"You Think He Got Shot - Did You Maybe Shoot Him By Accident?": Linguistic Manipulation Of The Communicatively Immature During Police Interrogations, Kathryn C. Donoghue
Richmond Public Interest Law Review
It is undeniable that "punishment of the innocent makes a mockery of the law." Police who linguistically coerce false confessions from communicatively immature suspects mock the criminal justice system by evading accountability and convicting the vulnerable. This paper documents how common linguistic strategies directed at certain vulnerable groups have the potential to elicit false confessions. Part II reviews linguistic strategies routinely employed by trained interrogators. Part III then explores how mentally challenged and juvenile suspects, otherwise known as communicatively immature groups, are more susceptible to deceptive linguistic strategies. Part IV discusses how interrogators learn to extract confessions, while Part V …

The Gaelic Goetz: A Case Of Self-Defense In Ireland, Stacy Caplow
The Gaelic Goetz: A Case Of Self-Defense In Ireland, Stacy Caplow
Cardozo Journal of International and Comparative Law
For two years, the name Padraig Nally was a household word in Ireland. Nally killed an intruder on his farm in a rural community by shooting him in the back as he was running away, already injured from a brutal beating. The intruder was a Traveller, a minority group in Ireland that is mistrusted and ostracized. The killing was so far from the paradigmatic self-defense claim that the trial judge refused to instruct the jury on a full justification defense. Indicted for murder, Nally was convicted of manslaughter under a doctrine in Ireland called 'excessive force.' After the appeals court …
An Unnecessary Convenience: The Assertion Of The Uniform Code Of Military Justice ("Ucmj") Over Civilians And The Implications Of International Human Rights Law, Dan E. Stigall
Cardozo Journal of International and Comparative Law
The expansion of the Uniform Code of Military Justice (UCMJ) to include jurisdiction over civilians during contingency operations raises significant legal and human rights concerns, particularly regarding due process and equality under the International Covenant on Civil and Political Rights (ICCPR). While the UCMJ aims to maintain military order, its application to civilians may not meet the ICCPR's requirements for necessity and fairness, potentially undermining the U.S.'s international reputation. However, proponents argue that military jurisdiction can sometimes advance human rights and accountability, suggesting a need for balanced solutions.
Draconian Or Just? Adopting The Italian Model Of Imposing Administrative Fines On The Purchasers Of Counterfeit Goods, Amanda Silverman
Draconian Or Just? Adopting The Italian Model Of Imposing Administrative Fines On The Purchasers Of Counterfeit Goods, Amanda Silverman
Cardozo Journal of International and Comparative Law
The note examines the effectiveness of penalizing consumers for purchasing counterfeit goods, focusing on Italy's approach and its implications for the U.S. It argues that such penalties can deter demand and reduce counterfeiting, aligning with the propertization of trademarks. The analysis highlights enforcement challenges, including proving consumer intent, and suggests using objective criteria like price and seller credibility. The note proposes adopting Italy's model in the U.S. to protect intellectual property and consumer trust, despite potential privacy concerns and enforcement difficulties.
Examination Of The Capacity Of The Cathelicidins To Control Bacillus Anthracis Pathogenesis, Mark W. Lisanby
Examination Of The Capacity Of The Cathelicidins To Control Bacillus Anthracis Pathogenesis, Mark W. Lisanby
All ETDs from UAB
cillus anthracis is a gram-positive, spore forming bacterium that causes infection through three routes: cutaneous, gastrointestinal and pulmonary. Historically, anthrax pathogenesis was thought to be initiated via the uptake of spores by resident macrophages, which then transited to the regional lymph nodes. While en-route, the spores germinated and developed into bacilli within the phagolysosome, escaped into the cytoplasm, killed the cell and eventually the host. Following the recent use of B. anthracis as a biological weapon, researchers began to reevaluate anthrax pathogenesis in order to develop novel treatments. One aspect of anthrax pathogenesis that saw renewed interest was the intracellular …
Selling The Ghetto: Rap Music And Entrepreneurialism, Stuart Lucas Tully
Selling The Ghetto: Rap Music And Entrepreneurialism, Stuart Lucas Tully
LSU Master's Theses
By focusing on incidents during the careers of rap moguls Russell Simmons, Sean Combs, and Shawn Carter, it becomes evident rap music has become more conservative and affirmative of traditional American entrepreneurialism than believed by prior scholarship, which regarded rap music primarily as radical and counter-cultural black expression. For Russell Simmons and Run-DMC, the Madison Square Garden concert and its effect on the perception of a subsequent endorsement deal with Adidas demonstrate the emergence of rap music unto the mainstream consumer culture. Though the parties involved would later claim singularity in the event, the process was not just a spur …

The Use Of The Online Tutorial And Assessment System, Mathxl, In Teaching Of Algebra I, Darlene Noble Ford
LSU Master's Theses
The integration of web based learning tools into the teaching of mathematics holds much promise for engaging middle and high school students. The purpose of this thesis is to report about my experiences regarding the effectiveness of using an online homework, tutorial and assessment system as part of two of the six Algebra I math classes I taught in the 2008-2009 school year at Sherwood Middle Academic Magnet School in East Baton Rouge Parish. Comparing the two sets of classes I found that such online systems offer many potential advantages to educators, such as the ability to provide instantaneous feedback, …
Effects Of Plant Maturity And Bacterial Inoculum Level On The Surface Contamination And Internalization Of Escherichia Coli O157:H7 In Growing Spinach, Shuaihua Pu
LSU Master's Theses
The incidence of foodborne outbreaks linked to fresh produce has increased in the United States. Particularly noteworthy was the 2006 Escherichia coli O157:H7 outbreak associated with pre-packaged baby spinach. Factors affecting the contamination of spinach leaves with E. coli O157:H7 are not yet well understood. This study aimed to determine whether E. coli O157:H7 would be present in the aerial leaf tissue of a growing spinach plant when introduced at various plant maturities and different inoculum levels in the growth media in a greenhouse setting. Spinach seeds of a standard commercial variety were sown individually in 8-inch pots, watered daily …

