"The right to vote, as the citizen's link to his laws as government, is protective of all fundamental rights as privileges." This right is often unexercised or taken for granted; but for hundreds of thousands of homeless citizens, voting is a right which is beyond reach. The U.S. Department of Housing and Urban Development estimated that on any given night in 2005, more than 754,000 Americans were without a traditional residence--living in emergency shelters, transitional housing, or on the streets. While many of those people are only temporarily homeless, many others are being disenfranchised by an electoral system that requires …

Arguably, these sociological pressures are central to the future direction of the mediation field and, in the aggregate, provide a useful building block in the development of an emerging sociology of mediation-a development that could fill the theory-to-practice gap which currently bedevils the mediation field. Understanding sociological forces reminds us of the constraints within which mediators, as social actors, must work. More importantly, an awareness of these pressures is, conceivably, essential to the development of an autonomous and discernible profession that remains capable of welcoming a diversity of practitioners and their respective approaches. When It's So Hard To Relate: Can The Legal System Mitigate The Trauma Of Victim-Offender Relationships?, Jody L. Madeira

This article argues that, in the aftermath of violent crime, a relationship that is both negative and involuntary can form between crime victims and offenders. This relationship fetters the victim to the crime and the criminal, rendering it difficult to recover from the transgression. To illustrate how such a relationship may form and what consequences it may have for victims, this article uses the Oklahoma City bombing as a case study, documenting through the use of original interviews an involuntary relationship in which victims' family members and survivors perceived they were tethered to Timothy McVeigh. Among other meanings, "judicial activism" can be defined as judicial decisionmaking that frustrates majoritarian self-government and that is unconstrained by law. So understood, judicial activism is presumptively problematic, because it frustrates customary democratic and judicial norms.

In this essay, I address originalist and nonoriginalist responses to the presumptive problem of judicial activism in the context of Fourteenth Amendment privacy claims, including claims relating to abortion, sexual conduct, and same-sex marriage. I argue that originalism is an overrated solution, largely because current understandings of originalism, despite claims to the contrary, do not provide standards of decision that are sufficiently clear to …

American colleges and universities have traditionally lumped all of their black students into a unified “Black/African/African American" category. However, there is growing evidence that American higher education is witnessing a historic change in the racial and ethnic ancestry of Blacks who are the beneficiaries of affirmative action. Recent studies have pointed out that disproportionately large percentages of Blacks benefiting from affirmative action are foreign-born Black immigrants, their sons and/or daughters, and multiracials. In addition, the number and percentage of blacks approaching college age from these groups will increase substantially in the next five to ten years.

Herminie (1828) is a secular cantata which Hector Berlioz composed for the Prix de Rome competition on a libretto by Pierre-Ange Vieillard de Boismartin. This document begins by placing the composition of Herminie within the biographical context of Berlioz’s life and musical output. It outlines the early education of Berlioz and discusses significant individuals and events which influenced his compositional style, as well as the rules, prizes, and expectations of the Prix de Rome competition. Using Jowett and O’Donnell’s system of propaganda analysis, the present case study concentrates on America’s dominant propaganda messages, techniques, and media channels used in Iran during the time period between 1951 and 1953. The chosen period is of historical significance since it entails the Iranian nationalization of oil crisis and the 1953 coup against the government of Prime Minister Mohammad Mosaddeq. The coup was the first CIA-sponsored covert operation against a foreign government and served as a model for subsequent operations elsewhere. Shrimp is one of the most common seafoods and a favorite among consumers. Like any other food there are safety concerns about shrimp. Listeria species, Salmonella species, Clostridium species and Vibrio species are among the pathogens of prime importance. Most of these pathogens can be eliminated by cooking. However, the extent of cooking and temperatures greatly influence the safety of these foods. The current study is focused on the determination of minimum cooking temperatures for shrimp to eliminate Listeria species, Salmonella species and Vibrio species. This thesis examines the crossroads between printmaking and digital technology as our culture shifts towards a more digital media focused existence. As technology shifts art-making more and more away from the analog creation process towards a more digitally mediated one, printmaking’s history stands out among other traditional mediums as well suited to embrace the transition whole-heartedly. By using the analogies of the matrix, the map, and the building, this body of work creates a bridge from the historical and time-tested approaches of printmaking towards the future of the art form; a chimera of technology and tradition.

While the DMCA was passed to protect copyrighted content in the digital age, the cases interpreting the statutory terms "circumvention" and "authorization" are inconsistent. The courts have staked out two poles on what does and does not constitute circumvention under the DMCA: aftermarket parts that run items like garage doors do not circumvent, but code that allows an unanticipated device to play a CD is a circumvention. This Note explores the surprising consequences of carrying the reasoning of each of these lines of cases to their logical conclusions. Supply Restrictions At The Margins Of Heller And The Abortion Analogue: Stenberg Principles, Assault Weapons, And The Attitudinalist Critique, Nicholas J. Johnson

Through a consideration of the assault weapons question, this Article engages the criticism that District of Columbia v. Heller provides an insufficient standard for resolving many questions that emerge under the newly-clarified Second Amendment. After arguing that assault weapons might enjoy threshold protection under Heller's common-use test, the Article shows how the principles grounding the Supreme Court's abortion jurisprudence are especially suited for resolving aspects of the question that Heller does not explicitly answer. Closing The Tax Gap: Encouraging Voluntary Compliance Through Mass-Media Publication Of High-Profile Tax Issues, Elizabeth Branham

In 2001, the IRS estimated the gross tax gap was approximately $345 billion dollars. Each dollar not collected represents lost revenue for the federal government, the collection of which would be contributed to federally-funded public works. Within the tax gap, underreporting of individual income represented over half of uncollected revenue. Among that group of noncompliant taxpayers, most are generally not subject to third-party reporting and are therefore capable of choosing to file or to evade. This Note discusses the impact of high-profile tax prosecutions on social norms and values as an avenue to address and encourage voluntary compliance.

