Gender Equality Within The Aerospace And Defense Industry, Shreyas Gandhi
Gender Equality Within The Aerospace And Defense Industry, Shreyas Gandhi
Theses and Dissertations
Three of America's largest aerospace and defense companies (ADC1, ADC2, and ADC3) have major operations in the Los Angeles region of Southern California. This study focused on a single aerospace and defense company, ADC1. In the broader population of ADC1, there are almost as many females (45%) as there are males. However, of the 19 members of ADC1's leadership team for its Southern California region-based division, as of October 2008, less than 16% were women. The purpose of this qualitative study was to understand what it is like to be a female senior executive leader in the male-dominated aerospace and …
Sharing Stories: Narrative Lawyering In Bench Trials, Paul Holland
Sharing Stories: Narrative Lawyering In Bench Trials, Paul Holland
Faculty Articles
Narrative lawyering theorists have demonstrated the ways in which the dynamics of stories affect the way lawyers deliver and jurors receive messages within trial. However, relatively little attention has been paid to the distinctive ways in which stories are developed in bench trials. Examining three roughly contemporaneous bench trials, this Article illuminates how this trial format requires lawyers to be both performers and audience, alternating roles frequently, sometimes within the span of a breath or a gesture. The availability of feedback to the lawyer and the possibility of direct intervention by the fact-finder produce a stark contrast to what lawyers …

Stories Absent From The Courtroom: Responding To Domestic Violence In The Context Of Hiv And Aids, Jane Stoever
Stories Absent From The Courtroom: Responding To Domestic Violence In The Context Of Hiv And Aids, Jane Stoever
Faculty Articles
HIV/AIDS dramatically impacts domestic violence survivors' needs and demands reconceptualization of current responses to domestic violence. This article aims to illuminate the problem of domestic violence in the context of HIV/AIDS and to prompt further development of legal response systems. Specifically, this article brings together the worlds of law, public health, and women's lived experiences to argue for recognizing and responding to domestic violence in the context of HIV/AIDS in the United States. Utilizing accounts of clients' experiences and data from public health studies, this article sets forth eight categories of HIV/AIDS-related domestic violence: repercussions from partner notification, use of …
A Phenomenological Study Of Nurse Clinicians' Participation In An Evidence-Based Practice Clinical Research Fellowship Program, Cheryl A. Hernandez
A Phenomenological Study Of Nurse Clinicians' Participation In An Evidence-Based Practice Clinical Research Fellowship Program, Cheryl A. Hernandez
Theses and Dissertations
Despite an abundance of scientific evidence to ensure nurse clinicians deliver the highest quality of care to achieve optimal outcomes for patients, barriers and challenges exist that prevent adoption of this evidence into routine clinical practice. Evidence-Based Practice Clinical Research Fellowship Programs (EBP CRFP) are designed and implemented to facilitate the adoption of scientific evidence into clinical nursing practice; however, these programs have not been adequately evaluated in terms of the impact of the program on participants, their clinical practice, and the organization. The purpose of this hermeneutical phenomenological study was to explore the lived experiences of nurse clinicians who …
Concordance Between Therapists' Self-Reports And Observers' Ratings Of Adherence To Marital Therapy, Arlene A. Cruz
Concordance Between Therapists' Self-Reports And Observers' Ratings Of Adherence To Marital Therapy, Arlene A. Cruz
Theses and Dissertations
In the context of psychotherapy research, investigators often assume that the assessment of adherence to treatment protocols should be done by trained observers, who are viewed as more neutral or objective than the therapists themselves. The aim of this present study is to check the concordance between therapist self-reports and observer ratings of adherence to marital treatment (IBCT and TBCT). The data for the current study were obtained from an archive of adherence data for 35 randomly selected therapy cases, collected by Andrew Christensen and colleagues (2004) in the context of a large clinical trial of marital therapy. For both …
