Using Tranparency To Regulate In The Age Of Technology: A Case Study Of The Childcare Business In Kent County, Michigan, Susan Toman Jan 2009

Using Tranparency To Regulate In The Age Of Technology: A Case Study Of The Childcare Business In Kent County, Michigan, Susan Toman

SPNA Review

In the shadow of a mountain of scandalous behavior exhibited by both government and business, it is easy to lose trust that any regulatory method can be effective. Transparency holds promise as a means to hold business and government accountable; particularly when both mandatory and voluntary disclosure are driven and shaped by their intended audience: Consumer/customer, employee, supplier, regulator or investor. With the beginning of the Obama Presidency, there is hope for increased governmental legislation and support for disclosure in all sectors (Obama, 2008). Transparency first was a term adopted by the business community to “describe the obligation to disclose …

The Divide Of The Coca Leaf: National Culture And The Drug Policies Of Bolivia And The United States, Megan Koops Jan 2009

The Divide Of The Coca Leaf: National Culture And The Drug Policies Of Bolivia And The United States, Megan Koops

SPNA Review

While the United States and Bolivian cultures have different values, attitudes and norms, these differences have not been a major factor in determining the aid Bolivia receives from the United States (US). Now, President Morales, a former union leader for coca leaf growers, has refused to comply with US foreign policy to eradicate the coca leaf, creating political and cultural tension. This paper examines the US and Bolivian relationship as a case study through Schein’s organizational cultural theory and Adler’s culture theory to determine how Bolivia’s battle to save the coca leaf may affect the aid it receives from the …

Theorizing And Generalizing About Risk Assessment And Regulation Through Comparative Nested Analysis Of Representative Cases, Jonathan B. Wiener, Brendon Swedlow, Denise Kall, Zheng Zhou, James K. Hammitt

Faculty Scholarship

This article provides a framework and offers strategies for theorizing and generalizing about risk assessment and regulation developed in the context of an on-going comparative study of regulatory behavior. Construction of a universe of nearly 3,000 risks and study of a random sample of 100 of these risks allowed us to estimate relative U.S. and European regulatory precaution over a thirty-five-year period. Comparative nested analysis of cases selected from this universe of ecological, health, safety, and other risks or its eighteen categories or ninety-two subcategories of risk sources or causes will allow theory-testing and -building and many further descriptive and …

Elimination Of The Deduction For Business Entertainment Expenses, Richard L. Schmalbeck, Jay A. Soled Jan 2009

Elimination Of The Deduction For Business Entertainment Expenses, Richard L. Schmalbeck, Jay A. Soled

Faculty Scholarship

The proposal is offered as a part of the Shelf Project, a collaboration by tax professionals to develop and perfect proposals to help Congress when it needs to raise revenue. Shelf Project proposals are intended to raise revenue without raising tax rates because the best systems have taxes that are unavoidable to reach the lowest feasible tax rates.

This proposal would deny deductions for all business entertainment expenses. Also, the definition of the term ‘‘entertainment’’ would be narrowed so that expenses that are incurred in a clear business setting and are deeply rooted in producing immediate income or in mining …

Unreasonable: Involuntary Medications, Incompetent Criminal Defendants, And The Fourth Amendment, Dora W. Klein Jan 2009

Unreasonable: Involuntary Medications, Incompetent Criminal Defendants, And The Fourth Amendment, Dora W. Klein

Faculty Articles

Involuntary medical treatment potentially compromises several individual constitutional interests. However, like all individual constitutional rights, rights under both the Due Process Clause and the Fourth Amendment can be outweighed by sufficiently important governmental interests.

To determine whether involuntary medical treatment violates the Due Process Clause, courts ask whether the government’s interest that the treatment advances is important enough to justify compromising the individual’s interest in making an autonomous decision to refuse medical treatment. Involuntary treatment must also be medically appropriate, but any physical harms that the treatment might cause are not balanced directly against the government’s interest.

When the government …

The Fair Labor Standards Act Exemptions And The Pharmaceuticals Industry: Are Sales Representatives Entitled To Overtime?, Steven I. Locke

Barry Law Review

This article discusses the battle in the courts as to whether highly compensated pharmaceutical sales representatives are entitled to overtime pay under the Fair Labor Standards Act, or whether they are excluded from such an entitlement under one or more of the Act’s “exemptions.” This article also conducts a review of the courts’ various conflicting positions and charts a course for addressing the issue before the Courts of Appeals and ultimately the Supreme Court.

Transport Of Fungal Symbionts By Mountain Pine Beetles, K. P. Bleiker, S. E. Potter, C. R. Lauzon, Diana Six Jan 2009

Transport Of Fungal Symbionts By Mountain Pine Beetles, K. P. Bleiker, S. E. Potter, C. R. Lauzon, Diana Six

Ecosystem and Conservation Sciences Faculty Publications

The perpetuation of symbiotic associations between bark beetles (Coleoptera: Curculionidae: Scolytinae) and ophiostomatoid fungi requires the consistent transport of fungi by successive beetle generations to new host trees. We used scanning electron microscopy and culture methods to investigate fungal transport by the mountain pine beetle (MPB), Dendroctonus ponderosae Hopkins. MPB transports its two main fungal associates, Grosmannia clavigera (Robinson-Jeffrey and Davidson) Zipfel, de Beer and Wingfield and Ophiostoma montium (Rumbold) von Arx, in sac-like mycangia on the maxillary cardines as well as on the exoskeleton. Although spores of both species of fungi were observed on MPB exoskeletons, often in pits, …

