This Article is an invited special projects paper for the Harvard Civil Rights-Civil Liberties Law Review. It examines how society and law work together to frame the normative ideal of intimate couples and families as both heterosexual and monoracial. This Article sets out to accomplish three goals. First, it examines the daily social privileges of monoracial, heterosexual couples as a means of revealing the invisibility of interracial marriages and families within our society. Because tort law generally and healthcare regulation specifically are traditional state functions and because medical, legal, and insurance practices are highly localized, legal scholars have long believed that medical malpractice falls within the states' exclusive jurisdiction and sovereignty. Indeed, this view is so widely held that modern legal scholarship takes it for granted. Articles on general federalism issues use medical malpractice as an easy example of a policy in which federal intervention lacks functional justification, and articles that focus on federalization of other tort reforms use medical malpractice as an easy foil, pointing out that the uniformity interest that justifies …

The authors identify a gap in Canadian policing law. Police have neither common law nor statutory authority to undertake the sorts of public order policing measures that are thought to be essential to securing large public events, such as Vancouver's 2010 Olympics. The paper argues for the adoption of a Public Order Policing Act designed to confer the necessary powers and ensure their operation in a manner that respects constitutional law and fundamental civil liberties. Nearly a million Sri Lankan women labor as migrant workers, the vast majority in the Gulf Cooperation Council (GCC) countries in West Asia. They are poorly paid and vulnerable to a wide variety of exploitative labor practices at home and abroad. Despite the importance of worker remittances to the national economy, and in spite of Sri Lanka’s history of organized labor and active political participation, migrants have received only anemic support from the state, labor unions, feminist organizations, and migrant-oriented nongovernmental organizations (NGOs). This dissertation explores the differences in the quality of radio foreign news and foreign correspondents between CBS during World War II and NPR during the Iraq War II. Triangulating quantitative and qualitative methods (content analysis, historical research, and in-depth interviews), this study proposes a model of quality foreign news to help determine what the Murrow tradition means. The model is then used to test if that celebrated tradition lives on in a non-commercial setting at NPR. This project assessed short-term temperature effects on total ammonia nitrogen (TAN) utilization rates in a batch laboratory-scale recirculating system. The tank system was designed for experiments on short term steady state and diurnal temperatures. A set of numerical models was developed to simulate observed results. The performance of the biofilters was determined with three tank replicates at fixed temperatures of 13, 20 and 300C; and at diurnal transient (sinusoidal) temperature regimes of (20 ± 30C; 30 ± 30C). Ammonia utilization rates and biofilter performance for beads acclimated at different temperatures regimes separated and mixed were also determined. Total ammonia utilization …

ABSTRACT In entertainment, the media often portray various social groups, including women, in certain negative ways and as having more negative qualities than other traditional social groups, such as white males. These portrayals provide viewers with ways of thinking about and acting towards members of a particular group, thus affecting communication and perception. This research seeks to analyze data on horror film stereotyping in a new way not by merely observing stereotypes of women in horror film, but by examining the content across time-periods and societal change. In this article, I propose to adapt the Talmud, a Jewish religious text, for the written representation of qualitative research. The form and the style of argumentation in and engendered by the Talmud can be adapted to present qualitative methods in a way that transcends the limitations of conventional formats. In addition, this format requires even greater participation in the act of reading. Because the Talmudic format uniquely addresses the difficulties involved in representing everyday life, I argue that adapting the format of the Talmud is ideal for giving voice, for presenting multiple and competing narratives alongside documents, and for …

The incidence of cognitive impairment in the aging population remains one of the most common morbidities in the elderly, often associated with a decrease in physical function, institutionalization, and death. Several different mechanisms have been proposed, including age-related changes to the vasculature. The purpose of this study was to examine the relationship between physical activity, carotid intima-media thickness and other vascular measures, and measures of cognitive and physical function in older adults. Law is a specialized semiotic realm, but lawyers generally are ignorant of this fact. Lawyers may manage meaning, but they also are managed by meaning. Seemingly trapped by the weight of pre-existing signs, their attempts to manage these meanings generally are limited to technical interventions and instrumentalist strategies. Signs have power over lawyers because they are embedded in narratives, a semiotic economy that confronts the lawyer as ‘‘given’’ even though it is dynamic and constantly under construction. Most lawyers do not make meaning through legal narratives; rather, they parrot bits of the controlling narratives in response to certain problems. Because …