A Longitudinal Study Of Student’S Representations For Division Of Fractions, Sylvia Bulgar
The Mathematics Enthusiast
The representations that students use as part of their mathematical problem solving can provide us with a window into their grasp of the concepts they are exploring and developing. In this paper, the author indicates how these representations can evolve over time and enrich the understanding of division of fractions, often thought to be the most difficult of elementary school mathematical topics. The results of this research suggest that when appropriate problems are provided for students, in a meaningful context, they can demonstrate understanding of division of fractions that is durable over time, and that they are able to flexibly …

3 Strikes And You’Re Out: Reasons To Eliminate Sports In School, Craig Vivian
3 Strikes And You’Re Out: Reasons To Eliminate Sports In School, Craig Vivian
Journal of Inquiry and Action in Education
The overgrowth of sports in our society and has resulted in a host of potential problems for the young people who associate with the sports culture found in schools. Although the positive elements of sports are routinely touted, the negatives are far more insidious to youth. Most of the positive aspects of sports are unproven, overstated, or subverted by the culture of sports as it exists today. The sports culture creates understandings of the world and self that are at odds with the public mission of schools in a democratic society. The essay proposes that sports be taken out of …
Redefining Motherhood: Discrimination In Legal Parenthood In Japan, Rachel Brehm King
Redefining Motherhood: Discrimination In Legal Parenthood In Japan, Rachel Brehm King
Washington International Law Journal
Due to Japan’s decreasing population numbers and low birth rate, the country’s legal forces and social norms put tremendous pressure on women to have children. To meet these expectations, Japanese women frequently turn to new forms of medical assistance called Assisted Reproductive Technology (“ART”) to increase their ability to become mothers. ART includes such procedures as artificial insemination, in vitro fertilization, and surrogacy. Although several of these methods are accepted by Japanese law and society, other forms of ART, including certain forms of artificial insemination and surrogacy, are strongly disapproved. Japan’s current legal framework prevents women from accessing the full …
Youth Ministry In The Emerging Culture, Joel Dietrich
Youth Ministry In The Emerging Culture, Joel Dietrich
Doctor of Ministry
Youth ministry is a relatively new endeavor for Christianity in the West. In its short history, youth ministry became a major aspect of Christian churches and Christian activity. This project focuses on youth ministry in the emerging culture. The problem is that an increasing percentage of Americans leave their Christian faith behind when they enter adulthood. The paper examines the latest research into the emerging culture and youth ministry, and it provides a practical approach to youth ministry in the emerging culture. The thesis is that youth ministries can connect effectively with teenagers through missional, relational, incarnational, and intergenerational strategies …

Maximizing Utilization Of Research, Frontiers In Reproductive Health
Reproductive Health
Operations research (OR) can only be judged successful if results are utilized for making decisions to strengthen RH/FP policies and service delivery. How can this best be achieved? How can both process and impact of OR be measured? Drawing from ten years of FRONTIERS in Reproductive Health OR experience, a number of key principles for promoting research utilization, illustrated with documented examples, are presented here. One important first step is clarifying terms used, almost interchangeably, in research utilization, as it incorporates a range of ways in which research can be used for making decisions to strengthen RH/FP policies and programs. …
Female Genital Mutilation/Cutting: Change Is Possible, Frontiers In Reproductive Health
Female Genital Mutilation/Cutting: Change Is Possible, Frontiers In Reproductive Health
Reproductive Health
Changing long-standing cultural practices—even when such practices are harmful—is difficult, but the impressive success in reducing the acceptability and incidence of female genital mutilation/cutting (FGM/C) in several settings shows it is possible. Research by FRONTIERS in Burkina Faso, Egypt, Ethiopia, Kenya, Mali, and Senegal has provided insight into the sociocultural and religious underpinnings of FGM/C and has identified approaches that, over time, have contributed to individual and community decisions to abandon the practice. This information can help reduce the risk of undergoing FGM/C faced by three million girls and women every year. This is one of eight Legacy Papers synthesizing …

Operational Research For The Introduction Of An Adolescent Health Package In The Context Of Cervical Cancer Prevention, Marieke G. Van Dijk, Katherine Wilson, Claudia Diaz, Sandra G. Garcia
Reproductive Health
This report provides findings from a WHO/PAHO/UNFPA meeting that took place in Mexico City in 2009. Participants discussed a proposed operational research study on adolescent health and cervical cancer prevention that would help support countries that have already made or will soon make a policy decision to introduce the HPV vaccine. Adolescents typically have little contact with health services, particularly for immunization programs. Since new HPV vaccines target adolescent girls, the introduction of HPV vaccines may provide an opportunity for adolescents to engage more with health services and this may create openings to offer packages of adolescent health services that …