This research work adapted and applied a recently developed method for assessing epiphytic lichen species diversity to the Irish semi-natural woodlands of Knocksink Wood Nature Reserve, Enniskerry, County Wicklow. The study focused on the differences that arise in relation to acidophilous oak woodland (Blechno-Quercetum petraeae) versus ash-hazel woodland (Corylo-Fraxinetum). The research also addressed differences in relation to the mixed oak-ash-hazel woodland located in Knocksink Wood and the neighbouring woodland at the Powerscourt Waterfall. The frequency of occurrence of lichen species on a defined portion of tree bark was used as an estimate of diversity and to evaluate the degree of …

Quality Of Life, Environmental Domain, And Use Of Identification Devices In Nursing, William L. Rhoads Jan 2009

Quality Of Life, Environmental Domain, And Use Of Identification Devices In Nursing, William L. Rhoads

Master's Theses or Doctor of Nursing Practice

Significant attention has been brought to the safety of medical and nursing care in acute-care hospitals, but nursing homes are not immune to errors that result in injury (Kapp, 2003). Errors, even minor ones, can have significant impact in this population group of aged, frail individuals (Scott-Cawiezell, et al., 2006). Nursing home residents do not wear an identification device for varied reasons. This places an extra burden on those passing medications to ensure they have the right person receiving the right medication. The purpose of this study was to determine the relationships between variables with the resident’s willingness to wear …

The Power Of The Mind : The Relationship Between Mindfulness, Quality Of Life And Anxiety For Older Adults With Chronic Illness , Tracy Elizabeth Ransom

PCOM Psychology Dissertations

This dissertation examines the relationship between mindfulness training and older adults with chronic illness and a documented clinical anxiety diagnosis. Six subjects (mean age = 69 years) who met criteria for a DSM-IV-TR anxiety condition and who endorsed one or more chronic illnesses participated in an 8-week customized mindfulness training program. The research evaluated the impact of mindfulness training and practice on depression, quality of life, health satisfaction and anxiety. This dissertation's findings suggest that of these variables, state and trait anxiety were significantly reduced at the conclusion of the program. Given these findings, this research proposes that anxiety in …

Caregiver Religiosity, Spirituality, And Positive Emotion As Predictors Of Psychological Well-Being In Amyotrophic Lateral Sclerosis Patients, Andrea Beth Weller

PCOM Psychology Dissertations

Amyotrophic lateral sclerosis (ALS) is a progressive neurodegenerative disorder that results in degeneration of motor neurons of the cerebral cortex, the brainstem, and the spinal cord. Also known as Lou Gehrig’s disease, ALS has no conclusive etiology and no known cure. The disease is ultimately fatal within approximately 3 to 5 years and robs individuals of all physical functions while leaving their intellectual capacity and personalities intact. Therefore, patients’ quality of life (QOL) becomes increasingly important in their lives and in the lives of their caregivers. Patients with ALS and their caregivers face a number of psychological, psychosocial, and existential …

Design, Synthesis, And Characterization Of Novel Hydrophilic Fluorene-Based Derivatives For Bioimaging Applications, Dao Nguyen

Electronic Theses and Dissertations

In this work, hydrophilic fluorene-based derivatives that contain ethylene oxide substituents, have been synthesized and characterized for potential use as new fluorophores for bioimaging applications and for fluorescence sensing of heavy metals. Symmetrical and unsymmetrical fluorene derivatives based on structural types of acceptor-pi-acceptor, acceptor-pi-donor, and donor-pi-donor were characterized by TGA, UV-vis absorption, fluorescence emission, lifetime, anisotropy, and two-photon absorption (2PA) cross section. They were found to possess high thermal stability, high photostability, high fluorescence quantum yields, and generally large two-photon absorption cross sections, making them quite suitable for new probes in single-photon absorption and two-photon absorption fluorescence microscopy imaging. Novel …

Decomposing The Increase In Reported Levels Of Subjective Well-Being In South Africa From 1993 To 1998, Benjamin Fitch-Fleischmann

Graduate Student Theses, Dissertations, & Professional Papers

Reported levels of household life satisfaction, also referred to as subjective well-being, increased dramatically in South Africa following the end of Apartheid. This study uses household surveys from 1993-1994 and 1998 in South Africa to investigate why. Models of subjective well-being are estimated following previous literature and a Oaxaca decomposition is then applied, which allows subjective well-being and the determinants of subjective well-being to be examined in a new framework. The decomposition determines what portion of the life satisfaction increase in South Africa is due to improvements in living conditions and what portion is due to changes in the way …

Callus Induction, Biomass Growth, And Plant Regeneration In Digitalis Lanata Ehrh.: Influence Of Plant Growth Regulators And Carbohydrates, Zohra Fatima, Abdul Mujib, Samar Fatima, Anjum Arshi, Shahid Umar

Turkish Journal of Botany

The effect of plant growth regulators (PGRs) and carbohydrate sources on callus induction, callus growth, and plant regeneration in foxglove was examined. Explants were transferred onto MS medium with various levels of PGRs and carbohydrates to determine the optimum explant and effective combinations of PGR treatment. For callus induction 6.0 mg L^{-1} of \alpha-naphthalene acetic acid (NAA) and 3.0 mg L^{-1} of benzyl-aminopurine (BA) were very responsive. Addition of cytokinins (BA and kinetin) at 0.5-3.0 mg L^{-1} to media containing NAA enhanced callus growth. Shoot regeneration was best achieved in MS + 6.0 mg L^{-1} of BA. Adenine sulphate (Ade) …