Continuously-connected, articulated revetment systems have potential to decrease the weight of armor cover in resisting wave attack, compared to traditional designs. Modes of instability for sloping revetments include uplift, sliding, and toe roll-up. Design methods are summarized by McDonnell (1998), Pilarczyk (1998), and Herbich (1999). Russo (2003) conducted a field prototype scale investigation on performance of Articulated Concrete Mattresses (ACMs) in coastal Louisiana, which demonstrated this structure’s ability to resist a range of wave loading conditions, and inspired scoping of further research to quantify structure performance beyond known limits. In surveying recent literature on difficulties with cross-border injunctions in patent cases, one may conclude that the problem appears to be limited to the phenomenon of pan-European injunctions granted by some courts in Europe in cases concerning infringements of foreign patents. However, even in cases concerning domestic patents, injunctions reaching beyond national borders can be issued; the empirical evidence presented in the paper demonstrates a variety of such instances in U.S. patent cases. Advances in enzymatic hydrolysis have developed new methods for conversion of lignocellulosic biomass into fermentable sugars for various applications, mainly ethanol production. The present study involves immobilization of a cellulase enzyme complex on a solid support which can be recovered for subsequent use in multiple reactions. The supports of interest include Fe3O4 nanoparticles (~13 nm) and polystyrene-coated particles containing a Fe3O4 core (1-2 µm). Each support contains amine functional groups based on the surface that allow covalent attachment of enzymes via carbodiimide activation. In October 2008, Karthik Rajaram murdered his wife, mother-in-law, sons and, ultimately, himself, in a wealthy Los Angeles suburb. This Article analyzes media reports about the deaths to illustrate the resilience of patriarchy and significant gaps in research and scholarship about domestic violence, and suggests a strategic approach to building counter-narratives about violence against women.

The Article is composed of five parts. Part I is the Introduction. Part II draws on narrative theory and critical media scholarship to lay the groundwork for analysis, and to show why media coverage of homicide-suicide is implicated in the production of dominant ideology.

The coordination geometry adopted by the lanthanide complexes of DOTA-tetraamides is a critical factor in determining their water exchange kinetics. Controlling the water exchange kinetics of DOTA-tetraamide complexes, and by extension their coordination geometry, is of particular interest because of the potential application of this class of complex as PARACEST MRI contrast agents. To facilitate the maximum CEST effect at the lowest pre-saturation powers much slower exchange kinetics are required than are commonly observed with these types of chelates. Coastal Louisiana marshes are eroding at a rate equivalent to one football field every thirty minutes. It is vital to understand the perceptions of the American public regarding this issue. I conducted a self-administered mail survey during the spring of 2006. The survey was sent to 4,500 residents living in the Mississippi River Valley. In recent years proposals have been made for an international convention that would facilitate a smooth recognition and enforcement of foreign judgments in intellectual property matters. Like all of these proposals, the American Law Institute’s preliminary version, short titled "Draft Principles" published in March 2007, strives to eliminate most hurdles to recognition and enforcement by providing rules for jurisdiction, choice of law and coordination of multi-territorial actions. Dissociable Antibody Microarray (DAMA) staining is a novel technique that integrates protein microarrays with conventional immunostaining techniques. It can simultaneously determine the expression and subcellular localizations (SCLs) of hundreds of proteins in cultured cells. I optimized this technology for protein expression and SCL profiling, and generated expression profile data analysis program DAMAPEP, molecular image database management program ChipView and automatic SCL assignment program DAMASCL. We demonstrated the application of this technique in the identification of potential biomarkers for breast cancer. We compared the expression profiles of 312 proteins among ten breast cell lines and identified 10 differentially expressed proteins. Among …

This thesis examines sociolinguistic characteristics of the Latino population in the Baton Rouge metro area and has a manifold purpose. The main purpose of the study is to determine whether Latinos consider that the way they speak their native language –Spanish– has changed as a consequence of their living in Baton Rouge, i.e., the United States. A questionnaire was applied to 106 Latinos in Baton Rouge, 58 male and 48 female, between the ages of 18 and 71 years old, from several socioeconomic backgrounds (white collar workers, blue collar workers, etc.). This study analyzed the personal and professional networks of four local television reporters using social network analysis methodology. Network analysis was carried out to the tertiary level allowing examination of demographic data for 773 individuals in the reporter networks. Analysis was conducted through the lens of media norms and routines and the sociological principle of homophily that states people are more likely to associate with people like themselves. Avid video gaming is proposed as a term for individuals that play video games for prolonged periods of time. These individuals were predicted to show similar performance on a MineHunter, an analogue to the Iowa Gambling Task, comparable to the performance of pathological gamblers reported in the literature. Comparisons have been made between gamblers and video gamers based on similarities in the interaction level of the activity, as well as similarities in demographics and reported detriments in social and employment areas.
