Canadian Forum on Civil Justice

The „justice system‟ is a fundamental and far-reaching component of our system of democracy in Alberta. It is not one united system but an institutionalized process to address criminal and civil conflicts. It is made up of a complexity of organizations with overlapping provincial and federal jurisdictions. There are substantive and procedural laws with four broad divisions: civil, family, criminal and administrative. Many of these laws and the legal services associated with them, function to avoid conflict and legal problems. Ideally, legal services work to resolve conflicts without resorting to the courts or tribunals, the purpose of which is to …

A Shift Towards Gender Equality In Prosecutions: Realizing Legitimate Enforcement Of Crimes Committed Against Women In Municipal And International Criminal Law, Tamara F. Lawson

Southern Illinois University Law Journal

A new era of law enforcement has emerged recognizing the importance of punishing gender-specific violence.  This first wave of "gender-sensitive prosecutors" has changed the way crimes against women are handled in the criminal justice system.  The enactment of gender neutralizing laws and policies has dramatically improved the enforcement of crimes against women and attempts to end the era of impunity.  This Article addresses the changes in prosecutions and further considers international human rights treaties that require gender equality in law enforcement.

Attorney Referral, Negligence, And Vicarious Liability, Bruce Ching

Southern Illinois University Law Journal

Attorneys commonly refer clients to other attorneys.  Despite this routine practice, only a few jurisdictions have considered whether a referring attorney can be held liable for  a client’s loss when the attorney who receives the referral commits malpractice. This paper analyzes the three approaches used by courts in such situations, along with relevant provisions from the Model Code of Professional Responsibility and the Model Rules of Professional Conduct.  First, the Michigan/Pennsylvania approach completely precludes liability for negligent attorney referral.  Second, the Florida/Illinois approach holds a referring attorney vicariously liable when he or she receives a fee for making the referral. …

Penalizing Poverty: Making Criminal Defendants Pay For Their Court-Appointed Counsel Through Recoupment And Contribution, Helen A. Anderson

University of Michigan Journal of Law Reform

Over thirty years ago the United States Supreme Court upheld an Oregon statute that allowed sentencing courts, with a number of important procedural safeguards, to impose on indigent criminal defendants the obligation to repay the cost of their court appointed attorneys. The practice of ordering recoupment or contribution (application fees or co-pays) of public defender attorney's fees is widespread, although collection rates are unsurprisingly low. Developments since the Court's decision in Fuller v. Oregon show that not only is recoupment not cost-effective, but it too easily becomes an aspect of punishment, rather than legitimate cost recovery. In a number of …

The Journal of Sociology & Social Welfare

Theories regarding the social cognitive origins of parenting risk have recently emerged. This work not only has implications for the nature of interventions with parents, but also for the approaches taken by the social service systems that work with them. This paper reviews the evidence that there is a significant number of parents with cognitive disabilities within child protection caseloads and outlines the types of human capacity building and organizational development that are needed to support the parents' needs. However, many of those who do serve in such roles have little idea of their responsibilities and no formal training to facilitate more knowledgeable participation and more effective boards.