The Relationships Among Early Maternal Emotional Support, Career Satisfaction, And Life Satisfaction For Baby Boom Women At Midlife, Wendy Knight
Theses and Dissertations
Maternal emotional support affects the early career behaviors of daughters, yet little is known about its contribution to the career outcomes of women later in life. This study used a lifespan approach along with relational theory to study the career satisfaction and life satisfaction of 101 employed, middle-aged women of the baby boom generation. Correlational analysis determined that career satisfaction and life satisfaction were strongly correlated, with much of the shared variance explained by supportive relationships at home and at work. Also strongly correlated with both career satisfaction and life satisfaction was the belief that one's career goals had been …
Religious Affiliation And Hiring Practice: A Case Study Of Concordia University Irvine, Marc Fawaz
Religious Affiliation And Hiring Practice: A Case Study Of Concordia University Irvine, Marc Fawaz
Theses and Dissertations
In 1976, Christ College (CC), located in Irvine, California, began offering degrees leading to positions in the Lutheran Church-Missouri Synod (LCMS). The college comprises only 1 of several departments within Concordia University Irvine (CUI). Meanwhile, CUI is part of the Concordia University System (CUS), a nationwide network of LCMS 2- and 4-year colleges. Transformation of CC into a diverse university has been accompanied by challenges. Although enrollment is up, costs have risen. And although stakeholders prefer to hire full-time faculty with ties to the LCMS, few qualified candidates fulfill this stricture. These and other threats, coupled with the economic recession, …
An Evaluation Of Congruency Of Nursing Staff Values And Organizational Vincentian Values, Beverly S. Quaye
An Evaluation Of Congruency Of Nursing Staff Values And Organizational Vincentian Values, Beverly S. Quaye
Theses and Dissertations
This case study was an exploration of values-congruence between personal and organizational values in a healthcare setting. Previous research has found that alignment between the two improves organizational effectiveness. The setting was a 384-bed urban Catholic hospital with Vincentian values. The efficacy of Vincentian values is found only in the academic and religious literature, not in that of healthcare. Published studies on registered nurses' values focus primarily on ethical reasoning and decision making. Employee values were defined using Rokeach's conceptual model for instrumental and terminal values. Both are based on enduring beliefs with specific modes of conduct or end-states of …
Correlational Study Between Emotional Intelligence Scores And Specific Personality Traits Of Professionals Working In The Nonprofit Sector In The Northwest, Suzan L. Huntington
Correlational Study Between Emotional Intelligence Scores And Specific Personality Traits Of Professionals Working In The Nonprofit Sector In The Northwest, Suzan L. Huntington
Theses and Dissertations
Emotional intelligence (EQ) has received much attention as a factor that is potentially useful in understanding and predicting individual performance at work. EQ is defined as the subset of social intelligence involving the ability to monitor one's own and others' feelings and emotions, to discriminate among them and to use this information to guide one's thinking and actions (Cobb & Mayer, 2000; Goleman, 1995; Thi Lam & Kirby, 2002; Tucker, Sojka, Barone, & McCarthy, 2000). The two nemeses for EQ are general cognitive intelligence (IQ) and personality theory. Abundant research exists regarding the impact IQ has on personal success. Most …
Homes Affordable For Good: Covenants And Ground Leases As Long-Term Resale-Restriction Devices, James J. Kelly Jr.
Homes Affordable For Good: Covenants And Ground Leases As Long-Term Resale-Restriction Devices, James J. Kelly Jr.
Journal Articles
Covenants and ground leases have been, and continue to be, used to create shared spaces that are fundamentally, and often invidiously, exclusive. Famously made a dead letter in the case of Shelley v. Kraemer, covenants banning resale to nonwhite households put the force of law behind the segregated birth of America’s suburbs. Today, gated residential communities and shopping malls assure a degree of class exclusivity through covenants and commercial ground leases, respectively. These same legal mechanisms, however, are now deployed to assure long-term inclusion as well.

