Increased Market Power As A New Secondary Consideration In Patent Law A Review Of Recent Decisions Of The United States Court Of Appeals For The Federal Circuit, Andrew Blair-Stanek Jan 2009

Increased Market Power As A New Secondary Consideration In Patent Law A Review Of Recent Decisions Of The United States Court Of Appeals For The Federal Circuit, Andrew Blair-Stanek

American University Law Review

Courts have developed several non-technical “secondary considerations” to help judges and juries in patent litigation decide whether a patent meets the crucial statutory requirement that a patent be non-obvious. This Article proposes a tenth secondary consideration to help judges and juries: increased market power. If a patent measurably increases its holders’ market power in the market into which it sells products or services, then that increase should weigh in favor of finding the patent non-obvious. Using increased market power incorporates the predictive benefits of several other secondary considerations, while often increasing the accuracy and availability of evidence. It would provide …

Flame, Furnace, Fuel: Creating Kansas City In The Nineteenth Century, Twyla Dell Jan 2009

Flame, Furnace, Fuel: Creating Kansas City In The Nineteenth Century, Twyla Dell

Antioch University Dissertations & Theses

Though this work is a fuel and energy history of Kansas City from 1820 to 1920, it also provides a tool to describe and analyze fuel and energy transitions. The four parts follow the rise and fall of wood, coal and oil as their use grows to a peak and, in the case of wood, declines. The founding and growth of Kansas City as an “instant city” that grew from zero population to over three hundred twenty thousand in a hundred years embodies the increased use of fuels and energy in an urban setting and serves as a case study. …

The Aims Of Public Scholarship In Media Law And Ethics, Erik Ugland Jan 2009

The Aims Of Public Scholarship In Media Law And Ethics, Erik Ugland

College of Communication Faculty Research and Publications

This essay urges scholars in media law and ethics to reevaluate the extent and utility of their public-scholar efforts and to consider ways that they can transfer research-based knowledge to public audiences while also playing a more deliberate role in holding media and government institutions accountable. It suggests that the devolution of standards in mass communication, the increasing encroachments on media autonomy, and the broader collapse of power into fewer hands make this a particularly urgent moment for scholars to reengage the public and to abandon their feckless neutrality on public issues. The overarching aim of public scholars ought to …

Chemistry: Faculty Publications (1990-2023)

Nb2O5/HX (X = HSO4-, H2PO4-, NO3-) compounds were obtained from the treatment of niobium acid (Nb2O5·xH2O) with sulfuric, phosphoric, and nitric acids as well as Nb2O5 and Nb2O5·xH2O have been investigated as catalysts for the transesterification, esterification and pyrolysis of vegetable oils. The compounds were characterized by thermal analysis (DTA-TGA), spectroscopy (DRX, FT-IR and FT-Raman), surface area (BET) and the acidity (Ho) determined by n-butylamine titration using the Hammet´s indicator method. It was observed that after the acid treatment both the surface area and the acidity decreased as compared to the starting Nb2O5·xH2O. The only exception was a higher acidity …

Military Children And Holistic Education: A Narrative Reflection On Classroom Practice, Edith Allison Jan 2009

Military Children And Holistic Education: A Narrative Reflection On Classroom Practice, Edith Allison

College of Graduate Studies: Theses & Dissertations

This dissertation uses autobiographical narrative inquiry as a source of knowledge-generating reflection to examine how the educational needs of military children might be met through the use of holistic educational practices rather than a (well-intentioned) traditional, standardized curriculum. Data were gathered through observation; personal experience as a military child, military member, mother of military children and teacher of military children; journal entries and vicarious experiences shared by students, parents, educators and other invested in this population of learners. Experiences were compiled into fictional composites to protect the identity of all parties as well as national security. These composites were then …

New Techniques For Measuring Impedance Characteristics Of Three-Phase Ac Power Systems, Yakov A. Familiant, Keith Corzine Jan 2009

New Techniques For Measuring Impedance Characteristics Of Three-Phase Ac Power Systems, Yakov A. Familiant, Keith Corzine

Electrical and Computer Engineering Faculty Research & Creative Works

Naval ships as well as aerospace power systems are incorporating an increasing amount of power electronic switching sources and loads. Although these power-electronics-Based components provide exceptional performance, they are prone to instability due to their constant power characteristics that lead to negative impedance. When designing these systems, integrators must consider the impedance versus frequency at a power system interface (which designates source and load). Stability criteria have been developed in terms of source and load impedance for both dc and ac power systems, and it is often helpful to have techniques for impedance measurement. for dc power systems, the measurement …

Optimal Tracking Control Of Affine Nonlinear Discrete-Time Systems With Unknown Internal Dynamics, Travis Dierks, Sarangapani Jagannathan Jan 2009

Optimal Tracking Control Of Affine Nonlinear Discrete-Time Systems With Unknown Internal Dynamics, Travis Dierks, Sarangapani Jagannathan

Electrical and Computer Engineering Faculty Research & Creative Works

In this paper, direct dynamic programming techniques are utilized to solve the Hamilton Jacobi-Bellman equation forward-in-time for the optimal tracking control of general affine nonlinear discrete-time systems using online approximators (OLA's). the proposed approach, referred as adaptive dynamic programming (ADP), is utilized to solve the infinite horizon optimal tracking control of affine nonlinear discrete-time systems in the presence of unknown internal dynamics and a known control coefficient matrix. the design is implemented using OLA's to realize the optimal feedback control signal and the associated cost function. the feedforward portion of the control input is derived and approximated using an additional …

Discrepant Teaching Events: Using An Inquiry Stance To Address Students' Misconceptions, Judith Longfield Jan 2009

Discrepant Teaching Events: Using An Inquiry Stance To Address Students' Misconceptions, Judith Longfield

Faculty Center Publications

Science instructors have long known that the use of discrepant events with unexpected outcomes is a powerful method of activating thinking. A discrepant teaching event is similar to a discrepant science event in that it vividly portrays what is often an abstract construct or concept and has an unexpected outcome. The unexpected outcome creates what Piaget (1971) refers to as disequilibrium, thereby uncovering students’ naïve conceptions and tacit beliefs about the concept being studied. This article defines what a discrepant teaching event is and compares and contrasts discrepant science events and discrepant teaching events. Examples of discrepant teaching events useful …

Oxidative Stress, Calcium Homeostasis, And Altered Gene Expression In Human Lung Epithelial Cells Exposed To Zno Nanoparticles, Chuan-Chin Huang Jan 2009

Oxidative Stress, Calcium Homeostasis, And Altered Gene Expression In Human Lung Epithelial Cells Exposed To Zno Nanoparticles, Chuan-Chin Huang

Masters Theses

"The influence of 20 nm ZnO nanoparticles on oxidative stress, intracellular calcium homeostasis, and gene expression was studied in human bronchial epithelial cells (BEAS-2B). ZnO caused a concentration- and time-dependent cytotoxicity while elevating oxidative stress and causing membrane damage (cellular LDH release). There was a remarkably steep relationship between concentration and toxicity at concentrations from 5 to 10 μg/ml. Exposure to ZnO increased intracellular calcium levels in a concentration- and time-dependent manner. Treatment with the antioxidant N-acetylcysteine prevented cell loss and diminished the increase in intracellular calcium concentration, suggesting oxidative stress mediated cytotoxicity. Exposure to a sublethal concentration of ZnO …
