Resisting Anti-Intellectualism And Promoting Legal Literacy, Leonard J. Long Oct 2009

Resisting Anti-Intellectualism And Promoting Legal Literacy, Leonard J. Long

Southern Illinois University Law Journal

Professor Long urges everyone involved in legal education, including professors, lawyers, students, and judges, to ask just one question: Of what use is a law school education? Those involved with law school educations should strive to be intellectually curious and well-rounded in education, and not to maintain the narrow view of simply “training lawyers.” For the benefit of society, consumers of legal services, lawyers, and law firms, we must encourage the pursuit of legal literacy. Law students should be encouraged to explore American literature and traditions of Anglo-American law to facilitate their legal literacy and to become cultural elitists. Students …

Higher Education And The Society For Neuroscience: A Website Proposal That Helped Catalyze A Change In Policy, Richard F. Olivo Oct 2009

Higher Education And The Society For Neuroscience: A Website Proposal That Helped Catalyze A Change In Policy, Richard F. Olivo

Neuroscience: Faculty Publications

In the spring of 2007, the Society for Neuroscience (SfN) did not include support for higher education as a priority in its strategic plan. By the spring of 2009, its priorities had changed. One catalyst for that change was a proposal for a website that would list, review, and rate resources for teaching neuroscience at the graduate and undergraduate level. The proposal was sent to and accepted by SfN Council in August 2008; by spring 2009, SfN had taken initial steps to implement it. Two documents are presented here that mark the change in policy: the website proposal, and SfN …

In Search Of An Enforceabe Medical Malpractice Exculpatory Agreement: Introducing Confidential Contracts As A Solution To The Doctor-Patient Relationship Problem, Matthew J.B. Lawrence Oct 2009

In Search Of An Enforceabe Medical Malpractice Exculpatory Agreement: Introducing Confidential Contracts As A Solution To The Doctor-Patient Relationship Problem, Matthew J.B. Lawrence

Faculty Scholarly Works

Scholars have argued that the malpractice system would be better off if patients had the option of waiving the right to sue for malpractice in exchange for a lower fee. Some doctors have tried to follow this advice by having their patients sign medical malpractice exculpatory agreements, but courts usually have refused to enforce these agreements, invoking a void-for-public-policy rationale. This Note argues that a doctor could maximize the odds that a court would enforce her medical malpractice exculpatory agreement by somehow ensuring that she will never find out whether her patient decided to sign. A case study of the …

Response To Samuel Martinez's Review Of The Slave Next Door, Kevin Bales, Ron Soodalter Oct 2009

Response To Samuel Martinez's Review Of The Slave Next Door, Kevin Bales, Ron Soodalter

Connecticut Journal of International Law

We appreciate the review by Professor Martinez of our book The Slave Next Door.' He makes some excellent points, exactly the points scholars would expect when an expert reviews a book written for the general public. But the fact is that this book was not written for experts, and so it will never be the book that Professor Martinez would like it to be.

Creating The Extension Family Caregiving Community Of Practice, Debra M. Sellers, Andrew B. Crocker, Allison Nichols, Sarah D. Kirby, Mary Brintnall-Peterson Oct 2009

Creating The Extension Family Caregiving Community Of Practice, Debra M. Sellers, Andrew B. Crocker, Allison Nichols, Sarah D. Kirby, Mary Brintnall-Peterson

Journal of Extension

The Family Caregiving Community of Practice, part of eXtension, provides a national one-stop site for Extension's caregiving educational resources. The developmental process of this community's creation is discussed within the "expansive learning" framework. Negatively, community members found too much emphasis on process and a lack of criteria for academic credit. Positively, they experienced increased knowledge, improved networking, and innovation. Recommendations for others creating communities are to: 1) promote the benefits of networking; 2) seek out others with similar passions; 3) provide graduated opportunities for learning; 4) help members transition from an individual perspective; and 5) provide systems for academic recognition.

"Co-Opetition?" Can It Exist Between Extension And Agricultural Education?—A Study On Interdisciplinary Cooperation, Kristina G. Ricketts, Jacklyn A. Bruce Oct 2009

"Co-Opetition?" Can It Exist Between Extension And Agricultural Education?—A Study On Interdisciplinary Cooperation, Kristina G. Ricketts, Jacklyn A. Bruce

Journal of Extension

Interdisciplinary cooperation was explored between agriculture teachers and Extension educators in a northeastern state. A researcher-designed questionnaire that focused on three factors—perceptions toward interdisciplinary cooperation, behavioral intentions, and individual cooperative experiences—was used to determine the current cooperative environment. Results indicated that even though agriculture teachers and Extension educators appeared to have similar ideas involving personal perceptions, motivations, and experiences regarding cooperation, much less cooperation is occurring than is ideal. Recommendations include joint preparation for teachers and educators, pre-service and in-service incorporation of various facets of cooperation, and assembling an integrated discussion group where future interdisciplinary associations could be discussed.

Activities That Promote Wellness For Older Adults In Rural Communities, Mihyun Kang, Randall Russ Oct 2009

Activities That Promote Wellness For Older Adults In Rural Communities, Mihyun Kang, Randall Russ

Journal of Extension

Growing interest in healthier aging coincides with the comprehensive whole person wellness model that includes physical, emotional, spiritual, intellectual, occupational, and social dimensions. The study reported here examined current activities for older adults in rural community centers via a mail survey sent to the directors of Oklahoma community centers. To follow up, site visits to the centers and interviews with the directors were conducted. Findings indicated that 16% of the centers offered activities for all six dimensions and that older adults generated many activities. To accommodate activities in a rural community center, programs for these diverse activities must be addressed.