Notions Of Distance: Communication Constraints In Long-Distance Dating Relationships, Jenny Marie Farrell
Notions Of Distance: Communication Constraints In Long-Distance Dating Relationships, Jenny Marie Farrell
UNLV Theses, Dissertations, Professional Papers, and Capstones
This study addressed communication constraints perceived by individuals in long-distance dating relationships (LDDRs) and how these constraints are managed. Internal constraints are identified within the boundaries of the individual or relationship and external constraints are those that originate from outside the boundaries of the individual or relationship. Semi-structured qualitative interviews were conducted with 27 participants; ages ranged from 18-35. Participants reported perceiving 11 internal constraints (mediated communication, avoidance, talk habits, physical absence, emotions, view of outsiders, uncertainty and expectations, effort, notions of distance, visits, and miscellaneous) and five external constraints (schedules, social network, finances, and technology, miscellaneous). Participants reported managing …
Mental Illness, Co-Occurring Factors And Aggression As Examined In An American Prison, Stephanie Leigh Sullivan
Mental Illness, Co-Occurring Factors And Aggression As Examined In An American Prison, Stephanie Leigh Sullivan
UNLV Theses, Dissertations, Professional Papers, and Capstones
This study examines the relationship between several factors which have been identified in previous research as co-occurring and risk relevant to aggressive behavior. Although many factors have been addressed independently for various reasons in other studies, this study looks at the unique combination of a select few of these variables and their relationship for propensity towards aggression. The results of this study show propensity towards aggression is significant for two specific mental health issues; anxiety, and history of severe head injury. Results also indicate that co-occurring factors are prevalent in this sample and those inmates with prior mental illness are …
Finding A Reasonable Way To Enforce The Reasonable Efforts Requirement In Child Protection Cases, Jeanne M. Kaiser
Finding A Reasonable Way To Enforce The Reasonable Efforts Requirement In Child Protection Cases, Jeanne M. Kaiser
Faculty Scholarship
Under federal law, state child protection agencies are required to exert "reasonable efforts" to reunite abused and neglected children with their parents before seeking to terminate parental rights and free the children for adoption. The scope of this requirement is undefined in federal statutes and in the statutory law of many states. As a result, it has fallen to appellate courts to determine the degree of effort a state agency must exert before the relationship between a parent and a child is severed. This has proven no easy task. By the time a parental termination case has reached an appellate …
Instant (Gender) Messaging: Expression-Based Challenges To State Enforcement Of Gender Norms, Taylor Flynn
Instant (Gender) Messaging: Expression-Based Challenges To State Enforcement Of Gender Norms, Taylor Flynn
Faculty Scholarship
Most challenges to state enforced conformity with gender norms are almost solely status-based equality claims. Given that a common term deployed by members of the trans community and in antidiscrimination laws is "gender identity and expression," situating such challenges in expression may, at first glance, appear to be little more than linguistic legerdemain. An understanding of gender as expressive, however, helps capture an often unarticulated, yet central aspect, of the harm enforced conformity inflicts on trans persons---compelled expression of the state's gender message over their profound objection. Consider governmental insistence that a trans student or employee present herself, through dress …
The Yearning For Zion Raid And Its Impact On Texas Child Welfare Cases: How A Botched Rescue Effort Exposed A Need To Refocus Efforts On Effective Service Plans Comment., Shannon K. Dunn
St. Mary's Law Journal
The raid of the Yearning for Zion ranch exposed fundamental flaws in the operation of the Texas Department of Children and Family Services (the Department). In the raid, the Department took custody of 468 children without a court order and removed them from their homes. This is one of the most glaring examples of the Department’s disregard for the Texas Family Code. Subchapter B of section 263 of the Texas Family Code mandates for the creation and implementation of a comprehensive service plan whenever the Department removes a child from his home. The Department, however, failed to create service plans …

Medical Marijuana: The Conflict Between Scientific Evidence And Political Ideology, Peter J. Cohen
Medical Marijuana: The Conflict Between Scientific Evidence And Political Ideology, Peter J. Cohen
Utah Law Review
At the beginning of this article, a basic question was posited: Should the approval or disapproval of medical marijuana as a legitimate therapeutic agent be governed by the same statute (and philosophy) that applies to all other new drugs or pharmaceutical agents, the Food, Drug, and Cosmetic Act, and should the drug be evaluated by the appropriate regulatory agency, the Food and Drug Administration, for its safety and efficacy as demonstrated by "evidence consisting of adequate and well-controlled investigations, including clinical investigations, by experts qualified by scientific training and experience"? If not, should medical marijuana be exempt from scientific review …
Imagining The Addict: Evaluating Social And Legal Responses To Addiction, Elizabeth E. Joh
Imagining The Addict: Evaluating Social And Legal Responses To Addiction, Elizabeth E. Joh
Utah Law Review