The use of foam for mobility control is a promising means to improve sweep efficiency in subsurface applications such as improved/enhanced oil recovery and aquifer remediation. Foam can be introduced into geological formations by injecting gas and surfactant solutions simultaneously or alternatively. Alternating gas and surfactant solutions, which is often referred to as surfactant-alternating-gas (SAG) process, is known to effectively create fine-textured strong foams due to fluctuation in capillary pressure. This Note explores the procedural contours of hybrid actions: Combined state law optout Rule 23 class actions and Fair Labor Standards Act opt-in collective actions in one lawsuit. The Note contains four parts. Part I examines the history of the FLSA, the Portal-to-Portal Act of 1947, and Rule 23. Part II provides a brief procedural guide to the collective action and class action certification processes. Part III surveys published federal court cases and ultimately posits that hybrid actions violate the Rules Enabling Act. Taking the hangman's noose hanging in Jena, Louisiana in 2006 as a starting point, this Article begins by placing the hanging of a noose in historical context. The Article then proceeds to explore contemporary manifestations of noose hanging in the workplace, in schools and other settings. The Article examines noose hangings that occurred around the country since the display in Jena to explore the social meaning of a noose. Team Task Interdependence Perceptions: Toward An Integrative Model Of Teamwork, Jared Ledoux

The present study examines perceptions of task interdependence and workflow at the individual- and team-levels to evaluate the degree to which team perceptions and homogeneity of perceptions predict team communication and performance in a military combat computer simulation. Team members who perceived higher levels of task interdependence and workflow performed better at both the individual and team levels of analysis. These teams also communicated more frequently, although communication was not significantly correlated with performance. The present findings provide support for the examination of task interdependence perceptions as a means to explain team performance and communication.

Vibrio vulnificus and Vibrio parahaemolyticus are halophilic gram-negative bacteria that are found in warm coastal waters. These two species are the leading cause of fatal shellfish poisoning. The objective of this study was to determine the population dynamics of V. vulnificus and V. parahaemolyticus as impacted by temperature and salinity in Breton Sound and Barataria Bay of Louisiana. Water samples were collected from each water body along s salinity gradient transect monthly from September 2007 through July 2009. Teachers are now being held to high accountability standards in reading instruction, yet studies show that teachers lack adequate knowledge in reading and phonological awareness principles (Moats, 1994, 2009; Spencer, Schuele, Guillot, & Lee, 2008). The purpose of this study was to determine the effects of visual representations of letter/sound production (i.e., Phonic Faces, Norris, 2001) on improving teacher knowledge of phonological awareness principles, and to determine if there is a concomitant improvement in phonological awareness and reading acquisition for children in those classrooms. Student attitudes and teacher perceptions regarding creativity, composition, and its assessment possibilities were investigated using mixed-method techniques in two differing high school music programs. A Talented Music Program, providing accelerated instruction to gifted musicians (with composition instruction) and a typical performance based band program (composition never taught) were examined. Students participated in a six-week composition program. Final compositions were evaluated by differing judging groups: teachers, students, and expert composers. Data were collected through interviews, observations, attitude surveys, student and teacher journals, and composition assessment. Processing biomass in near- and supercritical water has garnered increasing attention because of its ability to accept a variety of wet feedstocks, energy efficiency, and ability to regulate the solubility and separation of components. Very few studies of biomass hydrothermal conversion provide a comprehensive evaluation of multiple process parameters and various additives and their effects on a single product phase. This research examined the influence of temperature, residence time, biomass concentration, and particle size on volatiles production from the hydrothermal conversion of sugarcane bagasse. The Marshland Upwelling System (MUS) is an alternative onsite wastewater treatment technology designed to utilize the natural ecology of saltwater marshes to remove human-borne contaminants. Scanning probe microscopy (SPM) characterizations are becoming more prevalent for surface investigations due to their capabilities for obtaining structural information and physical measurements. New capabilities of SPM for studying and controlling nanoscale processes are emerging as valuable assets in research. A fundamental understanding of the interactions of surface reactions provides essential information for developing workable applications for nanotechnology. Two applications of SPM are discussed in this dissertation. The objectives of this project are to design, construct, validate and test a low-cost, non-invasive and painless device to measure skin tension. Skin is a complex, multi-layered, anisotropic material with non-linear viscoelastic behavior during stress application. The intricate balance of different semi-elastic fibers and continuous regeneration has brought difficulty to the accurate measurement of its mechanical properties. Commercial skin tension measurement products have been described, but are too expensive to be readily accessible for skin research and clinical utilization.