A Descriptive Analysis Of The Perceptions Of North Carolina 4-H Agents Toward Minority Youth Participation In Agricultural-Related Activities, Antoine J. Alston, Cormanica M. Crutchfield

Journal of Extension

An analysis of the perceptions of North Carolina 4-H Extension personnel regarding minority youth participation in agriculture-related activities was conducted. Based on the data collected, the researchers found that 4-H agricultural programs were not fully meeting the needs of a growing diverse population. There is a strong need to improve agricultural program participation in order to increase recruitment and retention strategies for minority youth in relation to 4-H agricultural based activities.

Ecological Principles—A Unifying Theme In Environmental Education, Michael T. Mengak, Holly E. Rutledge, Barbara Mcdonald Oct 2009

Ecological Principles—A Unifying Theme In Environmental Education, Michael T. Mengak, Holly E. Rutledge, Barbara Mcdonald

Journal of Extension

Using ecological principles to form the basis of a succinct list of general environmental education (EE) standards will bring unity and strength to EE. Environmental education literature supports the importance of understanding general ecological principles, and general ecological concepts are prevalent in both widely used and locally adapted EE programs. In addition, an understanding of general ecological principles is included in both NSES (National Science Education Standards) and NAAEE Guidelines for Excellence. This article presents an analysis of the frequency of ecological references in several EE programs and discusses the implications of general ecological principles as a common thread in …

Strategery's Refuge, Christopher W. Seeds Oct 2009

Strategery's Refuge, Christopher W. Seeds

Cornell Law Faculty Publications

By popular account, the Supreme Court’s recent decisions on effective assistance of counsel in capital sentencing—aggressive critiques of counsel’s failure to investigate and present mitigating evidence—initiate an era of improved oversight of the quality of legal representation in death penalty cases. One would expect the new and improved jurisprudence to curb post hoc efforts by trial counsel to disguise incomplete trial preparation as a tactical decision, a practice that has long undercut the Strickland doctrine. But the shelters for post hoc rationalizations—the refuges for “strategery”—remain. Surveying decisions of the federal courts of appeals since the turn of the century, this …

Performing Discretion Or Performing Discrimination: An Analysis Of Race And Ritual In Batson Decisions In Capital Jury Selection, Melynda J. Price Oct 2009

Performing Discretion Or Performing Discrimination: An Analysis Of Race And Ritual In Batson Decisions In Capital Jury Selection, Melynda J. Price

Law Faculty Scholarly Articles

Research shows the mere presence of Blacks on capital juries--on the rare occasions they are seated--can mean the difference between life and death. Peremptory challenges are the primary method to remove these pivotal participants. Batson v. Kentucky developed hearings as an immediate remedy for the unconstitutional removal of jurors through racially motivated peremptory challenges. These proceedings have become rituals that sanction continued bias in the jury selection process and ultimately affect the outcome of capital trials. This Article deconstructs the role of the Batson ritual in legitimating the removal of African American jurors. These perfunctory hearings fail to meaningfully interrogate …

Making Homework Count: Homework As A Collective Task For Language Minority Families, Kathy R. Fox Oct 2009

Making Homework Count: Homework As A Collective Task For Language Minority Families, Kathy R. Fox

Journal of Praxis in Multicultural Education

In response to a writing prompt asking, “What can parents do to ensure academic success for their child?” a mother with three children under the age of six wrote: “In my opinion he needs motivation from his parents and interest in his homework. [He needs] to read a lot so he will have good confidence with his friends and about everything, about his teacher.” This response was typical of those given by participants in a family literacy program (FLP) sponsored by a small urban school district. This program was originally designed to help minority language and culture parents learn functional …

Reconfiguring The Borderlands Of Identity: Preparing Social Justice Educators, Anita E. Fernandez Oct 2009

Reconfiguring The Borderlands Of Identity: Preparing Social Justice Educators, Anita E. Fernandez

Journal of Praxis in Multicultural Education

This article offers multiple pedagogical approaches for mobilizing Gloria Anzaldúa's metaphor of borderlands to prepare social justice educators to address issues of justice and equity in increasingly diverse classroom settings. It describes an experiential course in multicultural education, including innovative processes through which Education students analyze the borderlands of identity, society, and geography through critical self-analysis, fieldwork, and social action. By investigating the intersectionality of social justice issues and the social construction of identity, students attempt to transform the borders of their own identities and engage in action projects to begin a process of bridging the edges of cultural inequity.

Relational Maintenance Strategies On Facebook, Erin M. Bryant, Jennifer Marmo Oct 2009

Relational Maintenance Strategies On Facebook, Erin M. Bryant, Jennifer Marmo

Human Communication and Theatre Faculty Research

This study explored how college students utilize the social networking site Facebook to maintain relationships. Focus group data was analyzed to develop a list of 58 Facebook relational maintenance strategies. Canary, Stafford, Hause, and Wallace’s (1993) relational maintenance typology was used to organize Facebook relational maintenance strategies. A new category was created to represent a popular relational maintenance strategy on Facebook: surveillance. This study also examined how maintenance strategies vary in different Facebook relationships; close friends, casual friends, acquaintances, romantic partners, and outsiders (e.g. parents, bosses, teachers). Participants suggested Facebook is an adequate stand-alone tool to maintain casual or acquaintance …
