A Uniform System For The Enforceability Of Forum Selection Clauses In Federal Courts, Ryan T. Holt

In the early 1980s, a successful and ambitious Alabama businessman named Walter H. Stewart purchased a failing local copying business. Through the Stewart Organization, a corporation he controlled, Stewart sought to steer this troubled business to the realm of profitability. To do so, he entered into a dealership contract with Ricoh Corporation, a national manufacturer of copy machines that conducted its operations in New York. Unfortunately, their relationship soured. Stewart sued Ricoh in an Alabama federal district court, basing jurisdiction on diversity of citizenship. Ricoh did not want to litigate in Alabama, and the original dealership contract seemed to provide …

Do Companies Value Maintaining Iso 9000 Certification? 2009 Case Study Of 41 Us Companies First Certified In 2000, Sarah Joy Namara

The costs of obtaining and maintaining ISO certification are high. Moreover, studies have shown mixed results on the benefits of the certification. Consequently, the objective of this research was to verify whether or not companies do value maintaining the ISO 9000 certification.
The empirical study was conducted on 41 U.S. companies that were first certified in 2000. The companies formed an existing database as they were used by Dr. Arbuckle in 2004 in his doctoral dissertation. Of the 41 companies, 12 were found to be out of business, leaving a final sample size of 29. Data were gathered from this …

Assuring Quality In The Delivery Of On-Line Classes, Jane Whitney Gibson, Susan Colaric, Julia Teahen, Michael Nastanski, Regina A. Greenwood
HCBE Faculty Presentations
The symposium participants, all long-time online faculty and administrators, discuss various methods of assuring quality in the delivery of online classes. These methods include standardization of courses, utilizing online protocols for both students and faculty, developing faculty training programs, and reinforcing and evaluating faculty performance through peer mentoring and evaluation. Participants will include real-life experiences with the large online programs at their three institutions. The discussant will pull the symposium together with general comments and suggestions for other quality initiatives. Time for audience participation through a Q & A session will be provided.

Population Change and Lifecourse Strategic Knowledge Cluster Research/Policy Brief
In the context of an aging population and aging workforce, we consider the relationship between cognitive function and paid work. Cognitive function is maintained for most adults as they age, and there is evidence of a positive relationship between stimulating and engaging work environments and both levels of cognitive function and their maintenance over time. At the same time, irregular and long work hours are associated with poorer cognitive outcomes. However, the relationship between paid work and cognitive function is complex; education and training as well as health status are also related to cognitive function and work. Torture After Nuremburg: Us Law And Practice, Elizabeth Rapaport

In this essay I will argue that the signature methods of interrogation used by CIA and military interrogators in the Global War on Terrorism (GWOT) -- torture lite' techniques such as hypothermia and stress positions -- may constitute torture, but that the question of their legality under U.S, and international law is not as straightforward as some critics of the Bush Administration maintained. I will take up only one thread in the complex discussion of GWOT interrogation practices and law, that of the boundary between torture and lesser cruelty.

Through this Professional Project, the author examines circulation and suitability pertaining to bicycle planning on a college campus, in the real-world setting of the University of Georgia (UGA) main campus located in Athens, Georgia.
Based on existing on-campus activity, bicycle circulation is established. Using an analytical tool, namely the bicycle level of service (BLOS) analysis, roadway segments within the study area are evaluated for suitability with respect to adjacent motor vehicle traffic. Several improvements are suggested throughout the project to enhance the existing BLOS, and in turn enhance the bicycling conditions. Most of the suggestions are based on traditional improvements, …

For nearly two centuries, the U.S. Constitution through the dormant Commerce Clause has protected the American common market from protectionist commercial stale regulations and taxes. During the past two terms, however, the U.S. Supreme Court created a new exception to the dormant Commerce Clause for protectionist state and local taxes and regulations that favor public rather than private entities. In this Article, we describe this “New Protectionism” and argue that the Court's embrace of it is profoundly misguided. As we document, there is no material difference, economically or constitutionally, between public protectionism and private protectionism. As illustrated by the variety …

Itraconazole-Induced Torsade De Pointes In A Patient Receiving Methadone Substitution Therapy, N.Z. Robson, B. Vicknasingam, S. Narayanan

Issues. Methadone, a pharmacological agent used to treat heroin dependence is relatively safe, but may cause cardiac arrhythmias in the concurrent presence of other risk factors. Approach and Key Findings. This case report highlights the risk of Torsade de Pointes, a life-threatening cardiac arrhythmia, in a heroin-dependent patient receiving methadone substitution therapy who was prescribed itraconazole for vaginal thrush. The patient presented to the accident and emergency department for chest discomfort and an episode of syncope following two doses of itraconazole (200 mg). Electrocardiogram monitoring at the accident and emergency department showed prolonged rate-corrected QT interval leading to Torsade de …

The False Promise Of Adolescent Brain Science In Juvenile Justice, Terry A. Maroney

Recent scientific findings about the developing teen brain have both captured public attention and begun to percolate through legal theory and practice. Indeed, many believe that developmental neuroscience contributed to the U.S. Supreme Court's elimination of the juvenile death penalty in Roper v. Simmons. Post-Roper, scholars assert that the developmentally normal attributes of the teen brain counsel differential treatment of young offenders, and advocates increasingly make such arguments before the courts. The success of any theory, though, depends in large part on implementation, and challenges that emerge through implementation illuminate problematic aspects of the theory. Recreational Reading: Useful Tips For Successful Implementation, Katherine Wiesendanger, Gretchen Braun, Jeannine Perry
Reading Horizons: A Journal of Literacy and Language Arts
This study analyzed characteristics of classrooms where recreational reading is being implemented. It scrutinized those classrooms that housed successful programs and looked for common elements among them. Specifically, we explored the physical, teacher, student, and program factors within these classrooms that contributed toward their success. Focusing on the responses from 33 participants, the article summarizes the elements most frequently mentioned under each of the four major components. Finally, we discuss how these factors contribute to the successful implementation of recreational reading.

This article addresses critical factors that impact learning for a growing population of students in American classrooms, the English Language Learner (ELL). Even in the smallest school districts, it is common for teachers to have one or more students with limited or no command of the English language in their classrooms. Many students in schools with specialized ELL programs spend the majority of their day in regular classrooms trying to fit in with their peers as they struggle to learn a new language.
