ratifying conventions …

This article was published by the University of Illinois Law Review in 2009. The citation is: Gregory E. Maggs, A Concise Guide to the Records of the State Ratifying Conventions as a Source of the Original Meaning of the U.S. Constitution, 2009 U. Ill. L. Rev. 457.

Starting in the fall of 1787, legislatures in the original thirteen states called for conventions for the purpose of deciding whether to ratify the U.S. Constitution. Many of the records of these state ratifying conventions have survived. The records reveal some of what the delegates at the state conventions said during their debates …

Citation To Legislative History: Empirical Evidence On Positive Political And Contextual Theories Of Judicial Decision Making, Michael B. Abramowicz, Emerson H. Tiller Jan 2009

Citation To Legislative History: Empirical Evidence On Positive Political And Contextual Theories Of Judicial Decision Making, Michael B. Abramowicz, Emerson H. Tiller

GW Law Faculty Publications & Other Works

We present empirical evidence suggesting that political context—judicial hierarchy and judicial panel dynamics—influences an authoring judge’s use of legislative history. Specifically, we find that to the extent that political ideology matters, a district court judge’s choice of legislative history is influenced, albeit mostly, by (1) the political makeup of the overseeing circuit court and (2) the political characteristics of a judge’s panel colleagues, as well as by the circuit court as a whole. These factors matter more than the authoring judge’s own political-ideological connection to the legislators. Put differently, an authoring judge will have a greater tendency to cite legislative …

Ending The Patent Monopoly, Michael B. Abramowicz, John H. Duffy Jan 2009

Ending The Patent Monopoly, Michael B. Abramowicz, John H. Duffy

GW Law Faculty Publications & Other Works

For nearly two centuries, an inventor applying for a U.S. patent has been required to obtain the opinion of an expert who has searched the prior art and determined that the inventor’s application meets the standards of patentability. And for nearly two centuries, those expert opinions could be obtained only from a single office run by the U.S. government. The patenting monopoly, which is almost certainly undesirable, is now being eroded. Rising global trade and technological sophistication have increased the number of patent filings in every country; government patent offices here and abroad are thus being driven to rely on …

Science, Politics, Law And The Arc Of The Clean Water Act: The Role Of Assumptions In The Adoption Of A Pollution Control Landmark, Robert L. Glicksman, Matthew R. Batzel Jan 2009

Science, Politics, Law And The Arc Of The Clean Water Act: The Role Of Assumptions In The Adoption Of A Pollution Control Landmark, Robert L. Glicksman, Matthew R. Batzel

GW Law Faculty Publications & Other Works

This article examines the assumptions upon which Congress relied in enacting the 1972 Clean Water Act and the extent to which they have been borne out or belied as the federal and state governments have implemented their statutory responsibilities in the quest to achieve acceptably clean water. It traces the development of federal water pollution control legislation before 1972, highlighting the deficiencies that contributed to the need for a new approach in 1972. It then examines the scientific and technical, political, and legal assumptions that helped shape the 1972 Clean Water Act in an effort to determine whether the failure …