Often we refer to the response to an unwanted addictive behavior, but of course there is no unified social or legal response. Instead, addictive or compulsive behaviors occasion a variety of social and legal responses: restrictive or prohibitive legislation, individual litigation, the emergence of advocacy groups, and the issue of expert opinion. Yet even if these responses do not originate from a single plan, they converge in a particular way. When a new "epidemic" of addictive behavior is identified, a narrative about that addiction emerges. Who are I the addicts? What danger do they pose? Who bears responsibility for the …
Feminist Fundamentalism On The Frontier Between Government And Family Responsibility For Children, Mary Anne Case
Feminist Fundamentalism On The Frontier Between Government And Family Responsibility For Children, Mary Anne Case
Utah Law Review
The equality of the sexes, and the instantiation of that equality in the repudiation of "fixed notions concerning the roles and abilities of males and females,'" are fundamental commitments on which all levels of government in the United States must follow through, not only in lawmaking, but in hortatory pronouncements, funding decisions, and necessary interventions into the family, such as child custody and adoption decisions. Not only in public schools and government funded educational programs, but in state-licensed private schools and home schooling, they must ensure that girls and boys receive equal opportunity. And evidence of commitment to sex equality …
Racism And The Law: Slavery, Integration, And Modem Resegregation In America, David Welsh
Racism And The Law: Slavery, Integration, And Modem Resegregation In America, David Welsh
Utah Law Review
"The destinies of the two races in this country are indissolubly linked together, and the interests of both require that the common government of all shall not permit the seeds of race hate to be planted under the sanction of law," declared Justice Harlan in his ringing dissent to Plessy v. Ferguson. Yet in 1896, his vision of a "colorblind" America was marred by centuries of racism and prejudice. Similarly, despite lofty ideals, the Supreme Court's historical treatment of African Americans in the United States stands in sharp contrast to the declaration that all are created equal. "Other racial injustices …
Justice In The Darkness: Mental Health And The Juveniie Justice System, Brian Jay Nicholls
Justice In The Darkness: Mental Health And The Juveniie Justice System, Brian Jay Nicholls
Utah Law Review
Unless states can provide a way to identify these youth at an earlier stage, intervene, and provide meaningful and effective treatment, the future of those youths as well as the public safety is in jeopardy. Research has shown, as illustrated by Utah's C3 Court, that a comprehensive and collaborative approach to treating these kids can "reduce both crime and costs in the long run while improving (and even saving) the lives of young people today." If states do nothing however, not only do those states fail the youth that they are supposed to rehabilitate, but the state also "fails the …
Not Guilty…Until Recommitment: The Misuse Of Evidence Of The Underlying Crime In Ngri Recommitment Hearings, Jana R. Mccreary
Not Guilty…Until Recommitment: The Misuse Of Evidence Of The Underlying Crime In Ngri Recommitment Hearings, Jana R. Mccreary
Utah Law Review
A criminal defendant found not guilty by reason of insanity was found not guilty. Commitment to a state mental facility is not designed to be punishment for a crime. The commitment is meant instead to address the acquittee’s insanity. Involuntary commitment strips a person of a vital liberty interest, and under our Constitution it should be done only with adequate due process. Recommitment of the person, though, is due that same protection. Accordingly, use of unfairly prejudicial evidence should be limited unless a court deems it necessary to a jury’s determination.
Adoption Of Infants Born To Unaware, Unwed Fathers: A Statutory Proposal That Better Balances The Interests Involved, Tyler M. Hawkins
Adoption Of Infants Born To Unaware, Unwed Fathers: A Statutory Proposal That Better Balances The Interests Involved, Tyler M. Hawkins
Utah Law Review
In December, Robert and Carol became engaged and Robert moved into Carol’s home. Their relationship deteriorated, however, and in February of the following year Robert moved out. Although Carol was pregnant when Robert left, Carol hid this fact from Robert, apparently fearful Robert would think “she was trying to coerce him into marriage.” During the following weeks, Carol asked her friends, a married couple, if they would adopt her and Robert’s child. The couple agreed. In October, Carol gave birth to a baby boy, who was delivered to the adoptive parents upon Carol’s discharge from the hospital.
Engaging And Motivating Young Readers, Alisha Briggs
Engaging And Motivating Young Readers, Alisha Briggs
Graduate Research Papers
It is well accepted in the teaching world that a student's success in reading is greatly influenced by the student's own motivation. A student needs to be engaged in a subject to be successful. An engaged and motivated reader chooses to read for a variety of purposes including reading for enjoyment and seeking information. A student may find this motivation within himself/herself or they may need the help of the teacher and learning environment to do so. This paper will look at the various aspects of motivation and engagement including self-determination theory, social contexts, and classroom strategies.

Parental Involvement In Child's Education : Does It Help? How Can We Make It Better?, Keith Galloway

How often and in what ways do my students' parents get involved in their children's education? How important do the parents of my students think it is to get involved in their children's education? How do I find out how and how much my student's parents involve themselves in their children's education?
For those parents already involved in their children's education, how do I get these parents to increase their involvement in their children's education? How do I convince the parents who are not involved in their children's education just how important it is?
The research discussed in this paper …
